RESOLUTION NO.
A RESOLUTION OF THE CITY OF DENTON RATIFYING THE SUBMISSION OF AN
APPLICATION TO THE NORTH CENTRAL TEXAS COUNCIL OF GOVERNMENTS
(NCTCOG) FY 2022 TO 2023 SOLID WASTE IMPLEMENTATION GRANT PROGRAM IN
THE AMOUNT OF $200,000 FOR THE REPLACEMENT OF TRASH AND RECYCL[NG
RECEPTACLES; DELEGATING AND AUTHORIZING THE CITY MANAGER, OR
DESIGNEE, TO ACT ON BEHALF OF THE CITY IN ALL OTHER MATTERS THAT ARE
RELATED TO THIS GRANT APPLICATION; PLEDGING THAT IF FUNDING FOR THIS
PROJECT IS RECEIVED, THE CITY WILL COMPLY WITH ALL GRANT REQUIREMENTS
OF THE NCTCOG, THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY (TCEQ),
AND THE STATE OF TEXAS; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the NCTCOG issued a Call for Projects (CFP) for the FY2022-2023 Solid
Waste Implementation Grant Program funding a variety of municipal solid waste (MSW) projects
for local governments; and
WHEREAS, the grant is funded by the TCEQ through MSW tipping fees collected by the
State and helps advance efforts that support the regional goals and objectives outlined in the
Planning for Sustainable Materials Management in North Central Texas 2015 - 2040 (Regional
Plan); and
WHEREAS, the City is qualified to apply for project funds under the FY 2022-2023 CFP;
and
WHEREAS, the grant is proposed to provide $200,000 in funding to the City for
replacement of trash and recycling receptacles in three City parks to reduce recycling
contamination and litter; and WHEREAS, grant applications were due on May 26, 202 1 with a
resolution from the governing body authorizing the application submittal no later than June 26,
2021 and
WHEREAS, the City did not receive notice of the grant in time to present the application
to the City Council prior to the application due date; and
WHEREAS, the City of Denton Parks and Recreation Department submitted an application
to NCTCOG for a Solid Waste Implementation Grant; and
WHEREAS, the Solid Waste Implementation Grant Program application requires a
resolution within thirty (30) days of the application close date and no later than June 26, 2021,
from the governing body authorizing the application submittal as well as receipt of funding if
awarded; and
WHEREAS, the City Council of the City of Denton has expressed their support and interest
regarding the above-referenced solid waste project;
THE COUNCIL OF THE CITY OF DENTON HEREBY RESOLVES:
SECTION 1. The application for the Solid Waste Implementation Grant made May 26,
2021 is hereby ratified.
SECTION 2. The City Manager or designee is designated, delegated, and authorized to
request grant funding under the NCTCOG Solid Waste Implementation Grants Program, including
the submission ofNCTCOG’s application, and act on behalf of the City of Denton in all matters
related to the grant application and any subsequent grant contracts and grant projects that may
result
SECTION 3. Should the project be funded, then the City shall comply with the
requirements of the NCTCOG, the TCEQ, and the State of Texas.
SECTION 4. The project funds and any project-funded equipment and facilities will be
used solely for the purposes for which they are intended under the grant.
SECTION 5. The activities of the City shall comply with and support local and regional
solid waste management plans adopted for the geographical area in which the activities are
performed.
SECTION 6. This resolution is effective immediately upon its passage.
