Dear Gilbert:
Thank you for taking the time on November 4 to meet with me
regarding joint elections for the City of Denton and the DISD.
To recap our discussion, we reached agreements for the April,
1987 election on the following issues:
toR 1. The DISD and the City will preclear with the
,A Justice Department to hold a joint election using
Ctty Hall for absentee voting and the four single
member district polling places on election day
2. The DISD will handle all the necessary procedures
dealing with candidates; toe&, filing of
applicattons for place on the ballot, assuring
eligibility to run for office, drawing for place
on the ballot, expenditure and contriLutton
reports, etc.
3. The DISD has agreed to use punch card ballots and
secure such equipment from the County Clerk's
office
4. The DISD will prepare their own ballots and be
responsible for the necessary computer
k programming to tabulate the votes
5. Absentee voting for both elections will be held
Y at City Hall with the City having one election
clerk and the DISD having one election clerk at
City Nall under the direction of the City
Secretary
t 6, The City and the DISD will furnish election
workers and election udges for the four polling
places on the day of A e election
7. The City and the DISD will be responsible for the
tabulation of their own election reuults

requiring the run-off will be solely responsible
for the holding of that election

workers, etc, for the 1988 election.

Pending Submissions
E The City of Denton had previously submitted on October 7
19870 a request for preclearance of "changes" for a city bond
election scheduled for December 13, 1986. The
proposed
changes included the use of paper ballots, a central
place, and eight annexations, poling
l On December 19, 1986, your department notified us that no
determination could be made on our October 7 submission
because the City had failed to submit and obtain preclearance
of some twenty-nine annexations made during the years 1977
through 1982. In response to your notification, we made a
submission, dated January 6, 1987, of the annexations in
question, under file no. R2507-2516 and R4313-4315. As of
f this date, those submissions have not been precleared by your
department.

April 4, 1987 City Council Election

The April 4, 1987, City council election for which this
submission is being made, will be held to elect four members
of the seven-member City Council, in accordance with section
2.01 of the City Charter. The four Council members will be
elected for the City's four single-member districts. The
present four single-member districts were established by
ordinance no. 85-25, which was submitted on February 3, 19860
and precleared by your department on April 4, 1986.
Changes Submitted
The only "change" for the April 4, 1987, election which has jJ
not been previously submitted or
proposed holding of joint elections withltheeDentonl be the
Indeen-
dent School District, The holding of the joint elections
will be done pursuant to a joint election agreement between
the two governmental entities. A copy of that agreement is
enclosed.
Technically, as to the City election, there will be no act•tal
change in the voting practices or procedures of the C: :y,
except that the City and the Denton Independent School
District will be conducting their
polling places At the same time. Bothtentities, thowever,
will use a separate set of voting officials, separate voting
machines, and separate ballots.
The Denton Independent School District has made a submission,
dated December 19, 1986, of the changes it intends to
implement pursuant to the joint election agreement. A copy
of that submission is enclosed.
The City of Denton will use the same polling places, punch-
card ballot machines, and other practices and procedures,
as submitted for our prior City Council election,
of the proposed ordinance calling the April 4, 1987 eleA co

The proposed joint election to be held by the city of Denton,

enforced or administered.

( (d) The City of Denton shad never be liable for personal _
injury or property damages of any kind unless within thirty
(30) days after the occurrence thereof a notice in writing
by or on behalf of the person injured or claiming damages
is delivered to the city manager stating specifically and ac-
curately In complete detail when, where and how the exact
injury or damages occurred, the full extent thereof, the basis
of the claim and the amount of damages claimed or asserted.
(e) The City of Denton shall never be liable for personal
1 injury or property damages resulting from any defect in any
public street, highway, alley, grounds or public work of the
city unless the specific defect causing the injury or damage
shall have been known to the city manager from personal
Inapection or written notice thereof for a period of at least
twenty-four (24) hours prior to the occurrence of the in.
jury or damage and proper diligence shall not have been used
i to rectify the defect after such Inspection or notice. Such
notice shall be required whether the defect arose from any ,
act or omission of the city itself through its agent or em.

practicable according to the provisions for a regular
election. The hours and places for holding all city elections
shall be determined by the city council.
(b) On the first Saturday in April immediately following
adoption of Section 2.01. and the drawing of election district
boundaries by the council. the voters shall elect;
(1) The mayor, place seven (7), for a term of two (2) yeah.
(2) Two (2) councilmembers, places five (b) and siz (6), .or
terms of two (2) years each.
i f (3) One (1) councilmember for an interim term of one (1)
year. This position shall be denominated for such
interim term as place four (4) and such ocuncilmember

(c) The city secretary shall immediately examine each such 1
petition and notify the candidate and the person who filed
the petition whether it is signed by the required number of
qualified voters. If a petition is found insufficient, the city
secretary shall return it Immediately to the person who filed
it with a statement certifying wherein the petition is found
insufficient. Within the regular time for filing petitions a
new petition may be filed for the same sand?date. The peti-

City Secretary shall be designated the joint ab;lentee voting
clerk for absentee voting and one or more of the deputy absentee
voting clerks shall be designated by SCHOOL. School's regular
absentee voting clerk shall receive applications for absentee
ballots to be voted by mail and shall complete the remaining
procedures for absentee voting by mail.

6) Each party shall be responsible for bearing the costs of
its election and for the tabulation of its own election results.
~w 7) CITY agrees to provide space for absentee voting for
t School District at the Municipal Building.
8) SCHOOL agrees to utilize the punch card voting system and
will secure the necessary equipment from the Denton County
Clerk's office and shall be responsible for any computer
programming related thereto.
F 9) CITY agrees to place signs at all polling places inside
the City on the day of election and to retrieve and store same
after the election, SCHOOL agrees to place County-owned voting
booths and other election materials at each voting box within the
City on election day. SCHOOL further agrees to return the booths
to the County after such electiol.
10) Should a run-off election be required, the party requiring
a run-off will be solely responsible for conducting such run-off
election.
11) Each party shall be responsible for any liability
resulting from its election should a recount be requested for the
City election, the City Secretary shall represent the City.
Should a recount be requested for the school election, the
Superintendent or his designee shall administer the recount on
behalf of SCHOOL.

WHEREAS, Chapter 171 of the Texas Election Code authorizes
` political subdivisions to conduct joint elections; and,
` WHEREAS, the Board of Trustees of the Denton Independent
School District have requested the City Council of the City of
Denton to conduct its regular election to be held April 4, 1987,
jointly with the School District election; and,
WHEREAS, the City Council, having given due deliberation to
the proposal for a joint election, is of the opinion that
designating common polling places for the April 4, 1987 election
could adequately and conveniently serve the voters of the City

In support of the submission and in compliance with Section 51.10 of the applicable
-egulattons, I respectfully hubmit the following information for consideration:
1. Enclosed with this letter is a copy of a resolution for the Denton
Independent School District Board of Trustees to hold elections at the acme {
l ! locations as the City of Denton. This would also include absentee voting.
t I` In addition, this resolution reflects that the Denton Independent School
District will change its voting procedures from a paper ballot voting system

y to a punch card voting system as provided under the Texas E1*_ction Code.
I ~ 2. This resolution was adopted at the regular meeting of the Board of Trustees
on December 9, 1986,

3. The authority responsible for the change is the Board of Trustees pursuant to
an official vote of the Board.
I
4. The effect of the change is to combine voting locations fir the City of
j Denton and the Denton Independent School District. These point voting
I locations would make voting more convenient for the constituents of each
entity. The school district Is changing from one voting location where all
i precincts vote to four voting locations located at various sites where the
i City of Denton also conducts its elections. Placing the voting precincts in
j the same location as the City of Denton will enhance voter convenience and
E participation. It is the intent of both entities to use a separate set of
i election officials and a separate set of ballots. Absentee voting will also
be combined at one (1) location
for both the E City of
Denton and the Denton
Independent School District. A map showing the effects of these changes is
enclosed. In addition, the change from a paper ballot syste to a punchcard
` system would enhance the efftcienc) of administering the el _tton and aid in
its counting procedures. The City of Denton and Denton County already use
the punchcard met-hod.

x 6. It is not anticipated that the changes will have any impact upon the voting
rights of any individual within the Denton Independent School District.
7. There has never been any litigation concerning voting practices in the Denton
Independent School District.
8. The Board's decision to make the above changes in voting procedure was made
after an open vote in a regular meeting of the Bcerd. Under Texas law,
members of the public received the following notice: Meeting notice posted
f at the administration building and Denton High School; notice was mailed to
Denton radio station KDNT, North Texas State University radio station KNTU;
notice was mailed to Denton Record Chronicle and Denton Enterprise both
local newspapers, as well as North Texas Daily and Texas Woman's-Daily Lau-0
y our universities' newspapers. The change was also advertised in the legal
} section of the Denton Record Chronicle. A copy of the agenda that vas
1 posted for the December 9, 1986 meeting is also enclosed.
In this submission, it is the district's intention to supply all required information and
other facts that are relevant to the question. The source of this information is Mr.

COUNTY OF DENTON S AGREEMENT FOR CONDUCTING
JOINT ELECTION
f
i This is an agreement by and between the City of Denton, Texas
(CITY), and the Denton Independent school District (SCHOOL).
` HNEREAS, article 978b, Texas Revised Civil Statutes and
Chapter 271 of the Texas Election Code authorize cities and
school districts to conduct joint elections; and
WHEREAS, CITY and SCHOOL represent that they have each
adopted resolutions authorizing the terms of this agreement:
1) CITY and SCHOOL agree to hold their respective general
i elections for officers and other issues jointly together on April
4th, 1987,
j 2) CITY and SCHOOL agree to jointly designate the same
]f polling places within the City. These polling places shall be:

4) The CITY and SCHOOL will each provide their own separate
ballots, poll lists, tally sheets, returns and ballot boxes.
CITY and SCHOOL will each and separately post election orders and
public election notices. :ach entity will separately receive
applications for place on the ballot, assure eligibility to run
' for office, draw for places on the ballot, prepare expenditure
and contribution -enorts, and handle other matters relating to
candidates.
S) CITY and SCHOOL agree to each separately appoint election
judges for all voting boxes located in the City at the polling
i places specified in Section 2 hereof. Absentee voting shall be
conducted in accordance with the requirements of the Texas
S Election Code at the Office of the City Secretary at City Hall,
21S East McKinney, Denton, Texas. The parties agree that the
City Secretary shall be designated the joint absentee voting E
clerk for absentee voting and one or more of the deputy absentee
voting clerks shall be designated by SCHOOL. School's regular
absentee voting clerk shall receive applications for absentee
ballots to be voted by mail and shall complete the remaining
procedures for absentee voting by mail.
6) Each party shall be responsible for bearing the costs of
its election and for the tabulation of its own election results.
f 7) CITY agrees to provide space for absentee voting for
School District at the Municipal Building.
8) SCHOOL agrees to t•tilize the punch card voting system and
will secure the necessary equipment from the Denton County
Clerk's office and shall be responsible for any computer
programming related thereto.
9} CITY agrees to place signs at all polling places inside
the City on the day of election and to retrieve and store same

` after the election. SCHOOL agrees to place County-owned voting
booths aelection day. SCHOOL efurther tageach rees vtoireturn the booths
to the County after such election.

10) Should a run-off election be required, the party requiring
a run-off will be solely responsible for conducting such run-off
election.
11) Each party shall be responsible for any liability
resulting from its election should a recount be requested for the
City election, the City Secretary shall represent the City.
Should a recount be requested for the school election, the
Superintendent or his designee shall administer the recount on
behalf .f SCHOOL.

the remaining portion or portions thereof, but as to such

full force and effect; and should this ordinance for any reason
be ineffective as to any part of the area hereby annexed to the
City of Denton, such ineffectiveness of this ordinance as to any
such part or parts of any such area shall not affect the
effectiveness of this ordinance as to all of the remainder of
such area, and the City Council hereby declares it to be its
purpose to annex to the City of Denton every part of the area
described in said Exhibit "A" of this ordinance, regardless of
whether any other part of such described area is hereby

PLAN OF SERVICE FOR ANNFXED AREA CITY OF DENTON TEXAS
WHEREAS, Article 970& as amended requires that a plan of servic
be adopted by the governing body of a city prior to passage of an ordinan~,
annexing an area; and
WHEREAS, the City of Denton is contemplating annexation of an
area which is bounded as shown on a map of the proposed annexation,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DENTON, TEXAS:
Section 1. Pursuant to tt;e provisions of Article 970a as
amended, Texas Code Annotated, there is hereby adopted for the proposed
annexation area the following plan of service:
I. Basic Service Plan

A. Police v
(1) Patrolling, radio responses to calls, and other
routine police services, using present personnel
and equipment, will be provided on the effective
date of annexation;
j ' (2) Traffic signals, traffic signs, street markinga,
and other traffic control devices will be installed
as the need therefore is established by appropriatr
study and traffic standards.
S. Fire
(1) Fire protection by the present personnel and equip-
ment of the fire fighting force, will be provided
on the effective date of annexation.
C. Water
(1) Water for domestic, commercial and industrial use
will be provided at city rates, from existing city
lines on the effective date of annexation, and
thereafter from new lines as extended in accordance
with article 4.09 of appendix A of the code of the
City of Denton, Texas.

D. Sewer ,
t (1) Properties in the annexed areas will be connected
i to sewer lines in accordance with article 4.09 of
appendix A of the code of the City of Denton, Texas.

(1) The same regular refuse collection service now pro-
vided within the city will be extended to the
annexed area within one month after the effective
date of annexation.

(1) Emergency maintenance of streets (repair of hazardous
chuckholes, measures necessary for traffic flow, etc.
will begin on the effective date of annexation.
(2) Routine maintenance on the same basis as in the
present city, will begin in the annexed area on

s (3) Reconstruction and resurfacing of streets, installa-
T tion of storm drainage facilities, construction of
curbs and gutters, and other such major improvements,
as the need therefore is determined by the governing
body, will be accomplished under the established
policies of the city.
a. Inspection Services
(1) Any inspection services now provided by the city
(building, electrical, plumbing, gas, housing,
sanitation, etc.) will begin in the annexation area
on the effective date of annexation,
H. Planning and Zoning
(1) The Planning and Zoning jurisdiction of the city
will extend to the annexed area on the effective
date of annexation. City planning will thereafter
encompass the annexed area.
I. Street Lighting
(1) Street lighting will be installed in the substan-
tially developed areas in accordance with the
established policies of the city.
! J. Recreation
(1) Residents of the annexed area may use all existing
recreational facilities, parks, etc., on the effec-
tive date of annexation. The same standards and
policies now used in the present city will be fol-
lowed in expanding the recreational program and
facilities in the enlargrid city,
ii K. Electric Distribution
(1) The city recommends the use of City of Denton for
electric power,

unconstitutional, illegal or invalid, or the application thereof
ineffective or inapplicable as to any territory, such unconsti-
tutionality, illegality, Invalidity or ineffectiveness of such
section or part shall in no wise affect, impair or invalidate
the remaining portion or portions thereof, but as to such
remaining portion or portions, the same shall be and remain in
full force and effect; and should this ordinance for any reason
be ineffective as to any part of the area hereby annexed to the
City of Denton, such ineffectiveness of this ordinance as to any
such part or parts of any such area shall not affect the
effectiveness of this ordinance as to all of the re!sainder of
such area, and the City Council hereby declares it to be its
purpose to annex to the City of Denton every part of the area
described in said Exhibit "A" of this ordinance, regardless of
whether any other part of such described area is hereby
effectively annexed to tho City. Provided, further, that if
there is included within the general description of territory
set out in Section I of this Ordinance to be hereby annexed to
the City of Denton any lands or area which are presently part of
and included within the limits of the City of Denton, or which
are presently part of and Included within the limits of any
other City, Town or Village, or which are not within the City of
Denton's jurisdiction to annex, the same is hereby excluded and
excepted from the territory to be hereby annexed as fully as if
such excluded and excepted area were expressly described herein,
SECTION V.
This ordinance shall be effective immediately upon its
passage.

be adopted by the goVeraing body of a city prior to passage of an ordinance
annexing an area; and
%7EREAS, the City of Denton is contemplating annexation of as
area which is bounded as shown on a map of the proposed annexatir,o.
NOW, THEREFORE, BE IT RESOLVED BY TSE CITY COtrXCIL OF THE CITY
OF DENTON, TMUS:
Section 1. Pursuant to the provisions of Article 970L as
amended, Texas Code Annotated, there is hereby adopted for the proposed
annexation area the following plan of service:
1. Basic Service Plan
A. Police
(1) Patrolling, radio responses to calls, and other
routine police services, using present personnel
and equipment, will be provided on the effective
date of annexation;
(2) Traffic signals, traffic signs, street markings,
and other traffic control devices will be install T

study and traffic standards.
B. Fire
(1) Fire protection by the present personnel and equip-
ment of the fire fighting force, will be provided
on the effective date of annexation.
C. water
(1) Water for domestic, commercial and industrial use

thereafter from new lines as extended in accordance
i with article 13.00 of appendix A of the code of the
City of Denton, Texas.
D, Sewer
(1) Properties in the annexed areas will be connected
to sewer lines in accordance with article 13,0E of
appendix A of the code of the City of Demon, Texas.
E. Refuse Collection
(1) The sane regular refuse collection service now pro-
vided within the city will be extended to the
annexed area within one month after the effective

The City Secretary is hereby authorized to prepare the

required by the Charter and Laws of the State of Texas for

This is to confirm that station N4 at 2110 Sherman Drive will
be the official polling place for District 2 for the April 4,
1987 City Council and School Board elections. The polls will
be open from 7:00 a.m. until 7:00 p.m. Election workers will
need some set up time prior to the opening of the polls and
will put away the tables and chairs after the polls closo at
7:00 p.m. I would appreciate it if you would see that the
Firefighters are aware of this date.

official polling place for District 1 for the April 4, 1987
City Council and School Board elections. The polls will be

away the tables and chairs after the polls close at 7:00 p.m.

Dear Ms. Walters:
On Saturday, 4 April 1987, I was a poll watcher for Randall S.
Boyd at the American Legion Hall on Lakey Street. The election ran
smoothly for the most part, with some exceptions that I mention in
the accompanying report. On re-reading my report, I should add that
Mr. Bob Speer visited the polling place several times during the day
to see if additional supplies were needed and that an Inspector from
the Secretary of State's office came to the Polling place in the
early afternoon. The inspector remained for about 30 minutes and
left after asking directions to the North Lakes Recreation Center
and to Oak Point.
The greatest difficulty in the actual administration of the
election seemed to arise from the fact that City Council District
lines do not correspond in all cases with voting precinct lines.
This caused some confusion for some voters who had read in the paper
that they voted at Lakey Street when in fact they lived in a part of
,heir precinct that voted at Denia Park or the Sherman Drive fire
station. While only a few voters were affected by this problem, the
willingness of people to vote in the future would probably be
strengthened if they could be certain that they were going to the
proper poling place. Several voters expressed satisfaction that they
could vote in the City and School Board election at the same place.

Denton, TX
At the polling place there was one election judge, five clerks, and
three poll watchers. The School Board election was held on the opposite
side of the room. Clerks directed voters to the proper voting machines
and ballot boxes without incident throughout the day. Workers in the
city election made a cunscientious effort to ensure that voters living
in precincts which were split by Council district lines voted in the
proper district. On several occasions during the day the election judge
or one of the clerks gave assistance to voters and twice the election
judge carried materials to voters who were unable to leave parked cars.
In these instances the judge's behavior was observed by watchers from
both candidates. Each time that the judge removed voted ballots from
the box as it became full, she was observed and always accompanied by
a poll watcher for Carl Young. At the end of the election, all poll
watchers expressed satisfaction with the judge's and clerks' conduct
of the election.
Prior to the opening of polls the poll watchers for Carl Young ,
entered the polling place and identified themselves as "ballot security" 1
and asked to see Carl Young. When they were told that lie was not i
there they left to look for him and returned with poll watchers' I
certificates signed by Mr. Young. The Judge accepted the Certificate
of J. Stanley Lennox III of Stonebridge, Argyle,although it lacked
his voter registration number. John D. Bauer, 1619 Northland, Carrollton,
assured the judge that Mr. Lennox was a registered voter in Denton
County. i
At about 9:00, James Lott, who said he was a write-in candidate
for the City Council seat, came to the polling place and was told by
the judge that he would have to remain across Lakey Street to be
outside the distance markers. Mr. Lott parked his car west of the
intersection and remained there until about 12:30. Later In the day
one of his fliers was found tacked to a phone pole in front of the
Legion Hall. i
At about 1:00 Carl Young was in the street soliciting votes from
the occupants of passing cars. He was told by the judge that he would
have to remain on the othprside of Lakey Street to be outside the
distance markers and he went across the street. Later in the afternoon,
a sound system was set up in the park adjacent to the Legion Hall.

The election judge and the judge of the School Board election walked to
the picnic pavillion and asked that the sound be turned down. The sound
level was reduced some. l'he city police came to the park in response to
a complaint about dogs in the park and spoke with the election judges.
Several announcements were made on the sound system which seemed to relate
to the election but they were generally unintelligible inside the polling
place. The phrase "help me out" was made out one time. At about 4:00
Mr. Young was in front of the polling place talking to voters as they
left the polls. The judge spoke to him and he moved across the street.
At about 5:00 Mr. Young was again on the cirb in front of the polling
place shouting at passing cars "Help we out," and "Vote tight" as he
talked with Mr. Lennox, one of his poll watcher.. Again, the judge. told
him to stay across the street. About 5:15, as Mr. Lennox returned to the
polling place from speaking with Mr. Young, Mr. Lennox stopped to talk
to the occupants of a car parked in front of the polling place. The
election judge spoke to Mr. Lennox. About 6:30, Mr. Young was again
in the street shouting at cars. When the judge instructed him to stay 1
across the street, Mr. Young replied that he intended to protest the
election because registered voters were not being allowed to vote.
He stated that as a deputy voter registrar he had registered a number
of people to vote and that those people had neither received their
certificates nor been included on the list of registered voters.
Mr. Young had [lie registration receipts with him and insisted that
the judge take the receipts and allow the people named on the receipts
to vote if they came to the poll without a certificate. There appeared
to be about twenty pages of five or six receipts each. The judge replied
that the people on the receipts would be allowed to vote if they came to
the poll with their receipts and identification but that she would not
take the receipts. After some discussion withthe judge, Mr. Young agreed
with her that if Mr. Young was describing the situation accurately,
there was a problem In the Courty Clerk's office but not with the conduct
of the election. He complained that the County Clerk's office was not
giving him a chance. After the judge returned to the Legion Hall, Mr.
Young remained standing in Lakey Street with one of his poll watchers
talking to the occupants of a standing car until a police car drove by.
At 7:00 the judges ordered that the door to the polling place be locked.
One or two voters in the Legion Hall were allowed to finish voting and were
let out of the Legion Hall. The judges and clerks began taking down the
voting machines and completing their paper work. No announcement was made
by either judge concerning the total vote or the result of the election.
As election materials were being removed from the Legion Hall, Mr. Young
came into the building and sought to talk to one of the election clerks.
He was told by the judge to leave. At about 7:10, Mr. Young again cane
into the Legion Hall and tried to talk to the judge as she was making the
final count of voted ballots and completing her forms. Mr. Young asked
what the outcome of the election was. The judge replied that she could
not tell him and that he should stay outside. Mr. Young remained out-
side the Legion Hall and engaged workers, poll watchers, and the judge
in conversation as they left. Ile did not ask again atout the election
result.
