Following the completion of the Work Session, the City Council will convene in a Closed Meeting in the Council Work Session Room at City Hall, 215 E. McKinney Street to consider specific items when these items are listed below under the Closed Meeting section of this agenda. The City Council reserves the right to adjourn into a Closed Meeting on any item on its Open Meeting agenda consistent with Chapter 551 of the Texas Government Code, as amended, or as otherwise allowed by law. 1. Closed Meeting: A. ID 15 -244 Deliberation regarding Personnel Matters - Under Texas Government Code Section 551.074. Deliberate and discuss the evaluation, duties, discipline, procedures, and contracts of the City Attorney, Municipal Court Judge, and City Manager. B. City of Denton, Cause No. 14- 09833 -431 currently pending in the 431st District Court of Denton County regarding hydraulic fracturing where a public discussion of these legal matters would conflict with the duty of the City's attorneys under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas. BACKGROUND The Denton Municipal Court is a statutory Municipal Court as designated under Chapter FF of the Texas Government Code. As such, it performs many functions related to enforcement of state traffic and penal laws as well as enforcement of City Ordinance violations regarding fire, safety and public good. However, the Court performs many other functions, including a number of magisterial functions including property hearings, orders for emergency protection in domestic violence matters, dangerous dog determinations, property abatement hearings, lost or stolen property determinations, and limited civil hearing processes as designated by law. Additionally, the Court issues arrest, search, and property inspection warrants in its magisterial capacity. The "municipal court" is a joint collaboration of three City departments. The appointed Municipal Court Judge presides over the day to day decisions and direction of the Court. However, the Municipal Court Clerk, as a division of the Finance Department, selects, trains and manages a number of deputy court clerks who have maintenance of the records of the Court as their primary mission. Additionally, the Court Clerk receives and deposits all fine revenue assessed and paid to the Court in accordance with promulgated finance department accounting standards and reports and deposits state court costs to the State of Texas. The third important component is that of the City Attorney's Office, who assigns at least one full time prosecutor and one part -time prosecutor who are charged with the responsibility of case evaluation, and prosecution of appropriate cases. The City Prosecutors represent both the state of Texas as well as the City of Denton, and are ethically bond to prosecute each case as the needs of justice might dictate. The Court would like to take this opportunity to present information to the City Council regarding the types and numbers of cases filed in and disposed by the Court each year, introduce the Council to Court's Judge's, Clerks, Prosecutors, bailiffs and support personnel, provide relevant statistics and trends in case filings and dispositions, and answer any questions the Council may have about current or future operations of the Denton Municipal Court. Ramsay, Denton Municipal Judge SUBJECT: ANNUAL REPORT: October, 2013 through December, 2014 DATE: March 2nd, 2015 DENTON MUNICIPAL COURT ACTIVITY REPORT October 1st, 2013 — December 31st, 2014 In late December or early January of each year, the Municipal Judge's Office usually prepares an "Annual Report of Court Activity" for the Council's review. As the annual review process for Council Appointees has grown later and later over the past few years, this report has usually been provided at approximately the same time as Council Appointee Performance Reviews. Consequently, while this report is somewhat later than in years past, I have prepared this year's report for a period extending over twelve months to include a period time from October of 2013 through December of 2014. . I can distinguish this report from my personal review of job performance inasmuch as these reports reflect the efforts and achievements of many people other the Judge alone — namely the Denton Court Municipal Court Clerk and Deputy Court Clerks (under the Finance Department), the Denton Municipal Court Prosecutors Office (under the City Attorney's direction) as well as the Presiding Judge and several Associate or Assistant Judges. Attached, please find an "Denton Mun Court Activity Report" for the City of Denton Municipal Court of Record for the twelve months of reporting year 2013 - 2014 (October, 2013 through September 2014,) as well as the first quarter of the City's fiscal year, from October through December of 2014. The information contained in the attached reports reflects various performance measures and statistics related to the Denton Municipal Court. This information is the same information and statistical data as officially reported to the Office of Court Administration (OCA), a Texas state agency charged with over -site of all levels of courts in the state of Texas. Please find a cumulative (or composite) report of Court Activity for the City of Denton Municipal Court summarizing court activity for the same period of time. Municipal Court Report to Council —March 2nd 2015 Page 1 of 2 Additionally, I have provided you with a report that has been drawn off of the Court's Incode System. Incode is the software case management system purchased by the City, and which has been fully deployed and installed over the last few years. These numbers may appear to vary slightly by category or classification from the OCA generated report. The raw data and case numbers are the same, but O.C.A.'s definitions and parameters may be somewhat different, depending on application and docket. This report provides a visual presentation of some of the same information provided to the State Office of Court Administration (OCA), along with additional financial information related to fine revenue received through the Court. This report is largely prepared by the Court Clerk in the form of an "Excel" document. Further, I have provided two documents entitled as "Warrant Reports." This is an Excel spreadsheet containing the total number of warrants of arrest issued by the Court between October 1st, 2013 through September 30th, 2014, as well as the following first quarter of the City's fiscal year. The numbers reflect Arrest Warrants, Capias Pro Fine Warrants and "Alias" Warrants issued by the Court during this time, but does not break down the total number of warrants by type. If you are interested in the type and nature of warrants issued, this office will be happy to provide you with this additional information. This spreadsheet also reflects the total amount of "jail credit" granted for defendants who have been arrested by the Denton Police Department of other police agencies. These reports convey the activity of our court and provide you with at least a numerical evaluation of the total cases filed and disposed, as well as the number and nature of the wide variety of cases filed.
