Special Called Meeting of the City of Denton City Council on Monday, November 9, 1998 at
12:00 noon in the City Council Chambers at City Hall, 213 E. McKinney, Denton, Texas, at
which the following items will be considered:

I. Consider adoption of an ordinance canvassing the returns and declaring the results of a
special municipal election held in the City of Denton on November 3, 1998 regarding the
exttnded hours for the sale of alcoholic beverages; and providing an effective date.

ORDINANCE NO.
AN ORDINANCE CANVASSING THE RETURNS AND DECLARING RESULTS OF A
SPECIAL MUNICIPAL ELECTION HELD IN THE CITY OF DENTON ON NOVEMBER 3,
1998 REGARDING THE EXTENDED HOURS FOR THE SALE OF ALCOHOLIC
BEVERAGES; AND PROVIDING AN EFFECTIVE DATE.
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The City Council finds and declares that the November 3, 1y98 special
municipal election was duly ordered for the purpose of determining whether an ordinance would
be adopted establishing a standard hours area for the sale of mixed beverages, beer, and wine, 1J
which would effectively repeal the current extended hours for the sale of alcoholic beverages
ordinance; that proper notice of said election was duly given and election officials appointed;
that the election was duly held and the returns of the election officials have been delivered to the
Council, all in accordance with the laws of the State of Texas and the Charter and ordinances of
the City of Denton.
SECTION It. The official returns of the election officials having been opened, examined,
and canvassed, and the Council hereby finds and declares that 13,315 ballots were cast at the
election, and that the votes cast for or against the ordinance and the proposition set forth below
were as follows:
TILE ADOPTION OF AN ORDINANCE ESTABLISHING A STANDARD HOURS AREA
FOR THE SALE OF MIXED BEVERAGES, BEER, AND WINE ON PREMISES WITHIN
THE INCORPORATED LIMITS OF THE CITY OF DENTON, SAID HOURS TO BE
BETWEEN 7:00 AM, AND MIDNIGHT ON ANY DAY, EXCEPT SUNDAY. ALCOHOLIC
BEVERAGE SALES ARE PERMITTED BETWEEN MIDNIGHT AND 1:00 A.M. AND
BETWEEN 10:00 A.M. AND MIDNIGHT ON SUNDAYS, EXCEPT THAT AN ALCOHOLIC
BEVERAGE SERVED TO A CUSTOMER BETWEEN 10:00 A.M. AND 12:00 NOON ON
SUNDAY MUST BE PROVIDED DURING THE SERVICE OF FOOD, PURSUANT TO
APPLICABLE PROVISIONS OF CHAPTER 105 OF THE TEXAS ALCOHOLIC
BEVERAGES CODE
TOTAL EARLY VOTES CAST:
FOR THE ORDINANCE 1,738 votes
AGAINST THE ORDINANCE 2,476 votes

SECTION III. The Council finds and declares that, as a result of the election, the
ordinance establishing a standard hours area for the sale of mixed beverages, beer, and wine or.
premises within the incorporated limits of the City of Denton is hereby declared to be defeated
and repealed, and the current Ordinance No. 96-01 1 establishing extended hours for the sale of
mixed beverages, beer, and wine shall remain in full force and effect.
SECTION IV. That this ordinance shall become effective immediately upon its passage
and approval.
