RE; Release of Water from Ray Roberts
Dallas contacted me Monday, August 15, 1988, and advised that
they believe it is in Denton and Da 1.las" best interest to
f release some of the water held in Lake Ray Roberts. The level
of the water in Lewisville has dropped to the point (509.6 feet
above sea level) where evaporation loss from Lewisville and Ray
Roberts could be minimized by transferring some of the water
from Ray Roberts to Lewisville. Dallas initially proposed to j
transfer 52% (that is the maximum quantity that could be
i transferred without triggering the Corps contract, wherein we
would have to start paying more than our $1.3 million annual
fee) of the volume from Ray Roberts, This would take about 60
days and would result in a final Lei, ~svllle elevation of S131, f
if no rainfall occurred. I have asked Dallas to consider only
j transferring enough to make up the 300 plus million gallons per
clay that is presently being withdrawn, and fill only to the
511, elevation.
The transfer will riot affect Denton's present credit for water
from Ray Roberts, but the risk is loss of water in the event we
get a large rain in the Lewisville Watershed and we exceed the
515' conservation elevation, wherein the Corps will "spill" the
water, However, the Corps might allow some overfilling of
Lewisville, i.e., filling above 5151, since the highway
reconstruction and boat ramp work is nearing completion. The
Corps of course does not plan to start "deliberate" impounding
above the 515' level to the 522" level until the end of.
November. With Lewisville Lake being the smaller lake, already
with substantial volume in it, and having approximately 1,000
square miles of watershed draining directly into it, it would
fill to the 522" level much faster than Ray Roberts, which only
has 700 square miles of watershed draining into It, if we were
to get a large rain throughout the entire watershed, In that
event, we would lose water and the safe yield.

I'll keep you posted on this action, but I believe we can
expect some transfer of water to take place. Dallas plans to I
release at a rate of around 500 million gallons per day, which
Will result in a fairly heavy river stream, probably in the
range of 3' to V deep.

We are beginning to get pressure from the recreational
interests on Lewisville to release water from Ray Roberts for
recreational purposes. We, i.e., Denton and Dallas, are
continuing to maintain a firm water conservation management
k position and not release any water from Ray Roberts. (see
attached copy of Mike Tubbs letter).

In response to your letter of July 25, 1988, the City of Dallas is keenly
aware of the recreation benefits provided by Lewisville Lake. However,
the City of Dallas Water Utilities Department has as its first and
foremost responsibility the supply of drinking water to over 1.5 million
people in the Dallas/Denton County area. Both Lewisville Lake and Ray
Roberts Lake were developed primarily at the expense of the rate-payers
of water utilities of Dallas and Denton.

We shared your enthusiasm when the gates were closed at Ray Roberts Lake
in 1987. Ray Roberts offers the last major water supply source in the
Upper Trinity watershed. By transferring, a portion of the flood storage
from Lewisville Lake to Ray Roberts Lake, the authorized conservation
level of Lewisville Lake will be raised by seven feet this coming
November. After Ray Roberts fills, the increase in the conservation
level will allow a larger, deeper Lewisville Lake which varies somewhat
less in elevation than it would without the presence of Ray Roberts
Lake. However, there are no plans, nor have there ever been plans, to
utilize Lewisville Lake as a "constant level lake"
You expressed concern that the water in Ray Roberts Lake would now be in
Lewisville Lake had it not been trapped earlier. In fact, had Ray
Roberts Lake not been impounding water during the past year, much of the
water it now holds would have been released from Lewisville Lake as flood
waters during the winter.

Operation of the Lewisville-Ray Roberts system is designed to maximize
the amount of water available during a drought. To increase the yield of
the system, OWU began releasing 49 million gallons of water per day from
Grapevine Lake which would have normally been taken from Lewisville
Lake. This action was taken beginning July 16, 1988.

Dallas continues to monitor the available yield from its lake system, if
the elevation of Lewisville Lake drops such that there is a water supply
benefit to releasing additional water from Ray Roberts, changes to the
operation of the lake system will be made.
I hope that the weather will be cooperative and provide sufficient
rainfall this winter to bring Lewisville Lake to a level greater than the
current conservation level while also significantly adding to the water
stored in Ray Roberts Lake,

one time in over thirty years and with the increase in water use now
present it would not happen again.
If the yachts and boats are left to sink into the ground, not to
mention fishing, while Ray Roberts retains water, we would think it
` would be np.xt to impossible to establish any future policy, other than
to make Lake Lewisville a constant level lake, without the present
users rising up in effective protest.

The purpose of this letter is to provide you with information to
f ! assist you in planning for the initial annual payments for the Ray
Roberts Lake Project. This information is based on initiating
f deliberate impoundment for the pool raise at Lewisville Lake at the
end of November 1988, and the City of Denton not desiring to utilize
any of the Ray Roberts Lake future use water storage at that time.

The initial investment cost payment will be $1,362,866.77 as shown

after the City is notified by the Corps of the

amount of the payment will be included in our notification letter.

SUBJECT: Greenbelt Corridor Between Ray Roberts Dam and
Lewisville Lake, Texas
THE SECRETARY OF THE ARMY
1 1. 1 submit for transmission to Congress my report on a
proposed modification to the authorized recreational
development for the Ray Roberts Lake project to allow
acquisition and development of a greenbelt corridor along
the Elm Fork of the Trinity River between Ray Roberts Dam
and Lewisville Lake. It is accompanied by the Post
Authorization change Report prepared by the Fort Worth
District. Public Law 89-298 contains authority for
construction of water resource development features
described in the Comprehensive Survey Report on Trinity
River and Tributaries, Texas (reprinted as House Document
276, 89th Congress).
2. The 1965 construction authority for Ray Roberts Lake
(PL 89-2980 Section 301) included authority to raise the
downstream Lewisville hake pool elevation and develop new
recreation facilities in response to the additional
recreation demand resulting from the pool raise. Whereas
the original plan called for traditional park development
at Lewisville Lake, the plan recommended herein consists
of acquiring a corridor of land between the two lakes and
i developing it as a greenbelt with trails and canoe
launching facilities. The Cities of Denton and Dallas,
local sponsors for the Ray Roberts Lake project, concur
with the-District Engineer-'s recommendation to'substitute
the greenbelt corridor recreation development for the
traditional park development at Lewisville Lake. The
Texas Parks and Wildlife Department has also expressed
intent to participate as a local sponsor on the greenbelt
plan. Any additional park development at Lewisville Lake
(authorized by PL-89-298, Section 103) would be a
non-Federal responsibility. Recreational development at
Ray Roberts Lake would not be affected by this action.
3. The key departure of the greenbelt proposal. from the
authorized project is the quantity, location, and title
of land ownership. House Document 276 authorized
acquisition of 2900 acres in fee for public !%as and
access at,Lewisville Lake (2800 acres easement conversion

and 100 acres fee simple). However, the plan that would
most likely be implemented at Lewisville Lake would be a
Facilities Only plan. The estimated total first cost of
the Facilities only plan is $4,272,000, based on October
1987 price levels. Average annual charges, based on a
5o-year period of economic analysis and an interest rate
r-- of 8-5/8 percent are $636,000, and include operation,
maintenance and replacements costs of $262,000. Average
annual benefits are estimated to be $1,851,000, and the
benefit-to-cost ratio is 2.9. Under this plan the first
cost would be shared 50 percent to the Corps and 50
percent to the Cities of Dallas and Denton. The
operation, maintenance, and replacement costs would be
the responsibility of the cities. The recommended
greenbelt plan would require fee acquisition of about 660
1 acres, acquisition of conservation easements on about Soo
acres, and conversion from existing flowage easements to
fee of about 440 acres. The first coat of the greenbelt
plan, based on October 1987 price levers, is $3,2430000.
Average annual charges, based on a 50-year period of
economic analysis and an interest rate of 8 5/8 percent,
are $338,000 and include operation, maintenance, and
replacement casts of $53,000. Average annual benefits
are estimated to be $10530,n00 and the benefit-to-cost
ratio is 4.5.

4. Cost sharing for the greenbelt plan in accordance
with PL 99-661 of the Water Resources Act of 1986 would
be 50 percent Federal and 50 percent non-Federal.
However, because of the sponsors' keen interest in
development of this unique recreational opportunity,
agreement has been teachei that 25 percent be paid by the
Texas Parks and Wildlife Department and that 37.5 percent
be split between the cities of Dallas and Denton. The
Federal share would be 37.5 percent. operation,
maintenWice, and replacements would be the responsibility
of the Texas Parks and Wildlife Department. ,
5. T recommend substitution of tho Greenbelt cirridor
between Ray Roberts Jam and Lewisville Lake, Texas, for
the original plan of traditional park development at
Lewisville Lake (Facilities only plan) as authorized by
PL 89-298, Section 301. Provisions of PL 89-298 shall
apply to the Greenbelt Corridor plan. The cost sharing

shall be in accordance with paragraph d above.
6. Extensive public involvement reveals that the
greenbelt plan is strongly supported by the broad public
interest, although some opposition has been expressed by
affected landowners. The greenbelt offers a lower total
Federal investment, a.larger than 50; share of the costs
to be borne by the local sponsbis, and an opportunity to
/ provide a ,needed resource unique to t;,e area. Texas
{ Parks and Wildlife Department has expres3ed3 written
intent to provide financial and managerial support,
including operation and maintenance.
r' 7. The rec3ommendationa contained herein reflect
information available at this time and current
Departmental policies governing formulation of individual
projects. They do not reflect program and budgeting
priorities inherent in the formulation of a national
civil works construction program nor the perspective of
higher review levels within the Exwcutive 8ranch.
Consequently, the'recommendations may be modified before
i they are transmitted to the Congress as proposals for
authorization and/or implementation funding.

Dear Colonel Genetti:
This letter is in response to your letter of June 16, 1987, which we
received on July 1, 1987. Regarding the fish rearing ponds,
Denton's position is to honor our commitments to construct the three
(3) fish rearing ponds. On several occasions over the past several
years of development of the Ray Roberts project, officials of the
Corps, Denton, Dallas, and the Texas Parks $ Wildlife Department
have publicly informed citizens in the Denton County area that the
subject fish rearing ponds would be included in the Ray Roberts
project. Although Denton recognizes that this commitment represents
a cost of approximately $7,400 per year to Denton, it is Denton 's
position that this commitment to the area citizens should continue
to be honored.
~ Regarding the development of the seven (7) wetland areas, Denton's
f j preference is that the Corps proceed with the cost sharing contracts
{f which will allow the 75%-25% funding participation, However, if in
the judgment of your staff, there is substantial risk that these
areas will be be inundated before the project is complete because of
the time required for contract approval, Denton would not object to
a 50%-50R funding in order to be certain that these projects are
completed in a timely manner. Again, Denton's position is to honor
commitments to the citizens of this area regarding these wetland
areas.

As we briefly discussed after the meeting in Denton June 9, 1987,
there are two areas relating to Ray Roberts Lake that 1 would
appreciate meeting briefly with you and your staff in the near
future.

The first item is Denton's interest in either leasing or purchasing
4 a 30 acre tract of property on the eastern part of Culp Branch Park
for a water plant site. This 8 MGD plant will serve Denton and
other north Denton and possibly southern Cooke and Grayson County
communities beginning in approximately 1992, Ultimate plant size
would be 50 MGD, We believe a plant at such a location could have
many mutual benefits, such as water and wastewater services for the
t future park, as well as providing some security to the park. As for
the plant, it would help knowing that the Corps is its neighbor,
rather than some questionable residential or commercial development.
The second item is Denton and Dallas' 1988 fiscal budget and water
rate concern resulting from project completion being scheduled for
July 1988 versus perhaps October 1, 1988. The July schedule places
the first annual payment in Denton and Dallas' fiscal 1988 budget,
whereas, an October 1 date, only 90 days later, but still prior to
fall rains, places the first payment in fiscal 1989. This would
allow for the Cities to phase this cost in a two stage rate increase
versus one large rate increase.
I have discussed these issues with some of your staff, plus the City
of Dallas. Representatives from Dallas and I would appreciate
visiting with you on this matter at your convenience .

WHEREAS, the City of Denton and the City of Dallas hold
permits for water rights in Aubrey Reservoir, with Denton
owning a twenty--six (26%) percent share and Dallas a
seventy-four (74%) percent share and sharing the costs of the
project by these same percentages; and
WHEREAS, the U. S. Army Corps of Engineers in 1938 included
Aubrey Reservoir in flood control plans for the Elm Fork of the
Trinity River, and later classified and received authorization
from Congress for Aubrey Reservoir as a multiple
11 reservoir for water supply and recreation pursuant o theuRiver
' and Harbor Act of 1965; and
E WHEREAS a financial feasibility study conducted by LWFW
! Inc., for the Cities of Denton and Dallas concluded that the
it Aubrey Reservoir Project with construction and financing by the
I U. S. Army Corps of Engineers is the most economical water
resource alternative available to the cities at this time; and

WHEREAS, the two cities must enter into water supply and
recreation contracts with the federal government before
V Li construction can begin; and
WHEREAS, proposed contracts require Denton to pay its
allocated share of actual construction costs, including
interest during construction on all facilities and lands needed
for water supply and to share fifty (50%) percent of such costs
with federal government for recreation; and
WHEREAS, the Corps of Engineers current estimate (in 1979
Dollars) for the total pr<;ject investment is $230,451,000 of
which Denton's share is $41,513,300 (water supply: $37,744,1001
recreation: $3,769,200) to be repaid over fifty (50) years at a
specified interest rate, currently 7.21%, with the first
payment due when facilities are complete; and
WHEREAS, Denton and Dallas will be responsible for their
proportionate share of annual operations and maintenance
expenses; and
WHEREAS, the inclusion of recreation as one of the purposes
for the project makes federal participation possible and
reduces the cost- to Denton for water supplYl and

supply resource to begin at the earliest possible time and
anticipated completion is 1990;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DENTON, TEXAS, THAT:
SECTION I.
The Mayor be authorized to enter into water supply and
recreational contracts with the United States Army Corps of
Engineers for the Aubrey Reservoir Project after completion of
final negotiations on subject contracts.
SECTION II.
The City Manager and Finance Director be authorized to
encumber and allocate funds 'at the appropriate 'time, from Water

TEXAS, HELD IN THE MUNICIPAL BUILDING OF SAID CITY ON THE 22ND
DAY OF JANUARY, A. D. 1980.
R E S O L U T I O N
WHEREAS, the Honorable Ray Roberts is the United States
Representative for the Fourth Congressional
District which includes the City of Denton; and

WHEREAS, Ray Roberts has served in the U. S. Congress for
eighteen years, and was a State Senator in the
Texas Legislature for seven years prior to that;
and
WHEREAS, Ray Roberts is chairman of the House Veterans'
Affairs Committee and chairman of the Water
Resources Subcommittee of the Public Works and
Transpottation:Committee; and
WHEREAS, Ray Roberts' bas. been a leader ~n the development l

and-.,conservat~on of the nation's water zcsources#
and as. the PK ineip&l : author, :'.cif; the , Water ;i
Resources Development. Act. and has-'guided authori
zatfoh'`.:ot the Aubrey Reservoir •Projeot; and
WHEREAS, Ray Roberts has spent many hours working with the
Corps of Engineers, Texas Water Rights Commission
and the City of Denton towards assuring the
construction of the Aubrey Reservoir Project; and
WHEREAS, Ray Roberts has worked hard and diligently
towards funding the project and has effectively
secured funding for the development of the Aubrey
Reservoir Project; and
WHEREAS, the Aubrey Reservoir Project is extremely
important to the seater supply of the City of

' assurance of an adequate water supply for the
City of Denton;
f NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF' THE CITY
OF DENTON, TEXAS, THA'I':
the Mayor of L•he City of Denton be authorized to
petition the United States Congress to
F redesignate the U. S. Corp of Engineers' Aubrey
Reservoir Project in honor of the Honorable Ray
Roberts for his hard work and dedication in
representing the City of Denton regarding its
interests and the construction of, this reservoir.

RESOLUTION
I by the Hoard of Directors
Dallas Chamber of Commerce
WHEREAS, Dallas should continue an aggressive program for development of
adequate water resources according to Its long-range water supply plan; and
WHEREAS, it appears that the construction of Aubrey Reservoir would be the
logical next step In carrying out the plan and would further ensure an adequate long-
term water supply for the Dallas area; and
WHEREAS, the construction of Aubrey Reservoir would create a strong regional
partnership among Dallas, Denton, and other cities in the metropolitan area; and
WHEREAS, Aubrey Reservoir would not be energy-dependent In that water could
be transported by gravity rather than by means of energy-consuming pumping devices;
and
WHEREAS, Dallas and suburban cities have reached agreement regarding future
water rates; and
WHEREAS, initial authorization to begin construction of Aubrey Reservoir has
been granted and applicable permits have been applied for and obtained; and
WHEREAS, Aubrey Reservoir promises to be economically feasible, capable of
providing Dallas and its customer cities with needed water at reasonable costs; now
THEREFORE, BE IT RESOLVED, that the Dallas Chamber of Commerce urges
1 the Dallas City Council to aggressively pursue the long-range water neerl,, of the
community through the development, construction, and utilization of Aubrey Reservoir.
