Regular Meeting of the City of Denton City Council on Tuesday,
February 4, 1986, at 7:00 p,m, in the Council Chambers of the

approval thereof will be strictly on the basis of the
Staff recommendations, Approval of the Consent Agenda
authorizes the City Manager or his designee to
implement each item in accordance with the Staff

time and place for public hearings concerning the
request of Teasley Road Associates and the City
of Denton for proposed annexation of
approximately 125.25 acres beginning at Kings
Road and proposed Loop 288, south of Oak Bend
Estates, and south of Silverdome Road (A-33).
E. Consider adoption of an ordinance authorizing the
use of compensatory time under certain condirion
for public safety employees governed by Article
1269m, V.T.C.S., as amended.

ordering an election to be held on April 5, 1986

SUBJECT: Proposed Revision of Ordinance Establishing
Single-Member Districts for the April S, 1986
City Council Election
DATE: January 29, 1986
In preparing the City's submission for the April 5, 1986, City
Council election to the Department of Justice, we have found
that minor changes need to be made in the ordinance establishing
the present single-member districts.
First, the Denton County Commissioners have adopted a new
election precinct map for Denton County. The only changge that
has occurred in the City as a result of the revision is that
former county election precinct 4-H has been divided into two
parts, now designated as 4-H and 4-N. Since the farmer precinct
4-H was entirely within council district 2, there would be no
change in population for, the district, but the present ordinance
establishing the single-member districts does need to be amended
to include the new Denton County election precinct. The map
showing the location of the new Denton County election precincts
will be available at yopr February- 4th meeting.
Secondly, as a result of annexations, there are parts of
additional Denton County election precincts that need to be
included in the ordinance establishing new single-member
districts. Those annexations, which include no additional
population, include Denton County election precincts 4-M and
1-C, which would be located in council district 2.
F'inslly, also as a result of the annexations, there are slight
revisions in the population figures for the single-member
districts. The new population figures are shown in the proposed
ordinance attached hereto. Ordinance No. 85-45, which estab-
lished our current single-member districts, is also attached, so
that you may compare the changes in the population figures for
each district. The changes in the language and racial minorities
in each district resulting from the annexations is also shown in
the attached documents.

Because of the need to submit the new annexations to the Justice
Department in a timely manner, we have asked that the proposed
ordinance establishing new single-family districts be scheduled
for a public hearing and adopted at your February 4th meeting.
Any additional information you may need concerning this matter
should be available at your February 4th meeting.

As requested by the Council, a draft of the Employment Procedures Manual was
presented for review at the December 3, 1985 meeting. At that meeting, the
Council directed staff to make the following changes:
1. A section for a Council-designed option was added.
2. City personnel involvement is limited to that requested by Council.
3. The Council will decide it they want the Director of Personnel to act
as facilitator between them and the search firm.
4. All applicant resumes will be available to Council for their perusal.
For your convenience, I have attached a highlighted copy of the prges on which
the changes were made. In addition, we will be present to receive any
questions and/or recommendations the Council may have concerning the manual.

1. PRE-WCRUITNENT PROCEDURES
At the time a vacancy occurs in one of the appointed positions, the Council
will determine the recruitment resource (search f_.m, in-house, or Council
designed option) to be used in filling the position.
o For the City Manager and City Attorney positions, the staff will make
a rec=*ndati~n to the Council after evaluating current market
conditions and tN availability of recruitment resources.
o Recruitment for the Municipal Court Judge and Deputy Court Judge
positions will always be conducted through an in-house search.
Once the method of recruitment is established, the following process will take
place.
A. Council Review of Pre-Recruitment Material
The Council will review the job opporttinity announcement and the job
specification and signify their approval by forwarding the signed
documents to the City Manager. If revisions are needed to either
document, the Council returns them with specific instructions on the
needed changes. Should the Council desire, the revised documents can be
returned to them for approval prior to posting.
B. Pre-R=.-::tment Form
Along with the job opportunity announcement and the lob specification, the
Council will also receive the pre-recruitment form (see Appendix A). This
form will provide the following information for Council perusal:
1. Proposed recruitment plan.
2. Issues for council consideration
3. Current benefits aid conditions of employment assigned to the position.
C. Selection of Recruitment options
Following the Council's approval of the pre-recruitment material, they
will inform the City Manager of the final recruitment plan. Based on the
L'ouncil's decision, the P/ER Department will:
1. Begin the recruitment process
1. Begin the search firm selection process or
3. Act upon Council's directive
If Option 2 is selected, proceed to Step .II. If Option 1 is selected,
proceed to Step 111. In the event the Council elects to tailor their own
recruitment plan, proceed to Step IV,

II. WORKING WITH A SEARCH FIRM
A. PROCEDURES FOR SELECTING A SEARCH FIRM
1. If the Council selects the services of a search firm, the following
options are available:
a. Instruct the City Manager to contact a particular search firm with
whom they have had recent experience, or
b. Instruct the City Manager to solicit search firm proposals for
their review.
2. Once the Council determines the search firrn;s) with which they want
formal presentations/interviews, the P/ER Department will notify them
of the time and place of their interviews.
3. Following the Council's selection of a search firm, they will notify
the City Manager of their decision. The P/ER Department will notify
all firms involved of their decision.
4, The P/ER Department, in cooperation with the City Attorney, will draft
a letter of agreement between the City and the search firm:
a. The City Attorney will draw up the ordinance authorizing the use
of the search firm
• b. The P/ER Department will place the item on the Council agenda for
approval.
5. The Council will forward the signed letter of agreement to the City
staff who will then forward it to the search firm.
8. PRE-INTERVIEW CODICIL DECISIONS
1. The P/ER Department will prepare a list of possible questions for the
Council's review.
2. The Council will then make the following decisions:
a. Select the final interview questions
b. Oecide if a committee is to conduct the ir.`.e-views or if the
entire Council is to take part
c. Decide on which of the selected questions eac'i member of the
interview panel will address, and forward them to the City Manager

4. The P/ER Department will also provide the Council with a scoring form
to facilitate the selection process (see Appendix El and E2).
C. ROLE OF PERSONNEUEM LOYEE RELATIONS Df_PARTMENT IN SEARCH FIRM PROCESS
After th- initial meeting, the Council will decide if they want the
Director of Personnel to serve as the contact person for the search firm.
If the Council elects to appoint the Director of Personnel as facilitator
the following process will take place:
1. The P/ER Department, under purview of the City Manager, will act as
facilitator between the search firm and the Council,
2. The P/ER Department will provide the search firm with introductory
information to candidates about the City.
3. The P/ER Department will also provide the search firm with the Council
approved pre-recruitment form outlining the salary, benefits, etc.,
relevant to the position.
D. PRE-INTERVIEW PHASE
1. The Council will inform the City Manager of the time and place they
wish to conduct the interviews.
2. The P/ER Department will schedule the appointments and inform all
parties involved, in writing, of the time and place of their
respective appointments.
3. The P/ER Uepartment will provide the Council with a current salary
survey of comparable positions.
E. INTERVIEW PHASE
1. The Council will interview all referred applicants.
2. Following the Interviews, the Mayor will:
a. Inquire into the applicants' salary expectations
b. Get applicant approval to contact current employer.

2, The P/ER Department will evaluate all resume based on the criteria
spelled out on the job opportunity arnxmement, and only those that
meet the minimum qualifications will complete a formal application for
the position, However all resumes will be forwarded to the Council
for their perusal.
3, Following the Council's review ot_the resumes the P/M Department will
conduct pre-screening interviews, if asked to do so by the Cotmil.
4, Following the pre-screening interviews, the P/ER Department will make
a formal referral. The referral will consist of the names of all
qualified applicants. In the event the Council assigns the P/ER
Department with the task of pre-screening the applicants, only the
best suited applicants will be referred.
5, Applicants that did not meet the minimum qualifications will receive a
letter of appreciation for their interest.
D. PRE-INTERVIEW COUNCIL DECISIONS

2. If the referred applicants are not acceptable to the Council, they
will revise the criteria for the recruitment process. Then the
Council will provide the City Manager with the revised criteria and
instruct the City Manager to begin the recruitment process over.

ANALYSIS
This site borders Carroll Boulevard and is located in an older
neighborhood. This request for Planned Development office
zoning conflicts with Denton Development Guide policies
encouraging protection of surrounding residential uses.
Protection of older neighborhoods and encouragement of
development where public facilitiee capacity is available are
two basic objectives of Denton's overall growth framework.
Maple and Pacific Streets do not provide major street access for
high intensity uses and continuous approval of piece meal up
zoning and redevelopment severely threatens neighborhood
stability. As reported time and time again, older neighborhoods
and existing housing stock are given priority s:.•tus in current
and long range community goals. When zoning stability is not
maintained in areas such as this, there is little incentive for
proper maintenance of residential property, To put it in more
graphic terms, some individuals may be fortunate enough to see
their property sold and redeveloped for high intensity purposes,
but the prospect of every parcel being affected is slim at
best. Those residences and individuals that remain deserve
protection. This request differs from earlier zoning requests
on Carroll Boulevard in that this is the first time that houses
will actually face the proposed development. The owner of one
of these houses has expressed opposition to the proposed
development.
The County's decision to acquire property along West Sycamore
for office and/or parking facilities has created an aura of
uncertainly and speculative thinking. The office at the
northeast corner of Carroll and West Prairie and the approval of
office zoning at the southeast corner of Prairie and Carroll
introduced additional high intensity use to the neighborhood.
Approval of this request will, in the estimation of staff, have
additional negative impact on an area that is already in danger
of totally losing its once stable residential character.
Several area property owners have commented that they too will
seek rezoning of their property. Several local developers and
realtors have questioned staff about what they perceive as a
shifting change in policy and a greater chance to introduce more
office, retail and commercial land use.

SUMMARY
Approval of this request will allow additional commercial
traffic to flow through a residential area and down residential
streets. The Carroll Boulevard and Maple Street intersection
will also be impaate~i. This is a hi4:h intensity area, but
policies requiring preservation and p:,otection of existing
neighborhoods are being neglected and staff feels that
additional up zoning will have a severe negative impact oi.
neighborhood character and stability. High intensity land use
at this site will also diminish the strength of policies
discouraging strip commercial and high intensity development
along Carroll Boulevard.
in addition to the fact that this request violates neighborhood
preservation policies, the proposed site plan does not meet City
requirements in the following areas:
1. The Subdivision and L&nd Development Regulations require
the curb cut on Maple Street to be at least fifty (50)
feet from the corner of Maple Street and Carroll
Boulevard. The curb cut is forty (40) feet from the
corner on the current plan.
2. Twenty-five (25) additional feet of right-of-way must be
dedicated for Pacific Street. This additional
right-o£-way is not shown on the current site plan.
3. The addition of right-of-way on Pacific Street will
eliminate approximately six parking spaces from the plan
and result in a slight reduction of floor area in the
proposed building. These changes are not shown on the
current plan,
RECOMMENDATION
The result of Planning and Zoning Commission consideration of
Z-1784 at the meeting of January 8, 1986 was a 3-3 vote. Staff
recommends denial of Z-1784. If the City Council is inclined to
approve this request, staff recommends the following conditions
of developments
1) Building height will be limited to two stories.
2) Maximum square footage of the proposed building shall be
6,600 square feet.
3) A landscaping plan must be included with construction
plans and approved before a building permit may be issued.
4) No detached signs will be permitted.
5) Any items not addressed on the site plan will be
consistent with the City of Denton Zoning ordinance
standards for the office district.

6) Construction must be residential in nature and compatible
with the character of the surrounding neighborhood.
7) Twenty-five (25) additional feet of right-of-way must be
dedicated on Pacific Street and parking spaces and floor

feet away from the intersection of Maple Street and
Carroll Boulevard to provide adequate corner clearance.

Chairman Bill Claiborne called the meeting to order,
I, MINUTES: Ms. Brock stated that on page 5 of the December 4,
Tlfr-wTnutes, paragraph S should read... "She said without this
freeway there would be tremendous burden on 8asc Mclinney, May-
hill Road, Loop 288, and 1-35," Mr. Claiborne stated that on
page 16, paragrapph 4 should read... "Ms. Brock move to recom-
mend that Jason Drive be terminated in its present state." it
was moved by Mr. Escue, seconded by Ms. Cole, and unanimously
carried (6.0) to approve the minutes of the regular meeting of
December 4, 19850 as corrected. Mr. Claiborne stated that on
page 3 of the December 18, 198S minutes, paragraph 2 should
read... "Mr. Claiborne asked if this was a central telephone
office type use or an unmanned switching relay," It was moved
by Ms. Brock, seconded by Mr. Escue, and unanimously carried
(6.0) to approve the minutes of the regular meeting of December
I8, I.?8S, as corrected.
11, CONSENT AGENDA: It was moved by Mr. Juren, seconded by
s. U610, a unanimously carried (6-0) to approve the con-
sent agenda as follows:
A, Approval of final plat of the Keas and Pruett Addition,
Lot 1, Block 1.
B, Approval of final plat of the Payne Drive Dedication,
C. Recommend approval of preliminary plat of the

III. PUBLIC HEARINGS
A. Z-1784. Petition of Jim Neale, representing Seventh
STIiet Development, requesting a change in zoning from
the two family (2-F) classification to the planned devel-
opment (PD) district on a 0.47 acre tract located at the
southeast corner of Carroll Boulevard and Maple Street,
The property is further described as a tract in the
William Loving Survey, Abstract 7S9. If the request 1s
approved, an office development will be permitted at this
location.
Eighteen notices were, mailed to pro arty owners within 200
feet; no reply forms were recelved ?n favor or opposition.
PETITIONER: Jim Neale, representing Seventh Street Devel-
opmentntend to build an office build-
, that looks like an old depot type station. He said
that they are not asking for any curb cuts or demolition
permits. He added that they meet all requirements.
Mr. Claiborne asked how much would this office development

that it is economically feaslble to put an office devel-
opment here.
Mr. Claiborne asked if he was aware of the condition of
the utilities in this area. Mr, Neale said yos.

STAFF REPORT: Ms. Spivey stated thtc this request for
anne evelopment office zoning conflicts with the
Denton Development Guide polic--s encoura ins protection
of surroundinC residential uses. She sal that Maple and
Pacific Streets do not provide maljr street access for
high intensity uses and continuous app:w7a1 of ;piece meal
up zoning and redevelopment severly tha:7atens neighborhood
stability. She said some individuals may be fortunate
enough to see their property sold and redeveloped for high
intensity purposes, but the prospect of every parcel being
affected is slim at best. She added that those residences
and individuals that remain deserve protection as far as
quality of life is concerned. She said the County's deci-
sion to acquire property along West Sycamore for office
and/or parking facilities L.%s created an aura of uncertain-
ty and speculative thinking. The office at the northeast
corner of Carroll and West Prairie and t'-,e approval of of-
fice zoning at the southeast corner of Prairie and Carroll
introduced additional high intensity use to the neighbor-
hood Approval of this request will allow additional com-
mercial traffic to flow through a residential area and
down residential streets. She said that high intensi,.,
land use at this site will also diminish the strength of
policies discouraging stripp commercial and high intensity
development along Carroll Boulevard. She said chat staff
recommends denial of Z-1784 but that if the Planning and
Zoning Commission is inclined to approve this request,
staff has conditions that are recommended.
Mr. Claiborne asked if the property abutted Carroll
Boulevard. Ms, Spivey said that there is a strip that
belongs to the City.
Mr, Juren asked about the condition of the structures on
Pacific Street up to Eagle Street. Ms. Spivey said fair
to poor. Mr. Juren asked if there were funds allocated
in this area. Ms. Carson said yes along with requests al-
ready made on Myrtle and Maple Streets.
Mr, Pearson asked about the likelihood of duplexes being
built on this property. Ms. Spivey said that she didn't
have any figures. Mr. Pearson stated that they had a re-
sponsibility to the City of Denton and citizens by not re-
zoning but that there is a detrimental effect to the prop-
erty owner. He said that according to the costs he had a
real question about duplexes being built there.
REBUTTAL: Mr, Neale said that lot 4 didn't have enough
square Footage to build a duplex. He said that it was
not cost effective to build duplexes because of the ex-
tension of the utilities. He said that he talked with
the surrounding individuals who are mostly renters and
that there was no opposition to the office building.

DECISION: Mr. Claiborne stated that he saw an erosion of
triS'Defflopnent Guide with an approval of this request.
He said that this property was ideal for a green space.
He said that he would like to see some kind of development
even though against this development.
Mr. Juren moved to recommend approval of Z-1784 subject to
the following conditions:
1. Building height will be limited to two stories.
1. Maximum square footage of the proposed building uholl
be 6,600 square feet,
3. A landscaping plan that will show 101 of the property
has been landscaped must be included with construction
plans and approved before a building permit may be
issued.
4. No detached signs will be permitted.
S. Any items not addressed on the site plan will be con-
sistent with the City of Denton Zoning Ordinance stan-
dards for the office district
6. Construction must be residential in nature and compat-
ible with the character of the surrounding neighbor-
hood,
7. 'twenty-five (25) feet of right-of-way on Pacific
Street will be added to the site plan.
Seconded by Mr. Pearson.
Mr. Ellison asked about the impact on the site pplain with
the additional 5 feet of right-of-way to be ded3eated.
Ms. Spivey s«id with the 5 feet that would be added on the
west side of Pacific Street, it would eliminate three park-
ing spaces and reduce the square footage of the building.
Mr. Claiborne stated that they would have to do more work
to their site plan. Ms, Spivey said yes and also includ-
ing the landscaping,
Ms. Brock said that Carroll Boulevard was built to function
as a thoroughfare. She said she felt with every piece that
they add to Carroll Boulevard the contract is broken with
the citizens of D<.nton for this thoroughfare to function as
a thoroughfare,

APPROXIMATELY 614.6 ACRES BEGINNING NORTH OF OLD ALTON ESTATES,
SOUTH OF RYAN ROAD, WEST OF FM 2181, AND EAST OF THE O.C. a S.F.
RAILROAD (A-30)
RECOMMENDATION:
The Planning and Zoning Commission will make a recommendation at its
meeting of February 12, 1986.
SUMMARY:
This is a 614 acre parcel including existing development ranging
from scattered low density residential and agricultural to heavy
commercial. The annexation request is voluntary on an approximately
160 acre portion and the balance is proposed by the city of Denton.
Preliminary plans for the Dunton Manor Estates Subdivision along the
south side of Hickory Creek Road has led to or represented only a
small portion of overall rumors and inquiries concerning development
along the Hickory Creek Road corridor.
BACKGROUND:
Staff informod the City council of the need to consider annexation
of additional property in this area Vhdng annexation of 117 acres
along the south side of Hickory Creek Road was being considered.
PROGRAMS, DEPARTMENTS OR GROUPS AFFECTED:
The Star C Ranch, two commercial businesses (Calvert Paving and a
boat storage/abandoned vehicle/recreational vehicle storage area)
two mobile home residences, approximately eix single family
dwellings, and one abandoned residence are within the proposed
annexation between Hickory Creek Road (north side) and Ryan Road
(south side). One single family residence along the south side of
Hickory Creek Road appears to be included. At least one-half of a
bridge reconstructed by the County approximately two years ago is
included in the proposed annexation.
Approximately 4,200 feet of both sides of FM 2181 extending south
from Ryan Road is included. Approximately 21500 feet of the north
side of Hickory Creek Road extending west from FM 2181 and continu-
ing for approximately 3,100 along both sides of Hickory Creek Road)
and then continuing for approximately 3,000 feet along the north
side of Hickory Creek Road is included as proposed. Approximately
41600 feel- of both sides of Ryan Road is included as proposed.

SUMMARY: Development procedure inquiries for property
along Hickory Creek Road persisted at a rate
faster or as fast as any area of the City and
its ETJ during the latter stages of 1985.
Preliminary plans for the 63 acre Dunton Manor
Subdivision prompted annexation of 117 acres
along the south side of Hickory Road (A--27).
The Dunton Manor project has not developed, but
interest in this area continues.
Richard Compton and Button-Ziff Properties,
owners of approximately 80 and 75 acres,
respectively, have petitioned for annexation.
The City of Denton is the petitioner on the
balance of the property. Both petitioner., own
property along the north side or Hickory Creek
Road. Both either have or will petition for
planned development (PD). A 200+ acre tract
south of Hickory Creek Road beginning adjacent
and west of the recently annexed 117 acres has
also been the subject of development inquiries.
Staff has had numerous discussions with the
owners of the 200 acres, but no preliminary
planning has been done to date. The suggestion
that annexation be requested for the 200 acre
site has no" been followed through on by the
owners.
Richard Compton has advised staff of information
reportedly given to him by Acme Brick Company
indicating that excavation work will begin or be
intensified in the near future on 80 acres
between Ryan Road and Hickory Creek Road.

Annexation of the 614 acres in this request
would form a logical boundary and extension of
the city limits into an area seemingly in need
of greater land use control, particularly, given
its relatively close distance from existing city
limits and existing City utilities.
Hickory Creek Road and a small portion of the
G.C. & S.F, Railroad would be included in the
annexation as currently proposed. Existing
development located within the 614 acre area
ranges from scattered low density residential
and agricultural use to heavy commercial. Old
Alton Estates is not included in the annexation
as presently proposed.
ACTION REQUIRED: Hold public hearing.
RECOMMENDATION: The Planning and Zoning Commission will make a
recommendation at its meeting of February 12,
1986.

WHEREAS, Article 970a as amended requires that a plan of service
be adopted by the governing body of a city prior to passage of an ordinance
annexing an area; and
WHEREAS, the City of Denton is contemplating annexation of an
area which is bounded as shown on a map of the proposed anner.ltion.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DENTON, TEXAS: .
Section 1. Pursuant to the provisions of Article 970a as
amended, Texas Code Annotated, there is hereby adopted for the proposed
annexation area the following plan of service:
I. Basic Service Plan
A. Police
(1) Patrolling, radio responses to calls, and other
routine police services, using present personnel
and equipment, will be provided on the effective
date of annexation;
(2) Traffic signals, traffic signs, street markings,
and other traffic control devices will be installed
as the need therefore is established by appropriate
study and traffic standards.
B. Fire
(1) Fire protection by the present personnel and equip-
ment of the fire fighting force, will be provided
on the effective date of annexation.
C. Water
(1) Water for domestic, commercial and industrial usq
will be provided at city rates, from existing city
lines on the effective date of annexation, and
thereafter from new lines as extended in accordance
with article 4.09 of appendix A of the code of the
City of Denton, Texas.
D, Sewer
(1) Pror'+rties in the annexed areas will be connected
to r3wwer lines in accordance with article 4.09 of
sppendix A of the code of the City of Denton, 'texas.
E. Refuse Collection
(1) The same regular refuse collection service now pro-
vided within the city will be extended to the
annexed area within one month after the effective
date of annexation.

(1) Emergency maintenance of streets (repair of hazardous
chuckholes, measures necessary for traffic flow, etc.)
will begin on the effective date of annexation.
(2) Routine maintenance on the same basis as in the
present city, will, begin in the annexed area on
the effective :late of annexation.
(3) Reconstruction and resurfacing of streets, installa-
tion of storm drainage facilities, construction of
curbs and gutters, and other such major improvements,
as the need therefore is determined by the governing
body, will be accomplished under the established
policies of the city.
0. Inspection Services
(1) Any inspection services now provided by the city
(building, electrical, plumbing, gas, housing,
sanitation, etc.) will begin in the annexation area
on the effective date of annexation.
H. Planning and Zoning
(1) The Planning and Zoning jurisdiction of the city
will extend to the annexed area on the effective
date of annexation. City planning will thereafter
encompass the annexed area.
I. Street Lighting
(1) Street lighting will be installed in the substan-
tially developed areas in accordance with the
established policies of the city.
J. Recreation
(1) Residents of the annexed area may use all existing
recreational facilities, parks, etc., on the effec-
tive date of annexation. The same standards and
policies now used in the present city will be fol-
lowed in expanding the recreational program and
facilities in the enlarged city.
K. Electric Distribution
(1) The city recommends the nse of City of Denton for
electric rower.

L. Miscellaneous
(1) Street name signs where needed will be installed
within approximately 6 months after the effective
date of annexation.
II. Capital Improvement Program (CIP)
The CIP of the City consi,bts of a five year plan that is up-
dated yearly. The Plan is prioritized by such policy guide-
lines as:
(1) Demand for services as compared to other areas
based partly on density of population, magnitude
of problems compared to other areas, established
technical standards and professional studies, and
natural or technical restraints or opportunities.
(2) Impact on the balanced growth policy of the city.
(3) Impact on overall city econom-cs.
The annexed area will be considered for CIP planning in the
upcoming CIP plan, which will be no longer than one year from
the date of annexation. In this new CIP planning year the
annexation area will be judged accordingly to the same
established criteria as all other areas of the city.

Single-Member Districts for the April 5, 1986
City Council Election
DATE: January 29, 1986
In preparing the City's submission for the April S, 1986, City
Council election to the Department of Justice, we have found
that minor changes need to be made in the ordinance establishing
the present single-member districts.
First, the Denton County Commissioners have adopted a new
election precinct map for Denton County. The only changga that
has occurred in the City as a result of the revision is that
former county election precinct 4-H has been divided into two
parts, now designated as 4-H and 4-N. Since the farmer precinct
4-H was entirely within council district 2, there would be no
change in population for the district, but the present ordinance
establishing the single-member districts does need to be amended
to include the new Denton Count election precinct. The
showing the location of the new Denton Count election map
will be available at your February 4th meeting. precincts
Secondly, as a result of annexations, there are parts of
additional Denton County election precincts that need to be
included in the ordinance establishing new single-member
districts. Those annexations, which include no additional
population, include Canton County election precincts 4-M and
1-C, which would bo located in council district 2.
Finally, also as a result of the annexations, there are slight
revisions in the population figures for the single-member
districts. The new p~~pulation figures are shown in the proposed
ordinance attached hereto. Ordinances No. 85-45, which estab-
lished our current single-member districts, is also attached, so
that you may compare the changes in the population figures for
each district. The nhanges in the language and racial minorities
in each district resulting from the annexations is also shown in
the attached documents.

SUBJECT: Lakeview Ordinance
We have run into a problem on the Lakeview ordinance. The
zoning case contained only 590 acres. The subsequent field
notes contained 703 acres. We have advised the developer and
the engineering company and they are trying to provide us with
the pertinent information for the ordinance at this time.
Debra and I have discussed the matter. Since the developer
wanted to move as quickly as possible and since the Council
instructed us to have this item on the February 4th agenda, we
have put it on. At this point we believe the ordinance can't
be written. We will provide it when we receive the appropriate
information.
All of the other information that was requested has been
couriered to you on Thursday, January 30, 1986
If the Council has any further questions, we would be happy to
try and discuss them Tuesday night.

Stmwy: This order is for the lease of a pavement profiler for 200
hours at $100.00 per hour. This machine is to be utilized
to perform a portion of the resurfacing of city streets

SUBJECT: Purchase Order to Caterpillar for Milling Machine
mast week some of you may have seen a machine that we have been
using to mill some asphalt off of the streets. This was a
Caterpillar machine and it was up here on a demonstration. We
found it's results to be very good.
We used the machine on several of the streets that are in the
overlay portion of the bond issue, By using this machine we
are able to mill a wedge-shaped section of asphalt from each of
these streets. This allows us 'to replace the asphalt with a
two inch thick layer of asphalt across the whole street. if
this process is not done, then the thickness of the asphalt out
at the gutters is'approximately one quarter to one half inch in
thickneso. Obviously this is not as structurally sound as a
two inch layer. When we are able to lay this new two inch
layer up against the gutter, it also makes a better joint seal
between the asphalt and the concrete.
The demonstration was very successful and the City was able to
gain approximately 150 tons of material (milled asphalt) that
we will be able to recycle. We have talked to a local asphalt
plant operator and he has advised us that the recycling costs
of this asphalt should be approximately $12 per ton. This
compares to our regular price of $24 per ton.
Since the demonstration we have been in contact with the people
at Caterpillar. They would be agrt-sable to renting us this
machine for 200 hours at approximately $100/hour, The 200
hours would allow us to mill all the other streets in the
overlay portion of the bond issue which we do not require

base work. We think the finished product after using this
machine is a much better product. Because we will be able to
recapture some of that money through recycling efforts, we
would recommend to the Council that they approve this purchase
order for approximately $20,000.

BACKGROUND:
The City Council on June 4, 1985 approved an application to
the Department of Housing and Urban Development that included
funding to purchase property for a proposed neighborhood center.

REAL PROPERTY BY THE CITY OF DENTON, TEXAS AS DESCRIBED HEREIN;
AUTHORIZING THE EXPENDITURE OF FUNDS THEREFORE; AND PROVIDING
FOR AN EFFECTIVE DATE.
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS:
SECTION I.
That the City Council of the City of Denton, Texas approves
the Contract of Purchase of Real Property providing for the
purenase of that certain real property described in said
contract attached hereto, by the City of Denton, Texas from
Clordle Branch, in the amount of One Hundred Twenty Thousand and
No/100ths Dollars ($120,000,00), in accordance with the terms
and conditions of said contract.
SECTION 11.
That the City Council authorizes the expenditure of funds in
the amount specified in said contract for the purchase of said
real property and authorizes the Mayor and City Manager to
execute any and all documents necessary to consummate said

1. Agreement To Sell and Purchase. Seller agrees to sell to

tain real property (hereinafter called the "property"), situated
in the City of Danton, County of Denton, State of Texas and
described as follows:
All that certain lot, tract or parcel of land out of the
Jonathan Brock Survey, Abstract No. 55, Denton County,
Texas;
BEGINNIiVG at the southeast corner of a tract of land
conveyed to J. Homer Kerley, which beginning point is
161.5 verse east of the southwest corner of the Jonathan
Brock Survey;
THENCE west with the south boundary line of the Jonathan
Brock Survey, 100 versa to the southeast corner of a
1-acre tract known as the Jerry Jackson Tract;
THENCE north with the east boundary line of the Jackson
Tract, 89.8 varas to corner;
THENCE west with the north boundary line of the Jackson
Tract 61.5 versa to a corner in the west boundary line of
the Jonathan Brock Survey;

2, Escrow Agent. Lawyers Title Guaranty Company of 513 West
Oak Street, y of Denton, Texas, is hereby designated as
oscrow agent and the Purchaser, on execution of this agreement,
shall pay the escrow fee.
3. Purchase Price. The total purchase price of One Hundred
Twenty ' ousan an No/100ths Dollars ($120,000,00), which sum
shall be the sole compensation due Seller for any and all claims
of any description whatever arising out of the Purchaser's
acquisition or use of the property for public purposes, is to be
payable to Lawyers Title Guaranty Company, as escrow agent as
follows:

(a) One Thousand and Ho/100ths Dollars (11,000.00) on
the execution of this agreement, payable to Lawyers
Title Guaranty Company as e,-roest money.
(b) The balance, in cash at closing on delivery to the
escrow agent of a general warranty deed with full
covenants, duly exea•.,ted is proper form for
recording so as to convey to the Purchaser a ood
and marketable record and title to the land tree
and clear of all recorded and unreeotded liens,
assessments, leases, taxes, and encumbrances,
restrictions and conditions, except public easements
and rights-of-way of record. Purchaser shall take
possession on the date of closing.
4. TitleW Insurance Pol~icy, The Seller egrees, prior to the
cloning, co procure it . _a Farchaser'a cost, from Lawyers Title
Guaranty Company, or another title company of Seller's choice
acceptanle to the Purchaser, a preliminary title report agreeing
to ensure marketable title to the Purchaser in the full amount
of the purchase price and to obtain such policy to be issued by
Lawyers Title Guaranty Company, or such other approved title
company.
5. Effect of Defective Title. Should the title prove
defective in the op n ono the Purchaser's attorney, then such
defect shall be pointed out in writing ':,y letter delivered to
the Seller after the delivery of such preliminary title report,
and the Seller shall have sixty (60) days thereafter in which to
cure such defects or, if agreed to by Purchaser in writing,
prior to closing.
6. Fees Cher as and Coats. The Purchaser shall pay all

recording ees, t e searches, reconveyance fees, trustees'
fees, forwarding fees for any full reconveyance of any deed of
tryst, and the premitm charged for any policy of title insurance
arising out of this transaction.
7. Inability to Conve Title. In the event Seller is unable
to convey gov an mar eta o record and title to the land as
provided for herein in the opinion of the Purchaser, then this
agreement shall terminate and any amount tendered by Purchaser
shall be returned to Purchaser.
8, Closiu Date. The transactions shall be closed on or
before: thirty calendar days from the date of acceptance of
this agreement by the Seller and Purchaser, or at such other
time as the parties may mutually agree, at the office of the
escrow agent or at such other location as is mutually agreeable
to the parties herein.
9. Integration-. This agreement constitutes the entire
agreement between the par;-ies and neither party relies upon any
warrants or representation not contained herein.
In witness whereof, the parties have executed this agreement
on the date first above written.

Present: Lucy Campbell, Birdell Carstarphen, Sybil Evans, William itamnan
Umie Prins and Connie Wells.
Absent: August Brown, Rebecca Cantu and Jo LA*er.
Staff Elizabeth Evans, Community Development Manager; Barbara Ross,
Present: Cammunity Development Coordinator and Penny Black, Clerk.
I. Chairperson, Connie Wells called the meeting to order at 7:30 p.m.
II. Elizabeth Evans introduced Barbara Ross, the new Community Development
Coordinator to the committee members. Lucy Campbell, the new oaminittee
member was also introduced to the committee at this time.
III. Ms. Evans then gave a presentation on the status of property acquisition
for the recreation facility in Southeast Denton. She said there had
been advertisements in the newspaper and two sites of interest were
offered following those advertisements. (1) Cm location is on Dradshaw
and Wilson Streets which consists of 1.54 acres. The property belongs
to Mr. Ben Franklin of Seattle, Washington. Mr. Franklin is asking
fran $60 to $70,000 for his property. (2) The other location is on
Wilson, Newton and Norris Streets which consists of 5.44 acres.
The property belongs to Mr. Claude Branch of Denton, Texas. Mr. Branch
is asking fran $80 to $85,000 for his property. The appraisal districts
value on Mr. Branch's property is 140,000.00. fie has also mentioned a
donation of score money for the center if his property is purchased by
the city. He has not made a firm decision upon the asking price for
his property at this time.
Ms. Evans noted that the northeast corner of Bradshaw and Wilson Streets
has a section of the lot within the 100 year floodplain. She also said
the county social services agencies were needing office space and possibly
they could rent same of the center's space to help and pay for the
operating expenses.
Ms. Campbell mentioned that the access to the NdWton property was better than
the others suggested although there coild be sane zonun problems within
that area. she said she had conducted a short survey of some of the
residents and that those asked favored the Newton street property.

Ms. Evans mentioned Planning and Zoning had denied a rezoning of
this area when the construction of duplexes and a convenience store
was proposed by a developer.

Me. Wells updated Ms. Carstarphen on the status of the meeting.
Me. Price questioned the acreage of the Dallas and port worth facilities.
Me. Evans said the Dallas facility was 19,500 square feet and the
Fort Worth facility was smaller, the actual footage was not available.
She also said the North lakes facility was 11,000 square feet with a
gym and meeting rooms. Ms. Carstarphen wondered if the Bradshaw, Wilson
property was too small considering the citizens first request was for
the center to be located adjacent to the park. Ms. Campbell said the
Newton, Wilson and Morris property was only $16,000 per acre whereas
the Wilson, Bradshaw property is more than 40,000 per acre, and that
it was smaller.
Mr. Kanman waked how much actual money was budgeted for the project.
Ms. Evans replied $75,000 for the acquisition of land and $52,000 for the
architectural designs and engineering plans. She said the plan was to get
enough MMISY to get everything set for consturction in Phase I.
Ms. Ca:%"11 said that with a 11,000 square foot building that 30,000
square feet would be adequate to build upon if the Bradshaw, Wilsoti
property was considered. Ms. Evans mentioned the property of Mr. Branch's
of already havirq sane city services hooked up to it.
Ms. Wells then asked for a motion. Mr. Kamman made a motion for
recam xiing the 5.44 acres and Ms. S. Evans seconded it. M. Wells
asked for further questions and stated that the motion had been amended
as concerning to the zoning question. All in furor 6, opposed 0, the
motion was carried.
Ms. Carstarphen requested the staff to research the zoning of the newton,
Wilson and Norris Street area. The ccnmittee members also requested
some type of map to show them the layout of the property at Wilson and
Bradshaw to determine the floodplain areas and the building sites drawn
on these maps including with parking areas. Ms. Wells requested Ms, Evans
speak with Burke Engineering regarding Mr. Branch's property.
V. Ms. Wells then asked for eldetien of officers.
Mr. Kanman o urinated Ms. Wells for Chairperson, Ms. Carstarphen seconded it
and moved that the vote be closed. All in favor 60 opposed 0. S. Evans
nominated Ms. Campbell for Vice-Chairperson, Ms. Carstarphen semnied it
and moved that the vote be closed. All in favor 61 opposed 0.
Ms. Wells is the re-elected Chairperson and Ms. Campbell is the Vice-Chairperson.
VI. Ms. Evans gave an update on the grant activities. She said there was still
money availab] Ior owner and rental rehabilitations and that the office had
the program underway eventhough a lack of contractors was still a pn,,blem.
There were advertisements sent to churches and the newspapers to make the
citizens aware of the program.

Associates. The total area of request is 110.5255 acres separated
into two parcels and located along Kings hoar, Si.lverdome Road, pro-
posed Loop 288, and an extension of Kings Row which turns northward
to fora a connection with Kartlee Field Road. A 18.5 acre portion
of the annexation between proposed Loop 288 and the existing city
limits and Kingston Trace Subdivision is involuntary.
The owners are requesting annexe•tion to pursue zoning and delivery
of City services. The current conceptual land use plan exhibits 126
lots of single family (SP-7) land use, 3.8 acres of commercial along

is approved. The existing city limits is at the right-of-way line
of proposed Loop 288 above the fringe of the Kingston Trace
Subdivision.

of Farris Road and 780 feet of the west half of Farris Road; and

SU;MMARYt This is a request for annexation submitted by
Teaoley Road Associates. A 14.5 acre area
between a portion of the subject site and
proposed Loop 288 is involuntary. The
petitioners are requesting annexation and zoning
to insure delivery of City ser''ices. A
conceptual land use plan is attached showing 128
Jots of single family (SF-7) land use, 3.8 acres
of commercial along proposed Loop 288, 9.6 acres
of multi-family, and a 10 acxe school site.
Planned development (PD) zoning will most likely
be requested if annexation is approved. The
Denton Independant School District has submitted
a preliminary plat for the 10 acre school site.
An elementary school similar to Evers Park is
proposed.
This site begins adjacent and south of existing
residential development in the Oak Hend Estates
subdivision and additional residential housing
is surrounded by the site to the east. The
nearest existing city limit line begins
approximately 400 feet south and west of the
southwestern edge of the subject tract (along
the fringe of the Kingston Trace Subdivision).
The southwestern edge of the subject parcel
abuts proposed Loop 288 right-of-way.
The property consists of two parcels separated
by Kings Row, Silverdome Road, and Farris Road
that branches off Kings Row to the North to form
a connection with Hartlee Field Road. Hartlee
Field Road is approximately 3/4 to 1 mile north
of the area of request.
There are no existing structures or population
located within the proposed area of annexation.
A resident of Oak Bend Estates contacted staff
to advise that the majority of the property
owners are not in favor of annexation of their
subdivision.

SUBJECT: Amendments to the Fair Labor Standards Act

As we all have received briefings on 5.1570, the amendments to
the Fair Labor Standards Act and are familiar with the changes,
the purpose of this memorandum is to outline the major changes
and inquire as to whether any changes in Cityy policies are
desired, particularly the use of compensatory tLw. The City,
wader the amendments, nay use compensatory time if an agreement
is reached between the employee and employer before the,
performance of the work. Effective April 15, 1986, public
safety employees may accumulate up to 480 hours of unused
compensatory time. If this cap is reached, the City must pay
overtias co ensation until sufficient accrued compensatory time
is taken off to come under the cap. Moreover, the time between
160 hours per 28 day work period and the 171 maximum hours per
work period allowed by the Act do not count toward compensatory
time accumulation ceiling.
The limit on compensatory time for employees engaged in
activities other than public safety, emergency response or
seasonal activities is 240 hours. These restrictions do not
apply t stcompensatory lsim e tims accumulated prior to April 15, 1966.
1 would presentation of the attached ordinance ,
authorising the use of compensatory time for police officers as
required by the existing regulations. The ordinance merely
authorizes the police officers to utilize compensatory time in
accordauca with the provisions of the Act. Previoualyq, the
Police Department had desired a cap of 40 hours in the
ordinance. I have deleted this cap which will allow the Police
Chief some discretion but still allow him to internally set a
lower limit.
Also, effective April 15, 1986 is tho requirement that when an
employee leaves the city, due to resignation, retirement, dis-
charge or death, he must be paid for his accumulated compensatory
time. Such compensatory time must be paid at the rate of pay
the employee is earning at the data of termination or the
average rate of pay for the last three years of employment,
whichever is greater.

The other provisions of the legislation which will haw the most
impact on city operations include permitting an employee to have
a part time job in another department without the hours being
counted towards overtime. The part time work must be in a
different capacity than the employee's regular job and suet be
on an occasional or sporadic basis. M to what constitutes
occasional or sporadic, we would urge caution in making such a
determination until the Department of Labor has issued
regulations defining the parameters of such part time work. It
appears that public safety employees, however, may routinely
accept second gobs without the hours being treated as overtime.
Please advise as to what the current practice is with respect to
City employees working second gobs within the City.
The requirements in existing federal regulations which require
t1u~t the City must keep records relating to shift trading and
that time must be traded back within one year have been deleted.
Finally, the amendments prohibit cities from discriminating
against eaployyems who have assorted rights to overtime pay. It
should also be noted that the safe haven afforded cities by
these amendments do not apply to proprietary functions such as
utilities.

SUBJECT: Take Home Vehicles for Police Department
Attached is some information from Chief Lynch. As you can see,
Hugh is very supportive of a tako home vehicle policy for the
Department. There are several areas that this kind of policy
can be of major benefit to the City. He has also attached a
set of rules and regulations that are currently being used in
the Mesquite Police Department for a program of this same
nature. If the Council would approve this concept, we would
incorporate rules and regulations that are virtually the same.
As Hugh mentioned, we have been working on this for several
months because we wanted to get good information to you on
programs in other cities. We have also been trying to
determine the effects of FLEA and recant IRS rulings. Both the
Finance Department and the Legal Department have been
satisfied that the IRS regulations or the new proposed FLSA
rules will not impede this program.
Since we have gotten these clearances, we are trying to proceed
as rapidly as possible. The thirteen patrol cars that you
approved for bid several months ago have not been built yet.
If you approve this concept we will be able to lease twelve
more cars and have them built at the same time. This will
allow us to implement the program sooner, since we would
receive all of our cars at the earliest date. We have reviewed
all of the financial numbers that are associated with this
program and funding is available in the Police Department
budgets to accommodate the program with some transfers being
necessary, If Council approves this program we would come back

to you in the last three months of tie budget year for the
appropriate transfers at that time.
Based on the above information, we would enthusiastically
recommend to you this program. If you have further questions
Chief Lynch and I will both be at the meeting Tuesday night to

SUBJECT: Individually Assigned Vehicle Plan
DATE: January 30, 1986
For several months the Police Department has been in the process of
researching the idea and feasibility of an individually assigned vehicle
program. As a result, I highly recommend and request implementation of this
program.
In an effort to minimiza initial capital outlay and allow for the opportunity
to determine actual cost effectiveness, it is my recommendation that the
program be implemented in three phases. Phase one would consist of twelve
vehicles being leased on a three-year pay-out. At the conclusion of the
first year of operation, it is anticipated that sufficient data would be
available to justify the implementation of the second phase. Phase two
would consist of the addition of twelve to twenty vehicles leased on a three-
year pay-out. The actual number of vehicles to be added would certainly be
dependent upon first year data and results. Phase three would be implemented
at the close of the second year of the project and would consist of leasing
twelve to twenty vehicles via the above method.
Attached is a statement outlining the project's goals and what we expect
to achieve as a result. I have also included results obtained from other
cities throughout the United states who have implemented this same or similar
program.

INDIVIDUALLY ASSIGNED VEHICLE PLAN
INTRODUCTION
In the Denton Police Department's individually assigned vehicle program,
marked police cars will be assigned to selected patrol officers and super-
visors assigned to the Patrol Division.
The officers are authorized to use the marked units for patrol and/or personal
activities during off-duty hours. When using the vehicle, off-duty officers
will notify the dispatcher and monitor radio transmissions by the Department,
responding to emergencies in their immediate vicinity. In return, the City
bears the expense of purchase, maintenance and operating costs of the vehicles.
Sergeants and patrol officers will be issued cars.
The program is planned to fulfill a number of law enforcement functions. It
places patrol vehicles throughout local neighborhoods of the City on a more
or less permanent basis. The theoretical concept behind this policy is that
these vehicles serve as a deterrent to crime. It is believed that the sight
of a patrol vehicle parked in front of an officer's home will discourage
burglars or vandals from committing crimes in the neighborhood and may encour-
age drivers to reduce their speed. officers using the vehicles during off-
duty hours will monitor Department radio transmissions and may perform arrests
or be called on to provide assistance in emergency situations. Another expec-
tation is that the vehicles will serve to identify officers as policemen
within their immediate neighborhood and encourage human interaction between
citizens and police.
The program will improve the maintenance and reliability of patrol cars by
placing the responsibility for personal care of each car on individual off-
icera. It is expected that the cars will have a better appearance due to the
pride officers will place in their cars.
The program will enhance the Police Department's ability to summon off-duty
officers in emergencies and have them report for duty directly to the area
they are needed. It will also increase the visibility of "presence" and dis-
play to citizens that there are police ready to respond when needed, contrib-
uting to their peace of mind.
The Denton Police Department is always in search of new methods and techniques
to provide citizens of our City with effective and efficient police service.
PROGRAM GOALS
1. Promote the security of the citizens of Denton by increasing the number
of police and police vehicles on the streets and roads of the City.

Cook County, Illinois - Cook County has prepared an extensive Comparative Cost
Analysis of their individual vehicle assignment program and have been using the
program since 1971. Sheriff Richard J. Elrod enthusiastically endorses the
program and advised that the continuation of the program has the potential of
saving the taxpayers of Cook County millions of dollars over the next ten years.
Jacksonville, Florida • According to T. C. Simms, a sergeant with the Planning -
i Research Unit in Jacksonville, their program has been very successful and
well liked by the ppoolice department. They have experienced a substantial
increase in calls handled-by off-duty units and the assistance lended to on-duty
units, all of which help to bring about a more rapid response time.
Longview Texas - The•individual vehicle assignment program has been successful
in Longview and 1s well liked by the police department. According to Glenda
Owens, Administrative Assistant, the program has proven very cost effective.
Lubbock, Texas - According to Frank D. Treadway a sergeant with the Planning,
Research b Evaluation Division, their vehicle plan has proven itself cost
effective in that they have seen improved maintenance records on the vehicles,
savings in overtime duties performed by patrolmen on and off duty, and,..of
course the increased police visibility factor. In the past years, they have
not had any major problems in justifying the program to their city council.
The consensus of the public toward the program is favorable as well.
Mesquite, Texas - Sergeant Harmon Ivie with the Planning and Research Division,
advised that the advantages of the vehicle'program include the projection of an _
expanded police presence in the city, the provision of additional resources upon
which to draw in emergency situations, greater flexibility in scheduling and in
development of special enforcement programs, and additional incentive for
employees.'
Tucson, Arizona - The individual vehicle assignment plan was used in Tucson for
about eight months and dropped. There were no new patrol programs initiated
during the experimental time period and the officers were very restricted
regarding the off-duty use of the vehicles. Sergeant T. Wflson advised that
after the program was dropped, the lease vehicles were placed back into the fleet.
The condition and care went downhill and the maintenance cost went up. He
maintains that the police department would like to go back to the individual
assignment plan.
Minneapolis, Minnesota - Minneapolis has never formally studied the plan, nor
have they attempted it. They advised that St. Paul tried it for only one year,
They were federally funded for that one year and they could not pick up the
expense. . 0
Phoenix, Arizona - According to Jack Brinson, with the Planning and Research
Division, they lonked at the plan at one time, but they decided against it
because of the initial capital outlay required. They were looking. at pur-
chasing all of the cars in one year instead of phasing into it. He mentioned
that they have between 1,500 and 1,600 sworn officers and 422 marked cars.

Indianapolis, Indiana - According to Lt. Mike Sherman with the Fleet Maintenance
Administration Division, they were one of the pioneers in the fleet car.concept.
They had it from 1969 until 1977. They lost the plan through wage negotiations.
They still believe that it is the best way to go, as far as bhing cost effective.
Mecklenburg County, North Carolina - According to Glen Mowery of Planning b _
Research and Assistant Chief Eudrick, they have had the plan for about four
years now. They talk very highly of the plan and believe that it is very cost
effective. Gerald Fox, ex-Wichita Falls City Manager, is presently their
County Manager. He inherited the program when he was hired and he required tier?
to re-justify the program. They showed him that it would cost the county over
$30,000 per year to revert back to their old fleet plan. Fox had his assistants
conduct a study and they came up with a hi her figure than did the police depart-
ment. The program has been very successful there.

PURPOSE: The purpose of this order is to establish policy and regulations
regarding the assignment and use of departmental vehicles desig-
nated as home-storage units.
POLICY: The Mesquite Police Department may assign departmental vehicles
to individual employees for home storage. Such assignment is
to be viewed as a privilege and not es an employment right, Vehi-
cle assignments may be revoked, modified, suspended, or denied
when such action would be in the best interests of the department.
OBJECTIVES:
The objectives of the program are:
1. To enhance public safety through 3.ncreased police visibility
on the streets of the city.
2. To maximize the quality of vehicle maintensnce.
3. To provide quick end ef2ective response to disasters,
disorders, or other incidents which may require the recall
of off-duty personnel,
4. To enhance the ability of the department to pr;vids police
service commensurate with the need for such service.
PROVISIONS:
A. Vehicle Assignment
,t. Vehicles will be assigned by the bureau commander and the Chief
of Police.

4. Violation of any of the provisions of this order may result in
revocation or suspension of off-duty privileges,
B. Off-Duty Operation
,l; Officers are authorized to use home-storage vehicles for personal
errands within tho city of ?Mesquite, consistent with the provi-
sions herein.
2. Each member of the department utilizing a departmental vehicle
shall exercise good judgement and shall not commit any act or
omission which would reflect unfavorably on the department or
tend to cause the public to lose confidence in the department.
3. No person other than a commissioned officer of the Mosquito Police
Department or an authorized service or maintenance technician shell
be permitted to operate a police vehicle, police radio, or other
puli.ce equipment,
4. Non-police personnel may accompany officers as passengers when
the vehicle is being operated off-duty. Because the officer
is subject to recall to active duty at any time, discretion
must be exercised in the transportation of civilian passengers.
The officer should consider:
a. the security of police operations and procedures.
b. the welfare and personal safety of the passenger, together
with tho possibility of related liability.
c. the integrity of the passenger.
8. Radio coma►unirations shall be maintained at all times while a
police vehicle is in operation, in accordance with current
departmental procedures.
4. The officer shall inform the communications center of his
availability and shall receive clearance before responding to
any call while off'-duty.
7,. The safety of passengers rests solely with the officer operating
the vehicle. The officer shall discharge civilian passengers
at a safe and convenient location before respcnding to a call
or making an emergency run.
,8. The use of red lights and/or siren is authorized only when
the police vehicle is being used as an emergency vehicle, i.e.
when answering an emergency call or when pursuing an actual
or suspected violator of the law.
."9. An officer operating a police vehicle as an emergency vehicle
shall do so in accordance with the current General Order regu-
lating Emergency Vehicle Operations.

-10. No officer shall operate a police vehicle with disregard for
the safety of others. Appropriate caution shalt be exercised
as suggested by conditions of the roadway, density of vehicu-
lar and pedestrian traffic, visibility and weather conditions,
and other circumstances affecting safe vehicle operation.
11,' An officer in civilian clothing should initiate traffic stops
or violator contacts only in order to prevent an ongoing vio-
lation constituting an immediate hazard. In most cases, the
better practice will be to refer violations to a uniformed
officer.
12. An officer operating a departmental vehicle off-duty shall
wear long pants and a sport shirt as a minimum requirement.
The officer is responsible for the conduct and personal ap-
pearance of passengers, who shall meet the same minirr;m dress
standar4s.
13. Use of seatbclts by the officer and passengers is recommended,
14+ Police vehicles shall not be utilized by officers or passengers
intending to consume or who have consumed alcoholic beverages.
No alcoholic beverages shall be transported in the vehicle for

16, Two or more officers assigned to attend the same school or
meeting out of the jurisdiction shall utilize the minimum

C. Vehicle Maintenance
1. The officer to whom a vehicle is assigned shall be fully re-
sponsible for the general maintenance and proper care of the
vehicle, and shall refrain from:
a. making anything other than minor adjustments.
b, altering the body, general design, appearance, or markings
of the vehicle.
c. using fuel, oil, lubricant, or other additives in the
vehicle other than the approved departmental issue.
2. The officer shall at rill times drive the vehicle with reason-
able prudence to conserve it at the highest possible degree
of operating efficiency.
3. Any mechanical or electrical alterations or equipment or
accessories, added must first have the approval of the Service
Center Superintendent, unless otherwise approved by the Chief
of Police.
4. Colored sealed beams will not be permitted in the spotlight
or headlights.
5. All repairs will be performed at the city service center by l
service center employees, or at a place designated by the
service center supervisor.
61 No weapon shall be allowed to remain in a police vehicle left
for maintenance or repairs.
7. The officer is responsible for insuring that all routine
maintenance and required service is performed on the vehicle.
IS. The officer shall be responsible for the cleanliness and
orderliness of the interior and exterior of the vehicle.
9. All routine serviciu g, such as cleaning, fueling, and opera-
tional repairs, will be performed on the vehicle prior to
assigned active duty.
D. Vehicle Records
1. Each officer utilizing a home-storage vehicle shall complete
a monthly report on the form prescribed by current procedures.
2. Information required shall inclncie:
a. miles driven on-duty
b. miles driven off-duty {
c. maintenance and repairs
d. off-duty incidents

E. Supervision
1. Inspection and supervision of the maintenance and care of a
police vehicle is the responsibility of the officer's assigned
supervisor.
2. An off-duty officer operating a police vehicle is subject to
supervision by on-duty supervisors.
3. Any supervisory officer may stop a police vehicle operated by
an off-duty officer upon reasonable cause that the officer is
operating the vehicle contrary to regulations. If corrective
action cannot be taken at that time, the vehicle shall be taken
to police headquarters by another officer. Deficiencies will
be documented in writing by the supervisory officer.
EFFECTIVE DATE: This order is effective May 10 1984,

SUBJECT: LAND USE PLANNING COMMITTEE
The City Council in September approved a comprehensive planning
process in which a self selected land use committee will serve
as the advisory body for policy formulation. Representing a
cross section of citizens, this committee will participate in
a series of workshops for the purpose of updating the 1980
Deaton Development Guide, as well as the Comprehensive Zoning
Ordinance.
The adopted committee composition is to include tour members
from the City Council. The workshops are scheduled to start
February 27th, 1986, so we are ,asking you to now select the
names of yovc representatives.
