dedicated street located wit n the corporate limits of
Grantee. A portion of the street crosses a portion of the real
property presently owned by W. H. Smith ("Grantor"), as '
described herein ("PropertyIn order to formally record the
existence of the publicly dedicated street in the Real Property
Records of Denton County, Texas, Grantor acknowledges by
{ execution of this deed that: (1) one or more of the Grantor's
predecessor in title to the Property have set apart and
dedicated the Property for public use for street purposes; (2)
the dedication of the Property for street purposes was accepted
by the public by reason of the use, maintenance, or improvement

Recitals. ,
The City of Denton, Texas ("Grantee"), a municipal corporation
of the State of Texas, is proposing to make certain j
improvements to Bonnie Brae, an existing, publicly dedicated
street located w t m the corporate limits of Grantee. A
portion of the street crosses a portion of the real property
presently owned by T.I. 239 B Joint Venture ("Grantor"), as
described herein ("Property In order to formally record the
existence of the publicly dedicated street in the Real Property
Records of Denton County, Texas, Grantor acknowledges by
execution of this deed that: (1) one or more of the Grantor's
predecessor in title to the Property have set apart and
dedicated the Property for public use for street purposes; (2)
r 1I the dedication of the Property for street purposes was accepted
br the public by reason of the use, maintenance, or improvement
j thereof; (3) there has been no abandonment of the Property for
public use since the date of dedication; and (4) by reason of
such dedication, Grantor has no claim, right, or title superior
to that of the public in the use of the Property for street t
purposes.
