HomeMy WebLinkAbout2014-139s:\legal\our documents\ordinances\14\industrial far ddc amendment ordinance.docx WHEREAS, the City of Denton has recognized that the existing Floor Area Ration (FAR) of 0.4 for the Industrial Center — General (IC-G) zoning district, as it appears in Subsection 35.5.7.3 of the Denton Development Code ("DDC"), is substantial lower than the FAR for less intense zoning districts; and WHEREAS, after providing notice and after conducting a public hearing on April 9, 2014 as required by law, the Planning and Zoning Commission recommended approval of the amendment to Subsection 35.5.7.3 of the DDC by a vote of 7-0; and WHEREAS, after providing notice and after conducting a public hearing on May 6, 2014 as required by law, the City Council finds that the change is consistent with the Denton Plan and the criteria in the DDC; NOW, THEREFORE, SECTION 1. The findings and recitations contained in the preamble of this ordinance are incorporated herein by reference as true. SECTION 2. The Maximum Floor Area Ratio in the Industrial Center — General zoning district as it appears in Subsection 35.5.7.3, is hereby changed from 0.4 to 2.0. SECTION 3. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid by any court, such invalidity shall not affect the validity of other provisions or applications, and to this end the provisions of this ordinance are severable. SECTION 4. Any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION 5.
