RESOLUTION NO. ZO-S 11
A RESOLUTION OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPAL
CORPORATION, AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO
CERTIFIY TO THE UNITED STATES ENVIRONMENTAL PROTECTION AGENCY THE
CITY'S COMPLIANCE WITH THE RISK AND RESILIENCE ASSESSMENTS
REQUIREMENT OF THE FEDERAL AMERICA' S WATER 1NFRASTRUCTURE ACT; AND,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on October 23, 2018, the federal America's Water Infrastructure Act
("AWIA"), whose purpose is to improve drinking water and water quality, deepen infrastructure
investments, enhance public health and quality of life, increase jobs, and bolster the economy, was
signed into law; and
WHEREAS, the AWIA requires public water systems serving more than 3,300 people to
conduct risk and resilience assessments and review and update, as needed, emergency response
plans; and
WHEREAS, the City operates a public water system for the use and benefit of its citizens;
and
WHEREAS, the City, with a population greater than 100,000, must have completed its
required risk and resilience assessments and certify compliance of the same to the United States
Environmental Protection Agency ("EPA") no later March 31, 2020; and
WHEREAS, the City has completed its required risk and resilience assessment in
accordance with the AWIA; and
WHEREAS, the City Manager, or his designee, seeks authority from the City Council to
certify with the EPA that the City has complied with the risk and resilience assessments
requirement of the AWIA; NOW, THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY RESOLVES:
SECTION 1. The findings and recitals contained in the preamble of this resolution are
incorporated herein by reference as true and as if fully set forth in the body of this resolution.
SECTION 2. The City Manager, or his designee, is authorized to certify with the EPA
that the City has complied with the risk and resilience assessments requirement of the AWIA no
later than March 31, 2020.
SECTION 3. This resolution shall become effective immediately upon its passage and
approval.
