All of the invoices for the joint City Council/School Trustee
ele~.ion held in May are finally accounted for. I have
attached for your information copies of all the invoices
documenting the expenditures for the election. As was the case
last year. I was able to coordinate election activities and
still maintain my usual office routine. The City of Denton is
requesting reimbursement of half of the hours I spent working
solely on the election. on one occasion. I did require the
assistance of another office worker and her time is documented
also.

For the 1989 election, I will be requiring all election workers
to attend an election school. For prior elections, only the
election judges for each district were required to attend the
school. I feel the issue of correct polling places can be
better addressed if done with all involved rather than only a
few. Voter registration lists dealing with split county
precincts and precincts outside the city limits will be
highlighted so that an election worker will be even more aware
of the necessity to double check correct polling places and
eligibility for a particular election for the voter.

r Dear Sir:
This submission is made on behalf of the Denton Independent School District,
1307 North Locust, Denton, Texas 76201. The submission has been prepared by
Gilbert Bernstein, Assistant Superintendent for Business Affairs for the Denton
Independent School District.
In support of the submission and in compliance with Section 51.10 of the
applicable regulations, I respectfully submit the following information for
consideration:

1. Enclosed with this letter is a copy of a contract of the Denton
Independent School District Board of Trustees to continue to
contract with the City of Denton for its regular trustee election
on May 6, 1989.
(a) The only change in this contract from the previous contract is
a change in voting location for those precincts formerly voting at
s the American Legion Hall, 629 Lakey Street, Denton, Tx.
(b) Portions of Precincts 1K, 1D, 1J, 4L, and 40 (as described in
the contract), all of Precinct 18, and all of Precinct 1V
E 1 currently vote at the American Legion Hall, 629 Lakey Street,
I Denton, Tx. These precincts will now vote at the Mcrtin Luther
I King Recreation Center, 1329 Morse Street. Denton, Tx. A dap
showing the location of this center is enclosed.
2. This contract was adopted at the regular meeting of the Board of
Trustees on January 10, 1989.
3. The authority responsible for the change is the Board of Trustees
pursuant to an official vote of the Board.

4. The effect of this change is to shift voting in the stated
precincts to a newly constructed and convenient facility owned by
the City of Denton.

3. The proposed change has not been put into effect.
6. It is not anticipated that this change will have any inpact upon
the voting rights of any individual within the Denton In0pendent
School District.
7. The Board's decision to make the above change in voting location
was made after an open vote in a regular meeting of the Board.
Under Texas law, %embers of the public received the following
notice: Meeting notice posted at the administration building;
notice was mailed to Denton radio station KDNT, North Texas State
University radio station KNTU; notice was mailed to Denton Record. `
Chronicle and Denton County Enterprise, both local newspapers, as
well as North Texas Daily, our university's newspaper. Notice was
also mailed to anyone on the agenda mailing list. The change was
also advertised in the legal section of the Denton Record Chronicle.
A copy of the agenda that was posted for the January 100 1989 trustee
meeting is also enclosed.
In this submission, it is the district's intention to supply all required
information and other facts that are relevant to the question. The source of
this information is Mr. Gilbert Bernstein, assistant superintendent, on behalf
of the district.

A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF DENTON
AND THE DENTON EFFECTIVE DAOOL DISTRICT FOR A JOINT ELECTION;
AND PROVIDING AN WHEREAS, Chapter 271 of the Texas Election Code authorizes
political subdivisions to conduct joint elections; and
WHEREAS, the Board of Trustees of the Denton Independent
School District have requested the City Council of the City of
jenton to the School District election;oand held May 6, 1989,
WHEREAS the Cit Council, havingg given due deliberation to
the proposal for a loint,.election, is of the opinion that such
joint election could adequately and conveniently serve the voters
of the City of Denton and facilitate the orderly conduct of such \
elections; NOW, THEREFORE,
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF DENTON, TEXAS:.
SECTION I. That the Mayor is hereby authorized to execute an
agreemen etween the City and the Denton Independent School Dis-
trict providing for the joint conduct of the may 6, 1989 regular
municipal election and the regular election for trustees of the
Denton Independent School District, a copy of such agreement

COUNTY OF DENTON § DENTON INDEPENDENT SCHOOL DISTRICT
I
WHEREAS, the City of Denton, Texas ("City") will hold an
election for City Council Members on Saturday, the 6th day of
May, 1989; and
WHEREAS, the Denton Independent School District ("District")
will also hold an election for school trustees on Saturday, the
6th day of May, 1989; and
WHEREAS, pursuant to Section 271.002 of the Election Code,
the City and the District desire to enter into an agreement to
hold their elections jointly in the election districts that can

1. POLLING PLACES
The parties agree to hold their elections jointly in the
election precincts that can be sierved by common polling places.
Absentee voting shall be conducted for both entities by City
officials at the Denton City Hall, 215 Eatt McKinney, Denton,
Texas. District polling places shall coincide with City polling
places. The Election Districts and their respective polling
places shall be as follows:

II. BALLOTS

At each polling place a single ballot form shall be used
which will show all the offices to be voted on in the elections
of both parties at that polling place; provided, however, that no
voter shall be provided a ballot containing any office on which
j the voter is ineligible to vote. In such cases, separate ballots
will be provided to voters residing in areas where boundaries are
not coextensive.
The City Secretary of the City shall prepare the ballot for
the joint election for both parties, and shall cause to be printed
and prepared the cards, inserts and other printed material
F necessary to set the ballot on the voting machines, and shall
cause to be listed the names of the candidates for Trustees of

the Board of Trustees of the District, said list and designation
to be separate and apart from the listing of the candidates for
City Council of the City, which shall also be listed on the
ballot.
The City Secretary shall furnish a separate jet of tally
sheets and return forms for use by the presiding officers in the
various precincts, so that the results of the election of Trustees
of the District shall be returned on a separate tally sheet,
placed in a separate envelope, sealed and so designated, and like-
wise,, the returns made by the presiding officers of the election
for City Council of City shall be separately returned on separate
tally sheets and in separate envelopes, sealed and designated.
All tally sheets and returns for the election of Trustees for the '
District shall be delivered directly to the Secretary of the
Board of Trustees of the District or other chief election official
of said District. All tabulations of the results of the election
for Trustees of the Board of Trustees of the District shall be
conducted by the Judge of the central counting station. After
completion thereof, all such tabulations, tally sheets and
returns related to the election of the Trustees of the Board of
Trustees of said District and said Board will assemble such
tabulations, and make the official canvass of the election and
the final declaration of the results thereof.

j III. ELECTION OFFICERS
One set of election officers shall be appointed by the City
to conduct the joint election, and any person who is qualified to
serve as an election officer in the election of either one of the
parties may be appointed to serve in the joint election. The
election officers shall be named and specified in the ordinance
or resolution of each party calling such election. The District
shall prepare its election order and forward a copy of same to
the attention of the City Attorney, 215 East McKinney, Denton,
Texas 76201 not later than seven (7) days prior to the meeting at
which the election is to be ordered.

IV. RECORDS
i
All records pertaining to the election of the parties shall
be combined in any manner convenient and adequate to record and
report the results of each election. Returns shall be made to,
11 and the canvass made by the governing board of each of the
i partiea. The officer designated by law to be the Custodian of
the Records for the City is hereby designated as the Custodian of
the Combined Records.

V. EXPENSE
The reascnable and necessary expense of holding said joint
election will be paid by the City, except that ono-half (1/2) of
the expense shall be paid to the City by the District upon receipt
of satisfactory billing and invoices reflecting the total of such
expense. This expense shall include the hiring of a part-time
clerk to assist the City Secretary with her duties while the
election process is in effect.
This agreement shall not apply to run-off elections or bond
elections held by either party.
VI. FILING
it is understood and agreed that candidates shall file in the
appropriate jurisdiction as provided by the Election Code.
VII. EFFECTIVE DATE

This a reement shall become effective upon the adoption by the
` governing body of each of the parties of a resolution approving
this Agreement and shall be effective each successive year there-
after until terminated in writing by either party; provided
ever, in the event that either party shall forego a joint election
F despite being eligible to participate pursuant to Section 271.002,
Vernon's Texas Election Code, that party shall notify the other
party at least ninety (90) days prior to the election date.
' A resolution incorporating the terms of this Agreement has
been adopted by the City Council of the City and the Board of
Trustees of the District, and in accordance with Section 271.002,
Vernon's Texas Election Code, executed the same (plicate
f iginals pursuant to their authority on the * day of
1999.

On behalf of the City of Denton, Texas, we are providing an
original and one copy of the City's submission of "changes
affecting voting" for the City Council election to be held on May
6, 1989. This submission is being made under Section 5 of the
i Voting Rights Act of 1965, as amended, and in accordance with the
provisions of 28 C.F.R. 51,

May 6, 1Q89 City Council Election
The May 6, 19890 City Council election for which this submission
is being made, will be held to elect four members of the seven
member City Council from the City's tour single-member districts,
in accordance with section 2.01 of the City's Cnarter. The present
four single-member districts were established by ordinance 85-25,
which was precleared by your department on April 1986. There
has been no subsequent change in the boundaries of those districts,
except for the expansion of the districts resulting from the
annexations herein submitted. As in 'he preceding two years, the
City and the Denton Independent School District will conduct joint
elections at the City's four designated polling places. The
procedures for that joint election were precleared by your
Department on May 6, 1988. There is no change relating to the
joint election except for a change in the location of the polling
place for Distr':t 1, as noted below.

annexation ordinances and proposes to enact one additional
annexation ordinance before the May 6, 1989, election, that have
not been previously submitted and precleared. information as to
the locations of the annexations and the changes in population
resulting therefrom are included. As shown in each annexation

A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF DENTON
AND THE DENTON INDEPENDENT SCHOOL DISTRICT FOR A JOINT ELECTION;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Chapter 271 of the Texas Election Code authorizes
political subdivisions to conduct joint elections; and
WHEREAS, the Board of Trustees of the Denton Independent
School District have requested the City Council of the City of
Denton to conduct its regular election to be held May 6, 1989,
jointly w4:h the School District election; and
WHEREAS the Cit Council, having given due deliberation to '
the proposal for a joint election, is of the opinion that such
joint election could adequately and conveniently serve the voters
1 of the City of Denton and facilitate the orderly conduct of such
elections; NOW, THEREFORE,
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF D£NTON, TEXAS:

WHEREAS, the City of Denton, Texas ("City") will hold an
election for City Council Members on Saturday, the 6th day of
May, 1989; and
WHEREAS, the Denton Independent School District ("District")
will also hold an election for school trustees on Saturday, the
6th day of May, 1989; and
WHEREAS, pursunnt to Section 271.002 of the Election Code, ,
the City and the District desire to enter into an agreement to
hold their elections jointly in the election districts that can
be served by common poling places; NOW THEREFORE,

V. EXPENSE
The reasonable and necessary expense of holding said joint
election will be paid by the City, except that one-half (1/2) of
the expense shall be paid to the City by the District upon receipt
of satisfactory billing and invoices reflecting the total of such
expense. This expense shall include the hiring of a part-time
clerk to assist the City Secretary with her duties while the
election process is in effect.
This agreement shall not apply to run-off elections or bond
elections held by either party.
VI. FILING
It is understood and agreed that candidates shall file in the
appropriate juriadiction as provided by the Election Code.
VII. EFFECTIVE DATE
This agreement shall becoue effective upon the adoption.by the
f governing body of each of the parties of a resolution approving
this Agreement and shall be effective each successive year there-
after until terminated in writing by either party; provided how-
l ever, in the event that either party shall forego a joint electica
despite being eligible to participate pursuant to Section 271.002,
Vernon's Texas Election Code, that party shall notify the other
party at least ninety (90) days prior to the lection date.

Trustees of the District, and in accordance with Section 271.002,

I. Enclosed with this letter is a copy of a resolution of
the Denton Independent Schorl Di strItt Board of Trustees
to continue to contract wlth the City of Denton for its
regular trustee election on May 6, 1989.
j (a) A copy of the current contract with the city is
attached. The only change in this :ontract from the
previous contract Is a change in voting location for
those precincts formerly voting at the American Legion
Hall, 629 Lakey Street. Denton, Tx.
(b) Portions of Precincts IK, ID, 1J, 4L, and 4G (as
described In the contract and resolution), all of
Precinct IS, and all of Precinct 1V currently 'rote at
j the American Legion Hall. 629 Lakey Street, Denton, Tx.
These precincts will now vote at the Martin Luther King
Recreation Center, 1329 Morse Street, Denton, Tx. A map
showing the location of this center is enclosed.
f 2. This resolution was idopted at the regular meeting of
r f the Board of Trustees on January 10, 1989.
3. The authority responsible for the change Is the Board of
i Trustees pursuant to an official vote of the Board.
4. The effect of this change is to shift voting In the

The Beard's decision to make the above change In voting
location was made after an open vo O in a regular
meeting of the Board. Under Texas law, members of the
public received the following notices tieeting notice
posted at the administration buildingl notice was mailed
to Denton radio station KONT, Borth Texas State
University radio station KNTUI notice was mailed to
Denton Record Chronicle and Denton County Enterrrise
both local newspapers, as well as North Texas Daily and
The Lass-o. our universities' newspapers. The change
was also advertised in the legal section of the
Denton Record Chronicle. A copy of the agenda that a,as
posted for the January 10, 1989 trustee meeting Is also
enclosed.
In this submission, it is the district's intention to supply
all required information and other facts that are
relevant to the question. The source of this
Information Is Mr. Gilbert Bernstein, assistant
superintendent, on behalf of the district.

WHEREAS, a request for annexation for the property described
in Exhibit "A", a copy of which is attached hereto and incorpo-
rated by reference herein, was introduced at a regular meeting of
the City Council of the City of Denton, Texas, on the petition of
the city of Denton; and
WHEREAS, an opportunity as afforde a a ublic hear ngg inheld
for that purpose on the jj day of 9 1988 the
Council Chambers for all interested per ons to state their views
and present evidence bearing upon the annexation provided by this
ordinance; and

I NOW9 THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION I. That the tract of land described in said Exhibit
1 ! "A's e, an the same is hereby annexed to the City of Denton,
Texas, and the same is made hereby a part of said City and the
land and the present and future inhabitants thereof shall be
entitled to all the rights and privileges of other citizens of
said City and shall be bound by the acts and ordinances of said
City now in effect or which may hereafter be enacted and the
property situated therein shall be subject to and shall bear its
prorata part of the taxes levied by the City.

such section or part shall in no wise affect, impair or invalidate
the remaining portion or portions thereof, but as to such remain-
ing portion or portions, the same shall be and remain in full force
and effect; and should this ordinance for any reason be ineffective
as to any part of the area hereby annexed to the City of Denton,
such ineffectiveness of this ordinance as to any such part or parts
of any such area shall not affect the effectiveness of this ordi-
nance as to all of the remainder of such area, and the City Council
hereby declares it to be its purpose to annex to the City of
Denton every part of the area described in said Exhibit "A" of this
ordinance, regardless of whecher any other part of such described
area is hereby effectively annexed to the City. Provided, further,
that if there is included within the general description of terri-
tory set out in Section I of this Ordinance to be hereby annexed
to the City of Denton any lands or area which are presently part
f of and included within the limits of the City of Denton, or which
are presently part of and included within the limits of any other
City. Town or Village, or which are not within the City of
Denton 's jurisdiction to annex, the same is hereby excluded and
excepted from the territory to be hereby annexed as fully as if
such excluded and excepted area were expressly described herein.
SECTION IV. This ordinance shall be effective immediately

All that certain lot, tract or parcel of land lying and being
situated in the County of Denton, State of Texas, and being part
of the M. Forrest sui Abst. No. 417, and also being part of
Lot 1 and 2, Block C of the Morreau Forrest Subdivision, and more
particularly described as follows:
Beginning at a point in the present city limits, said point being
an inner ell corner of the present city limits as described in
Ordinance No. 83-134, said point lying 250.0 feet north of and
perpendicular to the centerline of F.M. 426 (McKinney Street),
said point also lying in the west boundary line of the Meadows
Addition, an addition to the City and County of Denton, State of
Texas as recorded in Cabinet E. Page 60 of the Plat Records of
Denton County, Texas said point also lying in the east boundary
