RIght-of-Way for Masoh Branch Noad Per the Council's instructions, we have been discussing and negotiating with Mr. Frank and Dr. Wolski. our right-of-sway people have been extremely effective in these negotiations. k You may recall that the Council had given us authority for up I to $16,000, dlr. Frank and Dr,` Wolski have agreed to `sign all the releases and other documents for $6,500. We think this is an extremely good price considering their former position, and we are finalizing all of the documents. i The other iosuo that we did not talk about was how we would fund these improvements, Originally, when the bridge projects I were offered to the City of Denton back several yoare ago, it was our intention to use fund balance to fund all of this project. Obviously, because of the difficulties we encountered with the right-of-way acquisition, that plan was put on hold a number of years ago. We have been looking at funding options in a number of different places. we have discussed a number of options with j Finance, and our recommendation is to use excess interest from i the original U,Si 380 funding. As you know, the now ruling by the Highway Department snakes the original $4000000 tot U,$, ~ 380 almost totally available for other projeato. However, that original bond issue said that the funds could be spent only for U.11. 380, Since,the funds were acquired a 'number of years ago, thoy have been invested, There is ample interest, and we could still retain !,he $900,000 in this fund for use when U .S. 300 is built,, However, in the interim, it will be our°auggestion that we use the excess` interest to acquire the 'right-of-way and to actw,A ly help fund the cost of the bridge improvements on Masch 1 Branch Road, t N.r.yMy ast:,y~ JET ' F2i:4kIlPJA{ 'd Lloyd V. As we understand it, they are proposing to replace the bridge as a_two lane structure just as it existed before, In Fact, in terms of height Interference, this bridge will actually be lower since It will be a girder or box girder bridge, and it will not have any superstructure, The old bridge was a truss type of bridge that had a super structure some six or seven feet above the pavement. Since it isonly a replacement and since the existing Masch Branch Road would be. operated in the same fashion that It has been for a number of years, we think this meets the criteria as you explained it to us, Therefore, based on the discussions we had and the knowledge that it is just a replacement structure and not the r basis for any kind of enlargement to the road facilities, we I assume you no lodger have any difficulty with this project and will proceed accordingly. Inquiry from FAA Concerning the Masch Branch Road k project Although we are still trying to sort through all of the pparticulars, we have gotten a little moro' information regarding linnie's inquiry of Tuesday evening which we wanted to share with the City Council, We will be prepared to give you a more comprehensive briefing at your Council meeting of June 21, Following our meeting of Tuesday evoning, we received the referred to letter from the FAA on Wednesday afternoon, i have attached a copy of that letter which states that If the City { proceeds "with plans to build a freeway that asses through the north clear zone of the Denton Municipal Airport.,,Jt could result In a determination of noncompliance with its obligations f to the Federal Aviatiur, Administration," Such a finding of noncompliance could moan that we would be ineligible to receive i federal funding for future Airport projects, Attached to the letter., from the FAA, was a letter sont to Hairy Persaud on April 291 1986, As you will noto, that letter recommends that the thoroughfare plan of the City be amended for two reasons, First, the roadway is shown in `the clear zone is normally; discouraged by the FAA, An'd secondly,` a which concern is expressed regarding lighting, This first letter was sent to Harry during the final stages of the preparation of the Denton Development Plan and was judged to be matters which could tie o&sily handled during the design phase of any roadway project* No other communication, Formally Ur Informally, was directed to the City staff regarding this matter until the most , recent latter was received, It appears that the recommendation 3 of the Planning and Zoning Comilission for the adoption of the I now Plan prompted the latest letter. I 1 I H d Mayor and Members of City Council Julie 10, 1988 Page 2 Tho city staff has conferred by phone today with representatives from the FAA, and a meeting has been scheduled for early next week to review this entire project, Obviously, other folks with special interest regarding this roadway are communicating directly with the FAA. Complicating this entire matter, is the fact that the `City has been working for approximately three years on a $360,000 grant from the State Highwayy Department to replace two bridges on Maseh Branch Road which are located in the subject clear zone, As Council is aware, we are also in the midst of condemnation proceedings to get the necessary right-of-way for the final step for this project to proceed, It is unknown whether the latest inquiry will jeopardize this long planned project, but it will be one of the questions which we pose to the FAA on Tuesday, f ' Th,, City staff is perplexed about this recent stance taken by the FAA since the alignment location of Masch Branch Road has not changed from the Thoroughfare Plan contained within the I Denton Developnient Guide as adopted in 1982, Furthermore, during the preparation of the City's Airport Master Plan, it was noted that the existing Thoroughfare plan was consistent I with the Master Airport Plan, This latter document was l formally adopted and approved by the FAA, ~ . As soon as wo have more information, we will visit with the f Council about this Item, At this point, this does not appear to be a serious problem unless the FAA will not allow us to proceed with the bridge project 'arid reopon a road which was in existence long before the clear zone for the Airport was established. ABSENT; Mayor Stephens 11 The Council held a discussion regarding a draft of the Denton Development Plan. Mitchell Turner, Land Use planning Committee, presented background information regarding the Plan, He stated that the plan had been presented at five neighborhood meetings And to various groups and organizations in the Citys Turner then reviewed the major new policy areas of the Plan` which included intensity, housingp transportation, economic development? parks and recreation, urban design, balanced growth, compact growth and implementation. He indicated that team captains from the Committee were present to answer any questions the Council Members might have. J Council. Member Alexander questioned that Dallas Drive was not f i mentioned as an official city entranceway, He asked for { clarification of that. Harry Persuad, urban Planner# stated that Dallas Drive would be included as a major entranceway, j A question and answer period followed dealing with Council's questions of the Plan, The Council held a discussion of procedures for j preparing Appendix A of the Denton Development Plan. Harry Persuad, Urban Planner, stated that new zoning MAPS would need to be developed with the Denton Development plan which > would incorporate the City into low moderate high intensity areas, He presented three options to the Council regarding 'the r preparation of Appendix A# option A would appoint a task force ; which would prepare the intensity` maps The Planning And Zoning Commission and the City Council would review the maps, zoning 'cases would be presented to the Planning and zoning Commission and then to the City Council separate from the zoning loops, under this option, a zoning case would take approxiMately 15 weeks.
