COLLEGE AND 900 EGAN AS HISTORICALLY SIGNIFICANT SITES IN NEED OF TAX RELIEF TO ENCOURAGE THEIR PRESERVATION, PURSUANT TO THE TERMS AND LIMITATIONS OF ARTICLE VI OF CHAPTER 10 OF THE DENTON CODE OF ORDINANCES, AND TO REMOVE REFERENCES TO PREVIOUSLY APPROVED PROPERTIES THAT WERE NOT BEFORE THE CITY COUNCIL. WHEREAS, §11.24 of the Texas Tax Code, as implemented and made subject to the further conditions and limitations of Article VI of Chapter 10 of the City of Denton Code of Ordinances, provide that a municipality's governing body may take official action to exempt from taxation part or all of the assessed value of a structure or archeological site, and the land necessary for access and use the structure if designated as a historically significant site in need of tax relief to encourage its preservation, subject to the further limitations, as so codified; and WHEREAS, on May 21, 2019, the City Council considered and approved two properties located at 607 E. College and 900 Egan as historically significant sites in need of tax relief to encourage their preservation; and WHEREAS, due to a clerical error, the Mayor signed an earlier drafted resolution approving a list of properties that included these two properties, but which also ratified the prior approval of other properties that were not specifically discussed on May 21, 2019; and WHEREAS, the City Council desires to approve an amended resolution reaffirming its approval of two properties located at 607 E. College and 900 Egan as historically significant sites in need of tax relief to encourage their preservation, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY RESOLVES: SECTION 1. The facts contained in the preamble of this Amended Resolution are incorporated herein and found to be true. SECTION 2. Pursuant to authority cited in the preamble above, the properties tabulated below are hereby determined to be historically significant sites in need of tax relief to encourage their preservation, pursuant to the terms and limitations of Article VI of Chapter 10 of the Denton Code of Ordinances. The City Manager is hereby authorized to transmit a certified copy of this Amended Resolution to the Denton County Appraisal District, as certification that the listed properties qualify for partial tax exemption pursuant to the terms and limitations of Article VI of Chapter 10 of the Denton Code of Ordinances. SECTION 4. This resolution shall become effective immediately upon its passage and approval.
