HomeMy WebLinkAbout20-1934RESOLUTION NO.20-1934 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DENTON AUTHORIZING THE CITY MANAGER TO PAY CERTAIN EXPENSES RELATED TO THE LINE OF DUTY INJURY OF POLICE OFFICER URBANO RODRIGUEZ; AND PROVIDING AN EFFECTIVE DATE WHEREAS, on October 29, 2019, during the performance of his official duties, Denton Police Officer Urbano Rodriguez suffered catastrophic injuries; and WHEREAS, reasonable and necessary medical expenses related to Officer Rodriguez’ injury are subject to review and payment by the City’s Third-Party Administrator, pursuant to the Texas Labor Code, Workers’ Compensation Act; and WHEREAS, the reasonable and necessary medical expenses approved and paid for by the City’s Third-Party Administrator are funded by the City and subject to review and reimbursement by the City’s Excess Insurance Carrier; and WHEREAS, Officer Rodriguez has been on a line of duty injury leave of absence because of these injuries since October 29, 2019 and has not returned to duty; and WHEREAS, Officer Rodriguez’s line of duty injury leave of absence has been extended by Council pursuant to Ordinance No. 20-1759 for an additional one (1) year, continuing through October 30, 2021; and WHEREAS, expenses related to Officer Rodriguez’ injury are continuing. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON: SECTION 1. The findings and recitations contained in the preamble of this Resolution are incorporated herein by reference. SECTION 2. The City Council finds that while certain expenses incurred by Officer Rodriguez related to his injury may not be deemed reasonable or medically necessary by the City’s Third-Party Administrator or Excess Insurance Carrier, the Council finds the payment of some of those expenses may serve a public purpose. SECTION 3. The City Council authorizes the City Manager, after consultation with the Third-Party Administrator, Excess Insurance Carrier, and City Attorney, to consider and pay those expenses, or any portion thereof, the City Manager deems to be reasonably related to Officer Rodriguez’ line of duty injury, are not inconsistent with his treatment plan and compliance with that treatment plan is being followed, and whose payment the City Manager determines serves a public purpose. SECTION 4. This Resolution shall only apply to expenses incurred by Officer Rodriguez as of the effective date of this Resolution and for a period of 180 days therefrom. SECTION 5. This Resolution shall become effective immediately upon its passage and approval. The authority granted to the City Manager shall terminate 180 days from the effective date of this Resolution unless extend by future Council action.
