CONTRACT FOR THE CONSTRUCTION OF THE HIGHLAND STREET SANITARY SEWER
LINE AND DRAINAGE IMPROVEMENTS FOR THE CITY OF DENTON; PROVIDING FOR
THE EXPENDITURE OF FUNDS THEREFOR; AND PROVIDING AN EFFECTIVE DATE (BID
5535-AWARDED TO THE LOWEST RESPONSIBLE BIDDER MEETING SPECIFICATION,
QUALITY EXCAVATION, LTD, IN THE AMOUNT OF $357,390.80).
WHEREAS, the City has solicited, received and tabulated competitive bids for the
construction of public works or improvements in accordance with the procedures of State law and
City ordinances; and
WHEREAS, the City Manager or a designated employee has received and recommended that
the herein described bids are the lowest responsible bids for the construction of the public works or
improvements described in the bid invitation, bid proposals and plans and specifications therein;
NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The following competitive bids for the construction of public works or
improvements, as described in the "Bid Invitations", "Bid Proposals" or plans and specifications on
file in the Office of the City's Purchasing Agent filed according to the bid number assigned hereto,
are hereby accepted and approved as being the lowest responsible bids:

SECTION 2. The acceptance and approval of the above competitive bids shall not constitute
a contract between the City and the person submitting the bid for construction of such public works
or improvements herein accepted and approved, until such person shall comply with all requirements
specified in the Notice to Bidders including the timely execution of a written contract and furnishing
of performance and payment bonds, and insurance certificate after notification of the award of the
bid.
SECTION 3. The City Manager is hereby authorized to execute all necessary written
contracts for the performance of the construction of the public works or improvements in accordance
with the bids accepted and approved herein, provided that such contracts are made in accordance
with the Notice to Bidders and Bid Proposals, and documents relating thereto specifying the terms,
conditions, plans and specifications, standards, quantities and specified sums contained therein.
SECTION 4. The City Council of the City of Denton, Texas hereby expressly delegates the
authority to take any actions that may be required or permitted to be performed by the City of Denton
under Bid 5535 to the City Manager of the City of Denton, Texas, or his designee.
SECTION 5. Upon acceptance and approval of the above competitive bids and the execution
of contracts for the public works and improvements as authorized herein, the City Council hereby
authorizes the expenditure of funds in the manner and in the amount as specified in such approved
bids and authorized contracts executed pursuant thereto.
SECTION 6. This ordinance shall become effective immediately upon its passage and
approval.

Re: Highland Street Sanitary Sewer Line and Drainage Improvements
Dear President Smatresk:
As you are aware, the City of Denton has been coordinating water and wastewater utility upgrades and replacements with
street reconstruction efforts on Highland Street between North Texas Boulevard and Avenue A over the past few months.
The City installed the water line improvements with in-house personnel, but desired to publicly bid the wastewater line
improvements due to complexity and scheduling issues. In addition, the University of North Texas (UNT) has been
working to resolve some of the drainage issues associated with the Coliseum property, which ultimately involves a
connection to a public storm line in Highland Street.
The City of Denton agreed to assist the UNT with the bidding and construction phase of the storm drain installation
along Highland Street just north of the Coliseum in order to expedite the construction and coordinate this work with the
wastewater project. The City received public bids for the project on May 29, 2014, and a contract in the amount of
$357,390.80 was subsequently awarded to Quality Excavation, LTD. Of this total bid amount, $57,076.80 was directly
attributable to the storm drain work being constructed on behalf of UNT.
The University has agreed to pay the City of Denton the actual costs of the installation of the storm drain for the project.
The City of Denton has requested and UNT has agreed to pay the City of Denton $65,000 to provide for construction
costs and inspection and testing services. At the end of the project, the City of Denton will reimburse the University if
the actual costs are less than $65,000 or request additional funding if the project costs are greater. Please indicate your
agreement with this arrangement by signing both originals of this letter, keeping one for your records and returning one.
