TO HAVE AND TO HOLD the same temporarily unto the City of Denton and its successors, together with the 'right and privilege at all times to enter said premises, or any part thereof, for the purpose of constructing, reconstructing, and maintaining said drainage facilities and for making connections therewith. And the Grantee shall have the right to construct and reconstruct and the obligation to maintain the drainage facilities at all times in the future, within a forty (40) foot Temporary Drainage Easement as attached as Exhibit "C". j All upon the conditions that the CiCy of Denton will at all i times, after doing any work in connection with the construction, reconstruction or repair of said drainage facilities, or any lateral thereof, restore said premises to the condition in which they were found before such work was undertaken, and that in the use of the rights and privileges herein granted, the City of j Denton will not create a nuisance or do any act that will be detrimental to said premises. { It is anticipated that at some time in the future, the erosion control fence and grade to drain for which this easement is being provided will be conveyed by other means. GJ~LL AN ORDINANCE ABANDONING AND VACATING A CERTAIN DRAINAGE AND UTILITY EASEMENT AS DESCRIBED HEREIN; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Denton, Texas has determined that the hereinafter described drainage and utility easement is no longer needed for public use; and WHEREAS, in accordance with the provisions of Texas Revised Civil Statutes, Article 5421c-12, an appraisal of the fair market value of said easement has been obtained; and WHEREAS, in accordance with state law, said easement is being abandoned and vacated in consideration of the receipt of their fair market value by the abutting property owner thereof; ~ I J ' NOW9 THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: { SECTION I. i That the hereinafter described easement is abandoned and j vacated as an easement for drainage and public utilities: y All that certain lot, tract or parcel of land lying and being situated in the City and County of Denton, State of Texas, and being part of the Mary L.
