BACKGROUND In preparation for the joint meeting of the City of Denton City Council and the Denton Independent School District (DISD) Board of Trustees, staff has prepared a presentation of major development projects that have been approved, are currently in construction, and/or are currently in review by the City. Although some of the recent projects (i.e. annexations) do not have plans in place for development, many of the selected development projects will influence decision making for the City and DISD in the coming years. Due to the scope and scale of each project, the affects these projects will have on our mutual ability to maintain adequate service delivery will be monitored over a longer planning horizon to meet the needs our constituency. The presentation will identify major development projects including: Master Planned Communities (MPC); Rayzor Ranch; residential developments; and recent annexations. Of these projects, Rayzor Ranch is actively developing the area north of University Blvd (US 380) for commercial purposes. There has not been any development activity on any of the MPC projects however the City was approached recently by the developer of Cole Ranch who is interested in commencing the development in 2015. In 2010, the City completed the annexation of 3,377 acres of land from our Extraterritorial Jurisdiction. Although now incorporated in the City, further study is being performed through the update to the Denton Plan to determine the appropriate future land use designation which may or may not include residential land uses. Prepared by: Brian Lockley Interim Director Planning and Development Submitted by: John Cabrales Assistant City Manager AGENDA INFORMATION SHEET AGENDA DATE: October 1, 2012 DEPARTMENT: Finance ACM: Bryan Langley SUBJECT Receive a report and hold a discussion regarding the City’s proposed November 2012 Street Bond Election. BACKGROUND Over the last several years, the quality of streets in the City of Denton has deteriorated. As a result, the Citizens Bond Advisory Committee has proposed a $20.4 million bond program that is primarily focused on improving street infrastructure. The program assumes no tax rate increase, and voters will be asked to consider the program on November 6, 2012. On April 3, 2012, the City Council formally created the Citizens Bond Advisory Committee to provide recommendations on projects to be financed with General Obligation bonds. Additionally, the City Council appointed twenty-one (21) members of the public to serve on the Committee, and Mr. Tim Crouch and Mr. Marty Rivers were appointed as Co-Chairpersons of the Committee. The Committee met on April 23, May 7, May 21, June 4, and June 11 to discuss the condition of existing streets in the community. In addition, the Committee also conducted a tour of various streets on May 26. On June 6, the Committee presented their preliminary project recommendations to the Planning and Zoning Commission, as required by City Charter. The Committee focused their attention on streets which have an Overall Condition Index (OCI) value of 40 or less (on a 100 point scale). Streets with this value are considered to be poor streets, and as such, the Committee expressed an interest in focusing on the worst streets in the community. The Committee also initiated a public information campaign in May. The purpose of this campaign was to request bond project recommendations from citizens. As a result of this campaign, the Committee received a number of recommendations from the public, and each citizen proposal was discussed specifically by the Committee to determine whether it should be recommended in the upcoming bond package. Most notably, Scripture Street from Ector to Malone was added to the list of recommended projects due to the feedback received from the public. Agenda Information Sheet October 1, 2012 Page 2 Public Art In 2006, the City Council approved a Public Art Policy which stated The City of Denton shall “ include a base of 2% for the arts from all future Capital Improvement Programs, with the option and flexibility to increase to a 4% maximum, based on needs and economic conditions.” According to the definition contained in this policy, public art “encompasses the broadest definition of visual art including all artistic disciplines.” Under this policy, $400,000 to $800,000 of the proposed $20 million bond program for street reconstruction would need to be reserved for public art funding. Since a single issue bond program for street infrastructure had not been anticipated when this policy was drafted, the City Council also asked the Citizens Bond Advisory Committee to provide a recommendation on whether the policy should be applied in the upcoming bond program. On May 7, the Citizens Bond Advisory Committee formally recommended to the City Council that public art be included in the upcoming bond program, and on May 15, the City Council directed staff to include 2% ($400,000) of the upcoming bond program for public art. Further, the City Council asked the Public Art Committee to provide project recommendations. To this end, the Public Art Committee met on May 24 and May 30 to consider their recommendations. On June 1, the Public Art Committee formally voted to recommend that public art be included for the Interstate 35 (I-35) Corridor in the upcoming bond program. It is anticipated that artistic designs will be constructed in the concrete retaining walls which accompany the expansion of I-35. Exhibit 1 is a memorandum from Emerson Vorel, Director of Parks and Recreation, which describes the intersections that are expected to be funded by the Texas Department of Transportation and the City of Denton. Citizens Bond Advisory Committee Recommendations After reviewing detailed street information, citizen input, recommendations from the Public Art Committee, and other information, the Citizens Bond Advisory Committee voted on June 11 to formally recommend projects to the City Council for consideration. As part of this recommendation, the Committee voted in favor of the Public Art Committee recommendations. Further, the Committee recommended that both the public art and street project recommendations be presented to voters for consideration as one ballot and bond proposition. On June 19, the recommendations of the Citizens Bond Advisory Committee were presented to the City Council for consideration, and the City Council voted to formally call for the bond election on August 14. Exhibit 2 provides a detailed summary of the street segments that are recommended for reconstruction. Exhibit 3 is a PowerPoint presentation which provides a summary of the bond program, and in Exhibit 4, a copy of the bond brochure for the public education campaign is provided. Agenda Information Sheet October 1, 2012 Page 3 PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS) At the January 31, 2012, Annual Planning Session, staff briefed the City Council on the proposed 2012 Bond Election priorities and schedule. On February 6, 2012, the City Council discussed the proposed bond election and indicated a preference for a twenty-one (21) member Citizen Bond Advisory Committee (3 appointments for each City Council member). On February 21, 2012, the City Council discussed the proposed bond election, calendar of events, and Citizens Bond Advisory Committee appointment process. On March 6, 2012, the City Council appointed members of the public to the Citizen Bond Advisory Committee for the proposed 2012 Bond Election. On April 3, 2012, the City Council formally approved the creation of a Citizens Bond Advisory Committee and appointed additional members of the public to serve on the Committee. On April 23, 2012, the Citizens Bond Advisory Committee met to discuss developing recommendations for the upcoming bond program. On May 7, 2012, the Citizens Bond Advisory Committee met to discuss developing recommendations for the upcoming bond program. The Committee also recommended that public art be included in the upcoming bond program. On May 15, 2012, the City Council indicated that 2% of the upcoming bond program should be devoted to public art. On May 21, 2012, the Citizens Bond Advisory Committee met to discuss developing recommendations for the upcoming bond program. On May 24, 2012, the Public Art Committee discussed the upcoming bond program and potential projects. On May 26, 2012, the Citizens Bond Advisory Committee conducted a tour of various streets in City. On May 30, 2012, the Public Art Committee discussed the upcoming bond program and potential projects. On June 1, 2012, the Public Art Committee recommended that public art in the I-35 Corridor be included in the upcoming bond program. On June 4, 2012, the Citizens Bond Advisory Committee met to discuss developing recommendations for the upcoming bond program. On June 11, 2012, the Citizens Bond Advisory Committee formally voted to forward their recommendations to the City Council for consideration. On June 19, 2012, the Citizens Bond Advisory Committee presented their recommendations to the City Council for consideration. On July 17, 2012, the City Council discussed the upcoming bond election and potential options for language that could be included in the bond ordinance, proposition, and ballot. On August 7, 2012, the City Council conducted a public hearing for the upcoming bond election. On August 14, 2012, the City Council approved an ordinance which formally calls for a bond election on November 6, 2012. EXHIBITS 1. McCormick Street North Texas Blvd. West Oak St. Accent Aesthetic Treatments The intersections below will have (which consist of graphic display enhancements designated to specific primary intersection abutments and are considered as integral to all of the project corridor design) and will be funded by TxDOT with the construction of the corridor through Denton: Post Oak Drive/Lakeview Blvd. Lillian Miller Parkway/Loop 288 Hwy 377/Fort Worth Drive North Texas Boulevard Bonnie Brae Street Enhanced The City Council has also identified the University Boulevard/Hwy. 380 intersection as an Aesthetics Treatment intersection (above and beyond those listed above and are to be considered as an added option to the project corridor design and will require specific coordination, obligations and participation by the City of Denton.) The funding for the enhanced improvements will be provided by the proposed $400,000 public art bond issuance. The Public Art Committee has also discussed the possibility of designating the McCormick Street intersection for an enhanced aesthetics treatment with the same bond funds. At this time, the exact design and cost for the “baseline” and “accent” enhancements is not known. As such, it is possible that the City Council and/or Public Art Committee may wish to “enhance” these intersections beyond the standard improvements planned by TxDOT. As discussed previously with the City Council, enhanced panel designs in the concrete retaining walls will cost between $40,000 to $50,000 for intersections that are designated, and the majority of these enhancements are expected to be funded by the City of Denton. Campbell SUBJECT Discussion regarding: b) Status Report regarding DISD/City request to the NCTCOG Regional Transportation Council for funding to install sidewalks near Woodrow Wilson Elementary School and Pecan Creek Elementary School BACKGROUND Following the joint City Council/DISD Board of Trustees meeting on March 5, 2012, during which the North Central Texas Council of Governments delivered a presentation on school siting and transportation, both the City and School District began a unified effort to identify appropriate and potential projects for possible funding assistance through the NCTCOG. Through those efforts and more specifically the leadership of Mayor Pro Tem Pete Kamp, current Chair of the NCTCOG Regional Transportation Council, the COG has identified funding to install sidewalks near two school sites. More detailed information was presented to the City Council in an Informal Staff Report dated August 22, 2012, a copy of which is attached. The City and School District are now considering fund sharing options for the 20% local match required by the funding program through the Congestion Mitigation and Air Quality Improvement Program (CMAQ). Although no formal presentation is planned, Item 4(b) has been placed on the agenda for the DISD Board of Trustees/City Council joint meeting of October 1 to provide opportunity for further comment, discussion or questions regarding this effort should Council or Board Members so desire. Campbell City Manager Date: August 22, 2012 Report 2012-069 INFORMAL STAFF REPORT TO MAYOR AND CITY COUNCIL SUBJECT: City of Denton/Denton Independent School District Joint Project Update BACKGROUND: th As a result of the March 5 2012 joint meeting of the City of Denton (COD) and the Denton Independent School District (DISD) the COD and DISD staff identified two projects that were ultimately submitted to North Central Texas Council of Government (NCTCOG) for possible funding. The request submitted to NCTCOG was for funding to install sidewalks near both Woodrow Wilson and Pecan Creek Elementary School. COD/DISD staff met with COG staff only to learn that while the COG staff was willing to assist with a funding application through the Texas Department of Transportation’s (TxDot) Safe Route to School program, there was no funding available for the proposed Woodrow Wilson or Pecan Creek elementary sidewalk projects. However, on July 27, 2012, NCTCOG identified a funding opportunity for the proposed projects through the Congestion Mitigation and Air Quality Improvement Program (CMAQ) and submitted a modification to the Transportation Improvement Program (TIP) on the City’s behalf. The CMAQ program will fund 80% of the projects cost with a 20% local match. The total project cost is $471,112; 80% or $376,896 from CMAQ funds and 20% or $94,224 from local match. As partners in these two projects, if each entity contributed 50% of the local match, this would result in an expense of $47,112 for each partner. Attached is a letter from Pete Kamp, Chair of the Regional Transportation Council, notifying the COD and DISD of the project funding opportunity.
