Members of the Council, I'm Jo Storer and I would like to explain,tu You the kind of Zoning that We have arranged for this yargeou,s' piece of land. I hope you have all been down Lillian Miller Parkway. It's so pretty,' "We have SF-16 at the top there (referring to the overhead projection of the plan) that is going to have a cul-de-sac street through it. It is going to be called The Fridge of Southridge. We are going to have 25 lots,in'there in excess of 10000 square feet. Across the top over there we are going to have another section that will back up to the existing lf,000 square 'lot lots in the ;existing Southridge.area. Below that, We are going to 'do, some SPA-10. Along Ridgeway we pian two single family separate individual houses to be on individual lots but they will be attached With garages and gates and fences 'and that sort of thing.; The houses are not 'attached. Across the tiny we've really got something that 'we think As really going to be exciting and that is going to 'be called SoUthridge Plade.; It's going to be,a very high security area. It's going to have single family houses' on separato lots but a lot a green space around it. It's going to have jogg'ino trails, possibly 'tennis court, swimming pool. I'm with Fields, Edwards and Associates,, and an rspreren~iuq Mrs. Storer in connection with this case. Since the Planning and zoning Commission rsoomme'nded approval of this case, it has come to our attention that there was, perhaps, some confusion or some misunderstanding with respect to this particular cost. It was our firms responsibility to make application to the City for zoning and what we did was, we applied for zoning on the entire 83 acre tract as a planned development simply because it is one unified development bring developed by one developer, The area, that you !ee on the, screen that is shown as OP'-10 and teen the blind of Sr46 is curr.ep x'y 2OA64 Sr-10. The area to the u or right thAt ls `Sr-16 is currently zoned SF-16. 8e46u6e typically he staff likes a planned development type of zoning classification because it is all one unified development, we just auked for planned development' zoning on the entire tract, The purpose for the band of 00-16 zoning is that. to the north is existing sr-16 ,housing and the developer agreed to 'put in Sr-16 zoning as a buffer, for the existing SF-lb to the north. Then the SF-10 area predominantly would be developed as zoned. When we made this request it was, and always has been, the intent to lone this area SF-16 and SF-10 in accordance with all tho City of Denton zoning regulations and to clear up any misunderstanding we would respectfully request that, if the council's wishes, to add a condition to this planned development that all areas designated for single family 5F-16 and single family OF-1o,, will be developed in accordance with all requirements of A e of Ordinances of the City of D6ntonix We Are also' On d9.4n&eta$ o asking for what we labeled single family attached. Perhaps not the best label in the world because all through ,the developer has had'one idea in mind ap4 that is that the houses themselves, the livinq units at a density',leval of only 4.3 units _pot acre, would be built such that the'' living waits would be detached but the gatagas or fencing Areas would, be attached. I think that is consistent with some of the 'photo.graphi that` she has showed You. To clear any 'misundsrstanding' with reii'pect to this partioular area we'wouid respectfully request that the,;;COUna I14 add a condition that all dwelling in the single family attached area w:i11 be detached except for accessory Uses such as garages, storage space and fences. The other item I would like to address if,I may is the intensity of this area. r believe the staff, I know they looked at it in conjunction with the Planning and Zoning hearing', was of the opinion that the area that is designated single family detached, which is on the 'tight hand side of what to called Ridgeway Driver on the vngraph, exceeded the intensity standard for that area. Text to that is the `intensity reserved for this particular area and then we have the intensity of this particular request which is 1,060 trips per day,. If the zoning is approved then the entire intensity for Vhe area is shown on the far right and slightly exceeds the intensity standard. I would point 'out that the 326 acre intensity arsa is about half the site of a normal intensity area. The prototype wan a square miles 640 ♦cres, This area is only 326 acres. If you ohVse to expound the boundaries of the intensity area, this developpont would fall, practically no matter how you decided to expand the boundaries, if they were ,,expa'hoed in any logical fashion, the intensity of this, development would be within :the standards, ' "Is think it Ia extremely reasonable, I feel that this particular l.'sAd plan is an exoeileat land' plan 'given this area. You have seen me here before, generally labeled as a person Who is against progress. This tipa', i'm, here on the sid0 of progress, i ap in favor of this zoning, change or this pl'ilhned development. You heard earlier someone stay that they were ;favor raluctantly., I'm not going to say` that. I'm in favor cautiously. I''have been a homeowner since 1953 and IIve seen one neighborhood after anotherd4spoiled in that time." I spree with whet Mr, Watkins SOY$4 This i~s a beautiful piece or land.. It ought to lend itself to beautiful development. lie worrier about the selling of SP-16 lots. They don't go like hot cakes, What I worry about is that next yea; we will be here again with another proposal to change the Or-16 to a SP-6 or to commercial or to something else, We are very fortunate in Southridge, We don't have a pig form close by like those other poor folks do and I certainly don't gent to soo, anything like that in'Southr14oe, I have very much'reepect for Xt, Watkins inviting the City council to put a 'condition on his proposal, or Mrs. Storer's proposal. That why don't Youcwrite into out proposal that you, we will be held to the dovolorl~ent that was presented. that these will` be Single family houses= that they would not be anything, else. I urge you to do that. I also urge you to set this zoning and not change it again, We have seen changes over and over again and, in Most cases, cases in toning are 4etrimsot*1 to a neighborhood. to this case, I think this particular change would augment the nature of our neighborhood, I would like to .$06 you approve it, I would like to see you add the 'seoond condition together with Mt', Watkins, don't rake any sore changes. Leave it like that. We have been fightlrq this for 16 years, over since I have lived, 17 years, since I have lived out there and i really would like to and that fight,, I really would like for that tlght'to end. What we have boon fighting for, what we have bogn' holding out for 'is that this,'the development of this land be Sri character with what is already out there. Those of us who were early out there picked that site because that we thought it Would make, `a good setting for out homes. We than would hate to see another motorcycle shop out ther6, or a shopping center that would destroy the nature of our house, I have a very serious question. I have been out of town and have not been entiroly informed as to what is happening. I have a"question that says in the proposal before the 'Council tonight it says an area 'of 9,4 acros SF attached. Mrs. Stoker gave a very nice description of what that it.. I `am convinced that that is a b6autiful plan. But it says four units. Is this four` units a one single dwelling or is this going up 8 stoc.ies," Mayor Stewart asked' Dr.' Vela not to ask questions and guaranteed that the Council would ask that question during the staff presentation. Vela "Well, It let we pit it this way then. I would give hearty approval to this proposal if, where it says four units it means four 811gle family dwellings, not four duplexes, or four, quadruplexes,,.,or four condomihiums per acre. Let me say that Roland said that he lad lived out in Southridge for 17 years. I'm not expert in this but I've talked with the engineers and I 04erstand that is ebout 75 trips per acre per dry and that we come within that requirement, as I understand; it, I don't have anything ease to say but I hope you approve it, and if there's any questions I can answer I'll be glad to do so." Mayor Stewart asked it the Council had any questions. Council Member Riddlesperger "I'd like to ask one question, Ridgeway Drive is, I suppose, half built isn't it? Does this entail the developet building the other half?" Phillips "Nobo±iy has meAtiotied that to me. That's what we're going to call Lillian Millor Parkway." CounoV,. Member Hiddlesperger "It's only half built though, It's just two lanes." Phillips "I understand that, Let me put it this way. I haven't heard anybody talk about widening that particular parkway at this time." No one spoke in opposition, The Mayor closed the public hearing. Denies Spivey spoke for the staff. "Mr.., Mayor and Members; of the Council.. There_ were 75 reply forms wailed to property, 'owners within 200 feet, And we have received 5 in favor and 15 in opposition. This 93.2 acre tract is ;located in a low intensity area as designated by the Denton Development' Guide. These low intensity areas represent:the. city's primary housing areas and should emphasize residential use, All of the land uses included in this proposal Iitie single family uses. in Mr. w4tkigs's presentation a few moment ago he addressed the i'ntensi'ty `issue to you and the staff's position before the Planning and zoning Commission on the intensity issla6 was that the intensity analysis prepared for the Dimension Development. zoning case indicated than the zoning approved on that tract' utilized all of the available intensity on the east side of Ridgeway Drive. The staff report itAtcboted that to there and suggested that the intensity. standatd for that area east of gfageway or Lillian Miller Parkway was tilled to capacity by that Dimension Development proposal and that 'additional` high intensity and higher density land uses should not be recommended tot App ,0441, The miniouln reserved development rights would permit low `density Or-10 type of residential land use if the intensity was strictly enforced on the east side of LilliMn Miller Parkway. This was the statt's position. it's true that only, this development to only a little bit over the proposed intensity standard. The Planning commission felt that the differenco over the standard was not enough to make *,significant impact in this case and the Planning and Zoning commission recommend approval of this particular request by a vote of 4 to IJ Another issue that staff was concerned about was that the Dimension Development request was approved by altering a boundary line of the intensity study developed by the staff. The staff had prepared an intensity study as is attached in your back-up for, showing one line and the Dimension Development Company did a separate intensity study which is 'indicated as Intensity Study 40A in your bAok-up and they did adjust the line so that their development would fit the numbers there, And this second boundary line has never been formally adopted and staff,, another issue as Car as we were concerned was that (1) .that that partioUlar line should either be adopted or the original line should be adopted as the intensity Study. but, in any case, the Planning and Zoning Commission did recommend approval of this particular issue and I'll be glad to respond to any questions." The Mayor asked if there were any questions, The Mayor asked Spivey to answer Council Member Riddlesperger's question on Ridgeway Drive. Council member Riddlesperger "It had to do with the development of Ridgeway Drive; it's Supposed to be, as I understand it, a four lane road, What I asked, of oourse, just for my information is whether or not the developer is supposed to develop the other two lanes," Spivey "At I understand it the two lanes that are currently in or currently being finished are on the side nett to the single family attached section which shows up on the map. The developer would not be required to put that in as it's already there," Council Member Riddlesperger "I'm talking about the other two lanes." Spivey "Our platting regulations normally hold developers responsible for perimeter street paving, areas that are along the frontage of your property. The single family detached section on the other side would fall under the normal platting regulations and that can be enforced." 177 77 777 I' Mayor Stewart "It is my understanding that when we paved Ridgeway that the developer as they 0600 through apd developed would pay their portion of the street. Is this being ignored?" City !tanager Chris Hartung ~ "No, there is a street assessment for the whole length of Lillian Miller Parkway and as those properties are chancing hands or being developed that paving assessment is being retired. In foot, do you know off hand, Rick, we've retired a good portion of that, in effect, the developer paid for those two lanes that ate in there now, The City didn't put that in." Council Member Hopkins "OK, to what is going to occur, Chris, is that, are you saying that the state will be paying for the other two lanes?" Hartung "'the plan is to approach the state 'and we are in the process of putting together a letter to the State Department of Highways and Public 'Transportation to have this included on the state system as 6n addition to the farm to Market system as ask them to add the two lanes." Council Member Hopkins "OK, that's the way I thought it was. Also, then, are we dedicating right-of-way in this proposal. Is the total right-of-way dedicated." Hartung "It's alremAy there." Council Member ltiddlesperger "We've got so or 90 feet?" Hartung "It's not 100 feet and I realize that Dr. Stephens likes to see 100 feet some of the time." Council Member Alford "What, in the event that the state sloes not do this, Chris, what would the circumstances be then." Counci Member Alford "NO; welts Just saying that if we do it on one what's the difference in anotherV, Council Member Riddlesperger "Mr. Bancroft, if you remember, we asked that he develop both sides of the streets, even including a lot that was not his," Mayor Stewart "l think I can answer that, Jim. That was the minimum width that the City requires on streets and in order to get the open street, we did that, Y think this was up off of hart worth Drive, So we could require hest because of the minimum width of the street. The minimum width on this is already in and as they develop down to it, they are paying for it. They have paid for this portion." Council Member Riddlesperger "bk, i wanted the information." Mayor Stewart "And now, if the state approves this as a fArm to market road up there instead of Teasley, then it we request them that they continue it up, then they would pay for it." This is exactly the same situation.,, mayor Stewart "I'd like to ask a prooedural question. Would this require 6 votes or a majority of the Council? Mayor Stewart asked if there wao any more discussion. Council Member Stephens "Mayor, I'd like to say soatathiag. I appreciate the concerns that nave been mentioned by some 'oP the 'folks here. Council Member Stephens stated that the ordinance in the Council back-up material did not track with the motion which was made. Denise Spivey "The tapes, as to what the intent was, I cannot specify from that but the tape, the motion that was voted on Dr. Stephens wade the motion for a detached, the areas west of 'Lillian Miller Parkway to be dete'ohed and that was the particular motion that was voted on according to the tapes.,, Council Member McAdams stated that she remembered this petition very well and the lengthy discussion about detached versus attached with the finbes, garages and storage buildings.
