HomeMy WebLinkAbout18-1648• � # � � �;� � A RESOLUTION OF THE CITY OF DENTON, TEXAS, AUTHORIZING THE DONATION OF SURPLUS LIBRARY BOOKS AND MATERIALS TO THE FRIENDS OF THE DENTON PUBLIC LIBRARIES; PROVIDING PROCEDURES FOR DISPOSITION OF SUCH PROPERTY; PROVIDING AN EFFECTIVE DATE. WHEREAS, Section 2-106 of the City of Denton Code of Ordinances authorizes the City of Denton, Texas (the 66City") to dispose of excess property by danating it to a civic or charitable organization; and �WHEREAS, the City owns library books and ather library materials that were formerly used by the Denton Public Library and are still usable, but are worn, obsolete, or excess material because they are damaged, are no longer needed or na longer meet requirements of the Dentan Public Library; and WHEREAS, the Friends of the Denton Public Libraries is a Texas nonprofit assaciation and is duly qualified ta receive Federal income tax exemption under Section 501(c)(3) of ihe Internal Revenue Code; and WHEREAS, the Friends of the Denton Public Libraries was formed for the purpose of supporting the activities, programs, and facilities of the Denton public libraries by performing the follawing activities, which are legitimate public purposes, ta wit: (a) to promote the programs of the libraries as a cultural and educational asset to this area and to emphasize to the community the importance of public library service both now and in future development of Denton and Dentan County� (b) to conduct fundraising activities to include but nat limited to: regularly scheduled book sales of donated and withdrawn books, musical items, mavies, and ather such items as may deemed apprapriate; (c) to maintain and operate a book stare lacated within the North Branch Library to further offer sales of donated and withdrawn items on a scheduled basis; (d) ta devote all funds, whether income ar principal, and whether acquired by gift or contribution or otherwise to said purposes; and WHEREAS, the Friends of the Denton Public Libraries is in need of excess library books and ather materials to operate a book store located within the North Branch Library to further offer sales of donated library materials on a scheduled basis and suppart its public purposes; and WHEREAS, the City Council finds that the donation af excess library materials to the Friends of the Dentan Public Libraries, and the subsequent use of the donated library rnaterials by the Friends of the Denton Public Libraries, constitute public purposes and further the general welfare of the City's residents; NOW, THEREFORE, !, • # ! # . F�r��l����; ��� 1��°���:t„ The findings and recitations set out in the preamble of this Resolution are found to be true and correct and that they are hereby adopted by the City Council and made a part hereof for all purposes.
