The City of Denton City Council will convene in the Work Session Room on Tuesday, May 16, 2017 at
5:30 p.m. to attend a reception honoring City Council.
After determining that a quorum is present, the City Council of the City of Denton, Texas will convene
in a Regular Meeting on Tuesday, May 16, 2017 at 6:30 p.m. in the Council Chambers at City Hall, 215
E. McKinney Street, Denton, Texas at which the following items will be considered:
1. PLEDGE OF ALLEGIANCE
A. U.S. Flag
B. Texas Flag
"Honor the Texas Flag — I pledge allegiance to thee, Texas, one state under God, one and
indivisible."
2. ITEMS FOR INDIVIDUAL CONSIDERATION
A. ID 17-598 Consider adoption of an ordinance canvassing the returns and declaring the results
of the Regular Municipal Election to elect four City Council Members to Districts 1,
2, 3, and 4 of the City Council of the City of Denton, Texas held in the City of
Denton on May 6, 2017; declaring that no candidate received the majority of votes
cast for District 3 and that a runoff election is ordered to be held on Saturday, June
10, 2017; and providing an effective date.

B. ID 17-599 Consider adoption of an ordinance canvassing the returns and declaring the results
of a Special Election held in the city of Denton, Texas, on May 6, 2017 for the
purpose of authorizing the adoption of a ceiling or limitation on the City ad valorem
tax levy of a person who is disabled and a person who is sixty-five (65) years of age
or older who makes application for and receives a homestead exemption; and
providing an effective date.

SUBJECT
Consider adoption of an ordinance canvassing the returns and declaring the results of the Regular Municipal
Election to elect four City Council Members to Districts 1, 2, 3, and 4 of the City Council of the City of
Denton, Texas held in the City of Denton on May 6, 2017; declaring that no candidate received the majority of
votes cast for District 3 and that a runoff election is ordered to be held on Saturday, June 10, 2017; and
providing an effective date.
BACKGROUND
Adoption of this ordinance will formally canvass the election returns of the regular election for council
members in Districts 1, 2, and 4 held on May 6, 2017. It also orders a runoff election in District 3 to be held
June 10, 2017. A revised ordinance will be provided at the meeting reflecting any changes due to the Early
Voting Ballot Board qualification of provisional ballots and/or overseas ballots.

AN ORDINANCE CANVASSING THE RETURNS AND DECLARING THE RESULTS OF
THE REGULAR MUNICIPAL ELECTION TO ELECT FOUR CITY COUNCIL MEMBERS
TO DISTRICTS 1, 2, 3, AND 4 OF THE CITY COUNCIL OF THE CITY OF DENTON,
TEXAS HELD IN THE CITY OF DENTON ON MAY 6, 2017; DECLARING THAT NO
CANDIDATE RECEIVED THE MAJORITY OF VOTES CAST FOR DISTRICT 3 AND
THAT A RUNOFF ELECTION IS ORDERED TO BE HELD ON SATURDAY, JUNE 10,
2017; AND PROVIDING AN EFFECTIVE DATE.
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The City Council finds and declares that the May 6, 2017 regular
municipal election was duly ordered for the purpose of electing Council Members to Districts 1,
2, 3, and 4; that proper notice of said election was duly given and election officials appointed;
that the election was duly held and the returns of the election officials have been delivered to the
Council, all in accordance with the laws of the State of Texas and the Charter and ordinances of
the City of Denton.
SECTION 2. The official returns of the election officials having been opened, examined,
and canvassed, and the Council hereby finds and declares that ballots were cast at the
election, and that the votes cast for each District on the Council were as follows:

SECTION 3. The Council finds and declares that each candidate listed below received a
majority of the votes cast for each District on the Council and that each candidate listed below is
hereby declared to be elected to the City Council of the City of Denton:
FOR DISTRICT 1: Gerard Hudspeth
FOR DISTRICT 2: Keely G. Briggs
FOR DISTRICT 4: John Ryan
and the candidates shall assume the duties of their office on the date that they take the official
oath of office.
SECTION 4. The Council finds and declares that no candidate received the majority of
the votes cast for District 3 and that a runoff election is hereby ordered to be held, in accordance
with the provisions of Ordinance No. 2017-030, on Saturday, June 10, 2017. Candidates in the
runoff election for District 3 will be Don Duff and Paul Meltzer.
SECTION 5. The City Council has found and determined that the meeting at which this
ordinance is considered is open to the public and that notice thereof was given in accordance
with provisions of the Texas open meetings law, Tex. Gov't Code ch. 551, as amended, and that
a quorum of the City Council was present.
SECTION 6. This ordinance shall become effective immediately upon its passage and
approval.

2017 for a tax freeze for persons who are disabled and persons over 65. A revised ordinance will be provided
at the meeting reflecting any changes due to the Early Voting Ballot Board qualification of provisional ballots
and/or overseas ballots.

SPECIAL ELECTION HELD IN THE CITY OF DENTON, TEXAS, ON MAY 6, 2017 FOR
THE PURPOSE OF AUTHORIZING THE ADOPTION OF A CEILING OR LIMITATION ON
THE CITY AD VALOREM TAX LEVY OF A PERSON WHO IS DISABLED AND A PERSON
WHO IS SIXTY-FIVE (65) YEARS OF AGE OR OLDER WHO MAKES APPLICATION FOR
AND RECEIVES A HOMESTEAD EXEMPTION; AND PROVIDING AN EFFECTIVE DATE.
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:

election was duly ordered for the purpose of putting the question before the City of Denton voters
to authorize the adoption of a ceiling or limitation on the City ad valorem tax levy of a person who
is disabled and a person who is sixty-five (65) years of age or older who makes application for and
receives a homestead exemption; that the election was duly held and the returns of the election
officials have been delivered to the Council, all in accordance with the laws of the State of Texas
and the Charter and ordinances of the City of Denton.
SECTION 2. The official returns of the election officials having been opened, examined,
and canvassed, and the Council hereby finds and declares that -ballots were cast at the
