SUBJECT: Recent Events
First of all, J am happy to inform all of you that we have a
new Airport Manager. He Is Jesse Porester from the City of
Grand Prairie, Jesse has a fine background of 'making airports
grow and develop, lie was instrumental In building the new
hanger complex in Grand Prairio. All of them were pre-leased
before construction began. He also 'brought a.restaurant to the ~i
1 airport, lie has Bono several other things at Grarid Prairie to
enhance their facilities. This was the first choice of out,
I Interviewing panel, and I am excited to have Jasse with us, ;
If Jesse will be tying up things in Grand Prairie for the next
couple of weeks. However, there is a good chance that he wlll
also be working with us part of that time. We look to have him
on board permanently by the end of January,
i The second Issue is our continuing saga with Maverick, We are
I now trying to find out all the particulars on how a classified
loan will work at the FDIC. We are also looking at.differont
scenarios that we will be able to present to you at the next ?
meeting. We would like that to occur next Tuesday, January 5,
1988, at noon It will be here In the conference room at City;
Hallo and we will provide lunch for you, Please try to attend
if at all possible

SUBJECT! Information Concerning" Latest Developments on the
Airport
r ! Attached you will find a letter` that Otho sent to us on j
ii Monday, in° fact, Sunday night I picked up a check at the
j Ai,rpo'rt from Otho that was made out to the City from the Air
Academy, Otho told me that the reason they did it that way was
because of the uncertainties and his frozen bank accounts at US
Bank. We had the check chocked out Monday, We did receive
some assurances by late in the evening on Monday thAt the check
would be good. We did colloct a bank cheek from the Provident
Bank yesterday and the check is good, Debra is, currently j
chucking on another question that i had, i.e. in the agreed
settlement, l believe that we also made mention of the fees and
the rent having to be paid on those_ same deadlines. She is
currently checking that and should know by the end of today or
certainly by next Monday.

The Council is meeting next Tuesday night and on their agenda
will be discussion of otho's request in Executive Session.
Certainly by then Debra will know about the exact wording on
the judgment in terms of the fees and the rental also. We will
keep you posted on their decisions as soon as possibleo
on my other primary airport project, we are continuing to
negotiate uJth less Forester from Grand Prairie, Jess finally
made a rn;.+nter-offer to me on Monday, _ We have reviewed it and
have made a counterproposal to, him. 1 asked if he could
consider it, over the Holidays, and T will be contacting him
early next week to see where we stand, I think our prospects
are good. He continuos to be very interested, He understands
that we are interested in him, Obviously, I think he is trying
to negotiate for the best deAl he Can InAke,

meeting on August 27, 1987, at 10:00 a.m, The meeting will be
held in the City Council Chambers, Mokinney City Hall, 130 8,
0hestnut Avenue, McKinney, TeXds, The focus of the meeting
will be on the development- of IrAF? airports, in Collin, Denton,
Hunt, and 1Znckwall counties, (Please see the attached letter,)
Rick Svehla, Doputy City, Manager, will be attending the

Airport Role; the airport classification or, function based on the type of
service provided to communities within a geographical area
Commercial Service Primary; airports with scheduled passenger
service enplaning more than 36,800 passengers in 1984 - design
standards will likely accommodate large transport aircraft
Commercial Service Non-Primary; airports with scheduled passenger
service enplaning less than 36,800 passengers in 1984 - minimum

f SUBJECT; UPDATE ON AIRPORT ACTIVITIES
Last night, we met with the Council and briefed them on uur
negotiations with Maverick. Initially, we "met with Maverick
and had what I felt was a fairly productive meeting,
C We asked for a release from maintenance and we also asked for a
percentage on the fuel flow, They countered with reinstating
their eligibility for the option on the land behind them for
approximately thirteen months, and they asked that a
certificate of occupancy be given to thom for the hangar (i,e„ !
improvements to the hangar be trade to bring it up to code).
We also discussed fees and rent and indicated to them that they
would have to pay all back rent and fees, and we also indicated
that they would have to pay the taxes, On the taxes, they
countered with the fact that they would be agreeable, They
agreed to pay the taxes for, Maverick and the taxes for
Aerosmith Denton, Inc. He said they had problems with the
' Aerosmith, Inc, taxes since .they felt that was taxes basically
on personal property, i,e,,!airplanes. We loft the discussion
saying that we thought than ''letting the court decide on the
Aerosmith,`Inc,,-taxes , was probably a good compromise,
We also left the meeting agreeing, that Bill Smith would draw up
the language for our review,' We received thatCommunication on
Friday, 51u1y 2A, 1587,, That communication was quite different ~
than what we had discussed,'.. In 'that communitration, Maverick
asked fo'r damages to their business equal to tho fees and 'rent,
and the language' on the taffies was not clear at oil, Diane 1
Callender, Assistant City httorne , communicated with Bill
Smith that this was not what we had a rned upon, A new court

t As I mentioned, we visited with the Council last night. Since
Maverick is now sending us a shopping list, we suggested that
we also add some new requirements to our list. We suggested
adding minimum limits to the Insuranco (i.e., $I,000,000) as
well as language that would clear up past payments or lack of
I pay Monts of taxes or fees and rent. In other words, we could
invoke portions of the lease easier. We have also visited the
ppremises to ascertain what the cost of the improvements to the
building would cost. We estimate a maximum cost of $I5t000,
We will continue to negotiate with them and, as you suggested,
if there are not any movements, we will continue on to court.
I also have just received a letter of resignation from Ron
ff Bowling. Ron and I have only talked very 'briefl in the laat
f two days since I have been involved in Police Chef selection.
Ron has advised me that lie was approached by an east coast
l airport. They made him a`very good offer, one which he felt he
could not turn down so he has tendorod his resignation, I
will be visiting wits Bruce so that he can act in the interim
for Ron, We will start advertising immediately.
Finally, 1 have also visited with Ron about items for t'ha'
agenda for the board meeting next week. Ron has advised me
that, other than the update on the negotiations, we have no new
items, Since Ron has a very limited time frame and I will also
I F be out of town on vacation next week, I would suggest that we
postpone the meeting. I expect to be back in town the week of
August 24. We will either have a meoting then or will keep you
posted as to any further developments on the Maverick
negotiations,

i An airport safety inspection was conducted on July 21, 1987, at Denton
Municipal Airport by Juanita Jordan, Airport Safety Inspector. This
inspection is part of our General Aviation Airport Safety Program to
provide a safety analysis of the airport in an effort to enhance aviation
safety. A compliance inspection was also conducted to determine if the
city was maintaining the airport in compliance with its grant agreements,
R Observations and recommendations as a result of the inspection are as
folloves
1 a. Pavement.
I I ,
(1) There is some loose aggregate on portions of the'ruuay and
' f taxiway, The aggregate should be removed, We recommend an overlay or
i seal coat be considered in a future capital improvement project,
I
(2) The pavement at the touchdown area at the south and of the
f runway in showing signs of distroas. We recommend this area be repaired.
! t4 (3) The pavement area at the intersection of the fillet of the
oonneoting taxiway and Runway 35 is low and ponding has ooourred here.
{ The ground in this area should be regraded in order to establish drainage
away from the pavoment,
(4) Some vegetation is growing through the taxiway pavement on
the south end, A herbicide should be applied and the vegetation' removed,
b. Markings.
(1) The centerline markings on the south end of the taxiway are ?
faded. These markings should be repainted using paint with the
retro:ieotive-beads. The remaining markings are good.
(2) As discussed during the inspection, the taxiway holdline
markings to Runway 35 are 322' from the runway oenterline, These markings
should be removed and holdline markings painted at 200' from the runway
oenterline~

(1) All airport lighting was operational and well maintained,
The operating schedule may need some adjustment. Lighting facilities were
activated at approximately the following number of minutes after suneett
Supplemental wind cones - 10
Rotating beacon -e 20

Runway lights - 35
If the runway lights are on a timer, we recommend adjustment so they
activate at the same time as the beacon, or no more than about 20 minutes
after sunset,
(2) We repeat our previous recommendation to improve the apron
lighting by installing fixtures designed for that purpose to replace the
existing street lights.
d. Signs. We noted that there are no holdline signs. We reoommead
the oity consider installation of these signs in a future project,
e. Fueling. Maverick Aviation,
ll (1) There was to dust cap on the nozzle of Via fueling hose on
1 the 100LL fuel truck. A duet cap should be used to prevent debris and
water from entering the nozzle,

(2) There was dry grass and vegetation growing in the fuel farm' ;
area. A herbicide should be applied and all vegetation removed. We
reoommend gravel be placed in this area.

(3) "There was no "No Smoking„ sijp in the cab of the Jat A
truok, A sign 'should be ploood in the cab of the truck.

Overall the airport is in good condition and the Oity is in oompliance.

4. The hoard considered the presentation bil Frank Strickler of
Fox-51, Mr. Strickler asked for some conOlderation con-
cerning the property he has leased. Development has not
taken place like he had expected and so the lease for the
property was becoming a financial burden. The Board asked
for a written proposal to that it could be an item on the
agendas of the next meeting scheduled for September 8, 1907.
5. The Board considered the Airport reorganization and
budget. The Acting Chairman of the Board, Dr. Don Smith,
updated the Board on the meeting between he and the Mayor
and City Manager concerning the Airport staff y
reorganization and budget concerns.
6. The Board considered any new business, The Board asked if
the list of tenants had been updated. It had not been,
j The Board asked if insurance policies required in the land
leases were being checked. Risk management would be con-
sulted. There was a question concerning the money owed the
City by Mr, Bohnett. This was reported as resolved. The
Board discussed Airport aeburity, A motion was made and
seoonded to recommend to the City Legal Staff to draw up an
amendment to the trespassing ooda so that ownerr of private
f property, if they wish, can put up signs so; that local
I authorities can help in keeping unwanted people oft the
property. The motion passed unanimously. The board
{ discussed the possibility of airshows and C.A.10,

The Board ales in executive session at 6tss p.m. and reconvened
in open session at 7:15 p.m.

appropriated general revenue funds has, for forty-two years, helped to further the public's benefit through air transportation
and air services
development.
The incraasing importance of adequate airport facilities to your cummunity's
economic diversification endeavors, prompts me to make you aware that.our
f Legislature ended its .70th Regulhr Session on June It with .a proposed
appropriation that totally Eliminates the TAC's airport assistance prograia.
If this is not corrected in-the Special Session begirning June 22, hundrods
of Tnxas ocuamurrities'will N, ut a disadvantage 'With ±,he communities of other
states in trying to attract new business and industry.
e Today, the devulvpment and preservation of a modern air transport system
uhroughaut all of Texas is'an economic imperative: 7his can be accomplished
only if the visions exercised by that Legislature long ago are not allowed to
bo diminished by continued underfunding of the T'AC,
The TAC and its programs must be adequately funded through the implementation
of a 2 or 3 cent per gallon tax on aviation fuRl delivered into civil
aircraft in Texas. The revenues from this user fee must be dedicated to
aeronautical development for the benefit of all Texans. Thirty-six states
already use this type of state generated revenue for aeronautical
development.

communities to the air transportation system of the nation and the world. I '

for this year, The final two columns are proposed requests.
The Fourth column` whioh is titled "current funding" is the

column where we must, if necessary, add back in order to meet
present service levels. As-you can see, for the airport, these R
basically track, The reason we were Able to do that is that in

t this past year, we had significant 'budgeted amounts, i
j particularly in maintenance, Hervicen, and fixed assets, that
we will not have for this eominSl budget year;, Ron has
suggested that we eliminate much of out, maintenance costs for
vehicles for this coming year by not repairing the old surplus
sweeper. We were spending an inordirxate amount of money on the
sweeper and not gaining much benefit from it, Eton also
suggested that we `make :a significant cut In 'special cervices
this year. Last year, the special 'cervices was the budget for
the survey of the airport which has been completed, Finally,
in fixed assets, we will not be budgeting approximately

this year, I would like to call your attention to the removal
of the temporary/seasonal employees. You will see that later
in the budget,, we submitted a supplemental package which
requests that the funds for these positions be returned to hire
a part-time maintenance worker which we discussed last night.
In the supplies area, I would call your attention to `8109. We
have effectively doubled our postage. This is again in
response to the increased advertizing which we project to be
doing,
on page seven, ' you will note a significant increase in building maintenance as we discussed last night in account number

and a decrease in vohicle maintenance as previously discussed.

Who Is a visitor? Anyone coming to the motroplex "for bustntss, convention,
vacation or other travel-related purposes is considered a visitor to the Area.
The 1983 yearly total of 34,800,000 visitors to Texas reflects only out-of-state
visitors to our skate. There are also many visitors to our attractions, motels,
museums, restaurants and events who come from within the state.
The statistics used on the following pages do not reflect the primary purpose
of the visitor to the iretroplex area. For the entire area, there presently is no
comprehensive study oti' primary reason for visit. However, when e' visitor walks

During 19839 the total number of out-of-state visitors to Texas totaled 34.8
mMon. The reported statistics reflect the metroplex as the NI visitor destination
In the state of Texas. The metroplex also still holds the record for the 03
destination nation-wide, behind only Anaheim, California and Orlando; Florida.
Included In the metroplex statistics for our presentation are the cities of greaten
Dallas, Fort Worth, Denton and the surrounding areas. These three cities form

the ''Golden Triangle" of visitor attractions and accommodations for the metroplex.
Listed below are figures compiled from the annual report of the Texas Tourist
Development Agency for 1983, Visitors to Texas cities may visit more tMn

TVXAS VISITOR BUREAU STATISTICS
The Visitor Bureau at Gainesville, Texas serves as the gateway information
center for those entering Texas from the northern visitor markets. Those working
at the information bureau service visitors requiring information on points of
destination in Texas, The information bureau Is located on Interstate-35, 40
miles north of Denton, near the Oklahoma/Texas border.
i it Is estimated that of those served by the information bureau, 99.996 are
+ entering Texas via I-35 which passes` through Denton. In 1983, the information
I bureau serviced 238,512 individuals, 123,528 of which were from out of state.
During the first part of 18940 111,906 visitors at the center were offered
Information about Denton and the Metroplex area.
According to the Gainesville Visitor Bureau, the following most popular
destinations have been reported by those using the services of that bureaus

METROPLEX TRANSPORTATION ACTIVITY
DENTONMENTON COUNTY
Along I-35 north between the Sanger exit and the division of 1-36W and I-36E,
the traffic counts, as reported by the Texas Highway Department for 1983, range
from 21,000 vehicles daily to 33,000 vehicles daily, Both 1-361V and I-35E provide
high traffic counts ranging from 110000 vehicles daily on 1-36W up to 830000
vehicles daftly on 1-36E near Lewisville
TORT WORTH/TARRANT COUNTY

j In Fort Worth, traffic counts on major interstates through the city for 1-36
! are 2,550,b00 monthly' and 1,920,000 per month on 1-20. The total number of
vehicles traveled on 1-35 and 1-20 on a yearly basis is 53,64 million.
DALLAS/DALLAS COUNTY
Dallas County has an average Amount of vehicle miles traveled per year listed
E at 46.6 miliion. This is a different type of stat+stic than those above, reflecting
the miles estimated traveled on their major highways. However, the area has
1 a tremendous amount of traffic recorded daily on 1-30, 1-36 And 140, The
procedure for recording and estimating the traffic counts for the three counties
of Denton, Dallas and TAreant are complex. We have attached copies of the
1983 Texas Highway Department's traffic count figures for your further study.

DALLAS/FORT WORTH AIRPORT
In 1983, there were over 42 airlines offering direct service to 160 domestic
markets and 24 markets abroad from the DPW Alrport. With over 1500 daily
operations (arrivals/departures), DPW Airport is ranked as the 6th busiest airport
in the world.
Passengers arriving in the metroplex via the DFW" Airport In 1983 totaled
13,404,886. Domestic flights contributed 12,434,195 and International flights

same period` In 1983. This represents a 2896 increase in passenger arrivals for
the 1st half of 1984.
Both the DPW Airport and Dallas Love Field have experienced tremendous
growth In passenger arrivals. Both airports are located within `36 miles of the t

DENTON MUSEUMS
Denton has several fine museums presently drawing visitors from Texas and
throughout the country and world. Three Denton museums presently have records i
reflecting visitor counts and origin; 1) Daughters of the American' Revolution
Museum of Clowns of the First Ladies of `texas, 2) The Historical Collection at
North Texas State University and 3) Courthouse-On-The-Square Historical Musoum
of Denton County.

The curators of these museums have forwarded detailed listings of those
visitors who have registered at the museums during the years 1982 to present.

MOTEL/HOTEL ROOMS
There are 48,900 rooms available in the metroplex area Accommodations
range from world-class to economically-priced. The metroplex area has one
of the most concentrated total amount of hotel rooms and new hotel development
- in the country at the present time, making us a leader in offering the latest in
modern visitor accommodations.
In the Denton area `twelve months ago, there were 860 motel rooms. During
the past year, Denton has experienced a 20% growth in available room
accommodations. By June, 1985 we will have achieveda 33% increase in rooms

Looking at the Denton area specifically, the occupancy rate on a yearly basis
has remained consistently high, In 1983, the yearly occupancy average of Denton
area motels was 71%. This Is a high annual average rate, considering the national
occupancy depression' during 1983. Year to date, the average occupancy rate
for motels in the Denton area has been 76%. This increu.i^ is reported even with
i the addition of nearly 200 new motel rooms to the a. rket. Motel managers
project the 1984 average yearly occupancy rate will exceud 75% in 1984.

Within a fifty mile radius of the Denton Municipal Airport, there are over
1,067 developed camping sites available. There are an additional 2,720 acres
available for limited developed camping, Of the 1,067 developed camping sites,
the following statistics will demonstrate the various facilities in the areas

At the Dalla3 KOA Campgrounds, the management projects the 126 developed
sites accommodate over 36,000 camper nights yearly. ;There are an additional

management has been in contact with KOA about the possibility of `another
camping facillty development nearby due to the possibility of future attractions
development in the metroplex area.

1 LAKE LEWISVILLE
The metroplex Is fortunate to have several major Army Corps of Engineers
lake developments available to residents and visitors to our area. Both
representatives of Lake Grapevine and Lake Lewisville emphasized the Important
I fact that many of those visitors traveling to the Texas Rio Grande Valley during
the winter months stop in the campgrounds of the metroplex region. This is
j especially true of Lake Lewisville.
Over 7.5 million individuals utWzt the lake each year. Presently, over 85
1' camping sites without RV hook-up facilities are being upgraoed to meet the
I ft standards necessary to those travelers requiring water/electrical sites for camping.
This shows a committment to provide recreational vehicle camping sites for 1
those travelers coming Into Texas.
t i LAKE GRAPEVINE
With camping tees of $5 to $8. the Lake grapevine management makes an
1 effort to offer economical camping facilities for those coming into the metroplex.'
II Over 5.3 million visitors use Lake Grapevine per year. One of the camping
highlights of Lake Grapevine is the accessibility of group camping sites This
encourages the use of lake campgrounds for groups who, may come to the metroplex
area for the air shows and other attractions. Both lakes maintain gate attendants

Lake Ray Roberts, now under construction 20 mites to the northeast of Denton,
will be Completed_In 1981 or 1988. The dam Is almost completed, nearly a year
ahead of schedule. Proposed camping sites and visitor areas have not been included
in the camping facilities report section of this proposal. However, over 3,300
acres will be developed with campgrounds, beaches, picnicking, group shelters
and cabinsr

corporation, whose address is 611 Kimberly Drive, Denton, Denton
County, Texas, hereinafter called "Debtor", for a valuable and
sufficient consideration paid, the receipt of which is hereby
acknowledged, hereby TRANSFERS, ASSIGNS AND CONVEYS unto MBANX
DENTON whose address is 215 W, Hickory, Denton, Denton County,
Texas, hereinafter called "Secured Party" that certain Lease
Agreement dated September 15, 1987, by and between the City of
Denton, as Lessor and First Financial Resources, Inc,, as Lessee,

terms of the promissory note, Debtor was to make monthly payments ?
of $1,352.00 to Movant. Pursuant to an agreement entered into
between Debtor and Movant and approved by the Court on December
28, 19830 Debtor was to make monthly payments of $1,000.0u0
{ commencing on January 5, 1984, No payments in any sum have been
received by Movant since dune, 1983.

what was reccommended-in the instructions. When asked why he did '
this he said it was toprevent an environmental impact.
It is my understanding that the fire department will conduct
a controlled burning, I'd like this to be considered a foemal J

I recognize the city's concern for the safety of the people
working at the airport and the general public that utilize the
airport facilities. When there are maj,r'problems that affect
the safety of all concerned' I expect Penton Piper Sales to make

There is _a matter of safety that does concern me, It is' the
light post that is located on the west end of the parking lot, it
has been knocked over once in the last 120 d'uvs and since its
replacement has been hit numerous times. The placement of this
light pole is such that there is a natural' tendency when,backing
from a parking place to hit the pole, I have requested through
` the airport managger and Mr. Angelone that the, ,tight pole be moved
