Locust Denton, TX 76201 Dear Bill: We have done a little research on the Williams Trade Square parking lot and your concerns about the reserve parking, Our records indicate that in 1920 we did buy the lot for $8 000 from Mr, Williams, In the terms of the sale Mr, f stipulated that the property could not be sold by tie City, was intended for public use and should be known as the Williams Trade Square, y We resurfaced the lot in 1978 and provided for 124 parking spaces at that time. We Issued CO's to do this, one, of the ways we itre retiring those CO's is by revenue derived from leasing the spaces. From its inception, First State Bank reserved 58 of those spaces and still leases them. At one + point for several years, Cravens leased four of the spaces. However, they have ceased leasing them since 1986, In 1984, the Council authorized the Manager to advertise and lease up to 100 of the 124 spaces, With the reopening of the Court House, the County contracted to lease 30 spaces for the next three years. Between the First State Bank's leased spaces and the County, there are a total of 88 spaces leased at this time, "There still are 36 spaces available for open parking. Obviously, it has always been our intent to provide for public parking in the downtown area, On,, of the ways we felt we could ultimately do this was to repave the parking and allow use by the public, However, we also had to balance that by trying tu find ways to pay back the Certificate's of Obligation which allolard us to o the construction, The current level of loa!ng basically covers all of the CO costs, and we do not see any real need to increase the number of lease spaces. l 7.' it r Reverend Rill Crouch February G, 1988 Page 2 It has been our plan and continues to be our plan to enforce the reserve spaces on a complaint basis only and only if it becomes a problem to the leasees, As you mentioned, you disregarded that reserve sign the other day and parked in the space, We do not see any problem with this. Indeed, both the bank and the County have indicated that the parking could be used by anyone during non business hours. Because there are still 36 spaces available plus the fact that we have not received any complaints from either leasee, we think. that there are are adequate spaces for the general public. Locust. The City Council recently authorized the City Manager to lease up to 100 spaces in the parking lot nerr the downtown square at a rate of $14.00 per space per month or $168 yearly. Currently there are sixty-two spaces leased with forty-eight spaces available for leasing. All leases will be for a one year term with a renewal option of one year. As a result of this situation, the following recommendations are suggested: f 1, i Increase the annual leases for 100 spaces from $10 monthly per space to $14,00 monthly per space, This action will generate $16,eoo if fully leased, which is approximately the same as the average annual cost of $16,655 for the remaining debt payment, 20 Any amassed spaces by April 1, 1983, would have a meter placed on it at 100 an hour or 800 a day. This is a fee of $208 annually per space compared to the proposed $16e annual lease rate payment per spade. The following is an analysis of the impact of the new fee rates to tho First State Bank and Craven's Store. The $10,416 received from these entities by increasing leases from $10 monthly per space to $14 monthly per space will barely pay the $10,000 principal on the Certificate of Obligations for 1984. Location of Meters and Lease S ages To avoid placing meters in the concrete where possible, it is recommended that meters be placed initially in only the unleased spaces adjacent to the green space dirt areas in the parking lot. As a result, 14 spaces closest to the First State Bank parking lot will need to have maters placed by them since they are adjacent to a green space area, Adequate parking is available in the center lot spaces to maintain 62 spaces for leasing. Enforcement and window Sticker Requirement; Since only the spaces not leased will have rooters, then everyone leasing a space will need to use a window sticker which will cost approximately $15o for printing 260 stickers. Your office and the Council should be aware that the stuff suspended work days charged to this project on November 30 of last year, The counting was stopped because the City had to got into the islands to install a sprinkler system. This delayed the.planting operations by the subcontractor; therefore, the staff felt that no more days should be counted. As you are well aware since the holidays, we have not had many good days to work and i~ this has been the major cause of delaying the completion of the job. ` We have attached a final payment sheet for your review, The sig- nificant item is the 91 penalty days that have boon charged to the project, The penalty according to our contract is $105 per day. ' This amount's to $9,SSS in penalties which we have shown as being j deleted from the final payment. As you know, the contractor has advised the Council of equipment, i material and labor shortages on this project. The staff feels that ! a limited amount of days might be given for material shortages; (Le, not more than 10 days), but the labor and equipment shortages should have been anticipated by the contractor. This need has become even more evident with they recent completion of parking facilities by the First Statn Bank, The Planning Commission'has gone on record as supporting a major renovation of the trade square area to be compatible with other downtown improvements. Area merchants have also indicated strong support of improvements that could be made to the trade square. The attached map indicates the property that is owned by the city of Denton. The lots immediately west of the city property have recently been improved by the First State Bank for parking. While there has been widespread support for trade square improvements, the project has been delayed because of municipal funding limitations. The Planning Commission has considered several possible means of financing the project. They recently voted to include "Trade Square Improvements" as an integral part of the Capital Improvement Program. It was proposed to pave the entire lot for parking, install lighting, and generally J beautify the area. Preliminary estimates of $80,000 were prepared for the entire project. At th9 March 23rd meeting of the Commission, a presentation was made by Mr. Homer Bly with reference to financing the trade square renovation. Mr. Bly suggested that the project ' might be financed by user fees generated by leasing a portion of the lot to organizations such as the First State Bank. Mr. 'Iy's letter is attached for your, revibw. The Planning Commission voted to recommend acceptance of the offer and suggested that the matter, be referred to the City Council for possible implementation. If the City Council desires to consider possible acceptance of the trade square improvement program, they should take the fallowing action: (1) direct the City Attorney to investigate the legal status of the proposed financial arrangement; (2) ask that a study be made to determine the terms for amortizing the necessary payment certificates; I (3) direct the engineering department to prepare pro- liminary plans for improvement of the trade square property.
