McKinney Street, Denton, Texas at which the following items will be considered: NOTE: A Work Session is used to explore matters of interest to one or more City Council Members or the City Manager for the purpose of giving staff direction into whether or not such matters should be placed on a future regular or special meeting of the Council for citizen input, City Council deliberation and formal City action. At a Work Session, the City Council generally receives informal and preliminary reports and information from City staff, officials, members of City committees, and the individual or organization proposing council action, if invited by City Council or City Manager to participate in the session. Participation by individuals and members of organizations invited to speak ceases when the Mayor announces the session is being closed to public input. Although Work Sessions are public meetings, and citizens have a legal right to attend, they are not public hearings, so citizens are not allowed to participate in the session unless invited to do so by the Mayor. Any citizen may supply to the City Council, prior to the beginning of the session, a written report regarding the citizen's opinion on the matter being explored. Should the Council direct the matter be placed on a regular meeting agenda, the staff will generally prepare a final report defining the proposed action, which will be made available to all citizens prior to the regular meeting at which citizen input is sought. The purpose of this procedure is to allow citizens attending the regular meeting the opportunity to hear the views of their fellow citizens without having to attend two meetings. A. HISTORICAL BACKGROUND On November 3, 2014 the Solid Waste & Recycling Services staff provided a brief overview on the issue of dumpsters in the City of Denton's Rights -of -Way (ROW). At the City Council's request, they asked staff to come back for a further discussion on the issue and provide some options to reduce or eliminate dumpsters in the ROW. As a reminder of the legislative requirements of the State of Texas, a local government is responsible for providing solid waste services to its community. Additionally, both federal and state laws make the generator of waste responsible for its proper management and disposal. The Denton Development Code's (DDC) Site Criteria Manual requires new construction projects, and buildings remodeling greater than 25% of their square footage, to have dumpsters on the owner's property and they be screened by enclosures. Several years ago the city received a complaint that some dumpsters were partially blocking sidewalks, restricting some handicapped pedestrians from using them. During the month of December, 2003 the City of Denton Solid Waste & Recycling Department (SW &R) conducted a survey of dumpsters in the Right -of -Way (ROW), dumpsters in the front of buildings and dumpsters that were screened or in the rear of buildings. At that time there were 2,297 dumpsters in service, providing 24,350 cubic yards of weekly service, with 490 being in the ROW. The City Council's direction in 2004 was to reduce the number of dumpsters in the ROW and reduce the number of dumpsters located in front of buildings by working with businesses and property owners to seek their cooperation in the voluntary relocation of their dumpsters onto their property. In May, 2006 staff reported to the City Council that growth in the city had increased the number of dumpsters in service to 2,324, providing 25,049 cubic yards of service weekly, but staff was able to reduce the number of dumpsters in the ROW to 369. Believing that the Department had exhausted its voluntary marketing ideas to relocate dumpsters from the ROW, staff provided several potential programs to reduce the number even further which included: 1) requiring all dumpsters to be relocated through a change in the City's code; 2) require only dumpsters that have relocation potential to be moved and for those dumpsters which must remain in the ROW, assess a ROW usage fee; 3) take no further action except upon a change of property ownership or property management, and have the Department continue to seek voluntary relocation of dumpsters. Staff was directed to pursue a version of Program 3) to relocate dumpsters upon changes in property ownership and to continue seeking the voluntary relocation of dumpsters. Additionally, City Council indicated that new construction projects were required to construct dumpster enclosures for trash and recycling dumpsters. City of Denton Page 1 of 4 Printed on 1/29/2015 File #: ID 15 -054, Version: 1 In 2008, there were 2,526 dumpsters in service, providing 27,129 cubic yards of service weekly. There were 374 dumpsters located in the ROW, of which 30 were in the street, and 50 infringed upon sidewalks. The Departmental February 2014 inventory showed that we had 2,836 dumpsters in service, providing 31,732 cubic yards of service weekly. There were 322 dumpsters in the ROW, with 26 being in the street, and with 31 infringing upon sidewalks. The table below provides a comparison over time of the variances in cubic yards of service, and the dumpsters in the ROW due to growth in the business community and the changes in service levels. Of the remaining dumpsters in the ROW (which includes those in the street and on sidewalks), staff has established categories that describe their potential for relocation. Staff requests direction on which of the categories City Council wishes staff to prioritize their efforts on. See Exhibit 2 for the detailed location listing. Category 1. Possible relocation 2. Difficult to relocate 3. No relocation option Number of Dumbsters 169 49 104 322 Additional detail for some of the 322 dumpsters in the ROW are listed below: Downtown Square District, no relocation option 19 Dumpster in an alley ROW 28 Dumpster in Street 26 Dumpster on Sidewalk 31 Of the 322 dumpsters in the ROW, it appears that approximately 65 - 70% may potentially be relocated, may necessitate some involuntary requirement or other economic incentives over a period of time. Such a program would require City Council approval. The list of these dumpster locations is lengthy and is attached as Exhibit 2 to provide a better understanding of these specific issues. Dumpsters that have the potential to be relocated onto the owner's property, but the owners are not receptive to voluntarily relocating their dumpster. 2. Dumpsters that appear to have no inexpensive relocation alternative, such as parking lot surface which is not strong enough to support the collection truck without damaging the surface. 3. Dumpsters that are shared by more than one customer with none of the property owners or tenants wanting to move the dumpster(s) onto their property. 4. Dumpsters in the downtown area that appear to have limited or no relocation alternative on the customer's property or in the proximity of their business. 5. Dumpsters with no apparent relocation alternative, due to inadequate clearance or unsafe ingress /egress. OPTIONS The City Council may direct the staff to eliminate all dumpsters from the ROW or reduce the number of dumpsters in the ROW in one or more of the five listed dumpster categories in the previous paragraph. The city staff has provided options for each of the categories of dumpsters for City Council's consideration. The staff seeks the City Council's direction on the intermediate and end goals they wish to achieve in eliminating or decreasing the number of dumpsters in the ROW; the sequence which City Council would like to have the staff address the dumpster categories; and which options City Council would chose for each dumpster category. Costs for implementation some of these options may vary from current rates, and the staff will develop that information upon the direction of City Council. Dumpster Categories: 1. Dumpsters that have the potential to be relocated onto the owner's property, but the owners are not receptive to voluntarily relocating their dumpster. 2. Dumpsters that are shared by more than one customer with none of the property owners or tenants wanting to move the dumpster(s) onto their property. 3. Dumpsters that appear to have no inexpensive relocation alternative, such as parking lot surface which is not strong enough to support the collection truck without damaging the surface. Options for the Categories 1, 2, & 3: a. Continue working on a voluntary basis with these customers to relocate dumpsters. b. Provide incentives for the property owner to relocate the dumpster off of the ROW, such as a "No Fee" building permit to relocate the dumpster(s) onto the property by some deadline (such as 12 month). c. Provide a variance in the number of required parking spaces on existing property to allow space for moving the dumpster(s) onto the owner's parking lot. d. Provided a discounted rate for service over some period of time upon the relocation of the dumpster(s). e. Provide a matching grant for property owners to build compliant enclosures. f. Develop an ordinance requiring the property owner to relocate the dumpsters on the owner's property, even if the owner does not desire to have it placed on his property, with a deadline when the dumpsters will be relocated onto the owner's property. This may be a series of dates for different groups to meet the requirement. g. For small waste generators, consider sharing dumpsters with neighboring property owners or using carts if the City of Denton Page 3 of 4 Printed on 1/29/2015 File #: ID 15 -054, Version: 1 property is within a residential cart collection route and the property owner can meet the cart set -out and pick -up times. Provide a service rate discount or no charge incentive for a specific period of time upon making the change. h. Any other option recommended. Dumpster Category: 4. Dumpsters in the downtown Square District and the Downtown Implementation Plan (DTIP) area. Options for Category 4: a. No change in services. b. Consider alternative services such as bag service for recyclables and trash, with collection once or twice daily, seven days per week. This service will cost more than the current rate structure will support. Costs for implementation will be developed, if City Council chooses this option for a pilot program to determine its feasibility. These rates would be established on a district wide basis to meet the specific service requirements for the district. c. Set up multiple screened dumpster storage areas off of the public ROW for shared use of Square District and DTIP customers. This would increase the number of on- street parking places and eliminate the negative visual appearance of the dumpsters in the street. The cost for the relocation and revetments could be funded by the City, by rates established on a district wide basis to meet the specific service requirements for the district, or by a combination of both. d. Any other option recommended. Dumpster Category: 5. Dumpsters with no apparent relocation alternative, due to inadequate overhead clearance or unsafe ingress /egress. Options for Category 5: a. Require the property owner to work toward a remedy which would allow the dumpster to be relocated onto their property. Provide incentives such as discounted rates for some period of time upon completion of work and the relocation of the dumpster(s). b. If no ultimate solution exists, charge the owners a right -of -way fee. (If this occurs, the dumpster remains located in the right -of -way.) c. Any other option recommended. EXHIBITS 1.
