PROVIDING A SUNSET DATE.
WHEREAS, before the adoption of this Resolution, the Development Code Review Ad-
Hoc Committee was listed as an active Ad Hoc City Council Committee in the City's Handbook
for Boards, Commissions and Council Committees (which handbook was last revised by the City
Council via Resolution No. 2015-023); and
WHEREAS, currently the City, with the assistance of an autside consultant, Clarion
Associates, is reviewing and revising the Denton Development Code ("DDC"); and
WHEREAS, Clarion Associates and City Staff have completed drafts of proposed DDC
amendments to present to the general public and the Ad Hoc Development Review Committee
("Committee"), and the City Council for review and comment,; and
WHEREAS, City Cauncil has expressed a desire that the proposed DDC revisions be
reviewed in depth by the Committee and for the Committee to make recommendations to the full
City Council; and
WHEREAS, Resolution No. 2015-023 failed to address several issues relating to the
scope and operation of the ("Committee"), including the number of inembers, the Committee's
scope of review, and meeting rules, procedures and requirements; and
WHEREAS, at its April 10, 2018 Work Session, the City Council determined that it
would be advisable to approve the formal creation of the Denton Development Code Review
Committee to assist in the process of reviewing and revising the Denton Development Code; and
WHEREAS, at its April 10, 2018 Work Session, the City Cauncil also determined that it
would be advisable ta ratify all prior actions taken by the Committee related to actions taken in
response to reviewing the DDC revisions as proposed by Clarion Associates and City Staff; and
WHEREAS, at its April 10, 201$ Work Session, the City Council also determined that it
would be advisable to establish an immediate effective date; and
WHEREAS, at its April 10, 2018 Worlc Session, the City Council also determined that it
would be advisable that the Denton Development Code Review Committee terminate December
31, 201$ unless Council to reconsiders the continuation of the Comrnittee no less than three (3}
months before it is terminated; NOW, THEREFO ,
THE CITY COUNCIL OF THE CITY OF DENTON HEREBY RESOLVES:
SECTION 1. The foregoing recitals are adopted as findings of the City Council as though
set forth fully herein.
SECTION 2. A Development Code Review Committee ("Committee") is established to
review all proposed revisions to the Denton Development Code ("DDC") and make
recommendation to the City Council regarding the proposed revisions.
SECTION 3, The Committee shall be composed of three (3) City Council Members.
Three (3) Planning and Zoning Commissioners will participate in Committee discussions as non-
voting ex-officio members. The Chairperson and Vice Chairperson shall be City Council
Members. Quorum required to hold a Committee Meeting will be two (2) of the three (3)
Council Members serving on the Committee.
SECTION 4. Any matters not addressed by this Resolution shall be governed by the
"City of Denton Handbook for Boards, Commissions and Council Committees."
SECTION 5. The City Manager, or his designee, will provide support to the Committee
as necessary. The City Attorney shall provide legal counsel to the Committee and assist Clarion
Associates and City Staff with the drafting of all proposed revisions to the DDC as
recommended by the Committee.
SECTION 6. This Resolution ratifies all past actions taken by the Committee before the
approval of this Resolution.
SECTION 7. This Resolution shall become effective immediately upon its passage and
approval. �
mSBCTION 8. The Committee shall terminate on December 31, 2018. The Council may
reconsider the termination of the Committee no less than three (3) months prior to its
termination.
