« At your request, the Planning and Community Development Depart-
ment has researched the change in population as a result of 3
annexations since December of 1982.
Annexations have resulted in parts of three additional census k
tracts being added to the Denton study areal however, the annex-

SUBJECT: Submission to Justice Department of "voting changes"
under Section 5 of the Voting Rights Act as a result
of annexations.

As you know the City is required under Section 5 of the Voting
Rights Act to gain preclearance from the Justice Department of any
changes that affect voting patterns or practices of city electiona.
The last submission for preclearance for our present four single
j member geographic election districts was made on December 22,
I 1982. That submission included a copy of Ordinance No. 82.100
which established the current single member districts. I have no
records of any objections to the submission by the Justice
Department. I have no records indicating any submission was made
for the 1984 election.
I have contacted the Justice Department concerning the necessity
of making a submission for the purpose of obtaining preclearance,
where there have been no "voting changes" as defined by the Act,
except for annexations. I was told that a submission should be
submitted because of "voting changes" that may have resulted from
the annexations that had not previously been reviewed.
Our last submission in December of 1982 which established, our
present districts, received no objections. I am therefore
requesting that you supply the following information so that a
submission can be made as soon as possible for the upcoming city
election:
1. Duplicate maps of the city limits on or about December 22, 1982
showing the single member districts.

2. Duplicate maps of the present city limits showing the present
single member districts.
3. Copies of all annexation ordinances approved since Deceeber 22,
1982.
4. To the extent possible, an explanation of the purpose or reason
for each annexation, i.ee by request of property owner; to
control expected development; to protect the territorial
boundaries; etc.
5. Duplicate maps showing the location, area included, and date of
each annexed tract with reference to the four member districts.
6. The changes in population of the city and the four member
districts as a result of the annexations between December 22,
1982 and present.
7. Information on the number and/or percentage of change of racial
or language minorities in the city and each district as a
result of the annexations.
Since the Justice Department has 60 days to give preclearance of
any submission made, I must, of course, request that their review
be expedited in order to receive approval before the April °
election. I would appreciate your attention to this matter as '
-soon as-possible.

IN SAID ELECTION; PROVIDING FOR VOTING PLACES AND APFO:..:r:1NG

THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS:
SECTION I.
Pursuant to the terms and provisions of Section 3.01 of the
Charter of the City of Denton, Texas, a municipal election is
hereby ordered held in the City of Dentca, Toxas on the 6th day
of April, 1985, for the purpose of electing four (4) council
persona to the City Council of the City of Denton, Texas, as
follows:
Place 1 - Councilperson to be elected for a two (2) year term by
the qualified voters of Single Member District No. 1
of the City of Denton, Texas. Candidates for Place
No: 1 must reside in Single Member District No. 16
Place 2 - Councilperson to be elected for a two (2) year term by
the qualified voters of Single Member District No. 2
of the City of Denton, Texas. Candidatett for Place
No. 2 must reside in Single Member District No 2.
Place 3 - Councilperson to be elected for a two (2) year term by
the qualified voters of Single Member District No. 3
of the City of Denton, Texas. Candidates for Place 3
must reside in Single Member District No. 3.
Place 4 - Councilperson to be elected for s two (2) year term by
the qualified voters of Single Member Distt,ct No. 4

The election officials for said election on April 6, 1985
shall be as follows:
1. (a) Jo Luker shall be the Presiding Judge at the Central
Counting Station.
(b) Joann Garbacik shall be the Manager of the Central
Counting Station.
(c) Marilyn Robinson shall be the Tabulation Supervisor at
the Central Counting Station.
2. Bill Luker shall be the Presiding Judge at the American
Legion Hall in Single Member District No. 1.
3. Doris Chipman shall be the- Presiding Judge at the Fire
Station No. 4 is Single Member District No. 2.
4. Marsha Keifer shall be the Presiding Judge at the North Lakes
Recreation Center in Single Member District No, 3.
3. Mrs, R. B. Escue, Jr. shall be the Presiding Judge at Dania
Park Recreation Center in Si)-}le Member District No. 4. kk
6. Charlotte Allen, City Secretary shall conduct absentee voting E
under the Texas Election Code.
The respective Presiding Judge of each voting Place and the
Central Counting Station shall be authorized to appoint a ;
sufficient number of Clerks as they may deem necessary to assist
them in said election, including bilingual assistants as
required by law.
SECTION IV.
Absentee voting shall be conducted by the office of the City
Secretary in the municipal building on East McKinney Street in
the City of Denton, Texas, and the polls for absentee voting
shall be open for voting in person between the hour of 8:00 ABM.

absentee votings
SECTION V.
The City Secretary is hereby authorized to prepare the
official ballot for said election and perform each and every act
required by the Charter and laws of the State of Texas for

It is further ordered that the punch card electronic voting
system 'adopted; by Denton County be used in said election in
accordance with the term and provisions of Article 7.15 of the
Texas Election Code, The punch card electronic voting 'system
• shall be used for absentee voting in person and by mail.
