j' We have been advised by our regional personnel that the above-subject }
municipal solid waste site has been closed.
Municipal solid waste sites can generate flammable gases for many t'eat's I
after closure and can also contain materials which could be homful if
dug up by unknowing future landowners. Therefore, 325.132 of the
1 f Department's "Municipal solid {taste Management Regulations" requires
that the site operator shall prepare on "Affidavit to the Public" and
cause the same to be filed in the deed records in the office of the
county clerk of the county in which the site is locsted. The affidavit
shall include a legal description of the property on which the site is

located and may specify the area actually filled with solid waste, Also {
included in the affidavit sball be a notice to any future owner or us+r
of the site that they should consult with the Department prior to
planting or initiating any activity involving the disturbance of. tbe_ i'
landfill cover or monitoring system. 'A certified copy of the affidavit i
shall be obtained from the county clerk after recording snd sutstittod'Lo
the Departments Itnalosed it a suggested format for the affidavit.

i copy of your affidavit as recorded with the county Clark. We request ?

this Deportsotp rior to November 15,1984. If the affidavit copy cannot

periodically inspect tiv. jlosed site and correct as necessary any
problesse associated with erosion, vegetative growth, leacheto or methane
migrations and subsidence or pouding of w4ter on the site. Department
! representatives will alto inspect the site periodically during this
period to assure that the site is adequately maintained.
