Box 13246, Capitol Station Austin, Texas 78711 January, 1976 INTRODUCTION The Federal Water Pollution Control Act as Amended, passed in the closing days of the 92nd Congress, has been hailed as the most far reaching environmental protection measure ever enacted by Congress. Section 208 of the FWPCAA was Included to encourage states and local governments to engage in areawide planning and management of i'raste treatment and water quality control programs. The Nation's governors are the primary decision makers under Section 208. The governor may designate urban-industrial areas which he identifies as having a "substantial" wa*.er quality control problem. When an area is designated, an areawide planning agency must also be designated. The Texas Water Quality Board was charged by the Governor through Executive order #18 to provide recommendations for designated areas and planning agencies. "(2) The amount granted to any agency under paragraph (1) of this subsectior shall be 100 per centum of the costs of developing and operating a continuing areawide waste treatment management planning process under subsection (b) of this section for each of the fiscal years ending on June 30, 1973, June 30, 1974, and June 30, 1976, and shall not exceed 75 per centum of such costs in each succeeding fiscal year. "(3) Each applicant for a grant under this subsection shall sub- mit to the Administrator for his approval each proposal for which a grant is applied for under this subsection. The Administrator shall act upon such proposal as soon as practicable after it has been sub- milted, and his 'approval of that proposal shall be deemed a con- tractual obligation,tf the United States for the payment, of Its con- tribution to such proposal. There Is authorized to bi appropriated to carry out this subsection not to exceed $50,000,000 for the fiscal year ending June 30, 1973, not to exceed $100,000,000 for the fiscal year ending June 30, 1974; and not to exceed $160,000,000 for the fiscal year ending June 34, 1976. "(g) The Administrator is authorized, upon rrquest of the Gov. ernor or the designated planning agency, and without reimburse- ment, to consult with, and provide technical assistance to, any agen- cy designated under subsection (a) of this section in the develop- ment of areawide waste treatment management plans ur, 'er tsub- sectlun (b) of this section. ''(h) (1) The Secretary of the Army, acting through the Chief of Engineers, in cooperation with the Administrator is authorized and directed, upon request of the Governor or the designated planning organization, to consult with. and provide technical assistance to, any agency designed under subsection (a) of that section in develop- ing and operating a continuing areawide waste treatment manage- meet planning process under subsection (b) of this section. 11(2) There is authorized to be appropriated to the Secretary of the Army, to carry out this subsection, not to exceed $60,000,000 per fiscal year for the fiscal years ending June 30, 1973, and June 30, 1974. 32
