BACKGROUND In December 2016, staff briefed Council on estimated construction costs submitted as part of the formal bid process for the replacement of Station 4. The low bid for this project submitted by Ratcliff Construction was $4.814 million. This cost was higher than the original cost estimate for the project that was developed in 2013 for the 2014 Bond Program, however, the construction costs were within market when compared with similar projects in surrounding North Texas Communities and accounting for specific design elements. As part of a Council presentation on January 10, 2017 regarding the Station 4 construction contract, Council requested staff to establish a schedule providing City Council the opportunity to review design components and related construction costs on future fire station projects. After discussing various options, staff has developed a proposal that would provide Council the opportunity to weigh in on design components at key stages of the design schedule that may have impacts on construction costs. It is recommended that staff brief the Council a minimum of three times during the design phase to ensure Council was in agreement with specific design elements, construction methods and aesthetic features as well as the related impact to estimated construction costs. The following outlines the proposed decision points of the design phase when staff would bring the project back for Council consideration and direction: • Schematic Design • Design Development • Construction Documents (15% of design completed) (45% of design completed) (95% of design completed) Staff will facilitate the discussion on this proposal with Council through Exhibit 1. If Council agrees with the recommended approach, a contract to design the facility will be placed on the April 18' agenda for consideration. Key staff and representatives from the local design firm, Kirkpatrick Studios will be available to provide additional information as Council may request. BACKGROUND The purpose of this item is to provide an update on Council Committee discussions and Council Liaison activities. The following information represents major discussions or activities of Council Committees over the past month: Audit Finance Committee- On Tuesday, March 7, the Committee received a presentation by the external auditors regarding the Comprehensive Annual Finance Report (CAFR). City Council Employee Leave Ad Hoc Committee - On Friday, March 24, the City Council Employee Leave Ad Hoc Committee selected Kathleen Wazny as Chair of the committee. The committee discussed sick and vacation accruals, carryovers/maximum accruals, and payouts. They discussed recommending a change to the accrual structure to be more in line with other cities. Staff provided the committee with a couple of options for changes to the vacation accrual hours. The committee liked an option that simplified the accrual and created a graduated plan for employees with more years of service, without the need for bonus time. They asked staff to draft some options for sick leave accrual as well as vacation carryover and payout that could be discussed at a future meeting. The committee also discussed the need to expand the scope of the committee to include review of all benefits, not just vacation and sick. They recognized that expanding the role of the committee needs approval from the full Council. Committee on Citizen Engagement - On Tuesday, March 28, the Committee on Citizen Engagement discussed voter engagement initiatives. The Committee reviewed voter registration and ballot data in municipal elections, and discussed options to increase voter turnout. The consensus of the committee was to use the upcoming Citizen Survey to gather additional data on voter preferences and to review the issue in a future meeting. Committee on the Environment - On Monday, April 3, the Committee on the Environment discussed updating the City's Sustainability Plan and reviewed options for a green business program. The Committee continued its review of Subchapter 17 of the Denton Development Code. The consensus of the committee was to continue forward with these items and review future meetings. Mobility Committee - On Tuesday, March 21, the Mobility Committee gave staff direction to work with the Texas Department of Transportation (TXDOT) on the proposed West Loop 288 project. Additionally, staff will work with TXDOT to environmentally clear the project as part of the initial design. The Committee also reviewed design options for the proposed Loop 288/Vintage Boulevard intersection with I -35W and the committee indicated a more robust intersection allowing for direct connects to I -35W main lanes should be environmentally cleared to maintain future options. The Committee did request that staff schedule a Council Work Session later this year to receive direction on proposed design options; direct connects or a box intersection (traditional signalized intersection). BACKGROUND On March 7, 2017, the Council created an ad hoc City Council committee ("Committee") to "review policies related to employee sick leave and vacation benefits and to advise the City Council with regard to these matters" through the adoption of resolution 42017-007 The Committee met on March 27, 2017, to begin reviewing vacation and sick benefits. Councilmember Wazny was nominated to be the Chair of the Committee. During that meeting, the Committee discussed the need and benefit of expanding the role of the committee to review more than just sick and vacation benefits. This item is being placed on the agenda for Council to provide direction on whether they want to expand the scope of this Committee. BACKGROUND City of Denton has been experiencing substantial growth similar to other cities in the North Texas region. This growth has burdened the existing public infrastructure which has resulted in inadequate or insufficient parking and traffic congestion, particularly in the older areas of the City. On -street parking demand in certain areas of the City, especially close to the two universities (UNT and TWU) and in the downtown area is very high. Within the older areas of the City, the transportation network comprises of streets that were designed and constructed decades ago. Many street segments are narrow and cannot accommodate on -street parking while maintaining clear minimum access for emergency vehicles. The subject street segments are narrow streets that cannot accommodate on -street parking and maintain emergency vehicle access. On one hand, restricting parking along street segments in the sensitive areas is highly undesirable while on the other hand, public safety is an important aspect and providing access for emergency vehicles is an essential function served by City streets. Staff is currently in the process of evaluating whether a comprehensive approach is required and the feasibility of implementing it throughout the City. In the meantime staff will continue to review safety and emergency access concerns from residents that may require implementation of parking restriction along specific street segments. Texas Street On April 20, 2016, the Lonestar Apartments located at 600 Texas St. experienced a fire caused by a lightning strike. Several units were destroyed and all residents were displaced due to the damage. Continued weather events delayed repairs causing further damage to the structure. This resulted in a rebuild of the structure at a level of construction that required the building to meet current code standards. The apartment complex was constructed in 2002 and consists of three apartment buildings with a total of 34 living units used exclusively by Texas Women's University for student housing. The construction of the apartment building is 34 feet in height. Current fire code requires an aerial fire apparatus access road be provided where the vertical distance between the grade and the highest roof surface exceeds 30 feet. The complex has an existing fire lane on the south side of the complex that runs the length of its parking lot. The width of the fire lane is 24 feet and the length is 245 feet. The width of the existing lane does not meet the requirements for an aerial access road and exceeds the maximum length requirement of 150 feet. The fire lane dead ends into private property on the east side. The current site layout prevents the developer from making improvements on the property. Widening the existing fire lane at the east entrance off Vine St. is restricted due to utilities. The extended dead end of the fire lane does not support widening at the west end due to lack of a turn around. The code allows for the use of a public street as a fire lane if the street remains unobstructed. Texas Street, between Vine Street and Frame Street, runs the length of the apartment complex on the north side. Measuring at a 30 foot width, Texas Street meets the width requirement of 26 feet to serve as the development's aerial access road. To achieve the un -obstruction requirement, parking must be prohibited on both sides of the street from Vine Street to Frame Street. Considering and reviewing all potential options, restricted parking on Texas Street is the single viable option to meet fire code access requirements and advance the development project Denton Street In the recent past, City staff has received several requests from concerned residents regarding the segment of Denton Street between Oak Street and Hickory Street. The primary issue was the narrow street width and the heavy use of on -street parking (both side) along this section of the roadway. The segment of Denton Street between Oak Street and Hickory Street is approximately 24 feet in width and experiences heavy on -street parking on both sides due to the proximity of the University of North Texas (UNT) campus and multi -family residential units on both sites of the street. Given the location and surrounding land use, on -street parking demand in this area is high. As such, staff investigated the possibility of reducing the impact on parking supply by restricting parking on west side only while allowing on -street parking on the east side. The Fire Code requires a street to be a minimum of 26 feet for allowing on -street parking on one side. This requirement provides the necessary space essential for access and deployment of fire equipment. The current street width does not provide sufficient capacity to legally permit on -street parking on both sides of Denton Street between Oak Street and Hickory Street as it does not satisfy the requirement included in the fire code. Staff has notified the property owners and residents on and adjacent to Denton Street about the proposed discussion item regarding parking on Denton Street to ensure residents and property owners have an opportunity to voice any concerns they may have. Letters were mailed on February 24th and door hangers were placed on March 2nd on residential addresses on both sides of Denton Street. Based on review of existing parking conditions and the available street width for two-way traffic along Denton Street between Oak Street and Hickory Street and further review of the Fire Department access and response needs, staff recommends restricting parking on both sides of the street. This will allow emergency vehicles to respond to public safety calls and allow for the safe deployment of Fire Department equipment. While considering this recommendation, it should be noted that typically restricting on street parking reduces the side friction resulting in the possibility of increase in average speeds along this segment of Denton Street. Staff is in the process of identifying these street segments and reviewing options with the intent of developing a comprehensive plan to balance public safety requirements and on -street parking needs. BACKGROUND The Denton Enterprise Airport is one of eleven designated general aviation airports in the Dallas Fort Worth Metroplex designated by the Federal Aviation Administration (FAA) as a Reliever Airport. In FY 2015, the Denton Airport experienced more than 165,000 operations and in FY 2016 the Denton Airport experienced more than 137,000 operations. In FY 2015, in terms of total operations (one landing or one departure) the Denton Airport ranked 7' in the State of Texas as compared to all airports including commercial service airports statewide. The number of operations taking place at Denton Airport is impressive due to fact that the airport has a single runway. Each of the airports exceeding the number of operations experienced at Denton have multiple runways, which enhances the ability of those airports to support additional operations. Based on the volume of air traffic experienced at the Denton Airport, the 2015 Airport Master Plan recommended the design and construction of a parallel runway. The Texas Department of Transportation, Aviation Division (TxDOT) embraced this recommendation and included the cost of design and construction of a west parallel runway in their annual Capital Improvement Program (CIP) planning document. TxDOT's justification for funding the west runway was to separate the high volume of training traffic which is typically a slower, lighter, single engine aircraft, from the remaining air traffic operations on the primary runway that includes heavier faster jet and turbine aircraft. To this end, TxDOT agreed to fund an auxiliary runway of 4,500 feet long and, 75 feet wide with an aircraft design weight of 12,500 pounds. The additional capacity this runway provides serves the principal purpose of enhancing safety by separating light training type aircraft from operations on the primary runway. The 2015 Airport Master Plan (AMP) calls for a more robust runway design capacity to include an additional 500 feet in length and 25 feet in width to establish a runway measuring 100 feet wide and 5,000 feet long with an initial weight bearing capacity of 12,500 pounds. The additional length to extend the runway to 5,000 feet is important in providing a longer "take of run" which is a requisite for heavier and faster aircraft to operate. The additional width also provides benefits however, the cost benefit of the additional width is not as substantial as investing similar resources to improve the weight bearing capacity of the runway. Increasing the weight bearing capacity of the runway to 30,000 pounds and a length of 5,000 feet will increase the capacity of the runway to service up to 70 -percent of the aircraft operations of the primary runway in certain conditions. An occasional scheduled or unscheduled closure of the primary runway for maintenance activities or emergencies has a substantial negative impact to those dependent on access to an adequate runway facility. The Denton AMP states the local entity, Denton Airport, would fund 100 -percent of an additional 500 feet to lengthen the proposed runway to 5,000 feet. In addition to this local share contribution, the 2015 AMP recommends that the local entity also contribute 100 -percent of the cost to widen the proposed runway from 75 feet wide to 100 feet wide. In other words, Denton would fund the full cost of the additional 25 feet by 5,000 feet of pavement/construction costs rather than participate at the customary 90:10 grant match with TxDOT. After consulting with airport tenants, multiple aviation professionals, design consultants and the Airport Advisory Board, Denton Airport staff recommends the investment of resources in the enhanced weight bearing capacity of the proposed parallel runway rather than investing in pavement width. Staff contends this investment better serves the current and future needs of the Denton Airport by providing access to a wider range of aircraft, should the primary runway be out of service for any length of time. The investment to strengthen the pavement is currently estimated to cost approximately $100,000 more than investing in a wider pavement section. Current estimates indicate the 5,000 feet long x 75 feet wide, 30,000 pound design will cost the Denton Airport $2.6 million while the 5,000 long x 100 wide 12,500 pound design will cost the Denton Airport $2.5 million. TxDOT Aviation indicates that upon clarification of design and formal direction to move forward, final design of the west runway would be complete by mid-June and the project could be advertised for construction in late July. If this schedule is maintained, construction on the 270 -day project could begin by October 1, 2017. OPTIONS 1. Advance the parallel runway design scope of 5,000 feet x 75 feet with a weight bearing capacity of 30,000 pounds. Total estimated cost is $8.5M (TxDOT $5.9M, Denton $2.6M) 2. Advance the parallel runway design scope of 5,000 feet x 100 feet with a weight bearing capacity of 12,500 pounds. Total estimated construction cost of $8.4M (TxDOT $5.9M, Denton $2.5M). 3. Advance the TxDOT, Aviation scope of 4,500 feet x 75 feet with a weight bearing capacity of 12,500 pounds Total estimated construction cost of $7.5M (TxDOT $5.9M/Denton $1.6M). RECOMMENDATION Denton Airport staff and the Denton Airport design consultant KSA recommends Option 1, 5,000 feet x 75 feet with a weight bearing capacity of 30,000 pounds. Total estimated cost is $8.5M (TxDOT $5.9M, Denton $2.6M). ESTIMATED SCHEDULE OF PROJECT Final design is estimated to take six to eight weeks for the consultant to complete and an additional three weeks for TxDOT Aviation to provide final review comments. Project could be advertised for bid by August 1 with construction start of early October. Preliminary estimates of the west runway construction cost for Option 1, as provided by the Denton Airport design consultant KSA, demonstrates the total project cost of $8.5 M, $5.9 million TxDOT and $2.6 million local. TxDOT is requiring the City of Denton as the local entity to cover 100 -percent of additional costs above and beyond the scope of 4,500 feet x 75 feet with a 12,500 pound weight bearing capacity. Staff budgeted $3.56 million for the runway project in the FY 2017-18 CIP Budget. Since TxDOT plans to begin the project this fiscal year, staff plans to bring a reimbursement ordinance forward to City Council to fund the City's portion of project cost and issue Certificates of Obligation in FY 2017-18. BACKGROUND On March 3, 2015, the City Council adopted Ordinance 2015-072, accepting a Non -Annexation Agreement (NAA) for agricultural, wildlife management, or timberland use properties within an area of land generally located on the north and south sides of Ryan Road, consisting of approximately 85 acres. The subject property was included in the NAA. The NAA was scheduled to terminate on March 1, 2016. However, prior to termination of the NAA, the property owner(s) requested an extension of the NAA to enable the creation of a Pre -Annexation Development Agreement (PADA) pursuant to the Local Government Code for the properties located on the south side of Ryan Road. The 4.7 acre subject property was not included in the PADA. On February 16, 2016, staff presented to City Council an analysis outlining the intent of a PADA and associated advantages of creating a comprehensive development agreement for the subject site. On March 1, 2016, the City Council extended the NAA for an additional 120 days to afford staff and the developer the opportunity to author the proposed PADA. With the extension, the NAA was scheduled to expire on June 29, 2016. On June 7, 2016, staff requested a second extension of the NAA to allow more time for the PADA preparation. At the meeting, the City Council extended the NAA for an additional 90 days. With the extension, the NAA was scheduled to expire on September 5, 2016. On August 9, 2016, the PADA was presented to City Council and on August 16, 2016, the City Council approved PADA. Since the 4.7 acre subject property was not included in the PADA, and the property is already developed and with no reason to extend the NAA, the City Council directed staff to initiate an involuntary annexation of the subject property. WHEREAS, pursuant to Section 43.061, Subchapter C-1, Local Government Code, a home rule city is authorized to annex certain areas that are not required to be in an annexation plan, and the City desires to pursue annexation of a certain 4.7 acres of property located generally north of Ryan Road, west of FM 2181, and east of Country Club Road, more commonly known as 1101 E Ryan Road, and more particularly described in Exhibit A attached hereto and incorporated herein (the "Andrus Property"); and WHEREAS, Section 43.035, Subchapter B, Local Government Code requires the City to make offers of non -annexation development agreements to the owners of all properties which have been appraised for ad valorem tax purposes as land for agricultural, wildlife management or timberland within the area to be annexed; and WHEREAS, under a non -annexation agreement between an eligible property owner and the City, the land subject to the agreement retains its extraterritorial status and the owners of such land must abide by the City's development regulations as if such land were within the City limits, as provided further in such agreement; and WHEREAS, the City has offered said non -annexation agreement for a one year term in light of the rapid growth of the Denton area, the need to assure orderly growth, and the inadequate land area currently within the Denton city limits; and WHEREAS, on March 3, 2015, the City Council adopted Ordinance 2015-072, accepting a Non -Annexation Agreement (NAA) for the Andrus Property, which was then extended for 120 and 90 days on March 1, 2016 and June 7, 2016, respectively; and WHEREAS, the NAA expired on September 5, 2016 and the City sent the property owners of the Andrus Property a notice of its intent to annex on October 6, 2016; and WHEREAS, two public hearings were held with the City Council on March 7, 2017, and March 21, 2017, which were noticed in accordance with Section 43.063, of the Texas Local Government Code; and WHEREAS, the City has prepared a service plan for the area to be annexed in accordance with Tex. L,oc. Gov't Code section 43.056 providing full municipal services to such area; and WHEREAS, annexation proceedings were instituted for the property described herein and the first reading of the ordinance was conducted at the City Council meeting on April 11, 2017; and WHEREAS, this ordinance has been published in full one time in the official newspaper of the City of Denton after annexation proceedings were instituted and thirty days prior to City Council taking final action, as required by the City Charter; and WHEREAS, a second reading of the ordinance and final action on the annexation was taken at the City Council meeting on May 16, 2016; and WHEREAS, the Denton City Council deems it to be in the best interests of the citizens of the City of Denton to pursue annexation of the Andrus Property; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The land described and depicted in Exhibit A and Exhibit B, attached hereto and incorporated herein by reference, is annexed to the City of Denton, Texas. SECTION 2. A service plan prepared in accordance with applicable provisions of state law pertaining to annexation is attached hereto as Exhibit C and made a part hereof for all intents and purposes. SECTION 3. The newly annexed property shall be included within the corporate limits of the City of Denton, Texas, thereby extending the City's corporate limits and granting to all the inhabitants of the newly annexed property all of the rights and privileges of other citizens and binding the inhabitants to all of the ordinances, resolutions, acts, and regulations of the City. A copy of this Ordinance shall be filed in the real property records of the Denton County Clerk and with the Denton County Appraisal District. SECTION 4. The City Manager is hereby authorized and directed to immediately correct the map of the City of Denton by adding thereto the additional territory annexed by this Ordinance, indicating on the map the date of annexation and the number of this Ordinance, and the ETJ resulting from such boundary extensions. SECTION 5. Should any paragraph, section, sentence, phrase, clause, or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. AREA ANNEXED The area to be annexed includes approximately 4.7 acres of land contained within the City of Denton's Extraterritorial Jurisdiction (ETJ), Division 1. The proposed annexation contains one tract and one property owner. II. INTRODUCTION This service plan has been prepared in accordance with the Texas Local Government Code, Sections 43.021; 43.065; and 43.056(b) -(o) (Vernon 2008, as amended). Municipal facilities and services to the annexed area described above will be provided or made available on behalf of the City of Denton in accordance with the following plan. The City of Denton shall provide the annexed tract the levels of service, infrastructure, and infrastructure maintenance that are comparable to the levels of service, infrastructure, and infrastructure maintenance available in other parts of the City of Denton with similar topography, land use, and population density. III. AD VALOREM (PROPERTY OWNER) TALC SERVICES A. Police Protection Police protection from the City of Denton Police Department shall be provided to the annexed area at a level consistent with current methods and procedures presently provided to similar areas on the effective date of the ordinance. Some of these services include: 1. Normal patrols and responses; 2. Handling of complaints and incident reports; 3. Special units, such as traffic enforcement, investigations and special weapons; and 4. Coordination with other public safety support agencies. As development commences in this area, sufficient police protection, including personnel and equipment will be provided to furnish this area with the level of police services consistent with the characteristics of topography, land utilization and population density of the area. Upon ultimate development, police protection will be provided at a level consistent with other similarly situated areas within the city limits. B. Fire Protection The Denton Fire Department will provide emergency and fire prevention services to the annexed area. These services include: 1. Fire suppression and rescue; 1 2. Pre -hospital medical services including triage, treatment and transport by Advanced Life Support (ALS) fire engines, trucks and ambulances; 3. Hazardous materials response and mitigation; 4. Emergency prevention and public education efforts; 5. Technical rescue response; and 6. Construction plan review and required inspections. Fire protection from the City of Denton shall be provided to the annexed area at a level consistent with current methods and procedures presently provided to similar areas of the City of Denton on the effective date of the ordinance. As development commences in this area, sufficient fire protection, including personnel and equipment will be provided to furnish this area with the level of services consistent with the characteristics of topography, land utilization and population density of the area. It is anticipated that fire stations planned to serve areas within the City of Denton will be sufficient to serve the area now being considered for annexation. Upon ultimate development, fire protection will be provided at a level consistent with other similarly situated areas within the city limits. C. Emeraeney Medical Service The Denton Fire Department will provide the following emergency and safety services to the annexed area. These services include: 1. Emergency medical dispatch and pre -arrival First Aid instructions; 2. Pre -hospital emergency Advanced Life Support (ALS) response; and transport; 3. Medical rescue services. Emergency Medical Services (EMS) from the City of Denton shall be provided to the annexed area at a level consistent with current methods and procedures presently provided to similar areas of the City of Denton on the effective date of the ordinance. As development commences in this area, sufficient EMS, including personnel and equipment will be provided to furnish this area with the level of services consistent with the characteristics of topography, land utilization and population density of the area. Upon ultimate development, EMS will be provided at a level consistent with other similarly situated areas within the city limits. D. Solid Waste 2 Solid Waste and Recycling Collection Services will be provided to the newly annexed property immediately upon the effective date of the annexation at a level consistent with current methods and procedures presently provided to similar areas within the city. Private solid waste collection service providers operating in the affected area immediately prior to annexation and currently providing customers with service, may continue to provide their existing service for up to 2 years in accordance with Texas Local Government Code. E. Wastewater Facilities The proposed annexation area is within the City of Denton Sewer Service Area as defined by Certificate of Convenience and Necessity (CCN) Number 20072 as issued by the Texas Commission on Environmental Quality (TCEQ). As development commences in this area, sanitary sewer mains will be extended in accordance with the provisions of the City's codes, ordinances and regulations. City participation in the costs of these extensions shall be in accordance with applicable City ordinances and regulations. Capacity shall be provided consistent with the characteristics of topography, land utilization, and population density of the area. Sanitary sewer mains and lift stations installed or improved to City standards within the annexed area which are located within dedicated easement, rights-of- way, or any other acceptable location approved by the City Engineer, shall be maintained by the City on the effective date of this ordinance. Operation and maintenance of wastewater facilities in the annexed area that are within the service area of another wastewater utility will be the responsibility of that utility. Operation and maintenance of private wastewater facilities in the annexed area will be the responsibility of the owner. F. Water Facilities The proposed annexation area is within the City of Denton Water Service Area as defined by Certificate of Convenience and Necessity (CCN) Number 10195 as issued by the Texas Commission on Environmental Quality (TCEQ). Connections to existing City of Denton water distribution mains for water service will be provided in accordance with existing City ordinances and policies. Upon connection to existing distribution mains, water service will be provided at rates established by city ordinance. As new development occurs within this area, water distribution mains will be extended in accordance with Denton's Codes, ordinances and utility service policies. City participation in the costs of these extensions shall be in accordance with Denton's codes and ordinances. Water service capacity shall be provided consistent with the characteristics of topography, land use and population density of the area. 3 Operation and maintenance of water facilities in the annexed area that are within the service area of another water utility will be the responsibility of that utility. Existing developments, businesses or homes that are on individual water wells or private water systems will be allowed to continue to remain on these systems until a request for water service is made to the City. These requests for service will be handled in accordance with the applicable utility service line extension and connection policies currently in place at the time the request for service is received. G. Roads and Streets Emergency street maintenance shall be provided within the annexation area on the effective date of the applicable ordinance of acceptance. Routine maintenance will be provided within the annexation area and will be scheduled as part of the City's annual program and in accordance with the current policies and procedures defined by the ordinance and/or as established by the City Council. Any construction or reconstruction will be considered within the annexation area on a City wide basis and within the context of the City's CIP and/or yearly fiscal budgetary allotments by the City Council. Roadway signage and associated posts will be replaced in priority of importance starting with regulatory signs, then warning signs, then informational signs and in conformance with fiscal allotments by the City Council. All exiting signs will be reviewed for applicability and based upon an engineering study. New signs will be installed when necessary and based upon an engineering study. Routine maintenance of road/street markings will be placed on a priority listing and scheduled within the yearly budgetary allotments by the City Council. H. Parks, Playgrounds, Swirnrnin Pools Residents within the annexed area may utilize all existing park and recreation facilities, on the effective date of this ordinance. Fees for such usage shall be in accordance with current fees established by ordinance. As development commences in this area, additional park and recreation facilities shall be constructed based on park policies defined in the Park Master Plan and as specified in the Park Dedication and Development Ordinance. The general planned locations and classifications of parks will ultimately serve residents from the current City limits and residents from the area being considered for annexation. I. Publicly Owned Facilities Any publicly owned facility, building, or service located within the annexed area, and not otherwise owned or maintained by another governmental entity, shall be maintained by the City of Denton on the effective date of the annexation ordinance. J. Other Services Other services that may be provided by the City of Denton, such as municipal and general administration will be made available on the effective date of the annexation ordinance. The City of Denton shall provide level of services, infrastructure, and infrastructure maintenance that is comparable to the level of services, infrastructure, and infrastructure maintenance available in other parts of the City of Denton with topography, land use, and population density similar to those reasonably contemplated or projected in the area. III. UNIFORM LEVEL OF SERVICES IS NOT REQUIRED Nothing in this plan shall require the City of Denton to provide a uniform level of full municipal services to each area of the City, including the annexed area, if different characteristics of topography, land use, and population density are considered a sufficient basis for providing different levels of service. IV. TERM This service plan shall be valid for a term of ten (10) years. Renewal of the service plan shall be at the discretion of City Council. V. AMENDMENTS The service plan may be amended if the City Council determines at a public hearing that changed conditions or subsequent occurrences make this service plan unworkable or obsolete. The City Council may amend the service plan to conform to the changed conditions or subsequent occurrences pursuant to Texas Local Government Code, Section 43.056.
