cities for private purposes, for such consideration and upon such
terms as they may prescribe; provided, however, such use does not
interfere with the public use of such streets and sidewalks, or
create any hazardous or dangerous conditions thereon; and
WHEREAS, Texas Woman's University has applied to the City
Council of the City of Denton, Texas, for an easement permitting
the construction of an overhead passageway over certain portions

October, 1955, declared the necessity for the permanent improve-

of Houston Place lying immediately West of the West boundary line
of Bradley Street, in the City of Denton, Texas; and
WHEREAS, the City Commission of the City of Denton, Texas,

by said ordinance, provided that a portion of the cost of such
improvement would be assessed against the abutting properties and

the owners thereof, said assessment to constitute a first and prior..

lien upon all such properties and a personal liability of the real 1

WHEREAS, thereafter, on the 6th day of June, 1956, a notice
of the enactment of said ordinance was filed with the County Clerk
and recorded in Volume 422, Page 249 of the Deed Records of Denton

55-82 was never constructed and the filing of the notice of enact-

AT A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DENTON$
TEXAS, HELD IN THE MUNICIPAL BUILDING IN SAID CITY ON THE 24TH
DAY OF OCTOBER, A.D. 1961,
R E S O L U T I O N
WHEREAS, the City Council of the city of Denton, Texas, has
authorized a program or construction of sewage works at an esti-
mated cost of Nine Hundred Fifty-four Thousand, Seven Hundred
Twenty-seven Dollars ($954,727.00) and the United States Govern-
ment, acting through the Public Health Service, has offered a

Federal grant in the amount of Two Hundred and Fifty Thousand
Dollars ($2502000.00) as designated on Part A, Offer and Acceptance,
i
now under consideration by this body; now therefore be it

RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS,
that said offer as submitted, together with the terms and condi-
tions thereof, is hereby accepted and approved; and Mayor Frank ?y
Barrow is hereby authorized and directed to sign said Offer and b
Acceptance and any other necessary documents required to complete
the project on behalf of said City of Denton, Texas; and be it r
further
RE50LVED, that the (;ity of Denton, Texas, has or, will procure

a fee simple or such other estate or interest in the site of the
project, including the necessary easements and rights-of-way, as
i
to assure undisturbed use and possession for the purposes of con-
struct.ion, operas' n and maintenance of the works for the estimated
life of the projects and that in the event such title, estate, or
interest in such sicc, easements or r'.ghts-of-way may in the future
be contested, the City of Denton, Texas, will defend and maintain
its title in such site and hold the United States Government blame-
less in such action.

applies to Ole City Couuuil of the City of Denton, Texas, for a temporary
establishment of a helicopter landing area on certain property belonging
to Central Baptist Church at 2300 Beaumont Street in the City of Denton,
Texas, under provisions of '~ticle 2,08 of the Code of Ordinances of the
City of Denton; and
WHEREAS, such landing area is requested for he ptirpooe of offering

helicopter rides to the public for hire for the duration of the 1961 North
! Texas Stdta Fair only; and
j WHEREAS, such proposal her the approval of the Central Baptist Church !
j and the North Texas State Fair Association; and

"WHEREAS, it appears that Trinity Valley Helicopter Stirvice has secured
liability insurance ooverage with $50,000/$500,000 1,+.mits for the protection
of the public; now therefore F
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON) TEXAS, that
the vacant property ad,jecent to and belonging to Central Baptist Church at
(t 2300 Beaumont Street in the City of Denton, Texas, be, and the same is her5hy,
designated as a regulnr helicopter landing axes undnr the provisions of Article
2.05 of the Code of Ordinances of the City of Denton, Texas, for a temporary

period not exceeding the duration of the 1961 North Texas Slate Fair; and be
it further
% RESOLVED, that: the said Trinity Valley Helicoptor Service be, and it is

hereby, granted permission to offer helicopter video for hire to the public

open to the public; and be It. further

of Denton, 'texas, agreeing to save and hold harmless the City of Denton from
any and all liability for damages of any kind which may arise out of, or be
in any way connected with, the conduct of helicopter rides for hire at the
location mentioned above in this resolution,
