3, 1998 for voting in a special election for the purpose of.

OF MIXED BEV11RAGES, BEER, AND WINE ON PREMISES WITHIN THE INCORPORATED LIMITS

SUBJECT
Hold a public hearing regarding a Standard Hours Area Initiative Petition that would establish a standard
hours area, reducing the hours for We of milled drinks, beer and wine, pursuant to Sections 105.03,
105.04, 105.05 and 105.06 of the Texas Alcoholic Beverage Code and Sections 4.01-4.10 of the City of
Denton Code of Ordinances.
BACKGROUND
On May 8, 1999, Mickey George, as a member of a Committee of Petitioner, submitted to the City
Secretary, an initiative petition entitled "Standard Hours Area Petition". That petition was examined by
the City Secretary who determined that it did not fully comply with the City Charter and Chapter 277 of
the Texas Eiection Code. The Committee then submitted an amended petition to the City Secretary on
June 12, 1998. Jennifer Walter, City Secretary, determined that the amended petition met the
requirements as stated in the Denton City Charter and certified the petition on July 21, 1998. The City
Charter indicates that the initiative petition must be read at a Council meeting and a public hearing held.
FISCAL • INFORM kTION
Should the initiative ordinance be submitted to the voters, there are several options the Council might
consider in regards to that election The first available uniform election date is November 3,1998. As the
County will be holding an election on that date, a joint election might be considered. Voters would be
able to have "one-AV" voting on that day. Cast of that election would be prorated with the County. An
alternative to holding a joint election would be to have a single polling place at City Halt. While voters
would have to go to two polling places on that day, one for County voting and one for City voting, ore
City location would be less conNsing for the voter. This would also be a less costly option as the cost per
polling location is approximately 52,800.00.

Texas on November 3, 1998 for the purpose of considering a standard hours area

making provisions for the conduct thereof.

277 of the Texas Election Code. The Committee then submitted an amended petition to the City
Secretary on June 12, 1998. Jennifer Walters, City Secretary, determined that the amended petition
met the requirements as stated in the Denton City Charter and certified the petition on July 21, 1998.
The City Charter indicated that the initiative petition had to be read at a City council meeting and a
• public hearing held. That reading of the petition and holding of the public hearing was done at the
August 13'h City Council meeting. Final action on the initiative petition must be taken within 60 days
of certification by the City Secretary which is September 21" The Council must decide whether to
adopt the proposed initiative ordinance (Ordinance A) or call an election for November V to have
Denton voters decide the issue (Ordinance B).
Several options are available for Council consideration should an election be called. • •
Option 1 - Joint Election with Denton County
As November Yd is the general election day, the City could contract with Denton County to hold the
election. This option would afford voters "one-stop" voting on election day and would be the easiest
type of voting for the voter. The initiative proposal would be included on the County ballot. Ballots
