C l/~ Ka 7Nard na w STATE OF TEXAS X COUNTY OF DENTON THIS AGREEMENT, made and entered into this day of June, A.D. 1965s by and between Steed Construction Company, a partnership composed of Richard D. Steed and Seldon D. Steed of the County of Tarrant,, State of Texas, Party of the First Part, hereinafter called CONTRACTOR, and the City of Denton* Texas, a municipal corporation, of the County of Denton, State of Texas, Party of the Second Part, hereinafter called OWNER, WITNESSETH: That for and in consideration of the payments and agreements hereinafter mentioned to be made and performed by Owner, and under the conditions expro:ssed in the bond bearing even date herewith, the Contractor iereby agrees with Owner to commence and complete the construction of certain improv,--meets described as follows: For the construction and completion of a water feeder line for the purpose of extending water to the City of Denton Airport, as described in the specifications therefor incorporated herein and made a part hereof and all extra work in connection therewith, under the terms as stated in the Invitation for Bids, Proposal, and Information and Special Instructions to Bidders, and General Conditions of Agreement attached hereto and hereby made a part of this contract by reference the same as if set forth at length herein; aiid at Conrractor's own proper cost and expense to furnish all materials, supplies, machinery, equipment, tools, supervision, labor, insurance and other accessories and services necessary to complete the said construction in accordance with the conditions and prices stated in the proposal attached hereto, and in accordance with the conditions and prices stated in the proposal, and in accordance with all the General Conditions of Agreement, and in accordance with the plans, which include all maps, plats, blueprints and other drawings and printed or written explanatory matter thereof, and specifications therefor, as prepared by the City Engineer of the City of Denton, Texas, each of which has been identified by the endorsement of the Contractor and the said City Engineer therein. Contractor hereby agrees to commence work within ten (10) days after the date written notice shall have been given to com- mence, and to substantially complete said work within ,1,,; working days after the date established in the written notice to commence work. Owner agrees to pay the Contractor in current funds for the performance of the construction of the work in accordance with the proposal submitted therefor, subject to additions and deductions, as provided in the General Conditions of Agreement, and to make payments on account thereof as provided therein. IN WITNESS WHEREOF, the parties have executed this Agreement in duplicate in the year and on the date first above written. Fire Hydrant: Hydrants shall be located as shown on Plans or as directed by the Engineer. Hydrants shall be set truly vertical with the base resting upon a concrete pad six (611) inches thick and approximately sixteen (1611) Inches square. The base of the hydrant shall be surrounded by not less than seven (7) cubic feet of clean crushed stone or gravel maximum two (211) inches in size. 8., Highway Crossing; The Owner will obtain permission to install these cross- ings; however, the Contractor shall advise the proper State Highway represents- tives, not less than three (3) days ahead of the start of the work. All work within the limits of the State controlled Highway shall meet all requirements of the State Highway Department, including safety barricades, etc. The Contractor shall cooperate fully with the Highway Department in performing this work to their satisfaction. C. Railroad Crossings The Owner has obtained the necessary permits for the Railroad Crossing. All other negotiations with the Railroad Company, except for the rights-of way, shall be carried on by the Contractor, not less than five (5) days prior to the time of his intentions to beg±n work on that portion of the project.
