APPEALS, VARIANCES AND SPECIAL EXCEPTIONS 1. Sign Sward of Appeals Created. There is hereby created a Sign Board of Appeals consisting of five members. Members shall be appointed by the City Council for a two year term, except that the Council shall designate two members of the initial Board to serve one year terms, or until their successors are appointed. The council may remove a board member for cause on a written charge after a public hearing. A vacancy an the board shall be filled for the unexpired term. The Council may appoint two alternate members to serve in the absence of one or more of the regular members when requested to do t so by the city Manager. An alternate member serves for the same period as a regular member and is subject to removal in the same manner as a regular member. A vacancy among alternate members is filled in the same E manner as a vacancy among the regular members. f' The acard shall adopt rules to govern its proceedings. Meetings of the Board shall be hold at the call of the chairperson and at other times as determined by the Board. The chairperson or acting chairperson may administer oaths and compel the attendance of witnesses. All meetings of the Board shall be open'to the public. i 1 Each case before the Board must be heard by at least j four members. The Board shall keep minutes of its P proceedings that indicate the vote of each member on each y question or the fact that a member is absent or fails to vote. The Board shall keep records of its exas,inations and other official actions. The minutes and records ' shall be filed immediately in the !bard's office and are public records. The concurring vote of four members of the Board is necessary to: (1) reverse an order, requirement, decision, or determination of an administrative officialt (2) decide in favor of an applicant on a matter on which the Board is required to pass under a zoning ordinances or (3) authorize a variation from the terms of the sign ordinance. 2. He Introduced Mrs, Irene Price who presented the NAACP's request for the use of the park as well as the department's mobile stage. She asked that all fees i which may be owed to the City as a result of the fundraising activities be waived. The fundraising will include the sale of food and soft drinks. Tom Judd moved that the Park Board recommend to the City Council that the NAACP be allowed the use of Fred Moore Park and the City's mobile stage for the purpose of a voter registration and membership drive and fundraising activities and that all fee requirements be waived, Catherine Bell ascended the motion, and the motion was passed with a unanimous vote, Steve said the second item to be considered was the possibility of amending Sec. 15-3, Use of Public Parks; Concessions, of the City of Denton Code of Ordinances which requires a recommendation from the Park board to Council when a request is received for a waiver of the ordinance. Since there have been a number of requests from non-profit groups to use our parks for fundraiaing efforts and each one then requests a waiver from the fees, this presents a burden to the group or citizen to discuss the concern with staff and then need to go to both the Park Board and Council for approval, The consensus of the Park Board members was to let staff make recommendations with the Park Board serving as an appeal board if a request is denied. Williams, representative of the local chapter of the NAACP, for the use of Fred Moore Park for a voter registration and membership drive and fundraising activities which will include the sale of barbecue and soft drinks. Harrell, City Manager SUBJ: RECEIVE UPDATE ON THE STATUS OF THE WORK BEING PERFORMED ON ROBINWOOD TO DETERMINE THE SOURCE OF ODORS RECOMMENDATION: No recommendation is required, input and direction only BACKGROUND: Mr. Truman Harp and two other neighbors in the Robinwood neighborhood had expressed a concern to Council about odors that they were experiencing. Mr. Harp indicated that he felt that the odor was originating from the sanitary sewer line that is adjacent to his property II line. . i Based on this complaint, the Council directed staff to look into the problem and try to determine the source of the problem. Staff and Austin Water Attorney have, as directed by the I City Council, made major changes to the draft joint ownership contract. Some of these changes are: as Clearly identify that Denton will only sell 49% of the ownership of the plant, b. Eliminated the option of the sale of an additional t' 19%, C. Eliminated provisions relating to sale or sharing of reserve capacities, d. Eliminated any reference to Denton selling any participation in future expansion. (This leaves participation in future expansions a possibility, but will be dependent upon how well this proposed participation works), ` e. Changes the construction and operating committee from a controlling/approval group, to an advisory/review group, f. Hae City Manager City of De on 215 East X6xinney street Denton exas 76201 Res Employment Contract (106001s Billing File) I Dear Mr. Harrell: This will confirm our agreement that the firm of Lloyd, Gosselink, Fowler, Blevins & Mathews, P.C. will represent the City of Denton with respect to the analysis of contracts between the City and the Upper Trinity Regional Water District pertaining to the purchase of treated water from the City and use of its transmission lines on an interim basis, and the construction of a joint use, jointly owned water treatment plant on Lake Ray Roberts. At the present time we will work under the direction of you and the City Attorney, Debra A. Drayovitch. Additionally, we will represent the City of Denton in any other matter requested., provided we do not have a conflict of interest. Following our evaluation of the facts and estimated costs associated with this or other matters, upon which we represent you, we may request security against future billings. Failure to deliver the requested security within fifteen (15) days after receipt of a written request may result in termination of this firm's representation. At the present time our firm has a fee structure ranging up to $195.00 per chargeable hour for attorneys' services, depending on the individual involved and hirs or her level of experience and expertise. Additionally, we utilize briefing clerks and paralegals to perform those tasks not requiring the time of an attorney, Briefing clerk and paralegal time is billed at an amount not to exceed $50.00 per hour. We will submit all out-of-pocket expenses incurred for reimbursement, with a fifteen percent (158) overhead charge added. Uzually we ask the client to bay directly all filing fees, charges for consultants, etc. due to the size of such fees and to avoid the client incurring our overhead charge. Wilkinson, Engineering Tech II/Right ofWay SUBJECT: Mayhill Road Dedication and Abandonment s Mayhill Road from I.H. 35 E north to Colorado Boulevard was j reconstructed in 1987 as part of the Southern Hills Development. At that time, Mayhill Road was realigned with the t state School road bridge under I.H. 35 E and to intersect Colorado Boulevard at a right angle, i The current adjacent property owners Federal Deposit Insurance Corporation, Andrew Corporation, and Mayhill Road Realty have requested the old alignment abandoned. In exchange for this abandonment, the remaining necessary right of way for the current Mayhill Road location will be dedicated. Attached is a map illustrating the tracts to be abandoned and dedicated, The current right of way and street is superior to the old alignment. It is recommended that the dedications and abandonment be approved at this time. Also, after approval by D.R.C, and P & Z, it was determined that a utility easement needs to be retained. The circular drive is not to be used by parents or faculty, Motion was seconded by Mr. Glasscock and unanimously carried (4-0). Mr. Kamman returned to the meeting, IV, Consider the abandonment of a portion of Mayhill Road near I-358, ti Mr. Clark stated that the old alignment of Mayhill Road was off-set from I-35. When Southern Hills was planned, a new route was established, Mr. Morris has advised that since the City has accepted use of the road and It is used by traffic, then the other portions should be abandoned. The portion to be abandoned will be split between the three adjacent property owners, The present configuration keeps the property off the tax rolls and keeps the adjacent properties chopped up. All utilities have been removed, Staff still wants to have the right turn lane fixed, It is too sharp for semis and trucks. The-rest of the road is fine. E It was moved by Mr, Kamman, seconded by Mr, Appleton, and E unanimously carried (5.0) to recommend approval of the abandonment of a portion of Mayhill Road, V. Hold a public hearing and consider an ordinance amending the Subdivision and Land Development Ordinance to enable the Citizen's Traffic Safety Support Commission (CTSSC) 3 to make a final determination concerning an appeal from a Development Review Committee decision concerning driveways and parking lots, Mr. Clark said that the Commission has seen some attempts j to streamline processes. Driveways and curb cuts come up a lot. They are technical issues, The CTSSC is familiar with with these issues, It is frustrating for them to only get to make a recommendation. The developers complain of all the different groups that they have to go through Giving final approval to the Traffic Safety Commission would also ease the Planning and Zoning Commission's workload. The staff is recommending this change, , It is a positive step. Driveways and curb cuts do not control land use, Normally, if the CTSSC denies a case, it is not appealed further. AS A PUBLIC STREET; RESERVING A UTILITY EASEMENT THEREIN; ANU DECLARING AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission has recommended C that a portion of Mayhill Road between interstate Highway 35E and f the Union Pacific Railroad Tracks be abandoned and vacated as a f public streets and WHEREAS, the City Council has determined that portion of the street being abandoned and vacated is no longer needed for public E use; and WHEREAS, the fair market value of the street easement has been determined and received, as required by section 272.00. of the Local Government Code; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINSs SECTI011_,. That the 60.0 foot wide public street right-of-way of Mayhill Road described in Exhibit A, (and labeled as tracts, 3, r 4, 81 9, and 14), attached to and incorporated into this ordinance E by reference, is abandoned and vacated as a public streett pro- vided, however, that there is expressly reserved and excepted from vacation and abandonment in the property described, a utility ease- ment for the purpose of constructing, reconstructing, repairing, 3 and maintaining public utilities. ; SECTION II; That by operation of law the City of Denton's property interest in the street easement abandoned and vacated t shall revert to the abutting property owner, whether one or more, and the City of Denton releases all claims to the use of the f property for street purposes.
