McKinney Street, Denton, Texas at which the following items will be considered: NOTE: The City Council reserves the right to adjourn into a Closed Meeting on any item on its Open Meeting agenda consistent with Chapter 551 of the Texas Government Code, as amended, or as otherwise allowed by law. 1. Closed Meeting: A. ID 16 -013 Deliberations Regarding Certain Public Power Utilities: Competitive Matters - Under Texas Government Code Section 551.086. Receive a presentation from Denton Municipal Electric staff ( "DME ") regarding public power competitive and financial matters pertaining to plans, strategies, opportunities, and developments for generation improvements to the DME system; discuss and deliberate strategies regarding same; discuss and deliberate opportunities and strategies for the City to acquire purchased power and enter into agreements regarding the same, in order to meet its future energy needs. Discuss, deliberate and provide Staff with direction.[TMPA] B. ID 16 -056 Deliberations Regarding Real Property - Under Texas Government Code Section 551.072; Consultation with Attorneys - Under Texas Government Code Section 551.071. Receive information from staff, discuss, deliberate and provide staff with direction regarding the potential acquisition, exchange, lease or value of real property located generally in the 800 block of East Sycamore in the City of Denton, Denton County, Texas. Consultation with the City's attorneys regarding legal issues associated with the potential real property matter where a public discussion of these legal matters would conflict with the duty of the City's attorneys to the City of Denton and the Denton City Council under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas, or would jeopardize the City's legal position in any administrative proceeding or potential litigation. C. ID 16 -071 Deliberations regarding Real Property - Under Texas Government Code, Section 551.072; and Consultation with Attorneys - Under Texas Government Code, Section 551.071. D. ID 16 -078 Deliberations Regarding Real Property - Under Texas Government Code Section 551.072; Consultation with Attorneys - Under Texas Government Code Section 551.071. Receive information from staff and discuss, deliberate and provide staff with direction regarding the condemnation of (1) real property located generally west of the 2600 block of South Mayhill Rd. in the City of Denton, Denton County, Texas; and (ii) real property located generally in the 3900 block of Quailcreek Rd. in the City of Denton, Denton County, Texas; where discussions had, deliberation, and direction given, by the Denton City Council in an open meeting would have a detrimental effect on the position of the governmental body in litigation with the property owner. Consultation with the City's attorneys regarding legal issues associated with the condemnation of the real property interests described above; discussion of these legal matters in an open meeting would conflict with the duty of the City's attorneys to the City of Denton and the Denton City Council under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas, or would jeopardize the City's legal position in litigation. Hold a discussion with the City's attorneys and provide direction with regard to City of Denton Ethics provisions and state and federal law and regulations as it concerns ethics matters and regulation of the conduct of public officials. A public discussion of this legal matter would conflict with the duty of the City's Attorneys to the City Council under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas. Following the completion of the Closed Meeting, the City Council will convene in a 2nd Tuesday Session to consider the following. City ofDenton Page 2 Printed on 11712016 City Council Meeting Agenda January 12, 2016 NOTE: A 2nd Tuesday Session is used to explore matters of interest to one or more City Council Members or the City Manager for the purpose of giving staff direction into whether or not such matters should be placed on a future regular or special meeting of the Council for citizen input, City Council deliberation and formal City action. At a 2nd Tuesday Session, the City Council generally receives informal and preliminary reports and information from City staff, officials, members of City committees, and the individual or organization proposing council action, if invited by City Council or City Manager to participate in the session. Participation by individuals and members of organizations invited to speak ceases when the Mayor announces the session is being closed to public input. Although 2nd Tuesday Sessions are public meetings, and citizens have a legal right to attend, they are not public hearings, so citizens are not allowed to participate in the session unless invited to do so by the Mayor. Any citizen may supply to the City Council, prior to the beginning of the session, a written report regarding the citizen's opinion on the matter being explored. Should the Council direct the matter be placed on a regular meeting agenda, the staff will generally prepare a final report defining the proposed action, which will be made available to all citizens prior to the regular meeting at which citizen input is sought. The purpose of this procedure is to allow citizens attending the regular meeting the opportunity to hear the views of their fellow citizens without having to attend two meetings. 1. Denton Code of Ordinances §2 -30 (Confidential Information) Respectfully submitted: Anita Burgess City Attorney City of Denton Page 1 of 1 Printed on 1/7/2016 SAO.r P.1ky-A­Cnft.1.D0C &�0 _ 0 j RESOLUTION NO, A RESOLUTION AMENDING THE ETHICS POLICY FOR ELECTED AND APPOINTED OFFICIALS FOR THE CITY OF DENTON, TEXAS; AND PROVIDING AN EFFECTIVE DATE WHEREAS, on May 18, 2004 City Council passed Resolution R2004-025 adopting an Ethics Policy for Elected and Appointed Officials and upon a recommendation by the Council Ethics Sub-committee hereby approves an amendment to the policy as set forth herein; and WHEREAS, the City Council of the City of Denton acknowledges that our government is a representative democracy and those who are elected or appointed to serve others as representatives accept a public trust that requires them to faithfully and diligently fulfill their public responsibilities; and WHEREAS, the City Council of the City of Denton recognizes the those individuals who serve as public servants must adhere to a higher ethical standard of conduct since the activities of government should benefit the corrununity as a whole and should never benefit the individual interest of public decision makers; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY RESOLVES: SECTION 1. That the following ETHICS POLICY for Elected and Appointed Officials — City of Denton, Texas, which shall apply to all elected and appointed officials of the City, is hereby amended to read as follows: ETHICS POLICY for Elected and Appointed Officials - City of Denton, Texas. This Ethics Policy has been adopted to encourage and ensure the highest standards of personal and public conduct during tenure in office. Adherence to this Policy will maintain the confidence and trust in the decision-makers and representatives of the City who must remain independent, impartial, and accountable to the people they serve. hi addition, elected and appointed officials must adhere to Texas state statues and City Charter provisions and City Council Rules of Procedure governing their conduct. These are listed at the end of this Policy. Thus, elected City Council Members as well as appointed members of the City's Boards and Commissions are asked to subscribe to the Texas statutes, City of Denton Charter, Rules of Procedures for City Boards and Commissions, and this Ethics Policy. 1. As a representative of the City of Denton, I will be ethical. I will act with integrity and moral courage. I will be absolutely truthful. I will make impartial decisions that are free of bribes, unlawful gifts, narrow political interests and other personal interests that might impair my independence of judgment. I will always decide what is best for the whole city. BACKGROUND The purpose of this Work Session is to review recent trends related to special events downtown, and to facilitate a discussion regarding future policies to better manage the increasing number of events being held in our downtown area. Since October 2014, twenty four events were held in Downtown Denton that required coordination with the City. These events generally fall into one of four categories: athletic events, food truck events, music events, and street fairs. The street fair category includes the Denton Community Market, which ran weekly Apr. 4 to Nov. 28, 2015. The following locations are generally used for events: the Downtown Square, the McKinney Street Parking Lot, the Williams Trade Square Parking Lot, Walnut Street, Austin Street Food Truck Park, and a small number of miscellaneous other locations. One athletic event was held during this time frame (Denton's first Turkey Trot), which was based at the McKinney Street Parking Lot and used public streets. Approximately 1,400 people participated in that one -day event. There were ten food truck events, one in the McKinney Street Parking Lot and the remainder at the Austin Street Food Truck Park as part of other events, such as a part of UNT Homecoming events sponsored by the Denton Main Street Association and the CVB. The average number of attendees for a food truck festival is 300, but one event that attracted 21 food trucks saw more than 2,500 people. Of the six music festivals in this time period, three were multi -day events held in Williams Trade Square. Only one of the multi -day festivals closed East Hickory Street. One event used the McKinney Street Parking Lot, the final two events were held on Industrial Street and at a downtown business. These music festivals brought approximately 9,000 people downtown. Street fairs have the largest event attendance. These single day events, which typically close public street(s), were held on the Downtown Square, Walnut Street, East Hickory Street, and Industrial Street. Attendance can range from 200 to 12,000 people. These seven events attract about 23,000 people Downtown annually. The City of Denton Page 1 of 3 Printed on 1/7/2016 File #: ID 16 -012, Version: 1 Denton Community Market, located at the Denton County Historical Park, sees about 1,000 people each Saturday. This season about 34,000 people visited the market. The average Downtown event requires five separate applications that are turned in to the Economic Development Specialist. The application is reviewed with the applicant, then is distributed to the following City departments for review and approval: Fire, Police, Consumer Health, Building Inspections, Solid Waste, Recycling, Parks and Recreation, Risk Management, Waste Water - Streets, Denton Municipal Electric, Utility Customer Service, and the Bike and Pedestrian Coordinator. The Economic Development Program Administrator for Downtown also receives the application in order to coordinate scheduling of events with other event venues to prevent competing events on the same days. Those venues are: the Parks and Recreation Civic Center and Quakertown Park, Denton County Courthouse on the Square, Denton County Transit Authority, and the Patterson - Appleton Arts Center. If the application is complete and all fees are paid, the event is set. Each event is offered the opportunity to meet with key staff from the reviewing departments to make sure that their event meets all requirements. The average event will pay $230 in application/permit fees and about 4 percent of their budget will be for public safety. Both the event organizers and staff experience some challenges in the process. Event organizers would like to see a streamlined application, clear direction and reduced cost in regards to public safety, more time to set -up or clean -up an event, better coordination with surrounding businesses so that everyone benefits from the events, and not to be charged so many fees for required services such as solid waste. An example would be that solid waste and recycling containers are required for some events. The event is charged for delivery, rental, and pick- up of each container, plus the landfill fee for its contents. Staff is challenged by the amount of paper processed for each event, and manual tracking of updated documents between departments and even within divisions can lead to inconsistent information. There is a tendency with event organizers to under - estimate the number of attendees to reduce the cost of public safety they are required to hire, which can put attendees at risk. Additionally, gathering a comprehensive picture of an event, so that all City services which are affected by the event can be alerted, is challenging. One example would be a music festival which has live outdoor music until 11 p.m., and then indoor music at a different venue from midnight until 2 a.m. Normally, that information would not be included in the event organizer's application packet because it does not happen on City property or require a special event application. While it continues to retain a more than normal presence within the Downtown, no additional public safety is required. Another example where coordination between the City and special event organizers would be beneficial, could be an event such as a film festival which is held within a Downtown business. No permits would be required, but the event could attract 800 to 1,000 attendees Downtown. By planning ahead to have more police scheduled for the increase in pedestrian and vehicular traffic, making sure that the refuse containers are empty to prevent overflow, or communicating with local business who might change their hours of business to accommodate the special event attendees, would make for a better event not just for the attendees, but for local businesses, and City staff. BACKGROUND The purpose of this Work Session item is to discuss the status of the Old Central Fire Station located at the intersection of Bolivar and McKinney. Old Central was decommissioned in 2002 and has been used as surplus storage facility for public safety material and equipment until the fall of 2015. As part of a City Council Closed Session discussion in October 2015, staff received direction to review development options associated with the primary tract where Old Central is located and the two additional adjacent tracts on Cedar Street identified as the Rock Lot and Cedar Street Lot. Staff was requested to identify development costs associated with razing the existing structure and providing infrastructure amenities to increase public parking for downtown. Staff identified planning level cost estimates for the following three options: Low: Demolish the structure and fill the building foot print with select fill and utilize asphalt millings to create an all - weather parking surface. Similar to the old tax office on East McKinney. This option would include enhanced lighting, signage and pavement markings. The planning level estimate for the Low Option is $110,000 and would be facilitated primarily through City of Denton work force and could be substantially complete by March 1. Medium: Demolish the structure and fill the building foot print with select fill. A two - inch asphalt overlay is contemplated for the existing drive approaches, flatwork and building foot print to create a more aesthetic and consistent parking lot surface. This option will also incorporate enhanced lighting, signage, pavement markings, and landscaping. The planning level estimate for the Medium Option is $250,000. Demolition would be facilitated through City of Denton work force. Overlay, lighting and flatwork would be completed by outside labor and may be substantially complete by May 1. High: Demolish the structure and fill the building foot print with select fill and utilize asphalt millings City of Denton Page 1 of 3 Printed on 1/7/2016 File #: ID 16 -014, Version: 1 to create a temporary parking surface. Initiate a comprehensive design to incorporate the primary tract, Rock Lot and Cedar Street Lot. This comprehensive design contemplates the complete reconstruction of the subject tracts and could also incorporate a Solid Waste revetment to remove dumpsters from Cedar Street. The planning level estimate for the High Option is $525,000. Demolition of the structure would be facilitated through City of Denton work force. Design and construction is contemplated by outside vendor via design, bid, and build process. Demolition and temporary parking surface could be facilitated by March 1 to allow additional parking during festival season while design is completed and the project is publicly bid. The development process for this option is anticipated to take about six months depending on design constraints. OPTIONS: 1. Low Option as outlined above. Planning level cost estimate of $110,000. 2. Medium Option as outlined above. Planning level cost estimate of $250,000, 3. High Option: Temporary parking followed by comprehensive design and reconstruction as outlined above. Planning level cost estimate of $525,000. 4. Take no action at this time. RECOMMENDATION Staff recommends Option 3, High Option. The demolition of the structure, provision of temporary parking and the development of a comprehensive plan and reconstruction of a surface parking lot on multiple parcels. ESTIMATED SCHEDULE OF PROJECT A demolition permit has been issued and all utilities have been capped except for gas. Demolition of the structure could be initiated by the end of January 2016. Should Option 3 be endorsed, temporary parking surface could be in place by March 1. An optimistic schedule for the design, bid, build and process is about six months. PRIOR ACTION/REVIEW (Council, Boards, Commissions) October 27, 2015, Closed Session. FISCAL INFORMATION Funding has been identified to facilitate the recommended option.
