HomeMy WebLinkAboutJanuary 14, 2014 AgendaAGENDA CITY OF DENTON CITY COUNCIL January 14, 2014 After determining that a quorum is present, the City Council of the City of Denton, Texas will convene in a Special Called Session on Tuesday, January 14, 2014 at 4:00 p.m. in the Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which the following items will be considered: 1. Consider adoption of an ordinance rejecting any and all competitive bids for a public works contract for the constriction of Wastewater Collection System Improvements around Eagle Drive and Congress Street project for the City of Denton (Bid Number 5379); and providing an effective date. Following the completion of the Special Called Session, the City Council will convene in a Closed Meeting to consider specific items when these items are listed below under the Closed Meeting section of this agenda. The City Council reserves the right to adjourn into a Closed Meeting on any item on its Open Meeting agenda consistent with Chapter 551 of the Texas Government Code, as amended, or as otherwise allowed by law. 1. Closed Meeting A. Certain Public Power Utilities: Competitive Matters — Under Texas Government Code Section 551.086. I. Receive a presentation from Denton Municipal Electric ( "DME ") staff regarding public power utility competitive, financial and commercial information pertaining to energy risk - management strategies, risk management procedures, alternatives, and contracts that concern DME's acquiring power in the marketplace in order to optimize DME's energy portfolio. Discuss, deliberate and provide staff with direction. B. Deliberation regarding Personnel Matters — Under Texas Government Code Section 551.074. I. Deliberate and discuss the evaluation, duties, discipline, procedures, and contracts of the Municipal Court Judge, City Attorney, and City Manager. AGENDA INFORMATION SHEET AGENDA DATE: January 14, 2014 Questions concerning this acquisition may be directed DEPARTMENT: Materials Management to Frank Payne at 349 -8946 ACM: Bryan Langley � -A SUBJECT Consider adoption of an ordinance rejecting any and all competitive bids for a public works contract for the constriction of Wastewater Collection System Improvements around Eagle Drive and Congress Street project for the City of Denton (Bid Number 5379); and providing an effective date. BACKGROUND The Wastewater Collection System Improvements around Eagle Drive and Congress Street project consists primarily of the replacement of approximately 11,000 feet of existing 6 through 10 inch clay gravity sanitary sewer with new 8 to 12 inch PVC sanitary sewer (refer to Exhibit 1). The project is required due to the poor structural condition of the existing clay lines which need to be replaced. Bids for the construction phase of this project were received on December 12, 2013. There was only one bid received for the project at a price of $2,477,176.00. The engineer's opinion of probable construction cost for the work was $2,200,000.00. The bid summarN- is enclosed as Exhibit 2. The low bidder for this project, Housely Communications, Inc. appears to meet all of the necessary requirements for qualification on this project. The Purchasing Department indicates that this bid was sent to approximately 370 potential vendors on both the State and local vendor lists as well as being advertised in the local paper. However, inquiries made after the bid opening revealed that many of the utility contractors that typically submit bids on City of Denton utility work were not aware of the project, which is a possible explanation as to whN- only one bid was received. Engineering staff has provided the Purchasing Department additional information to ensure that future vendor list includes the names of vendors that typically submit bids on City projects. Staff believes that a more competitive bid will be received if the project is rebid with more extensive contractor notification; therefore staff's recommendation is that all bids should be rejected. OPTIONS 1. Reject all bids and rebid the project. 2. Award the contract to the qualified low bidder, Housely Communications, Inc. RECOMMENDATION Staff recommends rejection of all bids and rebid of the project. WHEREAS, the City has solicited, received and tabulated competitive bids for the constriction of public works or improvements (the constriction of a Wastewater Collection System Improvements around Eagle Drive and Congress Street —Bid Number 5379) in accordance with the procedures of State laws and City ordinances; and WHEREAS, the City Council has determined that it is in the best interest of the City that the herein described bids should be rejected; NOW THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The following competitive bids for the constriction of public works or improvements, as described in the "Bid Invitations ", "Bid Proposals" or plans and specifications on file in the Office of the City's Purchasing Agent filed according to the bid number assigned herein (for the constriction of a Wastewater Collection System Improvements around Eagle Drive and Congress Street Bid Number 5379) are hereby rejected: BID NUMBER MBER CONTRACTOR AMOUNT 5379 Housely Communications, Inc. $2,477,176 SECTION 2. The City Manager is hereby authorized to execute all necessary documents for the rejection of said bids. SECTION 3. The City Council of the City of Denton, Texas hereby expressly delegates the authority to take any actions that may be required or permitted to be performed by the City of Denton under Bid 5379 to the City Manager of the City of Denton, Texas, or his designee.
