HomeMy WebLinkAbout21-1312RESOLUTION NO. 21-1312 A RESOLUTION OF THE CITY OF DENTON PROVIDING FOR REMOVAL FOR CAUSE OF A MEMBER OF THE TRAFFIC SAFETY COMMISSION, IN ACCORDANCE WITH ARTICLE XIV, SECTION 14.16 OF THE DENTON CITY CHARTER; PROVIDING NOTICE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Denton City Charter, Article XIV, Section 14.16, states, "Members of boards and commissions of the City of Denton shall serve at the pleasure of the council. Members of such boards and commissions may be removed by the council only for cause and only after being given notice by the council. " WHEREAS, the Denton Code of Ordinances, Article III, Section 2.83(c), addresses member attendance requirements that must be met by members of boards, commissions, and committees; and further states, in part, "... lack of attendance at fifty (50) percent of the number of regular/scheduled meetings in a year, shall be considered "cause, " as that term is used in Section 14.16 of the Charter, for removal by the city council. " WHEREAS, the Denton Boards & Commissions Handbook, last revised by Resolution 21- 271 adopted on April 20, 2021, addresses notification be sent to any member who has failed to meet board member attendance requirements. WHEREAS, the City Secretary, on June 11, 2021, sent written notice to the Traffic Safety Commission Member on the failure to meet attendance requirements for meetings held July 20, 2020, September 17, 2020, November 9, 2020, and March 3, 2021 and the Member was afforded the opportunity to resign before referring the matter to the City Council. WHEREAS, the Member failed to submit a response to the City Secretary's notification; NOW THEREFORE; THE COUNCIL OF THE CITY OF DENTON, HEREBY RESOLVES: SECTION 1. Traffic Safety Commission Member Kevin Sample is hereby removed for cause for failing to meet the attendance requirements as set forth in the Denton Code of Ordinances, Article III, Section 2.83(c) for absences on the following meeting dates: July 20, 2020, September 17, 2020, November 9, 2020, and March 3, 2021. SECTION 2. This Resolution shall become effective immediately and the City Secretary is hereby directed to send a copy of this resolution as notice via certified and regular mail to the member within five days of the date of its passage.
