SUBJECT: Confederatk% Air Force Airshow
As you know the CO11flod0rate Air Force (CAT') has requested permission
to conduct an nirsho-~s, of the Denton Municipal Airport on July 9 and
10, 1983. Last year, the CAF conducted a "modified" airshow which
was extremely success!'ul and was conducted without incident. The
modified airshow generated approximately $1,000 in revenues for the
airport last year.
This year the CAF plans to conduct a "Class A" airshow which is the
most elaborate and largest class of airshow which the
The CAF Headquarters in Harlingen, Texas, has approved only six
"Class A" shows for this year. We are fortunate that Denton has
been selected as a site for one of these events.
During the .last: week I have met with representatives from the CAF'
regarding the inechanics of the airshow and the issue of compensation
to the. City for the use of the Airport. The CAF has agreed to pay
to the City of Fenton a base fee of $2,000 plus 2% of the gale
receipts. Although our revenues will vary with attendance I feel
confidant that the CiLy can expect revenues to exceed $5,600 for
the two day event.
For this fee the City will allow the CAF use o[ the runway, taxi-
ways, the Torrninal Bui.lding, and unimproved airport lands for the
airshow on July 9 and 10, 1983. The City will also provide for a
fire truck and crew, water t.r.uck$ front.--end loader and an equipment
operaLor to be located on the airport during the airshow. In addition,
the City will increase the level of sanitation service at the airport
during the t.wo days.
The CAF will also have various concession stands on the airport which
will sell drinks, food and souvenirs, The CAF has also requested
permission to sell beer from these stands at: the airshow. When
this issue was discussed with the Airport Board there was some
concern relative to the safety aspects and the liability of the City
allowing the sale of beer Zit the Airport.

representatives of the CAF' have developed a security system which
has been successful in preventing any unpleasant incidents at
other airshows.
Tho CAF will employ 20 off duty policemen for the airshow. These
officers will be responsible for crowd and Lrt.ffic control, and
gcnera.l. security. The CAF will also maintain a security work
force composed of experienced CAF members. These persons will
be stationed around aircraft and the ramp and taxiway areas prior
to, during, and after the airshow. One hour prior to the show
the ramp and taxiway areas will Le cleared of all unauthorized
personnel and spectator restriction lines will be rigorously
enforced until the show is complete and all aircraft have been
shutoff:.
It is obvious that beer sales on a hot July afternoon will
significantly increase the revenues generated by conccl:-s ions at.
the airshow. As you may recall, the Dallas/Ft. Werth Wring of the
CAP has been attempting to raise the funds for the construction of
a CAF Staging tlase.on the Denton Niunicipal Airport. The revenues
generated from the concessions are intended to help pay the ground
lease and the construction cost of this facility. Thus, the sale
of beer at this event would be advantageous to the City of Denton.
STAFF RrCOMMF,NDATION
It is apparent that the airshow will benefit Lhe Denton Municipal
Airport in terms of revenues and public exposure. The airshow will
also benefit: the entire cotnmuni.Ly bated upon the two day tourist
attraction resulting from the event. T;ae staff:, therefore, recom-
mends that the Airport Advisory Board and the City Council approve
the request- from the CAF' for permission to use the Denton Ntun.icipal
Airport for the CAF Airshow on July 9 and 10, 1983.

To the members of the City Council;
The above zoning case requests a plaraied
development with basic zoning of agriculture
for 54 acres, The request is for the right
to place three (3) manufactured houses on the
premises for family use.
As applicant, we request the authority to
amend that request to read one (1) housing
structure and 2 manufactured houses. We
have located a large house in Tyler, Texas
with a historical designation, It is
approximately 100 years old and is very well
constructed, two and a half story residence
of one of the former merchants in Tyler. It
would add a real distinction to these premises
and to the neighborhood.
We will be prepared to discuss it at the zoning
hearing if you will permit. This then would
make two major housing structures on this site.

PARK BOARD RECOMMENDATION
The Denton Park: and Recreation Board approves in
principle advertising in Denton Parks by businesses
that contribute scoreboards for athletic fields, There
is, however, a need for guidelines concerning this
advertising, and there is not time to write such guide-
lines quickly enough to cover the request of the Denton
Boys Tackle Football Association for three scoreboards
with advertisements to be used in the fall of 1983, if
the City Council will approve the specific request of
the Denton Boys Tackle Football Association for three
scoreboards at Evers Park with the intent of providing
general guidelines on the subject as soon as possible
(to which the three scoreboards at Evers Park will have
to conform), the Parks Board recommends that action,

SU%RMARY: This purchase order was issued after a request was received
and quotations were requested from several vendors %tith the
low quotation from The Print Shop of Denton, at a cost of
$2,947.90, FOB Plant, the merchandise was ordered and the
freight was prepaid and invoiced at $230.00, making a total
purchase cost of $3,177,00. This item was bid last year
and it was then not purchased as the budget funds were not
available and the low bid receivod meeting specifications
was $3,995.00. We estimated the freight at $200.00 on the
revised specifications sent this year.
ACTION REQUIRED: Approval by council for payment to be made to The Print
Shop of Denton in the amount of $3,177.00.

During our special work session held at the Service Center on April 260 1983) we discusses
In detail a number of specific projects to be undertaken to promote economic
development in Denton. Among these projects was (lie production of a slide shoti%
presentation.
The purpose of the slide show is to provide a short, audio-visual Image of Denton tc
business/industrial prospects who have not yet considered us as at desirable alternative for
relocation. The show could also be used by members of the City Council and other
leaders of the community to encourage the support and contributions of citizens for
economic growth and development in Denton,
'J'he staff has spoilt several months making contacts, interviewing audio-visual specialists
and reviewing samples of their productions. Based upon the results of our research, we
feel confident that AVtP Audio-Visual, Inc, in Dallas has the professional experience anu
exeellont reputation needed to insure the quality production that the City Cotnieii
indicated it desires. lie have shared AVW materials with the Council at both the
February 10 1983, and April 26, 1983) meetings on economic development. 1V1NIs
proposal was included with these materials at each of the meetings,
The slide show will be produced in various formats so as to facilitate its use by different
groups, It will be ten to twelve minutes long, and will be available in at one screen-three
projector format, a one projector format and as a videotape. The three projector slide
show will be used for large groups when it is puisible to use our more complex
equipment. 'rho one projector show will be used when it is more convenient, such as when
a Council member wishes to take the show to Givic group inuctings. 'I'lae videotape is
inainly designed to be sent to business prospects through the mail as an introductory tour
of our city.

SUBJECT: ECONOMIC DEVELOPMENT PROGRAM
After several months of research concerning economic and industrial
development possibilities for the City of Denton, it is apparent that there
are many alternatives available to us depending upon the extent of our
resources and the direction of the City Council, Attached are specific
recommendations regarding an economic development strategy for Denton that has
been developed for your consideration.
1 have found that the promotion of economic growth and development varies
across the country. Many cities have no economic development program, while
others have developed very elaborate programs including hosted tours of their
cities and full-time travelling representatives.
Most of the cities that do have an economic development department work very
closely with their chambers of commerce. Many cities have worked with their
chambers to institu e a private, non-profit corporation through which they
operate to buy land ,'or industrial parks, offer loans to businesses, advertise
in national publications, produce information packets for prospects and
conduct tours to targe'L areas of the country promoting their city. Usually
the city, the county and the private sector fund such organizatons,
In Denton we have Greater Denton Industries, which is a privately funded
corporation that purchases land for the purpose of promoting economic
development in the City, The original intent of the corporation was to set up
an industrial park with the necessary facilities already available to
industrial and commercial prospects. Due to a lack of funding, this
development project has not been realized. Currently, the group has one
remaining lot,
Some cites with whom we visited suggested that we conduct a community
analysis before instituting an economic development program, in order that we
be aware of problems that need to be solved in our community before attracting
new business. Such analysis could involve a survey of the businesses in

Denton with five or more employees, The respondents would be asked to provide
helpful comments concerning the problems that they have encountered in doing
business in our community. They could also provide suggestions for
improvements, along with a discussion of the reasons for their location in
Denton.
While realizing the constraints of our budget, and knowing the City Council's
priorities, I am recommending that we consider the implementation of an
Economic Development Program with the following goals:
• Identifying attractive industrial sites;
• Attracting potential industrial and commercial newcomers to Denton;
• Providing complete and accurate information to prospects by attempting
to eliminate conflicting instructions on development procedures;
This may be achieved through the use of a project management checklist
which would outline each step of the process along with appropriate
department indi.ators and fees; (See attached example)
• Organizing the process of the dissemination of information to serious
business prospects to avoid the often conflicting duplication of effort;
by the City, Chamber, school district, and other utilities to make the
needed data available in one location.
The above goals could be accomplished through several means, I have listed a
few of these for your consideration:
• A colorful quality of life brochure will be developed and used to
advertise the City to visitors and to potential prospects;
• A detailed f actbook will be compiled and :nade available to prospects who
have shown a serious interest in the area;
A slide show presentation will be produced and made available for
presentation to metroplex realtors and potential business prospects who
have not yet considered our City for relocation purposes;
• A reception will be given to provide business prospects, realtors and
other interested persons with an opportunity to meet and talk to
informed local business and community leaders regarding the
possibilities of relocating in Denton;
• Contact Barworth Corporation regarding plans for the development of a

All aspects of the program will serve to acquaint newcomers to Denton's great
potential as a rapidly growing, progressive community. With the
implementation of the above goals we would begin a purposeful, well planned
campaign to attract commercial and industrial prospects to our City.
It is our intent to design inuividual project work plans for each part of the
Economic Development Program. We will make a cooperative effort to coordinate
our research activities and work plans with those of the Chamber to every
possible extent on this project. Chuck Carpanter has expressed enthusiasm and
support for this effort.
It is recommended that the Red Board funds be made available for the funding
of this project. Possibly, cooperative funding could be obtained from the
Chamber and other community organizations. We would seek the financial and
technical assistance of the Convention and Visitors Bureau in putting on the
reception and preparing exhibits;
I have outlined each phase of the proposed Economic Development Program in the
following pages for your review, 1 have also included an estimated budget
proposal for the program, and a list of the cities contacted with their ideas
on how to attract businesses to their area,
It is my further recommendation that once we receive authorization from the
City Council, I will meet again with Chuck Carpenter and begin immediately to
develop work plans for the implementation phase. We would also plan to meet
with the Chamber Economic Development Committee to gain their input. 1 will
also set up a meeting with Newton Rayzor, Jr. to explore any mutually
beneficial potentials.

SUMMARY OF RECOMMENDATIONS
ECONOMIC DEVELOPMENT PROGRAM
BACKGROUND;
The City Council has proposed that one of the major goals to be accomplished
this year is to study different methods of increasing revenues for the City,
It was established that economic growth and development within the City would
greatly increase revenues, Following this contention, a study has been
conducted for the past several months to determine how the City might attempt
to increase economic growth in the area.
'We have also been aware that a problem exists in the handling of the
dissemination of information to serious business prospects, The industrial
client comes to Denton and is faced with a maze of procedures And processes
which in the past have not been clearly defined, In order to be on the
',eading edge of industrial/commercial sites, we must first be able to provide
those potential newcomers with the information that they require in a
professional manner.
Many cities in Texas and the Southern United States have been contacted and
asked to send any information that they have available ors how they attract
businesses to their area, Research has also been conducted to gather
pertinent information needed by business prospects when making a decision
concerning relocation of their company. An effort has been made to collect
data from the Chamber and City departments to produce a comprehensive and
useful document that will present a progressive image of Denton,
SUMMARY OF RECOMMENDATIONS;
The following recommendations are provided for your consideration;
1. We recommend that a short, colorful pamphlet or brochure of 4-6 pages be
compiled in order to interest potential prospects in moving to Denton.
This short brochure would be an introduction to the quality of life
aspects of Denton, highlighting our assets and encouraging the reader to
respond by returning a perforated card for more in-depth information. The
brochure would include short narrative sections with illustrations on land
availability, industry, housing, education, the labor force and
recreation. In many instances this brochure would be the reader's first
contact with the City of Denton. It must tnen, give a polished
presentation of the dynamics of the City and impress the reader enough to
motivate a response,
2. We recommend that a larger, more detailed factbook be compiled containing
statistical information and narrative sections on demographics, the labor
force, economic factors, utility rates and availabilil~,,-, transportation
and zoning requirements. This factbook would be used to provide complete
and accurate information to prospects who have shown a serious interest in
our area. This publication will eliminate duplication and often
conflicting efforts by the different entities, i.e., the Chamber, Lone
Star Gas, General Telephone, Denton Independent School District, and will
present a unified picture of the City to business prospects. Thp f4•tbook

would also be made available to any other interested persons for a fee,
We have completed 80% of the research for this document, The proposed
design would include options for quick updates without a great deal of
expense,
Along with the handbook would be provided a project management checklist,
This list would outline every step needed to be taken by a new industry or
business to become established in Denton, Attached is a sample of a
project management checklist which is used by the City of Knoxville,
Tennessee, to assist developers and investors through the often complex
development process,
3. The third phase of our economic development strategy involves the
production of a slide show which will include a ten minute entertaining
tour of the City and provide information that would be of interest to
viewers who are not familiar with the area. The show will be used to
advertise Denton to those business prospects who have not yet considered
us as a desirable alternative for relocation. It would also be used to
focus on the advantages of our proximity to the Dallas-Ft. Worth area,
Additionally, we could use the slide show to encourage Denton c-livic groups
to participate in and contribute to our economic development program.
Should the slide show be coordinated by a professional audiovisual
agency, it would be done in such a way that would enable us to use the
show in various formats, It would be a portable show which can be shown
with or> projector or several projectors, as the need may be. It is
planner. to convert the show to a video tape presentation, which could also
be mailed to seriously interested prospects.
4. The grand finale to our economic development campaign will be an
entertaining and informative event scheduled tentatively in July of 1983.
We will hold a reception for industrial and commercial prospects,
metroplex realtors and local businessess and community leaders. The
reception will consist of a presentation of our proposed slide show, along
with the introduction of Denton as a city ready and prepared for economic
growth and development, We are considering having the auditorium in the
Civic Center set up as an exhibition with information packets available to
interested guests. These packets would contain the proposea quality of
life brochure, a copy of the factbook, and other pamphlets from the
Chamber, the Denton educational facilities, the Greater Denton Arts
Council, and the relevant City Departments, and other community agencies.
Throughout the reception, a prevailing theme would emerge: "There's no
place like Oenton". From the designing of the invitations to the
specially created atmosphere at the Civic Center, the guests will have the
feeling that they have entered the "Emerald City" of Oz (Denton). Our
intent is to create an enjoyable evening with music and food that will
ensure that our guests will not forget us when it comes to relocation
considerations,

corporation that could buy and develop land, offer loans,
conduct research and do advertising,
3, The Economic Development Corporation conducted a Community
Analysis survey, Industries with five or more employees
vere surveyed to find out about existing problems in the
community that might hinder business development. Solutions
are found for the problems, (For Example: Visalia found
that there was a shortage of workers for one type of
industry, They contacted the Community College there, which
now offers the necessary training.)
4. A technical data book was compiled to send to interested
prospects.
5. They put together a short, colorful brochure with small
narrative sections and pictures on land availability,
housing, the labor force, industry and quality of life.
This brochure has a perforated card which can be sent back

The City of Denton, Texas, a Municipal Home Rule City
situated in Denton County, Texas, hereinafter called "City".
acting herein byy and througgh its City Manager, and AVW Avdio
Visual Inc. (AVW), hereinafter called Contractor, hereby
mutually agree as follows:
1. SeRVICBS TO BE PERFORMED: City hereby retains Con-
tractor to pereorm the hereinafter designated services and
Contractor agrees to perform the following services:
A. SCRIPT:
AVW will develop the script to the satisfaction
of the City Manager;
B. STORYBOARD:
AVW will provide advice of type and quantity of
slides per concept. AVW will work out visual
design, special effects, and transitions between
major parts of the presentation.
C. GRAPHICS:
AVW will be responsible for graphic design.
D. PHOTOGRAPHY:
AVW will produce all photography required fot
the slide show.
F. SOUNDTRACK:
AVW will be responsible for the recording of
the narration, the developing of the sound-
track, its :nixdown and for the syncnronization
of the soundtrack on City equipment.
F. AVW will be responsible for the editing process.
G. AVW will be responsible for production activ-
ities involving programming and synchronization.

AVW shall provide a separate, detailed production

5. SUPERVISION AND CONTROL BY CITY: It is mutually under-
stood and agree by an between City and Contractor that
Contractor is an Independent Contractor and shall not be deemed
to be or considered an employee of the City of Denton, Texas for
the purposes of income tax, withholding, social security taxes,
vacation or sick leave benefits, or any other City employee
benefit. The City shall not have supervision and control of
Contractor or any employee of Contractor, but it is expressly
understood that Contractor shall perform the services hereunder
at the direction of and to the satisfaction of the City Manager
of the City of Denton or his designee under this agreement.
6. SOURCE OF FUNDS: All payments to Contractor under this
agreement are to a paid by the i t y from special funds
appropriated by the City Council for such purposes in the Budget
of the City of Denton.
j. INSURANCE: Contractor shall provide at his own .ost and
expense workman's compensation insurance, liability insurance,
and all other insurance necessary to protect Contractor in the
operation of Contractor's business.
8. CANCELLATION: City reserves the right to cancel this
Agreement at any time by giving Contractor thirty (30) days
written notice of its intention to cancel this Agreement.

Denton, we have found that Group Graphics in Denton Is far le>~s costly than other
agencies and much more convenient, A contract for the production of the
Economic Development Faetbook by Group Graphics has been drafted for your
review
Initially, 500 covers of the Faetbook and 500 copies of each divider page will be
produced, 't'hese items are not likely to change soon and it is less costly to go ahead
and print them. One hundred and fifty copies of the contents will be printed.
Since many of these pages will need to be updated annually, it is not to our
advantage to have too many printed ahead of time.
Upon approval 4 C the contract, Group Graphics will begin work on the Faetbook,

3, SUPERVISION AND CONTROL BY CITY: It is mutually
understood and agreed by and between City and Contractor that
Contractor is an Independent Contractor and shall not be deemed
to be or considered an employee of the City of Denson, Texas for
the purposes of income tax, withholding, social security taxes,
vacation or sick leave benefits, or any other City employee
benefit. The City shall have supervision and control of
Contractor; and it is expressly understood that Contractor shall
porform the services hereunder at the direction of and to the
satisfaction of the City Manager of the City of Denton or his
designee under this Agreement.
4. SOURCE OF FUNDS: All payments to Contractor under this
Agreement are to be paid by the City from special funds
appropriated by the City Council for such purposes in the Budget
of the City of Denton.
5. INSURANCE: Contractor shall provide at his own cost and
expense workmen's compensation insurance, Liability Insurance,
and all other insurance necessary to protect Contractor in the
operation of Contractor's business.
6. CANCELLATION: City reserves the right to cancel this
Agreement at any time by giving Contractor thirty (30) days
written notice of Its intention to cancel this Agreement.
7, PERM OF CONTRACT: This Agreement shall commence on the
27th day of June, 1983, and end on the 22nd day of July, 1983.
S. XOOIFICATION; This writing constitutes the entire
Agreement of the parties. No modifications, changes or

Gentlemen:
In October 1958 the Unitarian Fellowship, in response
to a request from the First Christian Church, granted to
the citq a temporary easement for the installation of an
electric transmission line to First Christian, to serve
until a permanent line could be installed from A, different
direction.
The easement was for a period not exceeding three
years. There has not been an electric line over it for
many years now, since the permanent service to First
Christian was installed. The easement, however, still
appears on a recently drawn plat.
I do not have a copy of the original easement instzu--
ment, but I am enclosing herewith a copy of the resolution
of the Unitarian board authorizing the president to execute
the easement.
The Unitarian Fellowship (now the Unitarian Univer-
salist Fellowship) would like to have the easement vacated,
since it is no longer useful and since the original grant
was for only three years. Please let us know what pro-
oedure to follow.

1. RECONSIDER ABANDONMENT OF UTILITY EASEMhNT AT 1111 CORDELL:
Nelson introduced Jerry C),ark of the Engineering Department.
Clark explained to the Board that Engineering felt it was
necessary to keep the easement because: 1) it was in the flood
lain; and, 2) for maintenance purposes of the drainage ditch.
fter a brief discussion, the Board decide,i that there was no
need to change their decision that subject easement be abandoned
due to the fact that the Utility Department no longer needed the
easement. No further Board action was required on this item,
2. CONSIDER UTILITY DEPARTMENT 198384 OPERATING BUDGET:
Nelson stated that both the Electric Division and the
Water/Wastewater Division had tried to reduce their respective
Budgets by 10%, exclusive of purchased power, fuel and raw
water. A hand-out was given to the board showing, these budget
reduction alternatives A general discussion followed on
various aspects of the Budget, Chairman Laney suggested that
due to time restraints and the large amount of items to be
covered, that the Board spend little time on the fixed costs and
more time on the variables.
The Board reviewed the Electric Division section of the Budget
and discussed the Supplemental Decision Package for a Power Use
Advisor. Nelson explained to the Board the proposed duties of a
Power Use Advisor and how commercial users would benefit, The
Board agreed on the Power Use Advisor in the Budget.
Discussion continued with the Board expressing concern that the
Administrative Transfer Fund actually pays for a Cost Accountant
in the Finance Department. Chairman Laney suggested that once
the Board approved the Budget and recommen3ed it to the City
Council, that the Board also send a Resolution to the Council to
transfer the Cost Accountant to the Utility Department. After
further discussion, the Board agreed to drop the Cost Accountant
from the Budget for one more year.

ically addressed and studied unt31

provided in conjunction with platting;
however, it is not felt that the pro-
posal will. create any insurmountable
drainage problems.
Transportation; The site has Immediate access to Bell
Avenue ( rimary major arterial) and
Windsor Drive (primary major arterial),
Parking, Twenty-eight (28) on-site parking
spaces are required. Thirty-two (32)
on-site spaces are provided.

for extension to this site,
CONCEPT PLAN ANALYSIS
Four (4) quadraplex buildings (16 units) are proposed for this
site at a density of 11.26 units per acre (1.42 acre parcel).
The prospective developers have advised staff that plans are to
build four separate fourplex units and sell each individually.
The 16 individual dwelling units will not be marketed for indi-
vidual sale. Total proposed square footage of the building area
is 20,160 square feet. Projected square footage per individual
unit is approximately 1,260 square feet. Two bedroom, two bath,
1 1/2 story units, are planned. Parking is adequate and a cur,;'
cut is proposed off both Windsor and Bell. After Planning and
Zoning Commission review, the petitioners agreed to install
sidewalks along the frontage of both existing and proposed
Benchmark Villas property. A six foot masonry wall is located
near the southern boundary of the parcel because of a PD require-
ment fo the abutting benchmark Villas development. Staff has
been informed by some area residents that the masonry wall is
unattractive; the petitioners have indicated that they are not
in favor of extending the existing wall if their request for
the change in zoning is approved, the front yard setback off
Windsor Drive should be a minimum 25 feet instead of the pro-
posed 20 feet. The developers understand this requirement and
have agreed to make the necessary adjustments,
Overall, the PD concept plan rv.veals no major technical problems.

ANALYSIS
Essentially, .he etitioners are seeking permission to tixpand
the recently constructed and adjcent Benchmark Villas develop-
ment. Existing benchmark Villas consists of seven fourplex
structures (28 units) that are platted individually and included
in PD-25.1. 1he Benchmark Villas units are presently being
leased, but future individual sales remains a possibility. The
architectural style of the existing and ro osed development is
distinctive when compared to typical mul i- amily land use.
The proposed density of 11.26 units per acre is low and quite
reasonable when compared to standard multi-family development.
Major street access is available and site plan control is pro-
vided through PD zoning. it is not felt that the addition of
16 dwelling units at this site will negatively impact the
character of this area. No one spoke in opposition to this
request when the Planning and Zoning Commission conducted its
public hearing on May 25, 1983.
RECOMMENDATION
This development satisfies Denton Development Guide policies
regarding multi-family development in low inr,ensity areas and
the Planning and Zoning Commission recommends approval by a vote
of 6-0 with the following conditions;
16 The development shall conform with the approved concept plan
and all applicable City of Denton zoning ordinance re uire-
ments, subdivision regulations and development and bu riding
codes prior to issuance of building permits.
2. The architectural style of the buildings shall be compatible
and consistent with that of the abutting Benchmark Villas
development to the east.
3. A 25 foot setback shall be observed off Windsor Drive.
4. Sidewalks acceptable to city engineering staff shall be
installed along; the north frontage of the existing Benchmark
Villas development as well as the site proposed in this PD
request,
5. If required for drainage purposes and recommended by city
Engineer, a six (6) foot solid masonry wall shall be erected
prior to issuance of building permits and certificate of
occupancy.

The regular meeting of the Planning and Zoning Commission of the
City of Denton, 'texas was held on Wednesday, Ma 25, 1983, at 5;00
p.m,, in the Council Chambers of the Municipal wilding.
Present: Bill Claiborne, Ruby Cole, R. d. Eseue, Robert LaForte,
Marilyn Mays and Andy Sidor

Chairman Robert LaForte called the meeting to order.
1. Minutes
Approval of the minutes of the regular meeting of
May 11, 1983.
The last sentence in the last paragraph on page 10 was
amended to read; ,They may store volatile chemicals or
chemicals that may contain some kind of toxin."
The second paragraph on page 13 was amended to read; "Ms.
Mays commented she would approve everything here but would
not permit a batch plant in commercial (C) district without
having a specific use permit."
Ms. Mays moved to approve t':hc ;:ay 11, 1983 minutes of the
regular meeting with amendments. Seconded by Ms. Cole and
unanimously carried. (5-0)
11. Public Hearings
A. ~Z 1581. This is the petition of Indigo Builders, Inc.
requesting a change in zoning from single family (SE-7)
to the planned development (PD) cla3sification on a
1.42 acre tract located at the southeast intersection
of Bell Avenue and Windsor Drive. If approved, the
planned development (PD) would permit the construction
of four (4) quadraplexes (16 units) that would be sold
individually as condominiums. The property is more
particularly described as lots 1, 2, 3, 4, 5, o and 7,
block 1, Windsor Place Addition.

Mr. Ellison stated that information from the developer
since the notices went out indicates that they would not
sell the individual dwelling units; if approved they
will develop four 4-plea structures and sell each build-
ing but not the individual dwellings.
Mr. Ellison explained 17 notices were mailed to property
owners; three were received in favor, four were received
in opposition.
Dale Morgan, ~Karketing Director for Indigo Builders,
spoke in favor, he gave Conunission a copy of the site
plan explaining they are developing the property immed-
iately to the east. He said the property is presently
zoned single family. Seven (7) buildings are under con-
struction, two (Y) have been finished. He said they a:e
proposing to increase to 11 units instead of 7; thinks
this location is well suited for this request being mace
to Planning and Zoning Commission. At this time would
like to introduce Ms. Joyce Pittman,
Joyce Pittman explained they are here to ask Commission
to change the zoning from single family which would
allow seven (7) residences to a planned development,
She wens on giving a brief history of Indigo Builders.
Some of the custom features of their homes are sky-
lights, fireplaces, full GE appliances in the kitchen,
etc.
On question Ms. Pittman said these will be two story;
there is a loft upstairs that could be used for another
room,
No one was present to speak in opposition.
Mr. Ellison explained the request giving the surrounding
land use and stated the area is low intensity. Mr.
Ellison said there are two concerns. One is the trafc.c
and major street access. This site has immediate accl-ss
to Bell Avenue and Windsor Drive, and both are desig-
nated as major arterials by the City of Denton. He sa:d
staff feels the capacity of the roadway systems are ai.e-
quate to serve this development, Another concern is
drainage, He said Jerry Clark has advised him that t,-,e
drainage channel located along the southern perimeter 3f
this parcel will be looked at. lvith respect tothoten-
• tial drainage problems ttilr. Clark does not feel is pro-
posed density will impact ene drainage system nega-
tively; if it does it is a problem that would have to be
worked out when final and preliminary platting is pro-
posed. He said this is a PD request which means Commss-
sion can attach conditions. Staff recommends approval
with conditions.

Mr, LaForte asked how wide is Bell Avenue? Mr, Ellison
replied 45'.
Mr. Ellison explained with respect to parking 28 parking
spaces are required, and 32 spaces have been provided,
'there was discussion concernin, sidewalks in the area.

north side of this property and along the north side of
the existing Benchmark Villas.
Mr, Claiborne arrived at the meeting.

SPECIAL INFORMATION
Transportation: Robinson Road remains a responsibility
of Denton County because it was not
included in the rocent annexation of
this tract, Lakewood Estates, and
other surrounding properties.
Robinson Road functions as a major
street, but its condition is obviously
less than adequate. Construction of
Lakewood Estates is creating addi-
tional maintenance problems and staff
is unaware of specific improvement
plans on the part of the county,
The condition of Robinson Road is, and
will remain, a principal concern when
zoning change requests are considered
for undeveloped tracts in this area.
Staff has notified the county of this
proposal and requested input. No feed-
bacfchas been offeted at this stage,
but we will continue to solicit any
thoughts on the part of county otfi-
cials regarding this, and future pro-
posed zoning change and development
requests which impact Robinson Road,
The Planning and Zoning Commission and
an adjacent property owner raised ques-
tions regarding the proposed alignment
of Loop 288 and its effect on the sub-
ject tract. The present thoroughfare
plan shows an alignment that affects
this general area, however, it was not:
possible to acquire right-of-way
through the Lakewood Estates develop-
ment and it has recently been suggested
that the alignment should be further
to the south.

as standard residential streets with
50 feet of right-of-way and 31 to 34

but it can be built, Telephone, gas
and cable TV services are available,
ANALYSIS
This site is located in a low intensity area. The amount of
density and intensity proposed is not considered prohibitive
given the amount of undeveloped property in the area. As stated
previously, staff is primarily concerned with the condition of
Robinson Road, Unless the County reports differently before
City Council consideration of this request, no immediate improve-
ments are planned for Robinson Road. In terms of pure land use
questions, this PD request appears reasonable. An adjacent
property owner responded when those in opposition were recognize
during the Planning and Zoning Commission public hearing, How-
ever, he went on to state that he was not particularly opposea
to the proposed use of the property as much as he was curious
about the plans for Loop ^SS and its bearing on this particular
case, No other individuals spoke in opposition to this request
during Planning and Zoning Copmission consideration,
RECOMMENDATION
The Planning and Zoning Commission recoramiends approval by a ,,ote

Mr. Ellison explained 8 notices were mailed to property
owners; none were returned in favor or opposition.
bob Crouch, representative for Mr, Compton, stated they
are requesting zoning change on approximately 6,3 acres
on Robinson Road for purposes of developing this tract;
17 duplex lots which would be 60' x 100 , three 4-plea
lots which would be 100' x 155', and three general
retail (GR) lots. He said the subdivision will have 50'
dedicated to the city streets within it, The frontage
is on Kobinson Road, it is planned for duplex whim
will be owner occupied.
Mr. LaForte commented on Robinson Road being a county
road.
Robert H, Mitchell, owner of property next to this
tract, spoke in opposition. He said he did not get a
notice regarding this. Hissmajor concern is what is
being preserved for loop 288.
Mr, bidor said he is not sure of Mr. Mitchell's objec-
tion and asked are you for or against the requast?
Mr. Mitchell replied he is not for or against it, he is
just concerned about the Loop.
Mr. Ellison said in regard to drainage, all drainage
concerns will be looked at during platting. He gave a
brief history of the property, He said in regard to
Robinson Road, the county has been supplied with infor-
mation.
Mr. Ellison continued saying we don't feel this partic-
ular development proposal is prohibitive in terms of its
effect on Robinson, and staff recommends approval.

mr, LaForte asked if this would cause a problem for the
Loop if approved, Mr. Ellison replied no. Mr. Watkins
advised that there has been discussion with respect to
moving the alignment of the Loop further to the south.
Mr. Ellison said water and sewer can be extended,
Electrical service is not available at the present time
but can be built. Telephone, gas, and cable TV are all
available for extension to this site.

C. Z-1583. This is the petition of T. E, Saunders request-
ing a change in zoning from single family (SF-7) to the
two family (2-F) classification on a 4.995 acre tract
beginning approximately 160 feet east of Audra Lane,
700 feet north of East McKinney Street, and adjacent ana
south of the Miller Street right-of-way.
Mr. Ellison pointed out research has been done and the
Miller ROW mentioned in the notice is not dedicated
right-of-way. Therefore, there is no public access at
this time. 10 notices were mailed to property owners;
one was received in favor, two received in opposition.
Tony Raposa, representative for Lir, Saunders, gave
Commission a map and explained, He said this is a
request for single family to two family classification.
He feels putting duplex zoning would create some type of
buffer between this parcel and the General Retail zoned
property which is to be developed with apartments. He
continued to say as far as the road (Miller), they
realize they will have to work that out.
Kay culler, 708 Audra Lane, spoke in opposition. She
said her main objection is this would be invading the
privacy.

ANALYSIS
The regUested zoning is intended to accommodate an interium use
for the property as a family recreation area. The applicant
agreed to restrictions that, according to preliminary discussion
with the City Attorney, could be made part of an ordinance,
These restrictions, if legally part of the ordinance, can help
ensure that the three units are not to be used for mobile home
park type use, no substandard street could be built, etc, The
planned development (PD) zoning also restricts the interium use
location of the mobile homes. Therefore, it is staff's opinion
that the typical public concerns of these types of request are
well protected, if the agreed on restrictions are made a part of
the ordinance,
Analysis of the site did reveal a designated Flood Plain which
is not indicated on the PD site plan; therefore, it is recom-
mended, before a building permit is issued for the mobile homey,
that certification be given by a Registered Professional Engi-
neer that the mobile homes are not in the designated Flood Plain
area,
RECOMMENDATION
The Planning and Zoning Commission recommends approval by a vote
of 4 - 1 subject to the following conditions;
1. Mobile homes are not available to the general public for
rent.
2. Mobile homes to be located no closer than 100 feet to any ,
property line,
3, A portion of the property with or without mobile homes, not
to be sold without first submitting a subdivision plat and
planned development (PD) zoning modification for approval.
4. LMobile homes are certified by a Professional Engineer that

David Smith, owner of middle section of land, spoke in
opposition. He said he lives in Argyle. The house on
this tract is a rent house; and he does have people
renting the house who are opposed,
Mr, t,llison further explained that Mr. .'.aposa has sub-
mitted a preliminary drawing showing about 16 two family
(2F) lots that are larger than minimum two family lot
size in Denton. This is not a planned development;
theretore, lot size could not be guaranteed. He ex-
plained the city requirements and said from a land use
point of view this is a reasonable request. Staff
recommends approval.
On question Mr. Raposa said they came into two family
instead of planned development because it was the re-
quest of the owner. He wanted to run one street down
the middle with a cul-de-sac there and build some nice
looking duplex units.
Chairman closed public hearing,
Mr. Sidor inquired about the standard size of a city
street. Mr. Ellison said it is 31' back to back and 50'
right-of-way.
Mr. Ellison said there will have to be a city street
serving this property with 50' right-of-way and 31' back
to back. Staff does recommend approval of this request,
Mr. LaForte said he will have to vote against this
because of situation with the road.
Mr. Sidor moved to recommend approval. Seconded by Ms.

Mr. GaForte excused himself from this case and turned
the meeting over to GMs. Mays.
Mr. Fanning pointed out the conditions in the request
set by the petitioner and explained. 7 notices were
mailed to property owners; none was received in favor,
three were received in opposition.
Mr. bickley spoke in favor of request stating purpose is
for a family use. He said the conditions were set so
that Commission would have control of this,
Dlr. Sidor asked if there is airy development on the prop-
erty now? bir, bickley replied yes there is an old two
story house and barns. He said they have building per-
mits to renovate; they plan to have a large two story
house.
Dlr. Sidor inquired where the three mobile homes are to
be located on the property and if they will be new. Mr.
I Bickley said one is to be set back in among the Oak
f trees just East of the main house and another is to be
back in amon& the Oak trees on the other side. He said
these will be new mobile homes and will be properly
situated and tied down.
Ms. Mays advised one of the neighbors responded nega-
tively to this because he was under the impression this
was to be a trailer park. She asked Mr, bickley if he
had talked with any of the neighbors and explained what
they are planning? Fie replied no, he was not aware that
they had responded that way but will be glad to work
with the neighbors.
Mr. Claiborne asked if this is intended to be a per-
manent residence or gust a weekend type situation?
Mr. bickley said it is to be permanent residence.
No one was present to speak in opposition,
Mr. Fanning further explained request. He said he
understands there is a flood plain on this. To protect
the city we need some kind of assurance that the mobile
homes will not be placed in that flood plain. Staff is
recommending approval with conditions set by the peti-
tioner and one additional condition from staff regarding
the flood plain.
On question Mr. Fanning said the zoning is agricultural
(A).

Triangle Addition.
Mr, Ellison explained that this is a replat, He said
the intent of this replat is to split lot 3 in the
center and crea._ two separate lots for the sale of
existing multi-family structures, He said covered
parking is being constructed and pointed out that these
structures would be erected on property lines which is
in violation of the zoning ordinance. These structures
would either have to be torn down or will have to come
in with new plans to correct this problem,

they are proposing, at this time to go ahead and modify
the structures.

northwest corner of Bernard Street and the

Summary; 1-)o Planning and Zoning Commission first
cvosidered the above referenced request for
a change in zoning from single family (SF-7)
to office (O) classification at its meeting
of March 9, 1983, the Planning and ZoninL
Commission recommended denial of the re-
quest primarily due to the petitioners'
reluctance to modify his request to plan-
ned development (PD) for office use.
The City Council considered the request on
April 5, 1983, alter an appeal, and votea
to table after reviewing the staff report,
the Planning and Zoning Commission recom-
mendation, and testimony from the peti-
tioners' representative, The request was
tabled until May 10, 1983 with instructions
that staff and the petitioners seek an
acceptable planned development arrangement.
The petitioners Vibmitted crude plats, but
no tormal plans fot adequate technical
review and evaluation,, and staff reported
accordingly at the May 10, 1983 City Council
meeting. On May :LO, 1983, the City Council
referred the item t- the Planning and Zon-
ing Commission for reconsideration as a
planned development (PD). No new plans and
information was produced and the Planning
and Zoning Commission reiterated its on-i-
nal recommendation of denial at its meeting
of May 25, 1983. The Commission also
questioned the legality of their recon-
sideration of the petition given the lace
that no petition for PD zoning had been
officially filed.

AJZ-15680 Consider the potil.'ion of H, J. and Ann Minton
reyu` esting a change in zoning to permit office use on an
0.486 acre tract located at 1600 and 1608 Bernard Street
and 702 Stemmons. The property is presently zoned sin-
gle family (SF-7),
Mr. Ellison gave brief ''history of this case, explaining
petitioner appealed the Commission's decision to City
Council. After City Council tabled it, it came up a
second time. Staff advised Council what we had was not
adequate for planned development zoning; we could not
review it. At that time City Council referred it back
to Planning and Zoning Commission for reconsideration.
Mr. LaForte commented it is his opinion that they not
take any action on this.
Mr. Ellison pointed out staff advised City Council we
felt like the proper procedure would be to deny the re-
quest for office zoning and if the individual wanted to
come back for PD zoning he would have that option.
Mr. LaForte said he thinks it should be sent back to
Council and tell them we believe they should deny the
request for office zoning and if the petitioner wishes
he can resubmit a request for PD.
`Commission all agreed.

SUBJECT: Interpretation of Section 12 A. (49) (a) 5 of
Appendix B-Zoning Ordinance of the Cite of Denton
prohibiting the sale of alcoholic beverages within
100 feet of a residence.
Subsection S of the above Article reads as follows:
"The sale of any vinous and malt liquors or beer by any
dealer where the place of business is within 100 feet of
any residential dwelling unit is prohibited,
"Residential Dwelling Unit" for the purpose of this
condition shall be any single-family, two-family or
multi-family dwelling. The measurements shall be taken
as the most direct distance between the residential
dwelling unit and the building used for the consumption
of vinous and malt liquors or beer."
The above quotation is from (49) entitled on-premises sale of +:eer
and/or wine. Whereas under subsection (b) entitled sale of beer
and/or wine in restaurants, the following provision is set out:
"The sale of any vinous and malt liquors or beer by any
restaurant where the place of business is within one
hundred (1001} feet of any residential dwelling unit is
prohibited."
Under this section there is no Instructions on the type f
measurements to be made between the two locations.
Section 1+1) ,33 of the Alcoholic Beverage Code of the State
Texas authorizes a city to prohibit the sale of alcoha_i.-
beverages within 300 feet of a church, public school or public

hosppital. State Law provides that the measurement of the distance
shall be along the property lines of the street fronts and from
front door to front door, and in direct line across intersections
when within 300 feet of a church,
The Courts have interpreted the provisions of Section 109,33 and
we have some well defined guideline: on how to measure the
distance between buildings; therefore, i,t is the opinion of this
office that we should adopt the provisions of the Court cases
providing for measurements from front door ~*o front door so that
the provisions of our ordinance and the provisions of the
Alcoholic Beverage Code will ba consistent and in line with the
method of making measurements as approved by the Courts of Texas,
We are attaching an ordinance amending Article 12 A. 49 (a)
Article 12 A. (b) and Article 12 A (d) 50 of the Zoning Ordinance
for consideration by the Planning and Zoning Commission and the
City Council.

B, Apgroval of the preliminary plat of the Paisley Place
Subdivision,
Mr, Alison gave brief history of request, He said this
was the subject of a recent zoning change on Paisley
Street for duplexes and townhouses; Planning and Zoning
Commission recommended denial. He said ,sir. Duvall has
come in with a plat for single family development. Plat
meets all our zoning requirements and requirements of
the subdivision regulations. Staff recommends approval,
Mr. Escue moved to recommend approval of the Paisley
Place Subdivision. Seconded by Ms. Cole and unanimously
carried. (6-0)
C, Approve an ordinance amending article 12 (49) and (50)
of Appendix B - Zoning of the Code of Ordinances of the
City of Denton Texas relating to the on-premise sale of
alcoholic beverages within 100 feet of a residence by
providing for a uniform manner of measurement in accor-
dance with that authorized by state law for similar pro-
hibitions; providing for a penalty not to exceed two
hundred dollars ($200,00) for violations thereof; pro-
viding for a severability clause and providing for an
effective date,
Mr, Watkins said the existing zoning ordinance provides
that any place that sells alcoholic beverages which is
within 100' of any residential dwelling unit is prohib-
ited, He said the measurement should be taken as the
most direct distance between the residential dwelling
unit and the building unit for the consumption, He said
it should have an explicit statement as to how the mea-
surement should be taken, but it doesn't.
Ms, Cole asked who checks this when license are issued?
Mr. Ellison explained the process of applying for beer
and wine license,
Mr. Sidor moved should be approved if it meets state

to existing buildings in the City.
The staff has reviewed the problems with Chapter 14, Section
21, 05 concerning the hours of work for the construction
industry. We believe that a more ;appropriate work period would
be from 7:00 a.m, to 8:30 p.m. on weekdays and from 7:00 a.m.
to 8:30 p,m. on Saturday. We have discussed these changes with
the Attorney. Attached is the appropriate document to
implement these changes.
If you or the Council have any further 4uestions, we will be at
the meeting to try and answer them.

SEVERABILITY CLAUSE; AND PROVIDING FU AN EFFECTIVE DATE,
THE COUNCIL OF THE CITY OF DENTON, TEXAS HEREBY ORDAINS;
SECTION I,
rhat Chapter 14, Section 14.21 (S) of the Code of Ordinances
of the City of Denton Is hereby amended so thin the same shall
hereafter read as follows:
"(S) 1'he erection, excavation, demolition, alteration or
repair work on any building at any time other than
between the hours of 7:00 a,m, and 3:30 p,m, Monday
thruugh Saturday; provided, however, that the City
Council may issue special permits for such work at
other hours in case of urgent necessity and in the
interest of public safety and convenience,"
SECTION II.
That if any section, subsection, paragraph, sentence,
clause, phrase or word in this ordinance, or a plication thereof
to any person or circumstance is held invali by any court of
competent Jurisdiction, such holding shall not affect chi
validity of the remaining portions of this ordinance, and the
City Council of the City of Denton, Texas, hereby declares it
would have enacted such remaining portions despite any sic
invalidity.
SECTION ill
That this ordinance shall become affective Immediately upon,
its passage and approval,

RE: Planning and Zoning Commission Recommendation for the
Five Year Capital Improvement Plan
The purpose of a capital improvement plan (CIP) is to determine
the priorities for capital expenditures plus to coordinate the
projects selected, The first objective of the C1P is to decide
the most effective way to allocate our limited capital improvement
dollar, The C1P provides an opportunity to coordinate the City's
physical and fiscal planning and finally, the GIP provides a means
to coordinate capital improvement projects administered by dif-
ferent city departments,
The CIP is adopted as a plan with the knowledge that It will be
revised and amended In response to changing circumstances, Each
year the entire plan is revised in a comprehensive way and typi-
cally one new year is added within the five year planning frame-
work, This year, two years were added to the GIP because of the
rejection of the building expansion project by the voters, and the
first three years of the plan were left intact by the Planning and
Zoning Commission.

A special called meeting of the Planning and Zoning Commission of
the City of Denton, Texas was held on Tuesday, May 24, 1983, at
7;00 p.m., in the Council Chambers of the Municipal building.
Present; Bill Claiborne, Ruby Cole, K. b, bscue, Jr.,

Chairman LaForte called the meeting to order explaining that the
purpose of this hearing is to receive input for projects for capi-
tal improvement programs of 1986-87 and 1987-88. He outlined pro-
jects planned for 1983-84 as the SCan.ley, Thomas, Ector drainage,
also purchase of right-ot-way tot highway 380 widening. 1984-85
projects are Pr~,,irie Street drainage, also Yellowstone - Sheraton
area drainage, and upgrading signal system. 1985-86 project is
providing matching funds for widening of Highway 380 from bell
Avenue to Loop 288, also construction of a tire station. he con-
tinued that suggestions presented at this time, also those pre-
sented by letter, will be considered in a study session of the
Planning and Zoning Coaunission at which time a recommendation will
be made to the City Council of items to be placed in 1986-87 and
M37-88 CIP. Mr. Watkins outlined those projects currently under-
way giving beginning and completion dates. He explained the
reason for dewy as staff had to wait until after bond election
before proceeding with drawing of plans. ,sir. 5idor advised that
no decision would be made at this meeting and said that items pre-
sented would be added to the list of previously suggested projects
and from that list the Planning and Zoning Commission would decide
at its study session what items could be included in the 1986-87
and 1987-88 capital improvements programs.
Atha Kiker, 1013 Kings :tow, stated that the people in the
Yellowstone - Sheraton area are grateful for Planning and Coning
Commission's cooperation in getting their drainage p°oject, She
said she understood that the passage of proposition 2 of bond
election ensures that the drainage as outlined in CiP for 1984-85
would be carried out as scheduled. She said that citizens in the
area are asking tot a 100 percent guarantee that tunas voted for
their drainage project would not be 6iverted for other uses and
that this drainage project would be carried out as scheduled.
Chairman advised that the Planning and Zoning Commission could not
give that guarantee but he felt that it would be done as scheduled.

Robert Holmes, managger of Twin Lakes Mobile Home Park, advlaed
Chat a low point exists on Stuart Road near Selene, ;just bit,fore
the city limit line, which floods and cuts oft the mobile home
park every time it rains. He said he did not know of any plans to
correct the situation. He said there are plans for a street from
Locust to the park which would give them access; however, with a
population of 1200 people in Twin Lakes Mobile Home Park something
needs to done now, Chairman asked if anything minor could be done
to relieve the situation rather than a C1P project and Mr. Clark
answered that this was another subdivision put in without drain-
agge, that it is listed on suggested projects at a cost of
$320,000. Mr. Holmes suggested diverting the water a short dis-
tance so that it could run oft. mr. Clark said he would look at
it further Co see if any temporary work could be done, however c,;e
city has to be careful about diverting water onto private prop-
erty. Mr. Watkins asked it residents in 't'win Lakes Mobile Home
Park would like to be annexed into city and share in cost of cor-
recting drainage problem.
Jeanne Patterson, a resident of Twin Lakes, added that emergency
vehicles would not be able to get into park if a disaster occurred
or people would not be able to get out of the park, She said cr,at
she has had to wait to get into park when it rains and one night
last year she couldn't get home at all. She said she is not a
resident of the city, however this portion of Stuart is inside
city and she thinks the welfare of the people in the park shoulc
be consiaerea.
mrs. Leonhardt added that cars stall in the low place, Chat she
had water getting into her car Sunday night, She also asked that
something be done so water could drain, She said Chat if the r=.,ad
off Locust is constructed they would be ok, until then they are i)
a bad position.
Charlotte Stovall added that school buses have been late and oc-er
buses have had to be sent out because they get tlooded out. She
asked why a drainage ditch couldn't be dug in the dirt on side .:~t

sir, Svehla answered that a bar ditch exists but goes the wrong
way. He said the area is already on list of suggested pr.ojeccs
and staff will do whatever is possible with the bar diten.
Rodney HuCton, a member of the library board, offered informatil-n

which sets aside 50 million dollars for public library construc-
tion, 2.2 million of which is targeted for the State of Texas. rte
said that using the Texas Library Association standards of 75
square toot per capita, the City of Denton would need about 36,000
square filet of library space; at the present time there is 25,G00
square t-^t which leaves a shortage of 11,000 square feet. He

continued that the city can be expected to grow and have an in-
creasing need for public library space. He further stated that it
is believed this is just the beginning of funds that will be
available for construction and if city is in need of money, this
would be an opportunity to secure dollar for dollar matching
funds. Mr. Sidon referred to items of storefront library, book-
mobile and branch library which were suggested in previous years
and asked whether it is felt that a cit the size of Denton needs
a bookmobile or branch library. Mr. La orte advised that at one
time there was a bookmobile going to Sanger but it has been dis-
continued, that he understands county towns are going to try to
develop their own libraries. Mr, Hutton said he felt there would
be a need for a branch library in the future due to shortage of
existing library space.
Sue Smith, president of League of Women Voters, stated the
league's program includes the study of and action on selected
governmental issues. She said the members have reached agreement
on issues which includes 1) public transportation the league
supports overnment participation in regulating the planning and
managemengt of public transportation, particularly public transpor-
tation for the City of Denton; 2) the league supports public
transportation for the elderly and the handicapped, to be financed
by user fees, charitable donations and government funds; 3) land
use - the league supports government participation in regulating
the planning and management of parks and open spaces, water re-
sources, drainage, flood control, unique historical or ecological
sites; 4) resource recovery - the league supports recylcin~ of
reusable materials and safe disposal of remainder, Shc said the
l,eagua is following with interest the private project of resource
recovery involvin Acme Brick and NTSU. She continued that an
evaluation of cap tal improvements is a separate program item
adopted annually which is activated if a bond election is callea.
She said the league supports many bond election items when time
permits full consideration of the pros and cons of each item, She
suggested that bond elections be planned so there would be time to
study all aspects of each item.
Chairman pointed out that the Planning and Zoning Commission
recommended the last bond election about 6 months before it was
called, He said that the city could use help of the league on
city streets, that he noted from earlier staff reports that it
would cost about 30 million dollars to bring streets up to an
acceptable level.
Chairman asked how the recycling program was going and Mfr. Svehla
answered that the initial study was done last year, a test run was
made at Acme brick, that facility did burn well enough to continue
interest in the project. He said there is a technical problem as

moisture is retained and has a tendency to stick, discoloring the
brick. He said the study is continuing, that something will be
done late this year or early next year, that a massive test run in
an actual kiln at Acme Brick will be run rather than a pilot pro-
ject,
Deborah Shelton, representing the Denton Humane Society, addressed
the issue of expanding the city animal control center, She said
the humane society is proud of the city for building the present
center and for providing improved facilities; however, the number
of animals increases yearly which is a serious health and safety
problem, Denton has more surplus animals partly because of the
two universities and because of its location near the metroplex.
People drive up from city areas and dump animals in rural areas
and especially around the lake; some of those animals make their
way into city limits and have to be dealt with by the city. She
said that because of the long lag between the time the city de-
cided to build the present animal control center until the build-
ing was finished, about 5 years, the new building was full the
first week it was open. She stressed that it really is neces-
sary that present facility be expanded. Mr. Sidor asked whether
any study has been made about how large an expansion is necessary
and cost estimate for such expansion. Mr. Angelo advised that
preliminary numbers indicate an expansion of $75,000 to $100,000
now, that city desperately needs a quarantine facility for bite
problems. Ms, Shelton advised that a state law was passed in 1980
which requires a quarantine facility. 11r. Sidor suggested that
staff work up what would be desirable prior to study session so
that it could be considered along with other items, Mr. Angelo
agreed to do so.
Vera Robertson, a citizen and resident of Southeast Denton, sub-
mitted a proposal for a recreation center and a branch library for
their area because of the distance children in the area have to
travel to be involved in recreational activities. She said the
two facilities could be combined and children would benefit both
recreationally and educationally.
At 7;35 p.m., Chairman LaForte advised that he and Commissioner
Claiborne would be leaving the meeting in order to attend high
school graduation exercises. He asked Commissioner Sidor to
preside for the remainder of the meeting.
Charles Cryan, a member of Public Utilities Board, stated that
most figures in the packet presented to Planning and Zoning
Commission have been reviewed and reduced, with many programs
being pushed back in order to maintain a more equal line in rela-
tion to cost to consumers. He said the first 12 months of the 5

year C1P is planned, the second 12 months is fairly solid, and the
next three years are plans they hope to carry uut. He said they
are looking at a 10 million dollar expenditure for capital im-
provements in electric and a 26 1/2 million dollar expenditure for
wastewater and water treatment, for a total proposed budget in the
neighborhood of $36,500,000. Local needs in electric will, be
scaled back since city now will be involved with TiMPA and will not
be developing new generation locally. He continued the city will
have to provide for water and water treatment and wastewater. He
said they are looking at projections which show that city is now
running toward the end of its ability to meet the needs of local
residents and during the next two years the city will be spending
a considerable amount of money upgrading current facilities, water
treatment particularly, in order to provide water in the city
through current facilities. He continued that four to five years
down the road the city is looking t}t the necessity of building a
new treatment facility at a cost of approximately 15 million dol-
lars. He said they do not feel there will be any major impact on
rates to electric consumers but down the road there probably will
be some and possibly considerable impact on water and sewer
rates. They want to keep this down but are charged with providing
a necessary and expensive item of public need. He said that Kay
Roberts Lake is first step, now that the lake is coming on Line, a
way will have to be found to get water here, that is purpose of
the 15 million dollars budget item. Also, there are some problems
in providing adequate water service and pressure in the northwest
section of town since it is higher than current plant. They have
budgeted 1/2 willion to provide that upper water service plant.
He said they are still working on water line out to airport, also
electric substation out that way so growth can be handled as it
occurs. Mr. Nelson stated that document presented is complete, he
would be happy to answer any questions.
Mr. bidor advised that item will be taken into consideration at
study session,
itr. Sveh1A presented three items for consideration; streets,
drainage and traffic signals. He said that projects can be sup-
plied for any amount of money available, that he is aware that all
can't be funded with dollar amount commission will have to work
with. He said street lists as used in the last bond issue are
available, also list of drainage projects from last year, that he
is not aware of any new ones other than Twin Lakes area mentioned
tonight. He said that staff will take another look at that area.
He said staff will supply any particulars on on, articular pro-
ject. He referred to signals stating that as city •ows, addi-
tional signals will be needed; he said cost is about 525,000 p,,r
intersection for signals.

on question from Chairman, he said that figures for CiP budget are
based on concept of amount of money that could be spent for amount
of bonds that could be sold per year without causing a tax in-
crease.
Mr. bidor commented that bond issue tailed with regard to street
maintenance and rebuilding of streets, now there is a 5 year plan
with no mention of streets. He asked how city is going to get
street work done. Mr. Svehla answered they will be submitting
additional requests for funding to City Council; however, probably
not even one million dollars will be available, He advised that
generally a penny of tax generates a little over $100,000 of
revenue which would allow them to do 125 to 150 feet of a total
rebuild job. He said that street problem needs to be addressed.
Mr. Sidor commented that ideal thing would have been for bond
issue to pass so that city could get; streets in good shape, then
annually schedule monies for repair. mr, Svehla agreed that would
help.
Chair closed public hearing at 7;45.
Mr. Watkins. advised commission that on June 14, a joint meeting of
the City Council and Planning and Zoning Commission has been
scheduled to discuss proposed annexation of 9 - 10 square miles.

111. Develop a recommendation to the City Council on the Capital
Improvement Plan.
Suggestions made at the public hearing were reviewed as well
(UNAPPROVEu) as correspondence received. Additional correspondence re-
garding drainage problems in the Singing Oaks area which was
received after the public hearingy was presented; also a
letter from the president of N'fSU suggesting street and
drainagz) improvements and the installation of flashing
lights on Avenue L and Maple Street crosswalks and at the
crosswalks on Avenue C where no lights exist at resent
time. This item was estimated at approximately ,OOO.
Chairman stated that Commission should decide which projects
to Lund for CIP years 1986-87 and 1987-88, advising that
there would be approximately $2,500,000 available for the
two years.
The street issue was discussed and comment was made that
amount of money available would not be adequate for all
street needs. Mr. Clark advised that the city would like
to start a pay as you go program if a bond issue can't be
passed. He said special Financing with a minimum tax in-
crease would pprobably be involved, On question, Mr. Clark
said that 10 Lo 15 percent of street projects are slipping
from overlays into rebuild obs each year, also some seal
coats into overlays. He sad the city has money only to
fill in the large potholes in its current street maintenance
budget. Chairman commented that three years ago cost was
estimated at nine million dollars for streets, now it is 30
million dollars. Mr. Clark advised that the nine million
figure did not include all streets but the 30 million dollar
figure does include all streets. Mr. Claiborne commented
that city should budget money for normal repair of streets.
Specific streets were discussed and Mr. Glark and Mr. Watkins
advised that rebuilding Oriole Street and providing drainage
was necessary as Oriole is in a dangerous condition.
Prairie Street was discussed and staff advised that,; problem
on that street: was caused by concrete company washing trucks
on public street, that this problem is expected to be re-
solved soon as legal action will likely be taken if addi-
tional conversation does not solve the problem.
Lach item on the "Input to the Planning and Zoning Commis-
sion for Capital Improvement Plan (not prioritized)" was
considered.

Mr. La Forte suggested that sidewalks on Windsor Drive for
the new school in Evers Park area be included, also side-
walks on Hercules for school. Children,
Mr. Watkins presented figures for expansion of animal
control center as; new building and modifications -
$74,700, a 6' chain link fence, $1,400; rear parking area -
$900; total of about $75,000,
the suggested recreation center in Southeast Denton was
discussed and Mr. Juren estimated a cost of 1/2 to 3/4
million dollars for the building,
improvement of Woodrow Lane from McKinney tu Spencer was
further discussed, question was asked if county would par-
ticipate in this project and Mr. watkins advised that if it
was possible, city would get county assistance. It was also
suggested that bridge at Woodrow/Pecan Greek be considered
in conjunction with street improvements. Mr. Claiborne sug-
gested that the bridge be built first year and street be
improved the second year. Com.ient was made that this would
benefit people going to mall as well as people who work in
Woodrow area.
Drainage improvements in the Loma Del Ray Apartments area
was further discussed and staff advised that this would make
additional land area developable and would benefit people
who live in area now.
Rebuilding Oriole Street was further discussed and it was
decided that this was a priority Item.
Drainage improvements in Willowsprings area was further dis-
cussed and Ms. Cole advised :hat problems still exist on
Duncan Street.
Drainage improvements in Selene area was further discusse.)
and it was decided that this was important because of prob-
lem for school children and for emergency vehicles.

Mr. Watkins advised that at the Planning and Zoning
Commission meeting.of June 1, 1983, when the Capital
Improvement Plan for 1986.87 and 1987 88 was recommended
(UNAPPR01+1'sl)) to the City Council, no recommendation was made on the
Utility GIP, Mr, Sidor commented that he did not feel
qualified to approve or disapprove Utility CIP as he
felt that group had that expertise.
Mr. Sidor moved to recommend approval of the Utility
Capital Improvement Plan, Seconded by Mr. Juren and

In the past we have utilized work orders to our primary contract with
TRES Corporation for the purpose of consulting, training and
programming services when these needs were required, At this time,
I have presented to the Data Processing Advisory board a recommendation
that we enter into such a work order with TRES for the amount of
$8,000 to b,; utilized for these types of services through the rest
of this fiscal year. This work order would allow the City of Denton
to utilize TRIS5 personnel for these various activities on an as-noeded
basis for the remainder of this year, As you can see from the attached
minutes of the Data Processing Advisory Board meeting, the Data
Processing Advisory Board recommended approval of this contract, This
work order would not ^,1er any major tt'ai.ning effort that possibly
might take place t' -j year and the feeling is that we would initiate
a separate work order for a major training of Customer Service or
related areas.
