BACKGROUND At its November 2, 1999 meeting City Council held a public hearing and considered Zoning Case Z-99- 061. a proposed Concept Plan amendment to PD-I 13,a231 acre Planned Development located north of %'incisor Road betwren Bonnie Brae and Westgate. The Council was also scheduled to consider Zoning Case Z-99-077, a proposed Detailed Plan for a 194 ncre residential development within PD-115 immediately after the Concept Plan was approved. the validity or a letter of opposition that was received by staffjust before the start of the Council meeting was called into question one day later. The letts was used to change opposition area calculations required by state law, and added enough property to require a super majority vote by Council for approval of the Concept Tian, rather than a simple majority vote. Upon further review. the Legal Department made the determination that the opposition letter referenced the Detailed Plan rather than the Concept Plan, and should not have Men used to trigger the super majority requirement for Council approval of the concept flan. "Ihe matter Has discussed further during the November 9'h Council work session. Issues of "spirit and intent" versus "legal technicality" were raised, and Council eventually decided to repeat the entire zoning process, including public notification and Planning & Zoning Commission review. The intent of Council ~ was to avoid any appearance of Impropriety with respect to equitable consideration of the views of both opponents and proponents. Because the public notice fur the Detalled Plan indicated that a Nover ber 2nd public hearing would be A held (which ttas cancelicd due because the Concept Plan was thought to be denied), the Detailed Plan (r'. review process will also M repealed in the same manner as the Concept Plan. To accomplish this goal. Council will conduct a Special Called meeting on November 15'h to consider an ordinance that allows reconsideration and recission of the November 2"d vote, and refers the PD Concept Plan and Detailed Plan back to the Planning & Zoning Commission. Since the reconsideration and referral are not caused by the applicant. the City will not require payment for any additional application or public notification fees. I C t; • Calculation of Opposition Area Prior to the meeting, staff received letters of opposition from adjacent property owners representing 19.67 percent of the land area within 200 feet of the boundary of the proposed district. Twenty percent opposition triggers the requirement of approval by super-majority. The letters of opposition appear In three forms: the form mailed out by the Planning and Development Department, a form stating a preference for the existing Concept Plan, and a form stating oppo;ition to the proposed toning change for PD- 115. At the November 2nd meeting, staff was presented two additional letters of opposition. Staff did not notice that the two new letters of opposition referred to the Detailed Plan portion of the toning case (Z. 99-073, the next agenda item). Staff mistakenly considered the new letters as opposition to the Concept Plan and checked them again,t the letters received prior to the meeting. Staff found that one letter represented a duplication of opposition, while the other represented opposition not previously recorded. Adding the new property in opposition yielded 20.67 percent opposition, triggering the perceived requirement of approval by super-majority. Council voted to approve Z-99.061, with additional conditions, with a vote of 4 - 2. The four votes in favor of approval did not achieve super-majority and the request for approval of the Concept Alan was considered denied. Detailed Plan (Z-99-0731 This case "as listed on the agenda but was not considered at the meeting because the Concept Plan was not approved by supcr•majority. Prior to the meeting, staff received letters of opposition from adjacent properly owners representing 9.4 percent of the land area within 200 feet of the boundary of the proposed Detailed Plan. AN ORDINANCE OF THE CITY OF DENTON, TEXAS, RECONSIDERING CITY COUNCIL VOTE ON ZONING CASE 99.061 PERTAINING TO AN AMENDED CONCEPT PLAN FOR PLANNED DEVELOPMENT 115 (PD-115) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION FOR 230,287 ACRES OF LAND GENERALLY LOCATED NORTH OF WINDSOR ROAD BETWEEN BONNIE BRAE AND WESTGATE; RESCINDING AND REVOKING ORDINANCE NO. 99-413 AND ANY AND ALL APPROVALS AND ACTIONS TAKEN BY THE CITY COUNCIL ON NOVEMBER 2, 1999 PERTAINING TO ZONING CASE 99.061; DIRECTING THAT ZONING CASE 99-061 BE REFERRED BACK TO THE PLANNING AND ZONING COMMISSION FOR FURTHER PROCEEDINGS IN ACCORDANCE WITH SECTIONS 211.006 AND 211.007 OF THE LOCAL GOVERNMENT CODE AND CHAPTER 35 OF THE CODE OF ORDINANCES OF THE CITY OF DENTON; AND PROVIDING AN EFFECTIVE DATE WHEREAS, on November 2, 1999 Zoning Case 99.061 an amended concept plan for PD-115 was presented to the City Council for public hearing, review and approval as a rezoning of approximately 230,287 acres of land generally located north of Windsor Road between Bonnie Brac and Westgate; and WHEREAS, after the close of the public hearing city staff informed the City Council that by virtue of a new written protest that was just received prior to the meeting (the "New Protest'), owners of more than 20 per cent of the land within 200 feet of the proposed zoning change had protested the zoning case, thus apparently triggering the three-fourths voting requirement contained in Section 211.006 of the Local Government Code; and WHEREAS, the City Council by a vote of 4 to approve and 2 to deny failed to reach a three fourths vote to approve Zoning Case 99.061 thereby leaving the impression that Zoning Case 99.061 had not been approved; and WHEREAS, on November 3, 1999 city stall' discovered that the New Protest on its face stated that it was a protest to the detailed plan zoning case for PD-1 IS which was a separate zoning case on the City Council November 2, 1999 agenda bearing Zoning Case No. 99-073; and WHEREAS, because of the confusion as to the effect of the prior vote of the city Council and of the misimpression that may have been given to the public as to the effect of the prior vote, City Council at its work session meeting of November 10, 1999 directed that this matter be set for a special meeting on November 15, 1999 for reconsideration; and WHEREAS, by motion by one or more of the members of the City Council on the + prevailing side of the prior vote, a motion to reconsider the prior vote was made and seconded. NOW, THEREFORE,THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: f a u C 44 D~4 "[.w SECTION I The vote of the City Council on November 2, 1999 pertaining to Zoning Case No. 99-061 Is hereby reconsidered and rescinded. Such vote will have no force or effect. Any and all ordinances, approvals and actions in connection with such vote, including ordinance No. 99-413, are rescinded and revoked, thereby having no further force or effect. $EECTION 2. It is hereby directed that Zoning Case No. 99-061 be referred back to the Planning and Zoning Commission for further proceedings in accordance with Sections 211.006 and 211.007 of the Local Government Code and Chapter 35 of the Code of Ordinances of the City of Denton, including the readvertising of notices, mailing of written notices and public hearings to consider Zoning Case No. 99061 as If it were a new zoning cane. No new application fees shall be charged to the applicant. SECTION 3. The findings contained in the preamble of this ordinance arc incorporated herein as if fully set forth with the body of this ordinance. SECTION 4. BACKGROUND An alternative notification process is proposed for review of the draft interim ordinance intended to provide development review criteria from the time of comprehensive plan adoption until the new development code is adopted, At its November 91h work session, Council decided to consider the interim ordinance expeditiously, wanting the timing of comprehensive plan and the interim ordinance adoption to coincide if at all possible. Future meeting opportunities are limited due to upcoming holidays, and ajoint City Council I Planning & Zoning Commission public hearing would allow consideration orthe interim ordinance to keep pace with the draft Plan. ]he interim ordinance will affect property citywide and is considered a "textual" change, Under such a circumstance, public notification of affected property owncrs entails the publication of the notice of public hearing in the local newspaper and posting of the hearing on the appropriate meeting agenda. Council must adopt the attached ordinance (Exhibit A) by te'o-thirds vote for the joint public hearing to satls(Y slate la14'. stow-Requirement s City Council approved holding a joint public hearing with P&Z during consideration of the proposed interim Corridor Ordinance on October 20`h, 1998. The ordinance adopted approved the joint public hearing and set an alternative form of public hearing notification. For the interim "development standards" ordinance, the primary emphasis is approval of the joint public hearing. The ordinance also sets the public hearing notification process to include tw'o newspaper publications, 15 days and 7 days before the December 7'h public hearing date. City Council must by ordinance set a joint public hc3ring of the Planning and Zoning Commission and the City Council, and is at the same lime allowed to set the public hearing notification requirement. (Local Omernment Code 211.007 (b) and (d)] Local Government A. Code Section 211.007(d) states, "The governing body of a home-rule municipality may, by a w - hir + rote, prescribe the type of notice to be gh'en of the time and place of a public hearing held joinwly by the governing body and the zoning commission. it I a t. Section 211.007(b) still requires that the Commission make a recommendation before the k" governing body may take action. The proposed schedule sets the public hearing date as i December 7`h, 1999. On that same evening, the Planning & Zoning Commission will be asked to make a recommendation to City Council regarding the Interim ordinance. Cit~ Council will then be scheduled to consider adoption of the interim ordinance on Ikcember 7 . OPTIONS 1. Delay review of the Interim ordinance and schedule review by City Council and P&Z separately. j 2• Conduct the joint public hearing as proposed. RECOMMENDATION Staff recommends approval of the nttached ordinance, contingent upon approval of the review schedule for the comprehensive plan that will also be considered on November 15 , 1999. In the interim, Council conducted draft Plan work sessions on October 26' and November 91h, and decided to extend Vic review procc ss to December 7`h, 1999. Asper Council direction, the public hearing will be opened m November 10h and continued to December 7'h. Any persons interested in making comments rega.9Jing the drill Plan are Invited to speak on November 16'h, although the draft Plan is undergoing significant revisions. Council will not consider adoption of the comprehensive plan until December 7`h, 1999.
