2'EX. LOC. 50VIT CObE ANN. § 143,004 (Vernon 1988) governs a
municipality's election to adopt or repeal the civil service
system. On J'enuary 21, 1989, the City of Stephenville adopted the 11
civil service system, TEX. LOC. 00V'T CODE ANN, ch. 143 (Vernon I
1988 4 Supp, 1992). On September 19, 1991, less than three years
after It.,; adoption, a petition was submitted to the Stephenvillft
City Council to repeal the civil service system.
on the date of the election for repeal, Stephenville had 61141
registered voters. A total of 1,607 votes were oast in the
election to repealr 946 for repeal and 661 against the proposal.

of "qualified voters" means a majority of the voters who actually
voted in the repeal election. The facto were stipulated by thr3

When construing a statute, the courts must read the words
according to their ordinary meaning unless a contrary intention is
apparent from the context. Taylor v, Fireman's and Policemen's
civil Service Commission of the City of Lubbock, 616 S.W,2d 187
(Tex, 1981), Applying its ordinary meaning, we hold that a majority
of "qualified voters" means those qualified voters who voted in the
election, See Wallace v. Ranger Hospital District, 474 S.W.2d 568
(Tex.Civ.App. - Eastland 1971, writ ref'd n,r.e.)) Yeary v. Bond,
384 8,W.2d 376 (Tex,Civ,App. - Amarillo 1964, writ ref'd n.r.e.))
state ex rel. Wilkinson v. Self, 191 S,W,2d 756 (Tex,Civ.App, - San
Antonio 1945, no writ)) Bradshaw v, Marmion, 188 S.W. 973
(Tex.Civ.App, - E1 Paso 1916, no writ).
First, Walker argues that the legislature has defined
"qualified voter" in TEX. ELEC. CODE ANN. 1 277.0021 (Vernon Supp,
1992) which provides than '

Suction 143,004(a) states that, to repeal the civil service system,
a petition must be secured with the signature of at least 10
percent of the ''qualified voters" of the municipality. in this
context, "qualified voter" means "registered voter" under Section I
0 277.0021. Walker would have this court apply the same meaning to
"qualified voters" in the last sentence of Section 143.004(e) We
decline to make this application, By definition, Section 277,0021

Second, Walker argues that the term "qualified voters" under
Section 143.004(e) does not have the modifying clause, "Who voted
in the most recent municipal election," as in Section 143,004(b),

Therefore, by absence of the modifying clause, Walker contends that
the legislature intended "qualified voteroll to mean "registered 1
voters" for a repeal of the system. We disagree with Walker's
,
contention, gy construing the term "qualified voters" to mean
those f1votern who voted in the most recent municipal election," all
uses of the term are consistent throughout the entire statute
except whore expressly defined by the legislature in reference to
Section 277.0021, City of Dallas V4 Watkins, 651 S,W.2d 023

Third, Walker argues that the legislature intended for the
votes required for adoption and repeal to be different standards in
order to protect those agencies subject to the civil service system
from political pressures. We disagree with Walkerts interpretation
of the legislature's intent. 'the safeguard against political
pressures is provided for by requiring the signatures of 10 percent
of the "registered voters" for a petition to tall an election for
repeal of the civil service system, As observed in State ex rel,
Wilkinson v, Self, suprar
if appellantst construction of the statute (majority of
p registered voters needed for repeal of the system) be
acoepted, the elections provided for therein would in
many instancos settle nothing. Yt is common knowledge

that in moot elections$ all those legally qualified to
vote do not actually cast their ballots.
To accept Walker's construction, a qualified voter who did not vote
in the election would have been considered to have voto6 against
the repeal. Surely, the legislature intended only for a vote whioh
was actually cast to be considered.
Fourth, Walker urgos that his Exhibit Nos, 10 21 and 3 are
evidence of the legislative intent to support his construction that
"qualified voters" means "registered voters." Exhibit No, 1 is a
copy of the introduced version of House kill 1642, 71st Leg,, R,S,
(1989) 1 Exhibit No, 2 is a copy of the introduced version of House
bill 1264, 72nd Log,, R,S. (1991)1 and Exhibit No, 3 in a copy of
the original bill analysis prepared for the House Committee on
Urban Affairs concerning Tex. HS 1642, 71st Leg,, R.S. (1989), In
its Points of Error Nos, 61 7, and 8, Stephenville complains that
the trial court erred in admitting and considering those exhibits,
we disagree with Stephenville's Arguments, TEX, GOVT CODE ANN. §
311.023(3) (Vernon 1988)$ authorizes the court to consider these

overruled,
House Bill 1642 and House Bill 1264 both sought to clarify the
term "qualified voters." House Bill 1642 added the modifying
phrase "voting in said election" to Section 143.004(e), and House
gill 1264 provided that "(i)f it majority of the votes received in
the election are in favor of repealing,The original bill

This bill (1642) would change the requirements for the
voters of a municipality to repeal the State Fire
Fighters' and Police officers, civil Service law to equal
the requirements for voting to adopt the law.
Walker argues that this evidence supports his construction of
the statute. Evidence that the legislature sought to clarify the
term "qualified voters" is not proof that the legislature
originally intended the term to mean "registered voters." The term
"qualified voters" already had a well-defined court construction as
used in other statutes at the time Chapter 143 was passed. Sea

By execution of this Memorandum of Agreement, the City agrcea to
undertake financing of the City's participation with the County is
the construction of the First Stage of the Criminal Justice Center
("the Project") on the pro-rated basis described for the City in the
Clty/County Pro-Rate Costs Schedule, attached hereto as "Exhibit
and the architecta report for the Dallas County Justice Center,
attached hereto ae "Exhibit B", prepared by the architects JJV/A$W.
Both documents, Exhibit A and Exhibit B, are incorporated by
reference and made a part of this Agreement.
II.
(a) The City agrees that its participation in the Project shall
include financing oft
[ (1) the full cost of the municipal court facilities
constructed for the exclusive use of the Cityt and
(2) the actual cost of the City's pro-rated share
of' the remaining portions of the Project as described in
Exhibit Al and
(3) The total cost of the City's portion of the Project
shall not exceed 891995,000; except, that it is specifically
understood and agreed that bids will be taken by increments and that
the City may notify the County at the time any bid is token that
same is out of City's budget, whereupon the City will either (A)

The County agrees to provide to the City, as they become
available, cash flow,estitnetes and construction schedules. The City
will proceed with its participation in accordance with the County's
construction schedules to meet all deadlines.

It is understood that if the Project is expand ad beyond the

first Stage of construction as described in Exhibit B or if any
major change in the scope of the work in the First Stage is
undertaken, the City's participation .in the expansion or change will
be only with the City's consent and after the City's approval. The
County further agrees that no reduction in the scope of the work in
the First Stage will be made in any of the areas participated in by

the City without the consent of the. City.
VI.
(a) In further consideration of the City's intent to undertake {
financing in order to participate in the Project, the County hereby I
grants and convoyA to the City for the lease payment of one dollar {
per years
(1) a leasehold estate for the exclusive use of that
portion of the completed buildings neaassary,for the operation of
the Municipal Courts and its support functions so tsar of the
Project is used as a jail and criminal justice facility{

(2) a leasehold estate for thr: undivided use of the jail
facility, so long as the Project is used as a jail and criminal
justice facility, for processing and maintaining City ,jail prisoners
in accordance with Article Vil of this Agreement; and
(3) the agreement that if the County changes the use of
the Project from a Jail and criminal jt{stico facility to some other
use, the City has a continuing leasehold estate and is entitled to
continue joint use of the Project in the same proportion as provided
in Exhibit A for a municipal use to be detarminnd by the City.
(b) The County furthe, covenAntc and agrees that if the Project II~
should ever be sold, the County shall pay to City, and the City is
entitled to receive, an amount equal to 15 portent of the sale price
of the land which is now a part of the Project and a pernentsge of I

(1) a person who is brought by a City officer or comes to
the intake area and/or jail at the Criminal Justice Center in E
connection with inveStiSation and/or charges of a traffic o:fenea
and/or violation of a city ordinance; provided, the person is under
arrest on the promises of the Criminal Justice Center, and/or is
incarcerated in the Jail and charged only with A traffic offense or
violation of a City ordinance, or any other violation filed in City's
Municipal Court; or
(2) 'sny usher person who is brought to the intake area
and/or jail of the. Criminal Justice Center by a City officer for a
purpose other than listed in paragraph (a) above, prior to the time
formal charges of a county or state offense aru filed against the
person; provided, that the person shall become a County prisoner as
soon as county or state charges arm filed.
(b) Upon completion of the First Stage of the ProJer.t, the City
and County agree to the following' principles of oporationf

facility and shall have authority to supervise the operation and
maintenance of the fail, intake area, aaliyport, and other areas of
the detrntion'facility, pursuant to the provisions of Seta 4(h) of
Art. 4413(32c), Vernon'a Annotated Texas Statutes (Acts 1977, 65th

(2) The County agreed to house 100 City prisoners on any

shall, not be, construed to require overcrowding of the Sail,

and the Sheriff's decision shall he conclusive as to whether
additional prisoners would cause overcrowding.
(3) The City will pay the County a par diem rate for each
day or fraction of t day that a City priadner is incarcerated in the
fail.. This rate shall include only the acrual cost to the County
for maintaining a prisoner and shall not inaluds a capital
improvement amortization fee unless the City has more than 100 City
prisoners incarcerated on any one day. The City will then pay a
daily rate to itrelude a capital improvement amortization fee for
each City prisoner in excess of 100 sn a given day. Calculation of
the per diem rate for City prisoners shall be based on the following

COUNTY OF DALLAS X JUSTICE CENTER MEMORANDUM

WHEREAS, the Commissioners' Court of the County of Dallas
did, on the 8th day of December, 1978, authorize and execute the
Criminal Justice Center Memorandum of Agreement; and
WHEREAS, the City of Dallas, Texas, did execute said
Agreement through its City Manager, duly authorized by City
Council Resolution No, 78-3303; and
WHEREAS, the parties desire to amend said contract as
provided hereinafter;
NOW, THEREFORE, THIS MEMORANDUM OF AGREEMENT made by and
between the City of Dallas, Texaq, hereinafter called "City",
and the County of Dallas, Texas, hereinafter called "County",

By execution of this Amendment No, l to Criminal Justice

O Center Memorandum of Agreement, the City of Dallas and County
of Dallas, through the respective governing bodies, do hereby
agree that paragraph VII of said contract is amended by adding
the following alter VII (6) on page 9 of said Agreements
(6a) For the period October 1, 1982; through September 30, r
1983,' the City will pay the County a total of $3,83y,S00 unless
the Sheriff is unable to accept City prisoners (previously housed

in the downtown city jail) by February 1, 1983, in which
event the said amount will be reduced by an amount not to
exceed $428,611. This reduction of $428,611 will be 1
prorated
for each day in January, 1983, in which all City prisoners
are housed in the County jail, Payments for this period are
due on the last day of each month in which City prisoners are
housed. It the Sheriff is unable to house City prisoners -
(those previously housed in the downtown City jail) by March It

1983, then the City will pay for those housed in accordance with
the terms and conditions of Paragraph V72 of the original Agree-
ment for each month in which All City prisoners are not housed. it
is agreed that this paragraph supersedes other contradictory
payment provisions of this Agreement only for the period of
October 1, 1982 through September 30, 1983;
(6b) For the periods October 1, 1983'through September 30,
1984, and October 11 1984 through September 30, 1985, the
city will pay the County a minimum of 54,500,000/maximum of
$4,950,000, and a minimum of 54,5001000/max.lmum of $5,445000
A for each respective period. it is agreed that payments for
these periods will be billed and paid according to the terms of
the original Agreement. it is agreed that this paragraph
supersedes other contradictory payment provisions of this Agree-
meat for the aforesaid periods.

(6c) While the Commissioners, Ccurt does not have the authority
to ensure the implementation of a system of expedited criminal case
filings because of the constitutional and statutory authority of the
District Attorney, County/District Clerks, and County/01strict Judges,
the Court does commit to encouraging through reasonable budget allocations
the development and implementation of such a system by January 1, 1984,
as envisioned by the signators to the original Agreement, The intent of
the direct filing system is to ensure the expeditious filing of formal
charges in order to curtail costs for the County and City,
Except as provided in this Amendment No, i, the City and County
hereby reaffirm the remainder of said Agreement,

the 1983-1984 fiscal year will be billed and paid according to the
terms of the original agreement. During fiscal year 1985 the City
will pay the County $233,333 a month for the first eleven months and
5233037 for the twelfth month, no later than the fifteenth day of the
current month. It is agreed that this paragraph supersedes other
contradictory payment provisions of this Agreement for the aforesaid
periods,"

VII.
(a) As used in thin Agreement, the term "City prisoner"
meansi
(1) a person whose only offense(s) involve(s) a case`
or cases filed or to be filed in the City's Municipal Court and
who is brought to the Criminal Justice Center by a City officer
(2) any other person who is brought to the Criminal
Justice Center by a City Officer prior to the time an order of
detention and/or warrant of arrest has been issued by a duly
constituted magistrate,
(b) Upon completion of the First Stage of the Project, the
City and county agree to the following principles of operations
(1) The Sheriff shall be appointed as jailer of the
facility and shall have authority to supervise the operation and
maintenance of the jail, intake area, sallyport, and other areas
of the detention facility, pursuant to the provisions of sec.
4(h) of Art. 4413(32c), Vernon's Annotated Texas Statutes (Acts
1977, 65th Lag,, p. 1619, ch. 634, 52). In addition, the par-
ties agree that the Sheriff will have primary responsibility for
the dissemination of public information concerning all prisoners
to the extent that accurate and timely information is supplied by
the appropriate agency. City agrees to provide the County fine
• and bond information on a timely basis in order to fulfill this
responsibility, Morsovar, the parties iigree that the sheriff
will provide an officer to assist in providing security in the

Municipal courtroom twice a day, seven days a week as an added
level of service to be solely at the City's expense,
(2) The County agrees to house 100 City prisoners on any
one day, The County further agrees to cooperate with the City and to
make its beat efforts to house and accommodate all prisoners brought
to the jail by City officers, especially in the event of an emergency
situation requiring a large number of arrests, The County and the
Sheriff agree that they will not give prisoners from other cities
priority over City prisoners in admission to the jail, This Agreement
shall not be construed to require overcrowding of the jail, and the
Sheriff's decision shall be conclusive as to whether additional pri-
soners wovld cause overcrowding, it is the intent of the parties
entering this Agreement to consolidate their activities, thus
eliminating the need for a City jail,
It is further the intent of both parties to
negotiate the basis upon which they will cooperate in building
additional jail capacity when the Sheriff and Commissioners'
Court agree that more space is needed and the City's average
daily jail population exceeds the 100 bunks provided by thin
contract.

(3) The City will pay the County the cost of operating
the second floor of the Sterrett Inmate Rousing Tower (the 2nd
floor of Bui ding A) where most City prisoners are to be housed,

to compute the actual cost and number of prisoners as defined

the determination of staffing and costs, The actual computation
shall be used for the subsequent years, payments as described in
(6) above, =n addition, these computations shell be used by the
CPA to determine any additional payment or credit which the City
or County will be required to make in the subsequent year in
terms of the difference In the amount paid in accordance with (6)
above, the additional payment or credit shall be adjusted for
lost interest earnings by using the paying parties depository
Interest rate to the date of payment, assuming an average monthly
loss for the prior contract period. The initial audit shall be
performed for the period October 1, 1984 through March 31, 1983
and any payment or credit based on that period is payable by
October 34, 1985, in addition, the rate for the first six months
will be applied to the second six months of the fiscal year and
the difference from the rare paid by the City will,be included
in the adjustment payment or credit,
For purposes of the contract-years subsequent to October 1,
1983, the independent CPA shall base HL/her findings on costa
incurred and prisoners processed/housed for the period April i
through March 31 for each succeeding year, with any payment/
credit payable by October 30 of that year,

(8) The City end County agree to create a Justice Center
Steering Committee, This committee will select an independent
CPA for recommendation to the City and County, will meet on a r
quarterly or semi-annual basis to review matters related to
contract execution and to provide a communication vehicle to

carry out the intent of this Agreement. Said committee shall be i
composed of the County Judge, one Commissioner, the Mayor, the
Sheriff, the City Manager, and the City Attorney,
(9) In order to ensure a proper level of understanding by the

1992, As you may be aware, the Coordinating Committee of C10 Service Clties met
on Thursday, November 19, 1952, here in Fort Worth to discuss among other things,
Some of the auggestlons that you mentioned In your letter, On the Issue of
formalizing an organization and developing a dues structure, the Committee voted to
establish a 9250,00 city membershlp fee to be used to offset costs associated with
our combined efforts to keep abreast of the changes being sought relating to the civil
service system.
The meeting on the 19th also generated discussion` about the need to formalize an
information sharing network for civil service' cities, as well as discussion on the
establishment of a centralized file on arbitrators and a`database for all civil service'
related oases, The Committee Is very much Interested In developing a strong network
of civil aorvlce cities and fostering communication among those cities, We feel like
you do, that an organized effort will be the key to a successful effort to avoid
detrimental outcomes relating to civil service at the state andloaal`level,

The steering committee believes the coalition W).ll complement the
efforts of the Texas Municipal League's legislative efforts and
also will strengthen Chapter 143 Cities$ ability to affect
positively civil service legislation,
As you may be aware, the Texas Xuniaipal League will not seek any
legislative amendments to Chapter 149 for the 1993 session, TML
will endorse any beneficial amendments to Chapter 143, especially
those developed and actively pursued by the coalition, A summary
of the legislative program recommended by TMLIs Legislative Policy
committee on Personnel is attached.
Although the coalition has not developed any specific legislation,
the steering committee anticipates supporting positive legislation
being proposed by Chapter 143 cities, The cities of orand Prairie
and Lufkin have indicated they will propose' legislation related to
promotional testing for fire fighters, Appointment of the level
immediately below the Fire Chief, and entry level hirinq~
Establishing the coalition will require an effective communications
system, To defray expenses for communicating information to member
cities, the steering committee is proposing initial dues be set at
$260,00 per year for each oity,
On behalf of the steering committee, we invite you to join us in
forming this new organisation. Vor the Coalition to be effective,
it is imperative a significant majority, of Chapter 143 cities
participate. Obviously 70 cities working together can better
protect our interests in the legislature as well as help each other
to better administer our civil service systems,

Coalition of City Managers and Other Profs sionals, to address
Civil service issues anticipated In the upcom.ng state legislative
session
On October 13, mom Klinck and T met With James MaCarlay to explore
kleas that might be helpful in combatting CLEAT'S initiativeal
particularly, the collective bargaining bill,
From our discussion with James, it appears that the most feasible
strategy with the CLEAT initiatives would be defensive,
However, we also understand that the city of Lufkin has developed
a proposal for "acore banding" on entry and promotional exams, The
Police chief, indicated that he has lined up sponsors to introduce
these revisions to the law, We believe it will be strenuously
opposed by the Police and Fire Associations,
Recognizing these `factors, we would propose setting up a more
formal organization of the coalition members. Each city which
chooses to participate and be represented would pay a minimal
amount for dues (say, $200). This would assist us in defraying
expenses for communication items to members, etc, ! 0
