A RESOLUTION OF THE CITY OF DENTON PROVIDING FOR REMOVAL FOR CAUSE
OF A MEMBER OF THE HEALTH AND BUILDING STANDARDS COMMISSION, IN
ACCORDANCE WITH ARTICLE XIV, SECTION 14.16 OF THE DENTON CITY CHARTER;
PROVIDING NOTICE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Denton City Charter, Article XIV, Section 14.16, states, "Members of
boards and commissions of the City of Denton shall serve at the pleasure of the council.
Members of such boards and commissions may be removed by the council only for cause and
only after being given notice by the council. "
WHEREAS, the Denton Code of Ordinances, Article III, Section 2.83(c), addresses
member attendance requirements that must be met by members of boards, commissions, and
committees; and further states, in part, "... Absences resulting in cause for removal: An
unexcused absence of any board, commission, committee, member from more than three
regularly called and scheduled meetings of which he or she is a member in any one year shall be
considered cause" or " or lack of attendance at fifty of the number of regular/scheduled meetings
in a year, shall be considered "cause," as that term is used in Section 14.16 of the Charter, for
removal by the city council."
WHEREAS, the Denton Boards & Commissions Handbook, last revised by Resolution 21-
271 adopted on April 20, 2021, addresses notification be sent to any member who has failed to
meet board member attendance requirements.
WHEREAS, the City Secretary, on August 5, 2021, sent written notice to the Health and
Building Standards Commission Member on the failure to meet attendance requirements for
meetings held April 22, 2021, May 6, 2021, May 13, 2021, June 3, 2021, June 17, 2021, and June
24, 2021, constituting more than three regular/scheduled meetings of which she is a member in
any one year, and constituting a lack of attendance at fifty percent of the number of regular/
scheduled meetings in a year. The member was afforded the opportunity to resign before referring
the matter to the City Council.
WHEREAS, Member Addison replied to the notification referenced in Section 4 above,
such response attached as Exhibit A; NOW THEREFORE,
THE COUNCIL OF THE CITY OF DENTON, HEREBY RESOLVES:
SECTION 1. Health and Building Standards Commission Member Cyndell Addison is
hereby removed for cause for failing to meet the attendance requirements as set forth in the Denton
Code of Ordinances, Article III, Section 2.83(c) for absences on the following meeting dates: April
22, 2021, May 6, 2021, May 13, 2021, June 3, 2021, June 17, 2021, and June 24, 2021.
SECTION 2. This Resolution shall become effective immediately and the City Secretary
is hereby directed to send a copy of this resolution as notice via certified and regular mail to the
member within five days of the date of its passage.

I am so sorry to hear what has happened.
Because the removal clause has been triggered, I am unable to rescind my request that you submit
your resignation no later than today. If your resignation is not received, your potential removal
will be scheduled for formal action by City Council.

online rather than in person because of the COVIU-19 virus and up surge especially here in
Texas. I don't want my health further compromised by anything as serious as the COVI1D-
