BACKGROUND On August 13, 2019, the City Council adopted Ordinance 19-1831 which ordered a bond election on the question of the issuance of $221,519,000 in ad valorem tax supported public securities for streets, public safety, parks, and public art to be held Tuesday, November 5, 2019. Adoption of the ordinance presented for consideration will formally canvass the election returns of that election. The Final Unofficial Results are attached as Exhibit A to the ordinance as all ballots have been tallied. Of the initial four provisional ballots, three were not cured and could therefore not be counted. Of the 12 overseas ballots mailed, only four were returned. The Final Official Results are submitted by Denton County Elections after they receive our canvassing ordinance. WHEREAS, the City Council of the City of Denton, Texas ("City") ordered an election to be held in the City on November 5, 2019 for the approval or disapproval of general obligation bonds on the PROPOSITIONS hereinafter stated; and WHEREAS, said City Council has investigated all matters pertaining to this election, including the ordering, giving notice, officers, holding and making returns of this election; and WHEREAS, the election officers who held the election have duly made the returns of the result thereof, and these returns have been duly delivered to the City Council; and WHEREAS, it is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public, and public notice of the time, place, and purpose of said meeting was given, all as required by the Texas Government Code, Chapter 551; NOW, THEREFORE; THE CITY COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. That the City Council officially finds and determines that the election held on November 5, 2019 was duly ordered, that proper notice of this election was duly given, that proper election officers were duly appointed prior to this election, that this election was duly held, that the City has complied with the Federal Voting Rights Act and the Texas Election Code, that the returns of the result of this election have been made and delivered to the Council, and that the City Council has duly canvassed these returns, all in accordance with the law and the ordinance calling this election. BACKGROUND The owner and operator of a water well at Green Tree Estates currently provides water to Green Tree Estates residents. On or about the middle of October, the Owner informed the City and water customers that he will stop operating the well Nov. 15, 2019 — eliminating the only source of water for these customers. The City has held numerous discussions with the property owner, the Texas Commission on Environmental Quality, and the Public Utility Commission (PUC) of Texas in an effort to provide sufficient notification regarding the cessation of water services for the water system customers. Both state agencies have maintained they do not consider the water system to be a public system under the law due to the number of residents supplied by the system being below 25 persons. The City has argued that, due to population estimates reported by residents and reports that water payments were made to the system Owner, there is a high likelihood that the system would qualify as a public system. In the event the system would qualify as a public system, the Owner would be required to follow a procedure the cessation of services that includes an extended notification period (no less than 120 days). Staff has previously issued a fact sheet that provides a thorough background with frequently asked questions. The fact sheet is attached to this agenda item. Staff also held a public meeting with residents on Oct. 29, 2019 to hear concerns regarding their water service. Approximately 25-30 people were in attendance including the Owner and a representative of the PUC. During that discussion, many residents stated their intention to remain in their residences regardless of any potential cessation of water from the Owner. Residents were also presented cost projections of approximately $525,000 for a low capacity, water -only temporary pressurized water solution. This solution did not include engineering and real estate costs. The solution presented would have required variances from state regulatory agencies and would not have been up to city standards. A follow up meeting was held on Nov. 11, 2019 and was attended by nearly 100 individuals. At this meeting residents emphasized their desire for a permanent solution. Current Status: The City Council discussed the Green Tree Estates issue at their Nov. 12 City Council Work Session. During the meeting, staff and residents discussed options for immediate relief. Residents requested they be provided a 55 -gallon drum for each residence as soon as possible, with a 250 -gallon water tank as soon as possible. The City Council directed staff to take these steps and staff is in the process of implementing this direction. Additionally, Mayor Watts signed a 7 -day disaster declaration on Nov. 13 to allow the rapid mobilization of funds and resources to address the imminent water cessation at Green Tree Estates. Without extension by vote of the Council, this declaration will expire on Nov. 20. M DENTON DECLARATION OF DISASTER WHEREAS, the Green Tree Estates Subdivision is a residential subdivision of 52 lots located within the southern limits of the City of Denton; WHEREAS, water service for the residents of Green Tree Estates is provided by a private water provider with a privately maintained water well and distribution infrastructure system all contained and located within the Green Tree Estates subdivision; WHEREAS, the private water provider notified the residents less than thirty days ago that the private water service will cease operation on November 15, 2019; WHEREAS, the cessation of the operation of the private water service of Green Tree Estates constitutes an imminent public health and safety emergency for the Green Tree Estates residents as they will be without potable water for consumption and personal hygiene; WHEREAS, the Mayor of has determined that extraordinary measures must be taken by offering to provide the citizens of Green Tree Estates with the temporary provision of potable water in small sealed containers for consumption and personal hygiene, non -potable water in larger containers for other use (including the operation of toilets), and large containers for storage of non - potable water; NOW, THEREFORE, BE IT PROCLAIMED BY THE MAYOR OF THE CITY OF DENTON, A TEXAS HOME -RULE MUNICIPAL CORPORATION: 1. That a local state of disaster is declared for the Green Tree Estates subdivision, located in the City of Denton, pursuant to Section 418.108(a), Texas Government Code, and Section 9-21, City of Denton Code of Ordinances; 2. Pursuant to Section 418.018(b), Texas Government Code, and Section 9-27, City of Denton Code of Ordinances, the state of disaster shall continue for a period of not more than seven days from the date of this declaration unless continued or renewed by the City Council of the City of Denton; 3. At this meeting, the Council heard feedback and comments from residents and, based on that feedback, directed City staff to provide the following temporary resources: 1. Provide a 55 -gallon drum to each residence prior to the Nov. 15 cutoff 2. Provide a 275 -gallon tank to each residence and provide non -drinkable water on a regular basis to the residents of Green Tree Estates. This container does not contain a pump and will not be plumbed. The provision of the tanks and water will allow time to develop long-term options for the City Council to consider. Next Steps: 1. To allow water trucks to access Green Tree Estates for the provision of water, City employees will make improvements to the roads beginning tomorrow, Nov. 15. Residents will continue to be able to access their property during this construction. 2. The Mayor has declared a state of disaster for Green Tree Estates to allow the City to immediately mobilize resources to assist residents. The extension of the disaster declaration will be discussed at the Friday, Nov. 15 Special -Called Council meeting. A translator will be present, and residents will have the opportunity to give comments at this meeting. 3. City employees will deliver the 275 -gallon tanks to each residence on Monday, Nov. 18 beginning at 4 p.m. A signed agreement between the city and resident will be required. The City will provide water for the 275 -gallon tanks on a regular basis until further direction is received from the City Council. Additional information will be provided when the tanks are delivered. 4. Long -Term options will be developed by City staff and presented to the Council in December. These meeting dates and times will be communicated to the residents of Green Tree Estates. 55 -Gallon Drums: Residents may use the 55 -gallon drums the City has provided to store water. The water stored in these containers should not be considered safe for drinking and cooking. Residents that require gallon containers of drinkable water or if a 55 -gallon drum was not delivered to your residence, please contact the city at the numbers below.
