WOMMAS, the City of Denton, Denton County, Texas, a Hone Rule
City, hereinafter referred to as *Owner," Is the Owner and operator of a
►anitary landfill situated in Denton County, known as the Denton Nunirt-
} pal Landfill, hereinafter referred to as "I,andfilI," which landfill site
has been duly permitted by the State f Toxasi and

referred to as "User," desires to contract with the owner for the use of
the Landfill for the disposing of its refusal and
WHEREAS, the owner is vliling to contract with the user to make the
fI Landfill available fox disposal of its refusal

of the mutual covenants set forth Aertin, it is agreed by the parties as

i y 1. Use of Landfill. For thF, duration of the year beginning on
the 24th day of Julie 19 85 , and
ending on the 30th day of September ,
19 85 , unless sooner terminated as here inn tar provided, the
Owner shall permit the Usar to utilize the Owner's Landfill 111
for the dumping of the User's refuse.
' 2. The User shall pay to the Owner a monthly charge based on the

pric6 of S_ . 1.30 per., cubic yard of allowable refuse dumped
at the Landfill. The owner shall bill the User on or about
the first day of each month following the end of a month
r wherein the User dumped refuse on the Landfill, The Uner
shall pay the owner within ten (10) days of receipt of the
monthly bill. In the event the User fails to timely pay the
charges, the Owners at itt discretion, may terminate this
contract by giving the User ten (10) days written notice.
3. Ml of the User's vehicles shall carry readily asrertainable
1 i.ientification that is satisfactory to owner.
4. The User shall not dump hazardous, toxic, special, or re-
strieted wastes as defined by the U,S, £nvironmrntal pro-
tection Agency and tha (Mate Of Texas Department of Health;
barrels, tires, auto or truck bodies.

9 5, The Owner shall construct and continually maintain an
all-weither road maintained in a good, smooth condition from
the public road through the Landfill to the dkunping area,
' 6, a. User shall comply wi+,h all rules of operation established
x by Owner that are appli,^ablo to all ieaors of the Landfill
site. Failure to comply with such rules may result in
the User boinc denied use of the Landfill,
b. User estimates that the amount of monthly refuse to be
deposited at the site to be 560 cubie yards.
All use of the Landfill is subject to applicable City, County,
5".ate, and Federal ordinances, laws, and reyulatl.cns dealing
wi'~h the operation and use of a sanitary landfill site,
