SETTLEMENT AGREEMENT & RELEASE OF ALL CLAIMS
CUUN'1'1' OF DENTON §
This Agreement and Release is made and executed on the ~0 7%
day of Jauttary 085, by and between the City of Denton, Texas,
hereinafter referred to as "City" and Walker Hale and Louise Hale,
husband and wife, hereinafter sometimes referred to as "Releasors."

RECITALS
WHEREAS
' r
1. Walker Hale has been continuously employed with the City
since June It 1955, and is now Superintendent of the Electric Pro. '
duction Division in the City's Utility Department; and
' 2. During his employment with the City, Mr. Hale has
accumulated unused vacation and compensatory hours which entitle
him to time off with pay; and
3. The exact amount of vacation and compensatory time to which j

Mr. Hale in entitled is in dispute due to differing interpretations 1
of the procedures for authorizing compensatory time, limitations on
t vacation accrual and record keeping requirements over the years
~ involved; and
I 4. The City and Walker Hale desire that he be allowed to take E
i accumulated vacation and compensatory time until his retirement
data of February 11, 1985; now, therefore,
In consideration of the mutual covenants contained heroin, the ;
City and Releasors agree as followsi
i. That Walker Hale is authorized to continue on vacation leave z
'l from his employment through December 21, 1965.
t 2. That Walker Hale is authorized to take compensatory time
Crum his duties with the City from December 21, 1985, through
February 11, 19854
3. That Welker Hale shall retire from his employment with the
City effective at the close of business on February 11, 1985.

4. That Welker Hale shall remain on the City payroll, receiving
full pay, until the close of the payroll period ending February 11,

5, that Walker Hale shall continue to be eligible for and
receive all City benefits to which lie is otherwise entitled, except
t the monthly accrual of additional vacation and sick leave, until

6, That this 'agreement is the settlement of a disputed claim I

S„and shall not constitute any admission by the City or by Raleasors
as to the nature and extent of leave time accumulated by Mr, Hale

Releasora, for themselves and their heirs, legal
represen-tatives, and assigns, release and forever discharge the City, and

its assigns, from all claims, demands, actions and causes of action
zi+ of any kind or nature at law or in equity, based upon and arising
out of Mr. Hale's employment with the City, This release applies
to all past and existing claims, including, alithout limitation, all
rights of Roleasors to claim additional compensation from accrued
vacation leave and oompenaatory time,
IN WITNESS WHEREOF, the parties have executed this Release and
Settlement Agreement at the City of Denton, Texas) the day and year
