HomeMy WebLinkAbout19-790RESOLUTION NO. 19-%9O A RESOLUTION OF THE CITY OF DENTON SUPPORTING LEGISLATION THAT WOULD ALLOW TO-GO RETAIL SALES AT TEXAS BREWERIES, OF ALE AND BEER PRODUCED ON THE BREWER'S OR MANUFACTURER'S PREMISES, 1N THE 86tn TEXAS LEGISLATURE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, craft beer breweries are a growing market segment in Texas with more than 200 breweries operating or under development in the state as of 2018; and WHEREAS, craft beer breweries are shown to contribute to tourism and economic growth in commercial districts where they are located; and WHEREAS, the Texas Alcoholic Beverages Code currently does not allow breweries with only a brewer's permit or manufacturer license, to sell to-go ale and beer, produced on the brewer or manufacturer's premises, directly to customers; and WHEREAS, the Texas Alcoholic Beverages Code currently allows wineries and distilleries with applicable permits to sell to-go products directly to customers for off-site consumption; and WHEREAS, the ability to sell to-go ale and beer, produced on the brewer's or manufacturer's premises, directly to customers, would create a significant revenue stream for small independent breweries, helping the breweries to be more financially viable and increasing their economic impact on communities in which they operate; and WHEREAS, there are multiple breweries operating within the City of Denton city limits that positively contribute to the local economy; and WHEREAS, the Denton City Council finds that supporting such a change to the Texas Alcoholic Beverages Code regarding brewer's permits and manufacturer's licenses, is in the best interest of the City and its citizens; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DENTON HEREBY RESOLVES: SECTION 1. The City Council hereby adopts and incorporates the above referenced findings in this resolution. SECTION 2. The City of Denton supports Texas state legislation that would allow to-go retail sales of ale �and beer, produced on a brewer's or manufacturer's premises, by breweries with brewer's permits or manufacturer's licenses. SECTION 3. The Mayor, the City Manager, and/or the City Manager's designee are hereby authorized to communicate the City's support related bills to members of the Texas legislature, in general, and/or to the appropriate legislative committees, committee members, and other persons or groups. SECTION 4.
