SUBJECT; Status of City Hall Council Lighting Project
After discussing the possibilities of upgrading the existing lighting in
the City Council chambers and adding lights to accommodate the cable TV
company, I have come to the following conclusions and recommendations.
1. The representative of three lighting supply firms had no conclusive
recommendations and could not provide for a positive set of plans
and recommendations that would guarantee the light levels and color
spectrums requested by the cable TV company. Each representative
was interested in selling his line of materials, and their experience
is limited to what they had sold previously with very little instal-
lation recommendation in our facility.
2. We have purchased and installed new light bulbs in the existing
fixtures which are the most efficient and highest wattage the units
will safely accept. We will install double adjustable sockets in the
can type fixtures over the stage in an effort to double the amount of
light and direct it to eliminate dark spots on the Council desks.
3. As for the addition of light fixtures for TV lighting, I wish to
recommend that this project be considered for development by a
technical engineering firm which specializes in this type of work.
During my investigation, I learned that to do the job properly it will
tie necessary to determine the amount of power supply available as well
as the amount of cooling BTU's available to counteract the increased
heat produced by these high wattage lights. I have also learned that
mounting angles are very important to avoid shadows and not cause
eye strain when looking at the audience. Also, fixtures need to be
selected which will not interfere with the sound system. For these
reasons, I wish to recommend that an engineering company be secured
to independently select fixtures, determine mounting locations and
wiring needs, and develop a set of specifications and blueprints

Pursuant to our review of materials concerning the Television Lighting
of the city council chambers, I am pleased to submit the following proposal
for services:

Design and Speciflcatlon of lighting system to be used for television
production of activities In the council chambers. This work will con-
sist of the design of lighting for the council table and presenter, as
well as the first two rows of the audience. Also included will be
recommendations for the design of dimmable control of the circuits
corresponding to the above mentioned areas. Our services will
include complete design specifications and drawings, professionally
stamped.
Our fee for the work as Indicated will be hourly not to exceed $3, 000, 00,
and will Include two (2) trips to Denton during design and construction,
We will, of course, assist In evaluating bids and reviewing shop drawings
to assure compliance with the designs, If you have any questions or comments
concerning this proposal, please do not hesitate to call, This proposal is
based upon my current understanding of the project, and Is subject to
minor revision If the scope changes slgnlflcantly.
Should the above terms be acceptable to the City, please sign one copy of
this letter and return It to our office. The other copy Is for your files.

We are still receiving responses from the 31900 letters that were sent to out-of-city
patrons. 221 responses have been received. From the comments added to a number of
these letters, it is clear that some of these patrons identify with tho City of Denton
and are confused about taxes paid to the county. Many did not know who their ootamis-
sioner was. Some said "I didn't vote for any of these people." Others said "But I pay
my taxes." Overall there was little understanding about the county's participation in
library funding.

If the County Commissioners should decide to pay the 20% of the library budget that is
recommended by the Jamison Formula, the library could continue to stay open 60 hours a
week and retain the current staffing level. Reduction of County funding for next year
will impact our budget in that the salaries of ono full-time olerk, one part-time page,
and $23,994 in library materials will be deleted. In addition, service hours will be
out one day per week.
If the county Commissioners follow the plan stated in the Denton itecord Chronicle to
withdraw all funding for FY 1984/85, I would recommend at that time that service to out-
of-oity patrons be continued on a fee basis.

Excerpts from letters
"1 feel that the commissioners have no right to out funds, The people who
live in Argyle and other small towns in Denton county have no large libraries
to go to, Especially the students, We need the large library to get suffi-
cient information to reports and essays, The school libraries are too little,
and don't have enough sufficient information to write in our school work to
give us adequate grades. I would really appreciate you talking to the commis-
sioners and telling them this, Thank you, A desperate, hardworking student,"
"It disappoints me that a county service like this will not be available. I
don't use the library like I would like to--mainly because of my life style at
this period, but T always thought the library was oounLz funded. I have a
many fond memories of the use of the library when I was a child, living in
Denton. An example; of alot a rural towns not knowing the uses or availa-
bility of what the library has to offer, It's a cost to us to come in an use
the library unless we make one trip count for several things, and then when
you do that you have clot, of time consumed. My son, Ryan, has been exposed to
the library & what it is all about, because earlier years in his life we used
to Include a virrit to the library with swim lessons in the summer at the Civic
Center. Then we have used the library for reference materials, Thank you,

"As a Denton County resident and tax payer I feel I have the right to the use
of a public library. I believe that you would be doing a great injustice to
the people who live out-of-city if you discontinue the service of your
library. Most people that live in surrounding towns are people like me who
work in Denton and spend a lot of time and money in Denton, You (Denton)
would be losing a lot of business if the people in surrounding cities have to
find other alternatives to the the use 'of a library. I believe more time
should be spent In considering such a decision on the part of the County Com-
missioners. Especially, when they are taking away from not only many adults
but many children the only public library that they can use, Where will our
children go if they want to read a book and can not afford to buy one? The
Commissioners should think about this and consider other means for funding,"

ditioned to give to every cause and special interest group that it would be
absolutely delightful to give to something we all have an interest in--this
would allow people to give whatever they can or will instead of imposing an
arbitrary fixed rate & an either or situation-425,00 a year is high--some
years we might use it & some years we wouldn't--I'll give $25.00 but I would
hate for everyone to be looked into that fee. Also--many of us 'so-called'
out-of-oily residents pay man dollars in city property taxes, eta. We should
not so easily be pushed aside when the going gets rough--we support Denton and
the loyalty in a public library, especially, should be mutuall"
"You seem to be defeating the purpose of Publio--though I live outside the
city limits our little community isn't big enough to have support for a Public
library--I shall d ive further & use another Public Library. My fondest sum-
mer memories as a child were the hours spent & books read in the hometown sum-
mer reading programs, My parents, with 3 children, could not afford to pay a
fee not, a rental fee. It did instill in us a great desire to road & learn--
something today's child misses with the video game age--they can't read,
count, nor carry on a normal conversation--a practioe a publio library helps
to preserve, Don't punish us for having the long drive in to use Our Public
Library, nor punish us cause we listen to a different drummer and can't. take
tramped city living."
"I pay county taxes & feel this should take care of the library charges so all
residents of Denton County who wish to use the service can. Not all people
can afford to purchase books, or have the space to store them. My daughter 5
I have used the library services almost weekly until winter, and haven't.
started back again, but will in the fall. We are in Ponder School District.,
and the school library'there leaves lots to be desired, There are not the
selections, & most of their magazines are years old. The smaller children
really enjoy the story time each week, & it gives them a real hunger for know-
lodge & reading. You will not have a good school student unless they learn to
read, A good library is a must for the out of town residence who live in the
smaller farming communities. And $25 a year seems a little too much to charge
each card holder, I've been to the library during the day it it doesn't seem
to have to large an overhead in employees, it does have alot of books. I'm
not sure what all the financial issues are but surely something could be put
together without it costing the out-of-town residents so much. Maybe the
county could pay a fee into the library per person or per family who holds a
card, & not a lump sum each year, although that does affect the budget, but we
all have had to cut back & maybe the library needy to follow suit as well.

"I drive from 9 miles west of Lewisville to the Denton Library because I don't
like the idea of paying $25 '.o use the Public Library. Should I decide to use
a library that chargef it would be cheaper and less time consuming for me to
use the one in Lewisville, (Lewisville charges $251 Since I have used the
Frye Public libraries for at least 55 years I find it goes against the grain
to have to pay. Isn't there anything left?"
"I think it would be unfair to the people who live in the county to have to
pay for librnry service. A lot of our tax money has gone into the F.mily
Fowler library and I think we should be allowed to use it."
"Lewisville Library already has a $25 fee for non-residents. I couldn't
afford that one so I started to use the Denton Library. I read 5-10 books
every 2 weeks and couldn't even afford to pay per book, Surely d am not the

Denton County, Should I have to pay because I don't live in the city limits?
We do 90% of our shopping etc. in the city of Denton--and we travel further
than residents of Denton to do so. I live with my daughter b n-in law & the
works in Denton. I'm on Social Security disability and my physical
are limited as well as the financial. One of my pleasures is reading and I
appreciate being able to use your library."

"I am a pro-school teacher at a private pre-sohool in Denton. I check out
many books to use in teaching Denton children. Because of the number of books
I use, I could not pay $1 per book. This would be denying
learning material that I normally provide. I also would have to limit my use
of the library. I live in Argyle and we do not have a public library so we

library should not deny access to certain facets of the up blic that, for some
reason, cannot meet this requirement. I also feel that a condition of this
sort would tend to discourage higher learning and education. I may live out-
of-town, but I attend school, church, and work, and do my shopping in Denton.
I do not feel that I should be fined simply because I live outside the city
limits. (I am curious as to whether four out of the five people listed on the
front make use of' the public library since they also live out of ttwn.)"

I cannot use Lewisville Library unless 1 pay $25 a year--I use and love your

My children borrow books regularly and I would probably give up using the
library if there was a fee involved, $1 per book is redieulous as my children
somotimes take out 20 books between them each week, besidos the book work
involved for the staff a the library. One other point I wanted to mention,
is that it seems an unfr system to charge per book for late books, We were
5 days late returning 1 children's books (between 3 children) and are now
facing a fee of almost $S "or returning late books (we were on vacation at the

The City of Denton City Council met On Tuesday, July 5, 1983, at 8130
P,% in the Civil Defense Room of the Municipal Building,
The Council convened into executive session at 5138 to discuss le'lal
matters, real estate, porsonnel and board appointments, NO offic,al
action was taken,
The Council reconvened in *0 open session, and received a report on the
City of Denton's liability insurance program,
The Arr asked that the City Attorney coordinate a time for him, John
Maxwell, and the Mayor to visit with T14L in Austin,
The Council discussed the water quality of Lake Lewisvllle. City
Manager, Chris Hartung referred the council to one of the goals they had
set at their retreat regarding this issue,
David Nnia reported that the quality is fairly good at this time, and raw
water is monitored by Denton, Dallas, and Lewisville, He stated that
Denton's concern is that one of the lake cities is discharing effluent
very close to our intake ppoint, He stated that the plant was, however,
working to correct this sftuation, Hamm also reported that a hearing is
being set for the near future to Involve the surrounding cities, He
stated that he will be attending as Denton's representative for the
purpose of objecting to allowing a discharge plant close to our water
intake,
Riddtesperger suggested that COG be contacted for the purpose of
providing us with some assistance, and exploring additional alternatives
for cleaning up the lake.
Stephens asked that the county commissioners, the director of the
city/county health department and all of the lake cities be contacted for
their support to a resolution regarding maintaining the control of
effulent being discharged into the lake,
Hopkins stated that the state water control office not be left off of the
resolution,
David Hanm further reported to the council that the City of Denton had
received approval of our permit, and that the city was commended for
excellent quality of the effluent.
Hartung stated that Bob King, Supt, of the wastewater Treatment Plant,
and his crew were doing an excellent ,lob.
The mayor instructed the City Attorney to prepare a resolution stating
that the water standards be kept up around Lake Lewisville, He further
instructed that this resolution was to be sent to COG, the County
Commissioners Court, the City/County Health Department, the State Water
Control Agency, and all of the surrounding lake cities,
Riddlesperger asked if we could establish a contract that would allow the
lake cities to work with our plant, It was further stated that a
developer of the Hickory Creek project had approached the City and had
asked to join onto our plant. laylor stated that as a City we could not
afford to negotiate with developers In this way,
Stephens asked that the City of Dallas not be overlooked for soliciting
support to our resolution,

City of Denton neoded another quality day care center,
Hopkins asked who would run the center,
Davis reported that he would be running the center with adequate staff
based on the ages of the children.
Riddlesporger asked what method Davis was using to determine these needs,
Davis stated that there would be one staff person for every five infants,
onee for every Child from 11 to 18 months, one staff person for every nine
childron from 18 months to 2 years, etc.
Hopkins asked Davis if he was in agreement with the PAZ which was
reconmending approval based on the premise that if the day care Center,
was riot successful in two years the zoning would revert back to the
original two family zoning,
Davis stated that he was in full agreement with this recommendation,
No one spoke in opposition,
Staff person David Ellison spoke, Ellison stated that there were two
letters returned in favor of the zoning change, one in opposition and one
undecided, He stated that the Individual who was undecided appeared
before the PAZ Commission and requested that a solid fence be erected,
Ellison stateo that PAZ had decided that this may have a negative effect
on the Children, and therefore would not agree to a solid wall or fence,

to further explore alternate access and discuss these alternatives with

Hamm stated that his people have done extensive surveys and it was found
that to increase the costs at this time by this percentage wotild be fair
to all, and yet would not be a profit making venture for the City.

SUBJECT: Bid 0 9162 Jason Lane Paving (Participation Bid)
SU'KMARY: This bid is to establish the cost of the extra width,
etc., for the above street. This is only a short length
and small ,job, which creates a problem for the City of
Denton. The low bid for 5" asphalt as per City specifi-
cations, $9,63 per sq, yd. and the 6" asphalt at $12,38
per sq, yd, (See tabulation sheet) This will make the
cost for the City higher than we recently paid on a
project laid 119153 opened May 26,1983 and approved
June 7, 1983 at $7,71 for 5" asphalt and $9,25 for 6"
asphalt, Somehow the procedures for establishing our
cost price Is not as effective and cost saving as it
should be, Total projected participation cost as per
this bid and as shown on the tabulation sheet, low bid,
$10,338,64 and according to our bid #9153 our total
cost would be $8,067.67 or a savings of $4,470,97,
ACTION REQUIRED: Approval by Council,
ALTERNATIVES; Not participate at present or set new procedures.
RECOMMENDATION: We recommend this bid be approved for the City of Denton
participation on this street and we immediately review
the policy and procedures established some 2 years ago
and revise to include recommended staff changes, .de

ment of the Montecito Lstates Addition.
SUMMARY; Mr. Jerry Sawyer, owner of property consti-
tuting lots 85 and 98, block B, on the pro-
posed replat Is requesting approval of this
replat. Offically, lot lines separating
lots 7, 8 and 9 remain in their original
form; however, the petitioner hap advised
staff that an illegal conveyance of prop-
erty by metes and bounds descripion occured
several years ago and, as a result, part of
lot 8 actually encroaches into the area of
lot 7. In addition, Mr. Sawyer informed
staff that a portion of his residence, which
primarily sits on lot 8, is built over the
ortginal lot 9 property line, A residence
also exists on lot 7. The area described
as lot 96 is currently undeveloped; however,
if the replat is approved, it will be sold
and development of a single family residence
would occur. '
Present staff has no informatlon to offer
which would aid in substantiating how an
illegal subdivision of this nature was
allowed to occur. What is apparent is the
fact that the discrepancy between what is
officially tiled in the way of lot layout,
and what actually Exists, has been in effect
for some time because City of Denton water
and sewer base map;a reflect the arrangement
created by the unlawful metes and bounds
conveyance. If the replat is approved, it
will allow the sale and development of pro-
posed lot 9b, but it will also result in an
oificial redesignation of lots 7 and 8 in a
manner that is consistent with what actually
exists.

The commitment to conduct a new employee orientation program wan made in
1981. The philosophy was to develop several slide oomponents for the
presentation to now employees. New employee orientation programs aotually
began February, 1982, At that timo, the first slide program had been
developed and was in use, That program was an overview of City operations,
We are nod ready to begin Phase II of that project, which is a program to
explain employee beuefito.
Since February, 1962, approximately 214 employees have attended an orientation
session, We are now in the process of training all supervisors. Our next
step will be to train all existing employees In addition to the on-going
program of training now employees entering the organization.
The first slide program on City operations has also been used for community
presentations to civic organisations and for City Council orientation,
We are proposing a contract with William M. Morcov, Inc., for developing a 10
to 12 minute benefits slide presentation for employees of the City of Denton,
This request is to utilize the staff of William M. Mercer, Inc„ to prepare,
for the City of Denton, a three projector s11do/sound presentation detailing;
our employee benefits, This contract will provide the script, photography,
word slides, soundtrack and all the programming,

Our selection of William M, Mercer, Inc., came after oontaoting three other
consultants for developing this programs Al Nicotia, HTSU Communioations
Department and MBM Productions. Al Niootia was unable to accept this project
due to our time frame for completion, The NTSU Communications Department and
MBM Productions would not produce the program within our specified budget. In
our meetings with Mercer we have been impressed with their high standards of
quality, the production ideas generated in those meetings and their
willingness to work with us to ensure their product meets our hoods. They
have been most helpful in working within our limits and keeping our systems
compatible, Since Mercer is a benefits consulting firm, their expertise in
communicating benefits will be extremely bonef.toinl in the effectiveness of
this program,
One of Mercer's recent productions, developed for Huntington National Ban);,
won a Silver Plaque Award at the recent film festival in Chicago, They have
also developed productions for St, Paul Hospital in Dallas, Red Lobster,
Wondy's and the State of Oklahoma, The progrnm for St, Paul Hospital and the
State of Oklahoma were for recruiting and now employee orientation. The
productions for Wendy's and Red Lobster are presently being aired on
television.
The benefits slide presentation will be used for the followings
o Provide our new employees with a comprehensive overview of each benefit
the City offers,
o Provide prospective applicants with information regarding each
benefit, This slide presentation will be utilized at employment fairs
and Fire and Police Civil Service orientation sessions,
o Provide an overview of benefits at annual City Council orientation
sessions,
o Provide interested community groups with an overview of the City's
benefits,
Several meetings have already been held with Mercer's staff to review the
format and purpose of this slide presentation. We have discussed what
information needs to be covered for each of our benefits. We have also
provided copies of all the benefits brochures, They have agreed to begin
working, on this project immediately after we receive approval, of the Contract.
The entire ;li.de presentation will be designed in a modular format, This
design was recommended to allow us to quickly change the program if
necessary, We will be able to retape a module if a benefit is added or
changed without having to redo the entire system,

III. SUPERVISION AND CONTROL BY CITY It is mutually
understood and agreed by and between City and Contractor that
Contractor is an independent Contractor and shall not be deemed
to be or considered an employee of the City of Denton, Texas,
for the purposes of income tax, withholding, social security
taxes, vacation or sick leave benefits, or any other City
employee oenefit. The City shall not have supervision and
control of Contractor or any employee of Contractor, but it is
expressly understood that Contractor shall perform the services
hereunder at the direction of and to the satisfaction of the
City ?tanager of the City of Denton or h!.s designee under this
agreement.
IV. SOURCE OF FUNDS: All payments to Contractor under this
agreement are to be paid by the City from funds appropriated by
the City Council for such purposes in the Budget of the City of
Denton,
V. INSURANCE: Contrnctor shall provide at his own cost
and expense workmen's compensation insurance, liability
insurance, and all other insurance necessary to protect
Contractor in the opersrion of Contractor's business,
VI. CANCELLATION: City reserves the right to cancel this
Agreement at any time by giving Contractor thirty (30) days

VII. TERN OF CONTRACT: This Agreement shall commence on the

ANALYSIS
this site is located in a moderate intensity area. Lxisting
land uses along Masch Branch Road range from ranch or estate
type housing and attractive single family, to a steel company,
commercial, and small business uses. Specifically, staff
counted twelve (12) residences and six (6) businesses alon
Masch Branch Road between Highway 380 and Jim Christal RM ,
A significant amount of agricultural (A) land and undeveloped
property also exists in the area. Although a moderate Intensity
designation exists at this site, the Development Guide encour-
ages protection of low density residential areas within one
block of potential high intensity developments through measures
normally associated with planned development (PD) zoning. This
request is for unrestricted commercial (C) zoning and no resi-
dences abut the subject tract. Future significant residential
development will most likely be discouraged in the future poli-
cies because of the proximity of this area to the municipal
airport.
The property in this request was included in a June, 1982 annex-
ation of 208 acres located between highway 380 West and Jim
Christal Road. All land uses in effect at the time of annexa-
tion are legal non-conforming uses. The legal non-conforming
status is not lost unless removed by the board of Adjustment or
the use is abandoned for a period of six (6) months or longer,
A construction business and related facilitkes were in lace at
this site when final annexation action was taken. The facili-
ties are presentlyy being used for thera)yy and recreational
training of menLally retarded adults. ~'he petitioner originally
sought light industrial (LI) zoning to ensure that existing uses
and construction activities could continue on the premises under
city zoning requirements. The Planning and lonintt,,) Commission
modified the request to the commercial (G) classification after
determining that this zoning would be adequate for construction
business related uses. It was felt that commercial (G) zoning
would serve the petitioner's purposes, as well as, limit in some
way the type of incompatible uses that could develop around
existing residences.

CONCLUSION
Approval of unrestricted commercial (C) zoning at this site
would violate Development Guide policies requiring protection of
existing housing within a one block area. but, it would also be
consistent with potential policies which would discourage resi-
dential development In the airport area, The tact that commer-
cial construction facilities existed at the time of annexation
was taken into strong consideration.

M COMMENDATION
The Planning and Zoning Commission recommends approval of Z-1587
by a vote of 7-0. However, it is respectfully urged that future
unlimited high intensity re•juests be effectively controlled
because this is a moderate intensity area with residential
development worthy of protection.

B. Z-1587. This is the petition of Wayne 0, Allen re-
questing a change in zoning from agricultural (A) to the
light industrial (LI) classitication on a five (5) acre
(UNAPPROVED) tract located along the east side of Masch Branch Road
and beginning approximately 1/4 mile south of the inter-
section of Masch Branch Road and Highway 380 best
(University Drive).
Mr. bllison explained request stating that six notices
were mailed to property owners; no reply forms were
received in favor, one reply form was received in
opposition.
Wayne Allen, petitioner, stated he is in construction
business and has a building on this property. When
annexation was taking place, he was advised that zoning
plans included light industrial in the area around the
airport. On question, he said there is a pipe and fence
business in the area which was there before annexation
so it could continue, also Allie I's Restaurant, On
further question, he said that he built his building
three years ago, before area was annexed, but since he
leased the building out he now is told he cannot move
back into his building. He leased the building for use
of mentally retarded adults-for a period of about seven
months while working on another job site. He was told
that if a non conforming use is discontinued for a
period of six months or greater then it is no longer a
non conforming use. He said he didn't know that when he
leased building out, lie further stated that when the
non-profit organization started to move in, city said
zoning didn't matter because it was a non profit organi-
zation. City staff suggested he go ahead and start zon-
ing change procedure which he is now doing as the non
profit organization has left premises and the lease is
about to expire. He is requesting light industrial zon-
ing so that he can reuse his building.
No one spoke in opposition to the request.
Mr. Ellison continued staff report stating that a con-
struction facility and operation with heavy equipment
storage was in existence at time of annexation, there-
fore, property had legal non conforming status, lie said
that in February, 1983, he was contacted by the Building
Inspector who advised him that intr. Allen wanted to lease
• the building to a non profit- organization for the thera-
putic and recreational care of the mentally retarded.
lie said at that time there was concern about the non
conforming status of property as a use existing at the
time of annexation is permitted, however, any different

use is not permitted, He advised that the legal depart-
ment interprets use for the care of mentally retarded as
a permitted use under agricultural zoning. Mr. Allen
was so advised and he also was advisor that if he aban-
doned his construction business for a period of six
months or greater he was in danger of losing his non
conforming status. He also was advised that a zoning
change to commercial or greater would be necessary,
he is asking for a zoning change to legitimize this
use so that he will not have problems in the future.
Mr. Ellison continued that Denton Development Guide
designates this as a moderate intensity area. He
pointed out that in area of Masch tsranch Road between
Jim Christal and Highway 380, there are 12 residences
and six businesses, retail to industrial uses. Staff
feels LI is too intense and suggests modifying to com-
mercial as commercial is more in line with mohrate
intensity, and recommends approval of commercial.
Mr. Sidor asked about zoning required for Allie I's,
restaurant, also the pipe company. Mr. Ellison answered
that general retail would be appropriate for the res-
taurant but pipe company would probably require light
industrial. He said that it is not necessary for a
property owner to come in and request a zoning change
as long as he continues to operate as in the past and
does not abandon the use.
Mr. Allen asked Mr. Watkins if he didn't say that area
was targeted for Light Industrial and Commercial.
~4r. Watkins explained that initially the city proposed
annexing an area consisting of 1500 acres, that the
Development Guide showed a large area as light indus-
trial around airport and also a commc-:cial area. He
said Mr. Allen's property is within the suggested com-
mercial area. Mr. Allen inquired about sellingg steel
out of the yard asking if that was a commercial or light
industrial use as it was a similar operation to pipe use
down the road.
Mr.. LaPorte asked if it was ok with petitioner to rezone
to commercial if he could operate his business under
that zoning classification. Air. Allen answered yes.
Chair declared public hearing clsed.
Mr. Sidor moved to recommend approval of a change in
zoning from agricultural (A) to the commercial (C)
classification on property described in Z-1587.

CONCEPT PLAN ANALYIS
The Pi) concept plan for the proposed office displays potential

fence along the north and east property lines. The Development
Review Committee reviewed the concept plan and found it to be
in compliance with all technical requirements provided maximum
floor area of the building is limited to 4800 square feet. '!he
Planning and Zoning Commission and staff have been advised that
building height shall not exceed two (2) stories and architec-

HISTORIC LANDMARK COMMISSION PERSPFCTiVE
because this site is located in a historically significant area
of Denton, staff solicited the historic Landmark Cnmfsslon's
thoughts and suggestions on the subject, Three area property
owners were present at the June 16 HisCoric Landmark Commission
(HLC) meeting primarily to discuss plans involving a possible
historic district that would include their property, After
discussing the change in zoning request at great length, the
general, feeling of both the HLC and the property owners was
that a well designed office could be more advantageous than
unrestricted multi-family land use at this site; but the prece-
dent for and further encroachment of higher intensity uses into
this neighborhood is a tremendous concern that exceeds all other
considerations. On several occasions, the comment was made that
a well controlled office development Chat respected the char-
acter of the neighborhood could be superior to apartments that
would only be subject to standard zoning ordinance reqquirements.
However, the Historic Landmark Commission as a body, directed
staff to Inform the Planning and Zoning Commission of their
feeling that the zoning should remain as is. They further com-
mented that their major problem with the physical design of the
concept plan is with the proposed parking in the front yard.
ANALYSIS
If the architectural style does not detract from existing resi-
dential character, an office development at this site could be
an attractive alternative to standard multi-family development
(MF-1 zoning is in place). On the other hand, this area is
residential in character and no matter what takes place in terms
of architectural design, an office is not a residential use and
multi-family development is. 'fhe Planning and Zoning Commission
discussed the prospect of establishing a precedent harmful to
the residential character of this area, if this petition is
approved, and decided that an architecturally compatible office
use is less of a threat to the character of the area than the
potential for standard multi-family development, Many of the
commissioners went on to state that they would not support this
request if the existing ^oning was single family and th~it they
are not in favor of existing housing in the area being rezoned
for office conversion. Overall neighborhood response appeared
to have a major effect on the Planning and Zoning Commission's
decision also because the majority of those who replied indi-
cated that the proposed office use would be a better addition to
the area than standard apartments,

because of strong historic fabric and general housing rehabili-
tation activity in the area, staff urges review and approval of
s ecific sate design and architectural plans ik approval of this
P~ request is granted. As a matter of consistency and applica-
tion of uasic urban design principles, elimination of parking in
the front yard is preferable, Elimination or a reduction in
front yard parking would most likely require a reduction in
maximum allowed floor area of the proposed building if parkii,A
requirements are to be satisfied. It is also typical to dis-
courage curb cuts on major arterials such as avest Hickory,
however, one may be necessary in this case to provide adequate
,~lrculation.
REGOMMENDAT 10N
The Plannint, and 4oning Commission discussed the pros and cons
of this petition and the fine line that separates the two at
great length before recommending approval of 2-1588, by a vote
of 4-I, with the following conditions;
1. Specific plans for site development, landscaping, and archi-
tectural style In conformance with approved 4'D concept plan
must be submitted for review and approval prior to issuance
of building permits and a certificate of occupancy, The
City of Denton Historic Landmark Commission shall be con-
sulted for recommendations and input regarding conformance
of architectura). style of building with historic character
of the area.
2, Total floor area of the building shall not exceed 4800
square feet; minor modifications in building shape and
location shall be permitted.
3. Curb cuts shall be limited to one (1) on hickory Street and

left his seat on the dais, and took a seat in the auditorium.
C, Z-1588. This is the petition of Phillip 0, Vick,
aD'n 'I ammell and Stephen E. Reese requesting a change
in zoning from multi-family (MF-l.) to the planned
development (PD) classification for office use at
(UNAPPROVED) 620 West Hickory, The property is located at the
northeast corner of West Hickory and Denton Street,
Mr. bllison explained that 19 notices were mailed to
property owners; four reply forms were received in
favor, two reply forms were received in opposition.
Gary Juren architect, stated property is zoned
multi-famijy, his clients (three attorneys) want to
develop property as offices. He said they have owned
property about two years, they are aware of historical
significance of area. They have not developed definite
plans as they did not wont to go to that expense prior
to approval of zoning change. They can provide sixtaen
(16) parking spaces which means they cannot exceed 4800
square feet of building area. They will probably build
about a 3800 square foot two story building; building
will not exceed two stories. They plan to have eleven
(11) staff and attorney parking spaces on the north side
of site and five (5) client parking spaces along hickory.
'they feel that will minimize circulation on Denton Street
which is a narrow street. An existing large tree on the
corner will be retained to butter the five parking
spaces on front, He continued he has suggested that the
building be residential in character with a pitch roof;
his clients are co-. tned about what goes on the lot as
it is a historical as He said he was concerned about
a staff recommendation of a 6 foot wooden fence along
north and east sides as it was their intent to only
fence the portion on the' east side to screen parking
area. On question, he said that both curb cuts will be
new and will be located as far as possible from the
intersection, He also said that they are observing all
required setbacks, that building will have a 15 foot
setback off Denton Street and a 45 to 50 foot setback
off Hickory; front yard will be landscaped, fie further
stated that diversified uses are considered a plus for a
city and this property is on the boundary of residential
and commercial. Elimination of the first parking space
on hickory was discussed and Mr. Juren said it is his
feeling that all five spaces are needed for client park-
ing„ that his clients might want to take on an additional
attorney.

Chairman suggested that staff consider a no parking zone
on Denton Street as it is a narrow street.
Dan Trammell, attorney, stated it is their intent to
construct a building consistent with character of area,
The alternative is multi.-fmamily housing; they have been
approached by two different developers to buy property
for that use. They feel office is the better use for
the neighborhood.
Mike Cochran, 609 West Oak, stated he is against request
because of neighborhood concern about a block of houses
that are in danger of going commercial, lie said he
realizes that area is zoned multi-family but that is
residential. use. He said he also owns a fourplex which
was divided into apartments in the 30's which from the
street appears to be a single family house and preserves
the character of neighborhood. He continued that amount
of traffic generated is a minor point. On specific
question, he said he would rather see property developed
with an apartment than an office as there is a potential
for neighbors.
Mark Smith, 705 (vest uak, said he did not consider
diversified land uses an asset to neighborhood. He said
he shares opinion of Mr. Cochran and would rather see
apartment development than an office because he doesn't
want to see commercial development this close. He
advised that 106 structures exist from Williams to
Welch; four structures which are commercial or office
been there a number of years. Eight multi-family
structures and a number of duplexes also exist in the
area; area is overwhelmingly residential in character.
He pointed out that area is historically significant and
a proposed historic district is being discussed. He
agreed that the building would probably be attractive
but feels that changing the zoning from residential to
office would be establishing a precedent. lie feels
proposal would erode residential character of neigh-
borhood. He further stated that substantial renovation
is being done on Hickory, that three houses immediately
across from subject property are being renovated, nine
others have been renovated within a one block radius.
It is his feeling that diversified zoning would encour-
age people in area to look for commercial buyers. He
asked that Commission support their residential point of
view.

John Howland stated he is speaking for owner of lot 7,
he lives on property, It is their feeling that if this
property is zoned for commercial use, more property will
be zoned for commercial.
Mr, Ellison continued staff report and advised Commis-
sion that at Historic Landmark Commission meeting last
week this iteal was considered because it is in an his-
torically significant :area and there has been some talk
about an historic district. He reported that it was
their feeling that an office use that is residential in
character and acknowledges historical signifance of area
would perhaps be superior to a multi-family development
that would only be subject to standard provisions of
zoning ordinance. However, as a body, after extensive
discussion, historic Landmark Commission suggested that
staff advise Planning and Zoning Commission that they
could be more willing to run the risk of maintaining
multi-family zoning, hoping that it would be done taste-
fully.
Mr. Ellison further stated that amount of traffic
generated by proposed office use would not be prohibi-
tive in terms of what would occur compared to multi-
family.He also said that if request is approved the
three or four residential structures between this site
and the Carroll Courts Center would run a high risk of
being subject to redevelopment pressures and would have
to be considered on a case by case basis. He said that
Development Guide does not set a specific policy for
this area but with planned development zoning with
suggested controls, proposal would meet policies of
Guide. He said that staff recommendation is not very
strong as this is a difficult case to evaluate and sug-
gested that Commission consider the overall feelings of
neighborhood. He said staff recommends approval subject
to conditions as building can be controlled in terms of
architectural style and scale as opposed to straight
multi-family zoning.
Mr. LaPorte asked if staff thought a park might ever be
located there. Mr. Ellison answered he dot.bted it.
Mrs Juren addressed issue of park by sayin, that value
of property would have to be considered; aso any multi-
family developer would want to maximize number of apart-
ments on site due to cost of property, He noted that
some beautiful areas exist in cities evith diversified
uses that are not high intensity. lie said that to elim-
inate parking in the front yard would as a practical
matter encourage parking on the street. He said that as

far as encroachment is concerned, he does not feel this
would be a factor as not manyy vacant properties exist,
he does not feel there will ba a decline of neighborhood
if office goes in since they are asking for PD fir office
use, not straight office zoning.
Mr. Sidor commented that since request is for Pik, city
would have some control as to type of facility and
arrangement of facility and would have a better chance
to consider historical integrity of lot, he said with
respect to setting a precedent between this particular
lot and Carroll, there probably will be requests for
change in zoning for those residential lots but the city
can't limit expansion of central business district. He
said lie felt Commission would be setting a precedent but
he doesn't feel it would be a bad one.
Mr, La Forte agreed with comments of Mr. Sidor, pointing
out that area '-.etween this site and Carroll is zoned
multi-family rather than residential.
Pls. Mays said she didn't understand why this area was
ever zoned multi-family; there is some multi-family
development around town she wouldn't want to see at this
location. She feels proporgl-would be compatible with
neighborhood. As far as setting 8 precedent, it is her
feeling that Commission has maintained residential char-
acter of neighborhoods as requests have been denied in
the past.
Mr. Erscue commented that he felt it was better to have
some control with office use than no control with apart-
ments,
Pls. Mays moved to recommend approval of 2-1588 subject
to the following conditions:

Transportation i ihis site has immediate access to the
I-35W service road. The road is in a
state of disrepair and is traversed by
large trucks serving industrial users
in the area. The service road dead-
ends to the south and ingress-egress
to the area is from Airport Road,
Some concern has been expressed about
the ,availability of adequate transpor-
tation facilities in this area, and it
is felt that any traffic problems at
thls time are more a problem of con-
gestion during peak hours rather than
one of capacity. It is possible that
sorsre internal decisions on the part of
present and future Industrial users
that would result in staggered work
shifts, could help relieve congestion
in the area during peak hours. The
Highway Department's position on area
road systems is that no Improvements
can be anticipated until capacity
becomes a critical problem. Develop-
ment of additional street systerns can
be expected as development occurs, but
it is apparent that some thought must
be given t:o the city's plans for par-
ticlpation or involvement in providing
adequate transportation facilities
that will serve this major activity
center.
The Planning and Zoning Commission,
urged staff to advise the City Council
of their teeling that the condition
and availability of transportation
tacilities should be made a priority
issue if the trend of approving addi-
tional. industrial zoning and develop-
ment is to continue. Staff was also
instructed to contract the state iligh-
way Department and request that some
immediate maintenance be done to the
1-35 W service road.

ANALYSIS
This property is located In a moderate Intensity area, but it Is
situated between numerous industrial users. The majority of the
Airport Road - 1.35 area is projected by the Development. Guide
as predominantly industrial land of approximatelyy 1,400 acres
that will result in a capacity of over 18,000 jobs. Very little
or no control of Intensity Is proposed for major activity cen-
ters. Control of intensity In moderate areas is an objective
established in the Developpment Guide. From a practical stand-
point, light industrial (L1) zoning at: this site would be
consistent with zoning and land uses present on surrounding
properties. However, future undeveloped land in this moderate
area should provide for some diversity and be subject to strict,
enforcement of Development: Guide policies. This is not a re-
quest for planned development (PD) zoning classification,

Jim Herrington asked about traffic problem and about
maintainenance of road.
Mr. LIlison answered that condition of 1-35 W frontage
road is a problem as well as overall road system in t,ne
area, He said that the frontage road is the total
responsibility of the highway Department; that conversa-
tions with them had identified the problem to be one of
congestion during peak hours as opposed to capacity. It
was suggested that if internal decisions were made on
the part of industrial users to stagger work shifts, the
problem could be dimenished. He continued that overall
access to area is a problem in terms of Airport Road but
it is the only existing road, if undeveloped properties
in the area develop, some additional road systems are
anticipated but that is contingent on future develop-
ment, he pointed out that developing additional roam
in the area would be a burden an all city taxpayers. he
said it is policy of highway Department to improve roads
when a' critical stage is reached and they do not feel a
critical stage has been reached.

Mr, LaForte asked if City Council understands the
importance of the need for roads in the area for light
industrial development to occur and Mr, Ellison replied
that it had been communicated W them a number of
times. On question, Mr, Watkins said he doesn't know
whether this particular area has been considered by the
City Council, Mr, LAForte suggested that some way be
found to call to the attention of the City Council the
need for improvements in the area,
Mr. Ellison continued staff report stating that request
for light industrial zoning is reasonable and staff
recommends approval,
sir, Browne advised that proposed use will not be a high
employee type operation.

Staff received a request from Texas Employment Commission indicating their
desire in designating Handicapped Parking 5pacos at their property, This
new ordinance designates two spaces at the T,E.C, parking tot, relocates
one space from the west side of Elm in front of Shrader's Pharmacy further
south in front of Pine Arts Theater, and removes design criteria from the
body of the existing ordinance due to its redundancy.
FISCAL SUMMARY:
No cost to the city except relocation of one traffic sign, which is
insignificant.

Mrs. James Bacon and Mrs. Larry Wheeler appeared before the Cotrtm.i.s ion
to express their concern about, the Truck Route Ordinance. Their -on-
corn is that since the passage of the Truck Route Ordinance their
husbands have not been able to bring their trucks home and that r_:-.ire
are not any secure places to park the trucks in the City.
Fir. Sam Brown, 2421 N. Locust, alao appeared before the Commissicn
to ask that N. Locust be taken off the tr'ock route because of th<~
danger to children in the residential area and the damage: the tru ?;s
do to the City streets.
Mr. Olyai stated that because the Truck Route Ordinance had bean
approved by the City Council that there was very little the Commission

(l) has a notice of the penalty for a Violation of
Section 10, Article 66ISa•Se,1, Vernon', Texas
Civil Statutes;
• (2) is permanentl; mounted on a pole at least five
feet in height;
' (3) has it profile view of a wheelchair with an
occupant in white on a blue background; and
(4) meets the design criteria establlshad by the
Texas State Department of Highways and Public
Transportation,

(b) Any person adjudged guilty of parking a vehicle

1,11. 35 from the Cooke County Line to U.S. 77 north of Denton, This (otter
is to request that the City of Denton pass an ordinance designating that
Lhe frontage roads on 1.11. 35 within your ;jurisdiction be made to operate
with one-way traffic,
The reconstruction of 1,11, 35 consists of upgrading the entire facility
to the latest design standards which will require reconstruction of the
entrance and exit ramps, In order to design these ramps to the Latest
standards, with the frontage roads operating with two-way traffic, would
require approximately 70 feet of additional right-of-way at each ramp

One-way operation of the frontage roads is considered necessary primarily
from a safety standpoint. If the frontage roads are operated s;litli two-
way traffic and with the restrictive right-of-way, the proposed ramps
would have to be constructed to a substandard design, 'T'his design would
result in inattentive drivers entering the freeway lilies in the wrong
direction and traffic on the frontage roads operating; in the wrong lanes.

partly due to the taro-way traffic on the frontage roads north of U,S, 380,
This interseetlon and turn-around on the northside of U.S, 380 has been
designed for one-way traffic on the frontage roads and this requested
ordinance will help alleviate this problem and should reduce the chances
for a serious accident at this location.
The section of I.H. 35 from U.S, 77 to 03, 380 is included In this request
although this part of I,H, 35 is not to be reconstructed as part of this
project, It is my understanding that considerable opposition exists to
making this section one-way due to the distance between UX 77 And U.S. 180
which results in a considerable amount of wrong way travel for persons using
the frontage roads. Perhaps the Council, would consider passing the requested
ordinance if this section was made one-way pending completion of the Loop
288 interchange at I.H. 35, This interchnngo Will reduce the distance of
wrong way travel and because of the volume of traffic that will be using the
frontage roads on I.R. 35 in connection with Loop 288 the frontage roads
should be operated as one-way at that time,

Koorosh Olyai again re-affirmed his reconunendation to remove the signal
at Bell and Withers. Koorosh, quoted the following reasons from Section
:LA-2 of the Texas Manual on Uniform Traffic Control. Devices that make
the signal light at. Bell and Withers illegal as the basis for his
recommendation. To be effective, a Traffic Control. Device should meet
5 basic requirements. They are
1) Fulfill a need
2) Command attention
3) Convey a clear simple meaning
4) Conunand respect of road user
5) Give adequate time for a proper response
Section 4C•-2 of the Texas Manual on Uniform Traffic Control Devicos
further states that "Traffic Control signals should not be installed
unless the signal warrants'in this manual are met. Information should
be obtained by means of Engineering Studies and compared with the
requirements set forth in the warrants. If these requirements are
not met, the Traffic Signal should neither be put into operation nor
continued in operation (if already installed)."
Virginia Gal.lian made a motion that the CTSSC recommend that the
signal light at. 13el.l and Withers be reinstated to green and red
rotating. Rocky !Cane seconded the motion. The motion carried

Koorosh Olyai presented the stafr's r.ocommendati.on that. the Commission
5 approve the state Department of Highways and Public Transportation's
proposal for reconstruction of I.H, 35 from Cooke County Line to U.S.
77. Upon completion of the project, the west service road of I-35 in
front of Westg.'ito Medical Center will become one way. Koorosh feels that
this will not be an inconvenionco to Westgate Medical Center and that
.it will be a step toward standardizing the service roads on I--35.
Vincent Nico and Nanny Horvat appeared before the commission to ex-
press their concern for the inconvenience to patients and visitors
at Westgate Hospital if the service road becomes one way. In addition
to an access problem to the Hospital, Westgate feels that the one way
service road would add to the already existing parking problem at
f Westgate Hospital.
• Cohn Shrader appeared before the commission suggesting that when
Loop 288 is joined into I.H. 35 that it will be at a point that would
allow access to Westgate Hospital and the Medical Center.
Koorosh Olyai again recommended to the commission that they recommend
approval on the proposal made by the State Department of Highways and
Public Transportation.
Rocky Kane made a motion that the Commission approve the proposal and
Virginia Gallian seconded the motion. The motion passed unanimously.
