After determining that a quonim is present, the City Council of the City of Denton, Texas will
convene in a Special Called Meeting on Monday, August 27, 2012 at 7:30 a.m. in the Council
Worlc Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which the
following items will be considered:
WORK SESSION
1. Hold a discussion regarding the Disaster Declaration by the Denton County Judge
concerning a West Nile Vinis Health Emergency, which calls for State assistance for
response and nutigation support to combat West Nile Vinis, including aerial spraying to
mininuze and control mosquito populations.
SPECIAL CALLED SESSION
1. Consider approval of a resolution of the City of Denton expressing its desire to
participate with and be included in aerial spraying to control mosquitoes that spread West
Nile Vinis as a result of a Disaster Declaration by the Denton County Judge concerning a
West Nile Vinis Health Emergency, which Declaration calls for State assistance for
response and nutigation support to combat West Nile Vinis, including aerial spraying to
mininuze and control populations of mosquitoes; and providing an effective date.
NOTE: The City Council reserves the right to adj ourn into a Closed Meeting on any item on its
Open Meeting agenda consistent with Chapter 551 of the Texas Government Code, as amended,
or as otherwise allowed by law.

BACKGROUND
On August 23, 2012, the Cit�T of Denton received a letter from Denton CounttT Judge ManT Horn stating
that the Judge had issued a Disaster Declaration and Eiecutive Order to request State Assistance for
support to combat West Nile Virus (WNV). As �Tou are a��� are, WNV has reached unprecedented levels
in Denton CounttT, and the CounttT currentl�T has the highest WNV incidence rate in the State of Teias.
In response the Denton Count�T Health Department is recommending more aggressive strategies of
mosquito control, in the form of aerial spra�Ting, for the unincorporated areas of the Count�T. The Count�T
has stated that municipalities can participate in the aerial spra�Ting effort, but requires the municipalities to
malce a formal request to be included.
It is ��� orth noting that Rislc Leve15 of the Denton Mosquito Surveillance and Response Plan acldresses
this issue. Specificall�T, the plan states " if public health emergencies are declared at the CounttT or State
level, the recommended responses associated ���ith the declaration ���ill talce precedence over the control
plan of the Cit�T of Denton".
This information is being provided to facilitate a discussion of aerial spra�Ting and to respond to Judge
Horn's request for the Cit�T of Denton to eipress its desire to be included or to not be included in the
aerial spra�Ting efforts in Denton Count�T.

Health Department Reeommends Aerial Spraying for West Nile Virus
August 22, 2012 — Denton Count�= Health Department has recommended that Denton Count�= Judge,
�Iary- Horn, declare a ��'est �ile �'irus Health Lmergency- and rec�uest that the Department of State
Health Sereices make adclitional resourc es aeailable to Denton County- in the form of aerial spray-ing.
Denton Count�= has recorded 105 cases of ti�lest Nile �'irus, and the number of cases connnues to
increase claily-. �Iore importantly-, Denton County- has the highest ��'��' incidence rate in the State.
"��'e are ��ei�- concerned at the number, rate, and seeerit�- of cases of ��'est �ile �'irus among Denton
Count�= residents", stated Bing Burton, Ph.D., director of Denton Count�= Health Department.
Ground spra�=ing and the use of lar�racide in ponds and standing water has not been successful in
containing this disease outbreak. Although these strategies, coupled with education and the
importance of personal protectiee measures `vill remain an important part of Denton County-'s disease
response, the geographic acleantages of aerial spray-ing may- be the most effectiee means of combating
��'��'. It is belieeed that the ability- of aerial spray-ing to coeer eei�-large areas of the county- at one time
may- proeide the needed boost in preeentiee measures to recluce the gro`ving number of cases occurring.
The pesticide used in aerial spray-ing is eei�- similar to the one employ-ed in ground spray-ing. It is not a
more concentrated dose, and it has been declared safe for humans and pets by- the Centers for Disease
Control. The persistence of this disease outbreak has led health officials to recommend that the count�=
expand measures to protect Count�= residents.
The declaration of a Health Lmergency- `vill allo`v the County- to rec�uest State and Federal resources.
Howe�rer, as in Dallas Count�=, the municipalities in Denton Count�= will determine whether the�= wish
to be included in the spra�=ing. Prompt response from the municipalities will be encouraged to enable
optimal use of the aerial spray- resource.

DISASTER DECLARATION
AND
EXECUTIVE ORDER OF THE DENTON COUTY JUDGE
WHEREAS, Denton County is experiencing a wide spread outbreak of mosquito-bome West
Nile Vines that has csused and continues to cause wide spread sever� illness and threat to loss of
life at the peril of public health and safety; and
WHEREAS, unless mitigation actions toward control and host elimination are conducted,
including response actions, the immediate threat of illness and threat to loss of life will continue
to increase; and
WHEREAS, the Denton County Health Department and the Denton County Department of
Emergency Services has established emergency protective measures, mitigation procedures and
response plans for this type of health emergency; and
WHEREAS, The Denton County Health Department has declared a serious health emergency
requiring the issuance of a Disaster Declaration and the implementation of the Denton County
Emergency Operations Plan and associated Emergency Policies; and
WHEREAS, said state of disaster requires that certain emergency measures be taken pursuant to the
Texas Disaster Act of ] 975 relating to Ernergency Management and Public Health, specifically
§418.108(a) of the Government Code and 418.012 through RP 32-Executive Order and by virtue of
authority vested in me by Denton County Gommissioners Court order dated July 21, 1986;
IYOW, THEREFORE, this Disaster Declaration and the following Executive Order regulations shall take ef%ct !
immediately upon issuance of this order and shall remain in effect for 7 days or urnil renewed by the Denton �ou
Commissioners Court:
