Note: Mayor Gerard Hudspeth, Mayor Pro Tem Meltzer, and Council Members Vicki Byrd, Brian Beck,
Jesse Davis, Alison Maguire, and Deb Armintor will be participating in the work session, closed meeting, and
meeting via video/teleconference.
Note: Adjournment of the Special Called Meeting is proposed to be at 12:50 p.m. to allow for the
Joint Meeting with the Denton Housing Authority set to follow at 1:00 p.m. (separate agenda
posting).
REGISTRATION GUIDELINES FOR ADDRESSING THE CITY COUNCIL
Citizens will be able to participate in one of the following ways (NOTE: Other than public hearings, citizens
are only able to comment one time per agenda item; citizens cannot use both methods to comment on a
single agenda item. Public comments are not held for work session reports.):
• Virtual White Card – On June 4, the agenda was posted online at
www.cityofdenton.com/publicmeetings. Once the agenda is posted, a link to the Virtual White Card, an
online form, will be made available under the main heading on the webpage. Within this form, citizens may
indicate support or opposition and submit a brief comment about a specific agenda item. Comments may
be submitted up until the start of the meeting, at which time, the Virtual White Card form will be closed.
Similar to when a citizen submits a white card to indicate their position on the item, these comment forms
will be sent directly to City Council members and recorded by the City Secretary.
City Council Members review comments received in advance of the meeting and take that public input into
consideration prior to voting on an agenda item. The Mayor will announce the number of Comment Cards
submitted in support or opposition to an item during the public comment period. Comments will not be
read during the meeting. The City Secretary will reflect the number of comments submitted in
favor/opposition to an item, the registrant’s name, address, and (summary of) comments within the Minutes
of the Meeting, as applicable.

• By phone – Citizens wishing to speak over the phone during this Council meeting, may call (940)
349-7800 beginning 30 minutes prior to the meeting start time. Comments by phone will be accepted until
the item is opened for discussion by the Council. When the call is initially received, a staff member will
receive the caller’s information and either: 1) offer to call the citizen back when it is time for them to speak,
or 2) record the caller’s information, support or opposition, and comment. If the caller chooses to record
their support or opposition, rather than speaking during the meeting, the Mayor will announce the number
of comments submitted in support or opposition to the item. If the caller wishes to receive a call back, the
voice of each caller will be broadcast into the meeting during the public commenting time of their desired
agenda item. Individuals will be able to comment once per agenda item, no matter the method.
• At regular meetings only, citizens can speak on any topic that is not on the agenda (Open Microphone).

After determining that a quorum is present, the City Council of the City of Denton, Texas will convene in a

Following the completion of the Work Session, the City Council will convene in a Closed Meeting to consider
specific item(s) when these items are listed below under the Closed Meeting section of this agenda. The City
Council reserves the right to adjourn into a Closed Meeting on any item on its Open Meeting agenda consistent
with Chapter 551 of the Texas Government Code, as amended, or as otherwise allowed by law.

Consultation with Attorneys - Under Texas Government Code Section 551.071
Consultations with City’s attorneys regarding legal issues associated with contemplated
litigation and a settlement offer involving Tracy Whitten, where a public discussion of these
legal matters would conflict with the duty of the City’s attorneys to the City of Denton and
the Denton City Council under the Texas Disciplinary Rules of Conduct of the State Bar
of Texas, or would jeopardize the City’s legal position in any administrative proceeding or
potential litigation.

Any final action, decision, or vote on a matter deliberated in a Closed Meeting will only be taken in an Open
Meeting that is held in compliance with Texas Government Code, Chapter 551, except to the extent such final
decision, or vote is taken in the Closed Meeting in accordance with the provisions of Section 551.086 of the
Texas Government Code (the ‘Public Power Exception’). The City Council reserves the right to adjourn into a
Closed Meeting or Executive Session as authorized by Texas Government Code, Section 551.001, et seq.
(The Texas Open Meetings Act) on any item on its open meeting agenda or to reconvene in a continuation of
the Closed Meeting on the Closed Meeting items noted above, in accordance with the Texas Open Meetings
Act, including, without limitation Sections 551.071-551.086 of the Texas Open Meetings Act.
NOTE: Any item for which a formal action at the Special Called Meeting has been taken by Council
may be subject to a request for a motion for reconsideration at any time during the meeting, at the

SUBJECT
Receive a report, hold a discussion, and give staff direction regarding funding for a new Economic
Development Catalyst Fund.
BACKGROUND
In 2019, the City engaged economic development consulting firm TIP Strategies to lead Denton’s
comprehensive economic development strategic planning process. Staff and the TIP team worked together
for more than a year to engage community stakeholders and develop a strategic plan for economic
development that outlines a specific vision for Denton, as well as the strategies and tactics to bring the
vision to fruition. The final plan was adopted on Feb. 9, 2021.
A proposed strategy outlined in the plan was the creation of a Denton Catalyst Fund, made up of
contributions of various funding sources, that would provide support for economic development
programs, incentives, and initiatives. The recommended strategy was based on the premise of ensuring
Denton was well positioned to execute the recommendations and priorities laid out in the strategic plan
and ensuring that Denton could remain competitive with communities with dedicated economic
development funding (E.g. those communities that have adopted the dedicated economic development
sales taxes. Denton is not eligible to levy the economic development sales tax since it has already hit the
local sales tax cap.). In addition, the Fund is designed to encourage growth in specific program areas,
support transformational projects, or provide seed funding for innovative initiatives.
At the Aug. 18, 20201, Oct. 27, 2020, and the Feb. 9, 2021 City Council work sessions, staff provided
details related to the cost of implementing the strategic plan and how values were determined, described
proposed project and program policies and funds, and presented options for funding the Catalyst Fund. As
part of those discussions, staff indicated they would bring back the Catalyst Fund as part of the FY 2021-
2022 budget development process.
At the time of the previous discussions and presentations, staff recommended making one-time funding
contributions from the utility systems to initiate the Catalyst Fund, then use a dedicated percentage of
utility system ROI for long-term funding support for the program. Unfortunately, due to the impacts of
COVID-19 Winter Storm Uri, staff does not recommend making a transfer or initiating use of a dedicated
percentage of ROI until at least FY 2022-2023. While creation of the Denton Catalyst Fund remains a
priority to enable full implementation of the economic development strategic plan, staff recommends
continuing to use the current economic development tools to support programs in the interim.

PRIOR ACTION/REVIEW (Council, Boards, Commissions)
• September 9, 2019 – The Economic Development Partnership Board and City Council held a joint
meeting and discussed the scope of work for a comprehensive economic development strategic plan.
• November 5, 2019 – The City Council approved the contract with TIP Strategies for development of
an economic development strategic plan.
• January 15, 2020 – EDPB strategic plan steering committee meeting and discussion.
• February 12, 2020 – EDPB strategic plan steering committee meeting and discussion.
• March 5, 2020 – The Downtown Economic Development Committee participated in a SWOT
analysis regarding the strategic plan development.
• June 24, 2020 – EDPB strategic plan steering committee meeting and discussion.
• July 8, 2020 – EDPB strategic plan steering committee meeting and discussion.
• August 8, 2020 – EDPB strategic plan steering committee meeting and discussion. The EDPB
recommended the City Council adopt the Economic Development Strategic Plan (8-0). The EDPB
reviewed funding options and recommended City Council pursue the staff recommended hybrid
option of utilizing some existing utility system fund balance and dedicating 0.5% of utility system
ROI for future funding (8-0).
• August 18, 2020 – The City Council held a work session to discuss the strategic plan and possible
options for funding an economic development fund.
• October 27, 2020 – the City Council held a work session to discuss the strategic plan and possible
options for funding an economic development fund.
• February 9, 2021 – The City Council held a work session to discuss the strategic plan and possible
options for funding the Denton Catalyst Fund. Staff indicated the Catalyst Fund discussion would be
brought forward as part of the FY 2021-2022 budget development process. City Council approved the
Economic Development Strategic Plan.

•In Nov. 2019, the City initiated its first comprehensive economic development strategic planning effort in 17 years.
•The goals of the process were to review best practices, modernize operations, align economic development strategies with community values, and focus on meaningful, inclusive economic growth.
•Staff worked with community stakeholders prior to and throughout the COVID pandemic to develop goals and strategies.
•The Economic Development Strategic Plan was adopted on Feb. 9, 2021.
•The Plan is the basis for economic development programs and operations.
•Implementation of the Strategic Plan was adopted as a priority of the City Council at their Feb. 2021 planning session.
•Policies and programs are currently being reviewed, drafted, and evaluated, with the intent to bring them into alignment with the Strategic Plan.

BACKGROUND
City Attorney Aaron Leal has provided notice of retirement on June 7, 2021. At the May 11, 2021, City
Council meeting, the Mayor and City Council provided direction to solicit proposals to review for a City
Attorney Executive Recruitment.
The proposals will be made available to the Council at the June 7th, 2021 City Council work session.
Staff is seeking direction on the selection of the executive search firm for a nationwide search.
