SUMMARY: Residents in the area of property described above have expressed concern about existing and potential development and land use patterns. Existing development along the City's 500 foot strip includes: Border Cowboy Truck Stop, Howdy Doody Grocery, Poster's Saddle Shop, Dozier Cabinet Works, Cunningham's Photography Studio and Mini-Warehouses, Port-A-Stall Factory Outleta and W & w Auto Salvage. The City of Denton Public Utilities Board has also recommended that the City Council consider annexation of this area after reviewing problems associated with the Border Cowboy Truck Stop sewer system approximately two (2) months ago. The Border Cowboy Truck Stop sewer problem has been :esolved for now, but environmental concerns remain with respect to this general vicinity. The City Engineer and members of the Planning Department have met with the owner of property between Barthold Road and FM 1173 which was formerly used as a driving range for golfers. The property owner has stated that it is his intention to develop mint-warehouses and similar commercial uses. Little or no regard for City Subdivision and Land Development Regulations was shown during discussions. The City Engineer is particularly concerned about stated plans to alter natural drainage patterns. A site visit has revealed some development activity on the land in question. City of Denton regulations governing property in the extraterritorial jurisdiction may not prove helpful if actual subdivision of land does not occur. But again, it appears to be the most expedient and forceful method available for monitoring future undesirable land uses. The relative proximity of this area in relation to the existing city limits (500 foot strip from c6nter line of I-35) appears to make it a good canditate for annexation when such factore as impact of land uses on the City of Denton and availability of City services is considered. ACTION REQUIRED: Receive study and determine whether to instruct staff to begin the annexation process (some direction is also needed on limits of possible annexation area). ALTERNATIVES% 1. No annexation 2. Annexation of parcels where development is underway or considered imminent 3. SUMMARY: This is a voluntary petition for annexation and a change in zoning petition for approximately 658 acres adjacent and north of the City of Denton Municipal Airport at its closest point has also been submitted. The requested zoning is light industrial (LI). The petition for annexation and zoning was possibly precipitated by the inclusion of this site in an area considered appropriate for light.industrial use by the Economic Development Fact Book (see exhibit 111). Approximately three (3) structures and residences are located within the affected area. A major annexation in 1983-84 included the bulk of the 658 acres included in the change in zoning petition. It is extremely difficult to anticipate the In- mediate development potential to this tract. The nearest public water and sewer facilities are approximately 2,000 feet away according to the Economic Development Fact Book. The City of Denton has customarily accepted petitions for voluntary annexation when the property in question is primarily undeveloped and the immediate demands on city services is limited. Annexation of this tract would be consistent with actions taken on previous annexations in this area and a recommendation from the Airport Board, as well as the Planning and zoning commission, will be forwarded to the City Council. Gary Collins explained the invoice of $3,5DO wts the cost of the license to use the SAS Software Package for another year. Ror, McDade made a motion that the Data Processing Board recommend the City Council approve the $3,500 for the annual license fee for the SAS Software Package. Dale Maddry seconded the motion and the motion parsed unanimously. 3. Gary Collins reminded the members of the Data Processing Advisory Board that there was a vacancy on the Board and that two of the current member's terms expired this year. WHEREAS, the Council of the City of Denton is desirous of renovating portions if the Municipal Building ; and WHFREAS9 the City of Denton wishes to retain the services of Jerry Frederick as a contractor for project construction manager to complete the renovation work; and WHEREAS, Section 2.09 of the Charter of the City of Denton, Texas requires that every act of the Council providing for the expenditure of funds or for the contracting for indebtedness shall be by ordinance; WHEREAS, Section 2.36 (f) of the Code of Ordinances requires that the City Council approve all expenditures of more than $3,000; and NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON, TEXAS HEREBY ORDAINS: SECTION I. That the Mayor and City Secretary are hereby authorised and directed to execute and attest, respectively, the agreement between Jerry Frederick, as a contractoe, for project construction manager, and the City of Denton, providing for renovation work to a portion of the Municipal Building under the tares and conditions being contained in said agreement which is attached hereto and made a pert hereof. Scheduling of all project zetivities; E. Keeping complete and detailed records and accounts for financial management of the project; F. Development of a critical path schedule for demolition and construction; G. Other duties relating to management of the project as assigned by the City Manager or his designee. 2. COMPENSATION TO BE PAID CONTRACTOR: City agrees to pay Contractor for the services performed hereunder as follows: A. Six Hundred Dollars (;600.00) per forty hour week not to exceed a total sus of Twenty-two Thousand and No/100 Dollars (:22,000.00); S. An additional One Hundred Twenty-Five bjllars 0125.00) rer forty hour week as compensation for use of contractor's private vehicle; C. Although the panel systems are not in place, the Public Workp Department moved into their allocated space in the Center !tall (Phase III) Monday, May 13. The Planning (P 6, Z) staff is oxpected to cove into their space now vacated by Public Works in the Center Hall next week. WEST WINO ADDITION The HVAC system in the West Wing Addition has delayed completion but should be completed and operational Friday, May 17. The carpet is scheduled to be installed next week, and the Customer Service Division should be moved into the space by May 319 1985. In order to ensure the finishing touches snd check-off lists are completed after our :Dove into these areas, we request that the ordinance authorizing an extension of the agreement between Jerry Frederick, as a contractor project construction manager, and the City of Denton be placed on the City Council agenda for consideration. This extension of agreement provides for renovation work tc the Municipal Building under the terms and conditions contained in the Extension Agreement and the independent Contractor's Agreement. This will provide a little added assurance that the project is satisfactorily completed since we are the responsible general contractor on the project.
