(p . m . ) CITY SECRETARY 1297C CITY OF DENTON MEMORANDUM DATE : March 13 , 1984 TO : C , Chris Hartung , City Manager FROM : Charles Watkins , Senior Planner SUBJECT : Solarway Phase III The Development Review Committee recently held a pre -design conference with Mr , William Rogers who is seeking to develop Solarway Phase 1I1 . The tract of land located between Interstate 35W and the existing Solarway sub -division was excluded from an annexation proposed for this area . Since this tract is outside the City , drainage requirements will be minimal but a preliminary engineering review shows substantial drainage improvements are needed , The City will be unable to require the needed drainage improvement if the tract is not annexed . In a rough estimate , lots #46 , #45 and the Culnde-Sac of Section IIIB are unbuilduble because of their location within the floodwayo The creek running northeast and southwest has an estimated flow of more than 2000 efs (as per Master Drainage Plan) . We think it is a mistake not to annex this property and see that drainage improvements with an approximated cost of $150 ,000 are done . When Sections I and II were platted , the same situation happened . The tracts of land were not annexed until after the plats were approved , at that time the City reviewed only water lines . If that situation happens again , the City will see its C , I , P , delayed by the cost of this drainage improvements . We strongly recommend the annexation of this tract of land and we would appreciate you presenting our recommendation to the appropriate channels . Th ou, , Pabl R+�b d4 Civil n . eer 1s 110209E SOLAR WAY AOOITION Proposal for Section III Since the r;ity Council of Oenton honored our request for the unplatted area of Solar Way Addition to remain outside the City limits in order to continue its development in the same manner as before , attached is a pro- posed plat for Section III superimposed on a topographical map. This proposal contains the following elementsr 1 , Lot size averages more than one acre, 2 . A sixty foot right -of -way for a blacktoppod road and bar ditches would meet County standards, 3 , The request is made to extend City water and electricity from Sections I and 11 of Solar Way, Water could come from the and of both cut -de-sacs , electricity from the same and or from ovorhoad lines on the north and south borders of the property. Underground electricity might be supplied by five outlets for ten lots , while the remaining lots could be served by existing overhead lines , 4. Sewage disposal would be by septic tanks unless sewer service may be made available from Corbin Road, 5 , An extension of Solar Way -could have to travel about 200 feet through the area within City limits , .requiring. a variance or whatever for blacktop roadway to match the road on either side of this section, 6. A creek will have to be crossed, the suggestion being two 4 foot culverts , twice the capacity of the crossing of Bonnie Brae just upstream, 7 . Some areas of road will have to be elevated with fill in crossing the flood plain , Creek banks will be straightened and creek beds excavated to aid unimpeded runoff , 8, Parts of some lots may be within the flood plain but in all cases actual home sites would be on higher ground on the same lot , 9 , 4ny City requirements for extraterritorial jurisdiction within the County will be met , William B . Due to lack of usable frontage either on Hickory or Mulberry , because of the number of driveways ( three on Hickory , two on Mulberry ) the remaining frontage does not yield many adequately sized stalls . Perhaps two spaces can be arranged on hickory between the two most eastern driveways . Allowing parking on Hickory is not desirable since the street is designated as Secondary Major Arterial . Chris Hartung , City Manager SUBJECT : RECOMMENDATION TO INCREASE FEES FOR WILLIAMS TRADE SQUARE PARKING SPACES . In an attempt to recover expenses associated with paving the Williams Square Parking Lot , I recommend the following action by the City Council : 1 . Increase the current lease per space charge from $10 monthly to $ 14 monthly per space . This action will result in the following financial impact on the City. Annual Fee Revenue FY 82-83 Spaces. Leased P-er Space Collected Current Fee ( $10 ) 62 $120 $ 7 , 440 Proposed Fee ( $14 ) 62 $168 10 , 416 Net Increase in Revenue $ 2 , 976 Presently , the City is only recovering $7 , 440 annually to pay the debt for paving the lot . To retire the cost for paving the lot , we still have six annual payments averaging $ 16 , 665 each year . The following formula is used to compute the monthly per spaces lease rate : ( $16 , 665 ; 100 spaces ) ; 12 months z, $13 . 88 A fee of $14 per space monthly is recommended for leasing 100 spaces with the remaining nineteen spaces reserved for public parking . All lease space owners will be provided window stickers to facilitate enforcement of parking violations . Mayor and City Couaoil March 74 1984 Page Two 2 . Authorize the City Manager to have meters placed on any unleased spaces in Williams Square after May it 1984 with the Cost per hour for a parking space to be ten cents . Assuming that 57 spaces are metered at ten cents an hour or eighty cents a day , Monday-Friday , the meters will generate $11 , 856 or $208 annually per space , The approximate installation cost of 57 meters is $ 1 , 117 . The City Council established the current rate on October 3 , 1978 . Attached is a resolution authorizing an increase in the per space lease amount and the placement of meters on any unleased spaces . o. Increase the annual leases for 100 spaces from $10 monthly per space to $14 . 00 monthly per space . This action will generate $16 , 800 if fully leased , which is approximately the same as the average annual cost of $15 , 655 for the remaining debt payment . 2 . Any unleased spaces by April 1 , 1983 , would have a meter placed on it at 100 an hour or 800 a day . This is a fee of $208 annually per space compared to the proposed $168 annual lease rate payment per space . The following is an analysis of the impact of the new fee rates to the First State Bank and Craven ' s Store . Location oMeters and Lease Spaces To avoid placing meters in the concrete where possible , it is recommended that meters be placed initially in only the unleasod spaces adjacent to the green space dirt areas in the parking lot , As a result , 14 spaces closest to the First state Bank parking lot will need to have meters placed by thou since they are adjacent to a green space area , Adequate parking is available in the center lot spaces to maintain 62 spaces for leasing . Enforcement and klindog Stick¢„ Requirement : Since only the spaces not leased will have motors , then everyone leasing a space will need to use a window sticker which will cast approximately $160 for printing 250 stickers . The Council considered approval of the plans for the renovation of the west wing of the Municipal Building. City Manager Chris Hartung introduced Jerry Wright and Kathryn Conrady, space planners , and Ann 9ingman, Program Administrator, Mr. Wright stated that tie and Ma . Conrody has boon commissioned to asses$ the space needs in the Customer Service and Cashiering areas. In order to do an accurate assessment, employee interviews had been conducted. The resulca of these interviews indicated good acoustics and lighting were priorities , Space allocations had been made using the interview results and a study of the areas available for the needs of Cashiering, Customer Service, the City Attorney's office , the Municipal Judge , and the Tax Assessor. There vas approximately 5500 square feet of space available ; 500 feet would be required for aisles and a reception or waiting area. The planners felt that the divisions which dealt with financial functions should be located adjacent to each other. A need existed to add more space for the Cashiering and Customer Service functions. Also then; were special needs which had been considered , such as a private conference room area for the City Attorney' s office and security considerations in the Cashiering Division. If a court room vere added, approximately b4UO square feat would be needed. If a court room were to be added In the west wing , a problem would exist on court days wLtli foot traffic because tna number of citizens appearing in court would be added to the persons already in the building to pay utility bills. The planners felt that for the short term, the Municipal Court should continue to meet in the City Council Chambers , Mayor Stewart stated that the City Council wanted to eventually nave a Court of Record, This would create a problem with holding court in the Council Chambers unless some bench seating arrangement could be made , Ann Bingman, Program Administrator, stated that she had spoken with the Fire Marshal and Building Official about using the Council Chambers for the court room. The Chambers were presently classified as an occasional use facility, if used for a daily court room , to moat codes , additional square footage per occupancy would be required , Mayor Pro Tam Riddlesperger asked if the court room could be extended from the resent Council Chambers into the courtyard area in front of the Municipal Building , City Manager Hartung responded an extension would require new construction, Program Administrator Bingmau stated tnat the staff and the space planners had looked for a flexible plan within current budget constraints , Council Member Hopkins stared one option was to call for bids to finish out the other two exterior walls at an approximate cost of $125,000. Council Member Hopkins asked What would be moved into the area presently occupied by the City Attorney's office . Bingman responded that those staff members from the Planning and Community Development Department which currently were officed oehind the Council Chambers would be moved Into this area. Mayor Stewart stated that a Court of keeord would reouire privacy. Council Member Alford responded that tea doors to the present Council Chambers could be closed . It was the consensus of the Council to approve the plan as presented , Council Member Barton asked if the City Attorney was satisifed with the presented plan, City Attorney C. J . Taylor responded no. The sketch of the area showed the Court Clerk a in his office which would oreate a foot traffic problem. City Manager Hartung responded that the space planners and Program Administrator would work with the City Attorney on those concerns . Direction was needed at this meeting concerning the court roe*n so that work could progress. Tne consensus of the Council was to use the Council Chambers , with the proposed additions , as the court room for now. Tne Council also directed the staff to work with the City Attorney and the Municipal Judge on the plan for the City Attorney' s area in the west wing, not including the court room, Barton motion, Chew second to engage the space planners to develop a plan for a court, whether on a second floor of the Municipal Building or the now Police Building , Motion carried unanimously . Alford motion, Chew second to continue to use titre City council Chambers as a court room and to furnish it immediately as a court of i record with the new areas to be Completed according to the plan as presented . Motion carried 6 to 1. Council Member Stephens casts the nay vote . A 53 acre estate subdivision along the east side of Highway 377 on the south side of Brush Creek Road is currently being subdivided , Approximately 25 , 99 acres of the subdivision is located outside the existing -city limit . The tract of land is being divided into approximately 45 lots at least one acre in size for single family residential development . The developers plan to tie into the Argyle water system but will install the waterlines and fire hydrants to City of Denton standards , sewer service is to be by individual septic systems . The internal street system will be built in accordance with City of Denton standards for estate subdivisions and the developer will be responsible for improvements to the frontage on Brush Creek Road . In the event that the owner of any lot , tract or parcel of land or portions thereof shall fail or refuse to comply with Section 12-26 , then the city manager or his designee shall notify such owner by letter addressed to him at his post office address , or by publication as many as two (2) times within ton (10) consocutive days , of personal service may not be had as aforesaid or if the owner 's address be not known , and at the expiration of ten (10) days after notifica- tion as provided herein , the city may enter upon such premises and may do such work as necessary, or cause the same to be done, in order that the premises may comply with the requirements of this article, A Statement of the cost incurred by the city to abate such condition shall be mailed to the owner of said premises , which statement shall be paid within thirty (30) days of the date of the mailing thereof. Therefore , said Nelson , significant savinggs pan be realized by improving production unit efficiency because the efficiency of those units is used as t a billing determinant in all non-TMPA purchased power , Nelson concluded by saying that it is reasonable to assume that this method will effect a gross savings of over $50 , 000 per year . Discussion followed during which the Board expressed its concern that the ultimate cost of this service contract not exceed the stated $250000 . Boyd further noted that the ' entire budgeted amount for such services was $50 , 000 and asked Nelson if he thought this project worth SOX of the budgeted amount . Location of Meters and Lease Spaces To avoid placing meters in the concrete where possible, it is recommended that meters be placed initially in only the unleased spaces adjacent to the green space dirt areas in the parking lot , As a result , 14 spaces closest to the First state Bank parkin lot will need to have motel- s ylaoed by them since the are adjacent to a green space area , AOequate parking is available in the Center lot spaces to mainta' n 62 spaces for leasing . Enforcement and Window Sticker Requirements Since only the spaces not leased will have meters , then everyone leasing a space will need to use a window sticker which will cost approximately *150 for printing 250 stickers . Belew ' s property near the Southeast corner in order to estimate the flood storage requirements , The watershed area is about 800 acres , with a present overall C factor of 0 . 266 . Following development of the PD the C factor would be about 0 . 321 . I estimate the existing Time of Concentration to be 78 . 2 min , and about 74 . 4 min , after PD development ( RUNOFF COMPUTATIONS are enclosed ) . Corresponding intensities are 2 , 75 and 3 . 0 in . /hr , and the resulting 25-yr , peak flows are 644 cfs and 799 cfs . I hav3 used two methods to estimate the storage volume required to main- tain the present 644 cfs peak flowl one is the City of Austin Modified Rational Method developed by Espey , Huston and refined by the Austin City Staff , and the other is using triangular hydrographs wi-�h base times equal to 2 . 67 times the Time of Concentration . The storage volumes came out to be 32 , 730 cy and 30 , 813 cy . I therefore conclude that based on this preliminary analysis about 31 , 750 cy of flood storage will be required . I propose to have the spillway at about elevation 649 . 5 ' so that it will be below the houses on Huisache , and excavate to about 646 ' elevation within the area designated for floodway ( requiring about 20 , 000 cy of on-site excavation ) . We think that this would encourage more traffic on Bell Avenue . This traffic would travel past Strickcland Junior High School . This would generate more traffic congestion and more vehicle-pedestrian conflicts at the school , it would also intensify the traffic congestion problems on Bell Avenue between Sherman and University . FinvIly , if Bell were kept to the south of the channel , it could be run along the drainage channel . This type of use of land in the flood plain is generally a more accepted practice in terms of planning and flood control . This will in turn create traffic control problems due to close spacing of major roadways , Practice calls for one ( 1) mile separation between major streets , Bell cannot intersect the proposed Loop 288, due to engineering problems associated with the grade separation of Loop 288 and Locust , As a result , the only reasonable alternative is to follow the general alignment of Bell as reflected on the Thoroughfare Plan with the relocation of its intersection with Locust . Intersection of Bell and Locust should stay to the south of the floodway , This will provide for the largest possible curve which will result in easier negotiation of turns , The new intersection will intersect Locust approximately half-way between Hercules and Windsor , which in turn will be easier to control , either by signing and/or signnlization. The planned devel - opment. concept plan shows an alignment for Bell Avenue that staff and Planning and Zoning Commission consider acceptable , Staff also discussed with the Planning and - Zoning Commission the prospect of downgrading right - of - way requirements for Bell Avenue north of Windsor Drive to 60 feet . The feeling is that North Locust and Windsor 'Drive are already major streets and acquisition of additional right - of -way and widening of Bell south of Windsor will be a difficult process . The Planning and Zoning Commission recommends 60 feet of right - of -way for Bell Avenue but the Council has the obvious alternative of modifying any portion of this request if the decision is made to approve the change in zoning . ANALYSIS The petitioner in this request is a proven developer that has worked with staff for several weeks in an attempt to develop a planned development concept that conforms to both private anO community needs and desires . Feedback from members of the Development Review Committee has been solicited both collec - tively and individual ) ), though some technical issues require , a g additional study , staff feels that the general concept is suit - able for zoning change consideration in its present form . Because of the scale and diversity of this request ) staff ' s approach to an analysis %'1111 he to provide some general comments regarding the proposal as a whole and attach 'a standard matrix evaluation summary which rates each 1 ( Case NZ - 1626) Page Five ANALYSIS ( Continued ) particular land use in accordance with applicable Development Guide policies , Comprehensive , dense and diverse are three descriptions that seem to apply when one looks at this development proposal as a whole , The fact that a comprehensive planned development resi - dential . community is being proposed is considered positive because it provides decision makers , the community and staff with an opportunity to evaluate and control a large tract of undeveloped property at once as opposed to incrementally . Util - ity and street layout , drainage , intensity gradation , land use compatibility , impact on public services and facilities and other critical planning factors can be studied in a more posi - tive manner when proposals of this type are submitted . However , it is important that the scale and scope of these type of propo - sals are not allowed to overwhelm basic policies and concerns such as protection of existing neighborhood character and adja - cent property owners and adequate site design control . This site is located in a low intensity area . Low intensity areas as stated many times represent primary housing areas whereas moderate and high intensity areas emphasize mixed devel - opments and commercial or employment areas , respectively . This request is extremely consistent with policies encouraging hous - ing diversity , Conventional single family residential development constitutes approximately 47 percent of the total acreage in this request , Moderate density housing ( garden homes , duplexes , fourplexes ) constitutes approximately 25 percent and high density housing constitutes approximately 14 percent of the total acreage , HIGH DENSITY HOUSING ANALYSIS The fact that low density single family housing represents the bulk of the proposal is considered positive ; however , concen - tration of multi - family housing in this area is substantial and the proposal increase will not conform with Development Guide policies . The' Development Guide recommends that apartments be dispersed throughout the City with limited concentration in any one area . One of several specific policies governing high den - sity housing in low intensity areas provides that a guideline for concentration of apartments in one area is under 500 units I with most under 200 units in any one continuous cluster . The Windsor Place Estates Apartments ( 64 total units approved and 28 built ) and the abutting to the East Windsor Village Apartments ( 117 total units approved ) ,begin within 1500 feet east of the proposed 16 . 1 acre multi - family site . The Benchmark Villas Development ( 44 units ) is also located along Windsor Drive south and east of the proposed multi - family section , i ( Casa BZ - 1626 ) Page Six HIGH DENSITY HOUSING ANALYSIS ( Continued ) It is generally felt that multi - family sites should be inter - rupted by distinctly different land use types for a considerable distance to comply with low intensity area concentration poli - cies , The petitioners feel that the 24 , 9 acres of duplex - fourp ) ex property proposed between the existing multi - family on Windsor and the proposed multi - family in this request provides an adequate and significant breafi in concentration of units in the area , . Shifting the proposed multi - family further north was discussed , but this thought did not appeal to the developer and staff agrees that major street access available along the south - ern portion of the property is more desirable , Intensity gradation is also a plus with the present proposal . Elimination of the multi - family housing suction altogether is obviously not a desirable alternative from the developer ' s point of view but it is an option available to the City Council , If concentration in .terms of the total amount of multi - family development in the area is less of a concern than the number of units proposed for this specific request , another Alternative is to attach a condi - tion reducing the density and/or the amount of property reserved for apartments , A property owner to the north and east of the proposed multi - family section appeared in opposition to this request , The Planning and zoning Commission considered the concentration issue , overall density and traffic reports on North Locust and recommended no changes to the current proposal , MODERATE DENSITY HOUSING ANALYSIS The 24 , 9 acres of proposed duplex / fourplex land use was a concern from the standpoint that if not limited to duplexes,, the previously discussed concentration factor becomes even more acute . Although considerably less dense than convential multi - family housing , fourplexes can be designed so that they are barely discernable from standard apartments . The petitioner addressed this concern partially by agreeing to all duplexes along the Windsor Drive frontage of the proposal and clarifying exactly how much duplex and fourplex development can be expected if the change is approved , Approximately 13 , 7 acres of duplexes and 9 , 2 acres of fourplexes is the precise ratio and compromise proposed by the petitioner , Again , the Planning and Zoning Commission felt that this was a reasonable response to the issue and recommends acceptance of the fourplex -duplex section as currently proposed , ( Case NZ - 1626 ) Page Seven MODERATE DENSITY HOUSING ANALYSIS ( Continued ) The propO.Snd single family attached garden homes are considered accept abM,- and staff feels that they add diversity to the development request , Arrangement of the units , parkins; , access , total yard area and other site design factors are unknown at this time , but detailed site plan approval is available through planned ' development zoning , OTHER The single family housing section is proposed at SF - 7 standards Wattractive amenities Stich as landscaped entries along North Locust and cul - de .• sacs on the interior , The developer has agreed to set up a maintenance arrangement' that Satisfactorily relieves the City from any maintenance responsibilities . A brick entry is shown off the Hercules Street frontage and a masonry and iron fence is also proposed along a portiun of the perimeter , The Development Review Committee is still studying plans for internal street layout , and recommends that this issue he resolved during the platting stage , if the petition is ap- proved , Overall , there are no major problems with the proposed single family land use area that cannot be resolved during the platting INrocess . The ten ( 10 ) acres of floodway/ open space will be privately maintained and used for standard drainage ppurposes as well as private recreational facilities that will be available to all residents , Details of plans for this area can also be reviewed during the platting and/or specific site plan approval process . The 4 , 14 acres of neighborhood services proposed at the South - east corner of North Locust and 1indsor Drive is consistent with the petitioner ' s desire to create an atmosphere of community with services available to residents , , Intensity is not a prob - lem , but curb cut control , and definition of specific land uses permitted at this site is strongly recommended , Traffic and access along Windsor is an obvious concern , and the presence of II Strickland Junior High dictates that decision makers pay close I attention to what activities occur at this corner, A dry cleaners , laundromats , ice cream and snack shops and other compatible small scale retail establishments which will truly, provide needed services to this area cou10, become a welcome addition , but again , these uses should be defined and detailPe, site plan approval should be required before construction is permitted . ( Case 1'2 . 1626 ) Page Eight OTHEP ( Continued ) Mr , Bob Tripp , appeared before the Planning and Zoning. Commis - sion in strong opposition to this request and the plan to locate the neighborhood service uses at the southeast corner of Locust and Windsor , Mr , Tripp also expressed opposition to the neigh- borhood service location during the staff review phase , The petitioner was also made aware of Mr , Tripp ' s concern an.d has opted to not move the neighborhood service portion of the request to the northeast corner of North Locust and ViAndsor as suggested by Mr . Tripp , Staff and the Planning and Zoning Commission did concur with the reasoning that though signi - ficant , the neighborhood service location issue is not consi - derable enough to justify a recommendation of denial kf the entire proposal. . SUMMARY AND CONCLUSION With exception of North Locust , all public faci ) ! ties - have adequate capacity to serve this proposal . An intensity study was done and this request does not exceed the intensity/density standard for the area based on existing land use . The compre - hensive planned development approach , housing diversity and proposed amenities are all considered positive , Negative. elements include concentration of multi - fami ) y housing in this area , potential capacity problems with North Locust ( F . M , 2164 ) and the location of the 4 , 14 acres of neighborhood service , RECOMMENDATION After considering the pros and cons , the Planning and Zoning Commission felt that in its ,judgement , the overall character and quality of this proposal is such that the proposal should not he denied and recommended approval of Z - 1626 subject to the follow- ing conditions ; 1 , Sixty ( 60 ) feet of right - of - way shall be dedicated for Bell Avenue . 2 . Activity in the division itas been very high , bast year inspection activities doubled over the previous year . In 1982 we did approximately 5 , '2U0 inspections , in 1083 , we did over 11 , 000 inspections , We expect: activity Lo LPe even greater Wis year , We also expeeL an additional 2 , 50U inspections will be made in the mobile liome parks because of new fees and ordinances that have been enacted . The combination inspector will provide relief in several areas , 'Phis inspector will be responsible for all inspections of the mobile tomes and mobile home parks (i , e . , all plumbing , elecLrical and building inspections) . 'Yetis new inspector would also be able to reduce the average work load from 20 to approximately 15 inspections per day for the existing inspectors . Finally , we feel that this inspector would be able to do 250 Certificate of Occupancy inspections per year , This will allow existing personnel to address other current, needs , 'Pile inspector will allow a more timely response for requests for inspections , It will also reduce the average inspections from over 20 per working day to in estimatt.d 15 or 16 per day (this is about the optimum inspections that can be made per inspector) .
