CITY OF DENTON CITY COUNCIL
March 3, 2014
Joint Meeting of the City of Denton City Council and the Library Board on Monday, March 3,
2014 at 11:30 a.m. in the Council Work Session Room at City Hall, 215 E. McKinney Street,
Denton, Texas, at which the following items will be considered:
1. Call to order; announce quorum, introductions.
2. Receive a report, hold a discussion and give staff direction regarding the Denton Public
Library Annual Report and Strategic Plan.
3. Under Section 551.042 of the Texas Open Meetings Act, respond to inquiries from the
City Council or the public with specific factual information or recitation of policy, or
accept a proposal to place the matter on the agenda for an upcoming meeting AND
under Section 551.0415 of the Texas Open Meetings Act, provide reports about items of
community interest regarding which no action will be taken, to include: expressions of
thanks, congratulations, or condolence; information regarding holiday schedules; an
honorary or salutary recognition of a public official, public employee, or other citizen; a
reminder about an upcoming event organized or sponsored by the governing body;
information regarding a social, ceremonial, or community event organized or sponsored
by an entity other than the governing body that was attended or is scheduled to be
attended by a member of the governing body or an official or employee of the
municipality; or an announcement involving an imminent threat to the public health and
safety of people in the municipality that has arisen after the posting of the agenda.
Following the completion of the Joint Meeting, the City Council will convene in a Closed
Meeting to consider specific items when these items are listed below under the Closed Meeting
section of this agenda. The City Council reserves the right to adjourn into a Closed Meeting on
any item on its Open Meeting agenda consistent with Chapter 551 of the Texas Government
Code, as amended, or as otherwise allowed by law.
1. Closed Meeting:
A. Consultation with Attorneys — Under Texas Government Code Section 551.071.
1. Consult with and provide direction to City's attorneys regarding legal
issues and strategies associated with Gas Well Ordinance regulation of gas
well drilling and production within the City Limits and the extraterritorial
jurisdiction, including Constitutional limitations, statutory limitations
upon municipal regulatory authority, statutory preemption and /or impacts
of federal and state law and regulations, standstill agreements or other
cessation regulations and take any appropriate action regarding the above
in the meeting of today's date as it concerns municipal regulatory
authority or matters relating to enforcement of the ordinance.
Following the completion of the Closed Meeting, the City Council will convene in Open Session
to consider the following item.

1. Consider adoption of an ordinance of the City of Denton, Texas amending Ordinance
Nos. 2013 -330 and 2014 -040 to extend a "Standstill Agreement" between the City of
Denton, Texas and Eagleridge Operating, LLC until midnight on May 6, 2014 with
regard to certain disputes and issues over gas drilling in the City to allow the parties an
opportunity to engage in global settlement negotiations as it concerns unresolved issues
between them; and providing for an effective date.

SUBJECT
Receive a report, hold a discussion, and give staff direction regarding the Annual Library Report for
FY 2012 -13 and the development of a Strategic Plan for the Library System.
BACKGROUND
Each year, Denton Public Library creates an annual report for the public in order to foster
transparency in government and promote library services to the community. For the past two years,
this report has included a video element. This brief report gives an accounting for some of the
activity that takes place within the Library department. During this work session, staff will review
the paper version of the report which is attached as Exhibit 1. Additionally, staff will present the
video element during the meeting as well.
The Denton Public Library's Strategic Plan expired in 2013. New administration in the Library
established a process to obtain input from the public, customers, staff and library leadership in order
to create a new guiding document for the next three years. This document is now ready to be
presented to City Council for their information and input. The plan includes three broad goals
under the headings Community Education, Community Connections and Community Resources.
Included in the document are plans to expand outreach, provide advanced training, and develop new
and emerging resources for public use. The new Strategic Plan is attached as Exhibit 2.

The Library Board has been kept abreast of procedures relating to the gathering of information for
creation of a new Strategic Plan, and accepted the resultant plan at the February 10, 2014 meeting.

3 Year Strategic Plan 2014 - 2016
The Denton Public Library serves the citizens of Denton, Texas as a department within the City of
Denton municipal government. Denton Public Library is embodied in three facilities, Emily Fowler
Central Library, North Branch Library and South Branch Library. Denton Public Library has a progressive
76 year history. This strategic planning document will serve as a guide to continued library growth and
governance during the next three years.
The current culture surrounding library services is denoted by remarkable change. Material formats,
delivery options, programming, and physical spaces have all come under scrutiny as the library
profession and concept adapts to reality in the 21" century. The current speed of change requires
innovation and ingenuity on the part of library leaders to meet demands and embrace opportunities.
This plan is designed to be a fluid document, open to revision and input as needs and opportunity
dictate. What will remain the same is the core commitment to the three guiding goals contained within:
providing education, connections and resources for our service community. Our challenge is to remain
relevant in an environment of many choices, and to communicate our considerable value and services to
our customers.
In many ways, these next few years will be an exercise in bridging the gap between traditional library
services and new endeavors. It will require a respect and understanding of our past and a willingness to
experiment, take risks, and embrace the opportunities of the future. The role of a public library is
moving from a static institution to a responsive entity; from just a provider of materials to a co- creator
of content; from a transaction -based model of service to a relationship -based participant in the
community. This document represents our willingness to begin.

Adoption and adherence to a strategic plan takes time. Library leadership will present the plan to staff
and guide the interpretation of the goals and objectives. Each staff member should be able to include
some facet of the stated action steps in their own Individual Development Plan or suggest another
applicable action step.
Progress on action steps will be considered monthly by managers during established meetings. Feedback
will be weighed and courses of action developed through this process of examination. As we work
toward our three goals, the Library experience will evolve through our various outlets — inside our
buildings, through our web presence and through our outreach. We expect our services to become more
and more collaborative as we connect more completely with civic and community life.
While we are looking forward to our role in the future we retain our basic commitments to literacy by
providing progressive children's programs and personalized adult literacy tutoring. We hope to expand
the definition of literacy provider to include comprehensive electronic literacy as an offering. The digital
skills needed for success in the 21" century must include an electronic component, and the Denton
Public Library is ready to respond with appropriate training and opportunities to practice. Purchase and
implementation of current technology options will enable our commitment to this facet of literacy to
expand.
Our strategic plan will impact every facet of library operations including

AN ORDINANCE OF THE CITY OF DENTON, TEXAS AMENDING ORDINANCE NOS.
2013 -330 AND 2014 -040 TO EXTEND A "STANDSTILL AGREEMENT" BETWEEN THE
CITY OF DENTON, TEXAS AND EAGLERIDGE OPERATING, LLC UNTIL MIDNIGHT
ON MAY 6, 2014 WITH REGARD TO CERTAIN DISPUTES AND ISSUES OVER GAS
DRILLING IN THE CITY TO ALLOW THE PARTIES AN OPPORTUNITY TO ENGAGE IN
GLOBAL SETTLEMENT NEGOTIATIONS AS IT CONCERNS UNRESOLVED ISSUES
BETWEEN THEM; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City enacted a "Standstill Agreement" between the City and EagleRidge
Operating, LLC until midnight on January 31, 2014 pursuant to Ordinance No. 2013 -330 to
address certain disputes which have arisen between the City of Denton and EagleRidge
Operating LLC as it concerns gas drilling in the corporate limits of the City; and
WHEREAS, the City extended the "Standstill Agreement" pursuant to Ordinance No.
2014 -040 on February 4, 2014, retroactive to 11:59 p.m., January 31, 2014; and
WHEREAS, the parties deem it in their respective best interests to extend said
Agreement to continue to attempt to negotiate the disputes between them; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The preambles above are incorporated in this Ordinance as though set forth
in full.
SECTION 2. The City Council of the City of Denton hereby amends Ordinance Nos.
2013 -330 and 2014 -040 to extend the "Standstill Agreement" to midnight on May 6, 2014 and
authorizes the City Manager to execute the extension to the "Standstill Agreement" attached
hereto as Exhibit "A."
SECTION 3. This Ordinance is effective immediately.

Extension to Standstill Agreement
The Standstill Agreement between the City of Denton and EagleRidge Operating LLC,
signed on November 22, 2013 and approved by Ordinance No. 2013 -330, and extended by
Ordinance No. 2014 -040, is hereby amended to extend the standstill period to midnight, May 6,
2014.
Agreed to this the day of ¢C,djo-u41c 2014, by the undersigned officers
acting on behalf of their respective legal entities.
