CITY COUNCIL REPORT FORMAT TO Mayor and Members of the City Council FROM: Lloyd Harrell, City Manager SUBJECT: Adoption of an ordinance and service plan instituting annexation proceediags for approximately 23.6420 acres of land being part of the Gideon Walker Survey, Abstract No. 1330, and beginning adjacent and north of Edwards Road approximately .5 mile east of Mayhill Road and approximately ,5 mile west of Swisher Road. (A-41) RECOMMENDATION: The Planning and Zoning commission recommended approval of the annexation as requested at its meeting of September 10, 1986. SUMMARY: The Tommy Corporation states in its applicatiun that it is requesting annexation for the purpose of developing the property in accordance with the City of Denton's standards. A petition for single family (SF-7) zoning has been submitted in conjunction with this annexation request. The site is not within a flood plain area. Edwards Road is an unimproved road that is subject to perimeter street paving standards (17 feet of curb and gutter and improvements to City of Denton specifications along the entire frontage of the property to be 0sveloped) regardless of whether the tract is annexed or not if development occurs. An existing 12" water line at the Mayhill Road and Edwards Road intersection must be extended 4,100 feet east to serve this parcel. City of Denton and TP&L electrical service is available. The Parks and Recreation Department and Fire Department have no objections to the proposed annexation. BACKGROUND: A 60.8 acre tract of land adjoining this parcel to the west was annexed and zoned planned development (PD) for mixed residential land use in January, 1986. A-41/TOMMY CORPORATION PLAN OF SERVICE FOR ANNEXED AREA CITY OF DENTON TEXAS WHEREAS, Article 970a as amended requires that a plan of service be adopted by the governing body of a city prior to passage of an ordinance annexing an area; and WHEREAS, the City of Denton is contemplating annexation of an area which is bounded as shown on a map of the proposed annexation. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ':HE CITY OF DENTON, TEXAS: Section 1. Pursuant to the provisions of Article 970a as amended, Texas Code Annotated, there is hereby adopted for the proposed annexation area the following plan of service: I. Basic Service Plan A. Police (1) Patrolling, radio responses to calls, and other routine police services, using present personnel and equipment, will be provided on the effective date of annexation; (2) Traffic signals, traffic signs, street markings, and other traffic control devices will be installed as the need therefore is established by appropriate study and traffic standards. B, Fire (1) Fire protection by the present personnel and equip- ment of the fire fighting force, will be provided o2 the effective date of annexation. C. Water (1) Water for domestic, commercial and industrial use well be provided at city rates, from existing city lines on the effective date of annexation, and thereafter from new lines as extended in accordance with article 4.09. of appendix A of the code of the City of Denton, Texas. D. Sewer (1) Properties in the annexed creas will be connected to sewer linen in accordance with article 4.09 of appendix A of the code of the City of Denton, 'texas, E. Refuse Collection (1) The same regular refuse collection service now pro- vided within the city will be extended to the annexed area within one month after the effective date of annexation. Streets (1) Emergency maintenance of streets (repair of hazardous chuckholes, measures necessary for traffic flow, etc, will begin on the effective date of annexation.' (2) Routine maintenance on the same basis as in the present city, will begin in the annexed area on the effective date of annexation, (3) Reconstruction and resurfacing of streets, installa- tion of storm drainage facilities, construction of curbs and gutters, and other such major improvements, as the need therefore is determined by the governing body, will be accomplished under the established policies of the city, G. Ynspection Services (1) Any inspection services now provided by the city (building, electrical, plumbing, gas, housing, sanitation, etc,) will begin in the annexation area on the effective date of annexation, H. Planning and Zoning (1) The Planning and Zoning jurisdiction of the city will extend to the annexed area on the effective date of annexation. City planning will thereafter encompass the annexed area. I. Street Lighting (1) Street lighting will be installed in the substan- tially developed areas in accordance with the established policies of the city, J, Recreation (1) Residents of the annexed area may use all existing recreational facilities, parks, etc., on the effec- tive date of annexation, The same standards and policies now used in the present city will be fol- lowed in expanding the recreational program and facilities in the enlarged city, K, Electric Distribution (1) The city recommends the use of City of Denton for electric power, Service Plan Annexed Areas Rage three L, Miscellaneous (1) Street name signs where needed will be installed within approximately 6 months after the effective date of annexation. II. Capital Improvement Program (CIP) The CIP of the City consists of a five year plan that is up- dated yearly, The Plan is prioritized by such policy guide- lines as: (1) Demand for services as compared to other areas based partly on density of population, magnitude of problems compared to other areas, established technical standards and professional studies, and natural or technical restraints or opportunities. (2) Impact on the balanced growth policy of the city, (3) Impact on overall city economics. The annexed area will be considered for CIP planning in the upcoming CIP plan, which will be no longer than one year from the date of annexation. Consider making a recommendation to the City Council concerning the annexation of approximately 2306420 acres of land being part of the Gideon Walker Survey, Abstract No. 1330, and beginning adjacent and north of Edwards Road ap- proximately .5 mile east of Mayhill Road and approximately S mile west of Swisher Road. S'AFF REPORT: Mr. Ellison stated that this is a voluntary annexa on request.; by the Tommy Corporation and for the purpose of developing the property in accordance with the City of Denton's standards. He said a petition for single family (SF-7) zoning has been submitted in conjunction with this annexation request. He said that a 60.8 acre tract of land adjoining this parcel to the west was annexed and zoned planned development (PD) for mixed residential land use in January, 1986. He said that the 'roma Corporation requested annexation and zoning for the adjoning tract. He said that no population is Affected and the only iet act on city services would be the fire department if they had .to respond to a grass fire in the area. He said that far- ther west along the west end of Edwards Road there is a specific use permit for a mobile home park. He stated that the one property owner that was contacted had no objections to the annexation. Ms. Brock asked about the 17 foot of perimeter street pav- ing. Mr. Ellison stated that a 17 foot section of the per- imeter of the property would be improved by the developer with curb and gutter and the city would participate in 7 feet to total a 24 foot section of improved road for this development. He added that the other side of the road would be improved when the property developed. Mr. Holt asked if the balance of the road would be unim- proved. Mr. Ellison said yes until others developed or a Capital Improvement Program is designated for this area. Ms. Cole asked about the extension of the 12 inch water- line. Mr. Ellison stated that it is the developer's responsibility. Mr. Holt asked about an oversize agreement. Mr. Ellison stated that the ordinance says depending on fund avail- ability the city may enter into an oversize agreement if approved by the City Council. Mr. Claiborne asked if there was an impproved road to this property. Mr. Ellison stated that it is mostly unimproved, P $ Z Minutes September 9, 1986 Page 3 M6. Carson stated that it is improved along Edwards Road abutting the mobile home park property. Mr. Ellison stated that there would not be a complete road from Mayhill Road to this site. Ms. Brock stated that this is a more arpropriate matter at zoning but that the road is a very serious matter. Mr. Claiborne stated that the city must assume maintenance if annexed. Mr. Ellison stated that prior to the mobile home park development the road and utilities were very poor in this area so the mobile home park has Improved the area. PETITIONER; Roger Barrett, Metroplex Engineering Corpora- tion representing Tommy Corporation, stated that the street paving would be addressed during the platting stage. He said that they are trying to continue contiguous growth within the city. He said that the only way to get Improve- ments in these areas is to annex and it is the petitioner's intent to do improvements. Mr. Claiborne asked if Edwards Road was included in this annexation. Mr. Ellison said yes and would be a city maintenance responsibility. He said that if the property is not annexed the perimeter street paving requirements would still be required but the county would have to main- tain the road. He said that the petitioner could develop SF-7 land use in this area without annexation and zoning. He said that the procedure is to submit a plat and meet the requirements in the extraterritorial jurisdiction. DECISION: Mr. Holt moved to recommend approval of A-41, seconded by Mr. Glasscock and unanimously carried (7-0).
