The City of Denton will further develop 350 acre North Lakes Park 11 to Include a playground,
4 lighted softball fields, I lighted soccer field, 4 unlighted soccer fields, 1 mile trail,
fishing pier, pavilion with 11 picnic tables, 5 benches, 5 picnic tables with grills,
concession/restroom building, utilities and signs,
Denton North Lakes Park It is located east of IH 35, north of US 390 on Bonnie Brao`at
Windsor Drive.
Pre•agreemont costs incurred from November 7, 1991 to the date of project approval in the
amount not to exceed $2,000,00 are allowable,

Part III - Projuct Assurances
A. Applicable Circulars
The State shall comply with applieabin rogula Ions, pollolos, guidelines and roqulremonts including the

State and Local governments), and TRACS (Texas Review and Comment System) as they relate to the application,
acceptance and use of State funds for grant assisted projects.
8. Project Application
1. The Application for Stale Assistance bearing the same project numbtr as the agreement and associated

2. The Participant possesses legal authority to apply for thn grant and to finance and construct the
proposed facill ties, A resolution, motion, or similar action has bnun ouly adopted or passed
authorizing the filing of the application, including all understandings and assurances container)
therein, and directing and authorizing the person identified as the official representative of the
Participant to act In connection with the application and to provide such additional information as
may be required, 1

C. Project Execution

plans and specifications for the project, the Participant shall bring the projort to the point of
recreational usefulness agreed upon by the Participant and the Director or his designee,
6. The Participant will provide for and maintain competent and adequate architectural onglnaoring
supervision and inspection at the construction site to ensure that the completed work conforms with
the approved plans and speoiflcationoi also. It will furnish quarterly pprogress reports and such other
under the provisions of Section 7, Article 601h, M.C.S. (3.8. 6111). The Participant will he
responsible for conducting iirspnetions to ensure complianco with these specifications by the contractor.
1, The Participant will comply with the terms of Title 11 and Title Ill, the Uniform RelocAtlon Assistanco
and Real Property Acquisition Policies Act of 1970 (P,L. 91.646) 94 Stat. 1094 (1970), and the
applicable regulations and procedures Implementing such Act for all real property acquisitions and whsre
applicablo shall assure that the Act has been complied with for property to be dovolopod with assistance
under the project agreement.

flood hazards, txooutive Order 11288, relating to the peavantlon, control, and abatement of water
pollution; Executive Order 1100 , relating to thu protection of wetlands; and tho flood Disaster.

9. The Participant will Assisi the Department in its complianca with Section 106 of the National Historic
Proservation Act of 1906 and the Archeological and Historic Preservation Act of 1966 by
(a) consulting with the Texas Historical Compission on the conduct of Investigations as necessary,
to identify properties listed In or eliglbin for Inclusion in thr National Rogistor of Historic
Piacos that are sub{oct to eftecls by tho activity, and to notify the Departmm t of the
existence of any such properties, and by
(b) complying with all requirements established by the Department to avoid or mitigate adverse
effects upon such properties.

D, Construclinn Contracted for by the Participant Shall Heat the Following Requirements,
1. Contracts for construction in excess of $5,000 shall be awarded through a process of competitive
bidding involving formal advertising, with adequate purchase description, "sealed bids, and public
openings. Copies of All advertisements, bids and e copy of the cantraot shalt be provided the Director.
2, the Participant shall Inform all bidders on contracts for construction that Program funds are being
used to assist in construction,
3, Written change girders shall be issued for all nocansary changes In the facility being constructed.

4. Contracts for eonstructlon shall include a provision for compliance with the Copeland "Anti -kickback"
Act (18 U.S.C, 814) as supplemented by Department of Labor regulations (29 CFR, Part 3),6

subccntract in connection with this project shall have any financial or other personal interest In
any such contract.

have a financial or other parsonal interest other than his employment or retention by the State or
local governmont, In any contract of subcontract in connection with this project. No officer or
omployeo of such interest Is openly disclosed upon the public records of the State, and such officer,
employee or person has not participated in the acquisition for or on behalf of the Participant.
F, Project Costs
\ Project Costs eligible for assistance shell be determined upon the basis of the criteria set forth by the
federal Land and Water Conservation Fund Program Manual and }louse Bill 233, Acts of the 66th Legislature,
1979.
6, Project Administration
1, The Participant shall promptly submit such reports and documantation as the Director may request.

M. Potention and Custodial Requiremonts for Records
1, Fimmiclal rocorde, supporting documohts, statistical records, and all other records pertinent to this
grant shall be retained for it period of three years after final payment; except the records shall be
retained beyond the threw-ysar period If audit findings have not been resolved.
2. The retention period starts from the data of the final expenditures report for the project.

d, The Director, State Comptroller of Publlc Accounts, State Auditors Office, or any of their duly
authorized representatives, shall Nava access to any books, documents, papers, and records of the
Participant which art) purtinent to a specific piojoct for the purpose of makiry audits, oxaminatlon,
excerpts and transcripts,
1. Project Terminatlon
1. The Director may temporarily suspend State assistanca under the project pending ;oreectlve antion by
the Participant or ponding a decision to terminate the grant by the Deportment,
2, Tho Participant may unilaterally terminate the project at any time prior to the first payment on the
project. Aftur the initial payment, the project may be terminated, modified, or amended by the
Participant only by mutual agroomont with the Department,
3. The Director may terminate the project In whole, or In part, at any time before the date tf completion,
whenever It is detormined that the Participant has failed to comply with the conditions of the grant.
The Director will promptly notify the Participant In writlnp of the dotermination and the reasons for
termination, together with the affective date, Payments made to the Partiulpanl or recoveries by the
Deportment undor projects torminated for cause shall be in accord with the legal rights and liabilities
of the parties,
4, The Director or Participant may terminate grants In whole, or In part at any tlmo before the data of
completion, when both parties agree that the continuation of the project would not produce beneficial
results conmoneurato with tho further expanditira of funds, The two parties shalt-agree upon the
termliiatlon conditions, including the offootivo data and, in the case of, partial termination, the
portions to be terminated, The Participant shall not Incur new obligations for the talmlaated portion
after the effective date and shall cancel as many outstanding obligations as possible, the Department
may allow full credit to the Participant for the State sharo of the nencancullable obllggatlohs, properly
incurred by the Participant pin writing of the determination and the reasons for tormination, together
with the effcctivo data. Payments mddo to the Participant or recoveries by the Department under
projects terminated for cause shall be In accord wllh the legal rights and 1tabllltioe of the parties.

5. Termination either for cause or for convenience requires that the project In question he brought to
a state of recreational usefulness agreed upon by the Participant and the Director, or that all funds
provided by the Department he returned,
J. Section 504 Guidelines for Assisted Park and Recreation Programs and Activities
Pursuant to the Department of Interior Office of Equal Opportunity Section 504 Guidelines (43 CFA 17,
Subpart 4), the following are required of all grant Participants:
1. Assurances - Participants are required to provide written assurance that their programs are to be
operated in compliance with 43 CFR 11, Subpart D,
2. Self-evaluation - All Participants are required to evaluate their programs, activities, policies and
practices to determine what actions need to be taken in order to comply with Section 504. This self
evaluation process must include Interested persons, including handicapped persons or organizations
representing handicapped persons. If the Partie'apant employs 15 or more full or part-time employees,
a copy must rariW on file and pvallaole for pcblic inspection for -3 ynors after it is completed.

Thn Texas Parks and Wildlife Commission, by authority of Sections 13,302 through 13,312, Texas
Parks and Wildlife Code, has adopted Rule 127,50.08,001, and under the authority of Section
MOOS, Texas Parks and Wildlife Code, has adopted Rule 127,60.09;661, to read as follows:
.001. Policy, (a) It is the Comsisslon's policy that the Department shall administer local
projects In accord with the following guidelines, with interpretation of Intent to be made to
provide the greatest number of outdoor recreational opportunities for Texas In accord with
priorities of the Texas Outdoor Recreation Plana In kneping with this policy, local projects
will not be approved from both the Texas Local Parks, Recreation and Open Space Fund and the
Federal Land and Water Conservation Fund Program unless extraordinary circumstances dictate
that high priority public needs will not be met without the full or partial funding of both
programs,

extraordinary *Ircumstances beyond the sponsor's control Failure to meat the following
time frames shall be grounds for the Department to Initiato canoollation of the affected
project in order to recommend reallocation of ivallable funds to other projects:
A. ACQUISITION PROJECTS:
1. Appraisals shall be forwarded to the Department no later than nine (9) months
after recelpt of official noting of project approval.
2. After the sponsor has been notified that the appraisal has boon approved, the
acquisition shall bd comp)oted and rehrbursament(s) shall be filed with the
f Department no later than twoivo (12) months,
B, VEMOPHtNt PROJECTS:
1. Construction plans and specifications shall be forwarded to the Oepartment no
later than pine (9) months after official notification of project approval
2, On-the-ground construction shall begin no later than six (6) months after the
Department by official notification has approved project plans and
specifications,
5. Sponsors will provide the Department with a report no less frequently than ninety (00)
days, setting forth the physical and monetary progress of a project as correlated to the
sponsors approved application,
6. Any provision of this policy shall be automatioatly Amended should the federal government
issue a regulation In conflict with this policy; provided that the State Lialson Officer
shall submit to the, Comsiselon for consideration any federal action In conflict with this
policy.

The standards and specifications Adopted by the Elimination of Architoctural
Barriers Program of the Texas Dopartmont of Licensing and Regulation (TDLR)`to

CIVIL RIGHTS
The contractor is required to comply with regulations issued pursuant to the
Civil Rights Act of 1964 with respect to nondiscrimination in assisted programs
of the Department.
The following provisions known as EQUAL OPPORTUNITY CLAUSE are to be incorporated
verbatim in each contract,

gompletion of the development, in the case of combined projects, a
sign acknowledging both acquisition and developmont'may be installed
at the time project development is initiated, Acquisition projects
require a sign for a period of not less than six (G) months,
Publicizing an acquisition project by installation of signs prior to
the completion of the acquisition, particularly those involving the
acquisition of several parcels, could seriously affect the
negotiations for the 'properties to be acquired,:. lherefare
installation of a sign for acquisition projects should be delayed
until the acquisition of all pparcels is completed and all
relocations have occurred, Development projects should'havu a
signed installed at the time construction is initiated
Temporary signs shall be no less than four (4) feet by eight (8)
feet, The attached sample reflects the minimum standard
requirement, The second line of the sign will indicate whether the
project is acquisition, development or both.

the temporary sign and the lettering to make the sign readily
visible without, being intrusive,

permanent sign should reflect that shown in the enclosed suggested

FEDERAL FUNDING IN PUBLIC ANNOUNCEMW+ITS
The recipient agrees that, when Issuing statements, press releases, requests for
proposals, bid sollcitadons, annpuncements of contract awards under the grant,
and other documents or announcements describing this project, the recipient
shall state clearly;
1) the dollar amount of Federal funds for 0 a project;
2) the percentage of the total cost of the project that will be financed with
Federal funds;
3) the percentage and dollar amount of the total cost of the project that
will be financed by nongovernmental sources.

Payments under this award will be made through the Education Department (ED) Payments Management System
(EDIPMS), administered by the Financial Management Service of the U.S. Deputmeot of Education.
Recipients twelve funds through one of two different payment methods: Automated Clearinghouse/Electronic
Funds Tramfer (ACH/EM or ED FEDWIRP, (Further information about each payment method appears
below.)
Each NEW recipient receives an information package from the Financial Management Service about BDJPMS
operations, Recipients who have not received an information package or who need further information about
the payment method that applies to their grant should call the ED/PMS account representative listed for their
state at the telephone number shown on the reverse,
ED PMS PAYMENT METHODS

Recipients participating in the ACH/EFT method of payment may call tho ED service bureau to request

using ACHIEFT, recipients must give the Accounting and Financial Management Service information

Under the ED FEDWIRE method of payment, recipients receive payment through the Federal Reserve
Bank in Richmond, Tbe Financial Management Service provides information about placing requests for
ED FEDWIRS payment in its booklet, Recipient's Guide (April, 1969), which it sends to recipients who
teceive payment by this method.

SPECL4L CONDITIONS FOR DISCLOSING
FEDERAL FUNDING IN PUBLIC ANNOUNCEMENTS
The recipient agrees that, when Issuing statements, press releases, requests for
proposals, bid solicitations, announcements of contract awards under the grant,
and other documents or announcements describing this project, the recipient
shall state clearly:
1) the dollar amount of Federal funds for the project;

2) the percentage of the total cost of the project that will be financed with
Federal funds;
3) the percentage and dollar amount of the total cost of the project that
will be financed by nongovernmental sources.
In addition, when announcing any contract award for goods or services with an
aggregate value of $500,000 or more, the recipient agrees to specify the
amount of Federal funds used to finance the contract and the percentage of
total costs of such a contract that the Federal funds represent.
